SEDIMENT AND EROSION CONTROL
PERFORMANCE SURETY BOND AND/OR AGREEMENT
SPOTSYLVANIA COUNTY, VA
KNOW ALL MEN BY THESE PRESENTS: That we, the undersigned, _______
________________________________________________________________ (Owner),
and_____________________________________________________________ (Surety)
are held and firmly bound unto Spotsylvania County, Virginia, in the sum of __________
____________________ ($______________) for the payment of which well and truly to
be made, we hereby jointly and severally bind ourselves, our heirs, executors,
administrators, successors and assigns, and do hereby waive homestead exemptions.
The condition of the above obligation is such that whereas, the Owner has
presented to the Board of Supervisors of the County of Spotsylvania, Virginia sediment
and erosion control plan(s), and will present additional such plans in the future, for the
purpose of obtaining present and/or future residential erosion and sediment control
permits at various sites, all within Spotsylvania County, Virginia; and whereas the penal
obligation for any one site shall be equal to One Thousand Five hundred and 00/100
Dollars ($1,500.00), and the total obligation for any and all present permits shall not
exceed the penal amount stated in the first paragraph of this document in the aggregate;
and whereas, a condition of the approval of said plan is implementation / construction /
installation and maintenance of the sediment and erosion controls and other
improvements therein in accordance with the specifications shown on said plans, and as
provided by law; and whereas, the Owner shall undertake to complete said sediment and
erosion controls and other improvements in a workmanlike manner and to maintain them
in accordance with said specifications and law until each job is completed.
NOW THEREFORE, if said Owner shall well and faithfully do and perform the
things agreed by it to be done, as hereinabove stipulated, then this obligation shall be
void. Should the Owner fail to perform the above stated obligations within the stated
time period, the cash amount shall become immediately due from the Surety upon
demand by the Board of Supervisors of Spotsylvania County. This obligation shall
remain in full force and effect until such time as it is released by Spotsylvania County; it
being expressly understood and agreed that the liability of the Surety for any and all
claims hereunder shall in no event exceed the penal amount of this obligation as herein
stated.
The said Surety for value received herby stipulates and agrees that no change,
extension of time, alteration or addition to the work to be performed shall in any way
affect the obligation of this bond and it does hereby waive notice of any such change,
extension of time, alteration or addition.
