No late proposals will be accepted. RFP’S shall be submitted in sealed envelopes labeled
“RFP 09-11, Right of Way Appraisal Services” with the name and address of the Proposer.
RFP’s shall be submitted in accordance with the attached City of Fayetteville specifications
and RFP documents attached hereto. Each Proposer is required to fill in every blank and
shall supply all information requested; failure to do so may be used as basis of rejection.
The undersigned hereby offers to furnish & deliver the articles or services as specified, at the prices & terms stated
herein, and in strict accordance with the specifications and general conditions of bidding, all of which are made a part of
this offer. This offer is not subject to withdrawal unless upon mutual written agreement by the Proposer/Bidder and City

Terms and Conditions
1. Proposals shall be received at the address listed below and are due by Friday, June 26th, 2009
before 3:00 PM, Central Standard Time:

2. It is the responsibility of the Proposer to have its sealed proposal at the Purchasing Office prior to the
date and time of opening. No late proposals will be accepted. Proposals received after the scheduled
proposal deadline will remain unopened and will not be considered.
3. The Proposers response shall include a technical proposal and a fee proposal. Combined, the two
documents shall include all information requested in this request for proposal. The proposed fees shall be
the full cost as well as revenue allocation detail to the City of Fayetteville, based on the scope of services
provided.
4. The Proposer participating in this solicitation shall submit proposals on or before the time and date
stated above.
5. The City of Fayetteville reserves the right to reject any or all proposals, waive formalities and make
the award based on the best interest of the City.
6. It shall be clearly understood that any costs incurred by the Proposer in responding to this request for
proposal is at the Proposer's own risk and expense as a cost of doing business, and the City is not liable
for reimbursement to the Proposer for any expense so incurred, regardless of whether or not the proposal
is accepted.
7. Any inquiries or requests for explanation in regard to the City's requirements should be made
promptly to Andrea Foren, City of Fayetteville, Purchasing Agent via e-mail (aforen@ci.fayetteville.ar.us)
or telephone (479.575.8220). No oral interpretation or clarifications will be given as to the meaning of any
part of this request for proposal. All questions, clarifications, and requests, together with answers, if any,
will be provided to all firms that have indicated an interest or intention to submit proposals, but the names
of any firms submitting any questions, clarifications, or requests will not be disclosed until after the
deadline for submitting proposals.
8. Any conditions or expectation on the part of the Proposer for performance by the City must be set
forth in the proposal. The City is not obligated to consider the Proposer's post submittal terms and
conditions.
9. At the discretion of the City, one or more firms may be asked for more detailed information before
final ranking of the firms, which may also include oral interviews.
10. The City will not be responsible for misdirected proposals. Proposer should call the Purchasing
Office at (479) 575-8220 to insure receipt of their proposal documents prior to opening time and date
listed above.

11. Any information provided herein is intended to assist the Proposer in the preparation of proposals
necessary to properly respond to this RFP. The RFP is designed to provide qualified Proposers with
sufficient basic information to submit proposals meeting minimum specifications and test requirements,
but is not intended to limit a RFP’s content or to exclude any relevant or essential data.
12. The RFP and any addenda issued may be obtained from at www.accessfayetteville.org and clicking
“Bids, RFP’s and RFQ’s” then tab titled “RFP’s”. Proposers are at liberty and are encouraged to expand
upon the details, qualifications and proposals to give additional evidence of their ability to perform and
provide a system as described in this RFP. All updates and changes to the RFP will be posted on the
website and Proposers are encouraged to check daily for new information or updates. Each Proposer is
required before submitting a proposal to be thoroughly familiar with the requirements and specifications
listed in this RFP. Additional allowances will not be made due to Proposers lack of knowledge relating to
the terms, conditions and specifications contained within this RFP. It is the responsibility of the Proposer
to determine if any component(s) of this specification do not meet the required standards of applicable
Federal Law or specifications.
13. The proposal must contain the signature of a duly authorized officer or agent of the Proposer’s
company empowered with the right to bind and negotiate on behalf of the Proposer for the amounts and
terms proposed.
14. The Proposer is required to submit one (1) original and five (5) copies of the proposal. In addition,
one (1) electronic copy of all submitted documents shall be submitted on a properly labeled CD. The use
of Adobe (PDF) is highly recommended but not mandatory. All electronic copies shall be compatible with
Microsoft Office and Microsoft Windows applications.
15. It is intended that the all documents pertaining to this request for proposal shall define and describe the
complete services to which they relate.
16. The Proposer is advised to examine all documents and current parameters of the services in becoming
fully informed as to their conditions. This includes the conformity with specific standards and the character,
quality and quantity of the reports and services required. Failure to examine these areas will not relieve the
successful Proposer of his obligation to furnish all deliverables and services necessary to carry out the
provisions of the contract.
17. The City of Fayetteville will consider the degree to which each Proposer has submitted a complete
proposal without irregularities, excisions, special conditions, or alternative proposals for any item unless
specifically requested in the RFP.
18. Following the evaluation of the proposals, the evaluation committee may request the top ranking
firm(s) to make an oral presentation and/or be interviewed. If a determination is made that presentations are
desired by the committee, a mutually acceptable date and time will be coordinated with the top ranking
firms.
19. Proposers irrevocably consent that any legal action or proceeding against it under, arising out of or in
any manner relating to this Contract shall be brought in any court in Fayetteville, Washington County,
Arkansas. Consultant hereby expressly and irrevocably waives any claim or defense in any said action or
proceeding based on any alleged lack of jurisdiction or improper venue or any similar basis.
20. The successful Proposer shall not assign the whole or any part of this Contract or any monies due or to
become due hereunder without written consent of City of Fayetteville. In case the successful Proposer
assigns all or any part of any monies due or to become due under this Contract, the Instrument of

assignment shall contain a clause substantially to the effect that is agreed that the right of the assignee in
and to any monies due or to become due to the successful Proposer shall be subject to prior liens of all
persons, firms, and corporations for services rendered or materials supplied for the performance of the
services called for in this contract.
21. The successful Proposer's attention is directed to the fact that all applicable Federal and State laws,
municipal ordinances, and the rules and regulations of all authorities having jurisdiction over the services
shall apply to the contract throughout, and they will be deemed to be included in the contract as though
written out in full herein. The successful Proposer shall keep himself/herself fully informed of all laws,
ordinances and regulations of the Federal, State, and municipal governments or authorities in any manner
affecting those engaged or employed in providing these services or in any way affecting the conduct of the
services and of all orders and decrees of bodies or tribunals having any jurisdiction or authority over same.
If any discrepancy or inconsistency should be discovered in these Contract Documents or in the
specifications herein referred to, in relation to any such law, ordinance, regulation, order or decree, s/he
shall herewith report the same in writing to City of Fayetteville.
22. Proposer shall at all times observe and comply with all such existing and future laws, ordinances and
regulations, and shall protect and indemnify City of Fayetteville and its agents against the violation of any
such law, ordinance, regulation, order or decree, whether by himself/herself or by his/her employees.
Licenses of a temporary nature, necessary for the prosecution of the services shall be secured and paid for
by the successful Proposer.

Section 1.0 INTRODUCTION
1.1. Scope of Proposal: As part of the Transportation Bond Program and under the administration
of the Arkansas State Highway and Transportation Department (AHTD), the City of Fayetteville,
Arkansas (City), is under obligation to construct road improvements to Cato Springs Road from
S. School Avenue to Razorback Road. As part of this project, there are approximately 43
properties from which additional right-of-way needs to be acquired.
1.2. Point of Contact: Questions concerning submission of a proposal in response to this RFP

In the event that it becomes necessary to provide additional clarifying data or information, or to
revise any part of this RFP, revisions, amendments, or supplements will be provided to all
recipients of this initial RFP and all who have requested information in writing.
1.3. Proposer Qualifications: All contract appraisers bidding on this project must be certified in
accordance with Title XI of the Financial Institutions Reform, Recovery, and Enforcement Act of
1989 (FIRREA) Public Law 101-73, 103 Stat. 1895, 511 (Aug. 9, 1989) and must have a
minimum of four (4) years professional appraisal experience, the most current being during the
year 2008. In the State of Arkansas a General Certification License is necessary. A Qualifications
and Experience Resume must be submitted with the time and cost bid for this appraisal project.
The City or AHTD has the authority to reject any appraiser if, in the City’s or AHTD’s opinion, the
appraiser does not qualify or have the experience necessary to meet the criteria of the Uniform
Act, under which this project will be conducted.
1.4. Information Restrictions: All information received by the City regarding this RFP is restrictive
and will not be available before award of the project to the successful Appraiser(s).
1.5. Choice of Law & Choice of Forum: This RFP shall be governed by and construed and
interpreted according to the substantive laws of the State of Arkansas without regard to its
conflicts of law or choice of law provisions. Any proceeding relating to any cause of action of any
nature arising from or relating to this RFP or contract may be brought only before the appropriate
forum in Washington County, Arkansas.
1.6. Ethics: “It shall be a breach of ethical standards for a person to be retained, or to retain a
person, to solicit or secure a State contract upon an agreement or understanding for a
commission, percentage, brokerage, or contingent fee, except for retention of bona fide

employees or bona fide established commercial selling agencies maintained by the Appraiser for
the purpose of securing business.” Ark.Code.Ann. § 19-11-708(a).
Section 2.0 PREPARING AND SUBMITTING A PROPOSAL
2.1. General Instructions: The evaluation and selection of an Appraiser will be based on the
information submitted in the Proposer’s proposal including references. Each Proposer shall
provide a description of the firm, a detailed work plan that identifies the major tasks of work as
shown in the attached work plan in Attachment A. Also required is a detailed work schedule, an
organization chart listing key personnel by name and title, proposed staff to perform on this
project and a cost proposal. Failure to respond to each of the requirements in the RFP may be
the basis for rejecting a response.
2.2. Incurring Costs: The City is not liable for any cost incurred by Proposers in replying to this
RFP. The cost of developing and submitting the proposal is entirely the responsibility of the
Proposer. This includes costs to determine the nature of this engagement, preparation of
proposal, submission of proposal, negotiation for the contract, and all other costs associated
with this RFP.
2.3. Time and Place for Submission of Proposals: Proposers must submit one (1) original and
five (5) copies of the completed proposal, along with all materials required herein for acceptance
of their proposal by 3:00 p.m. CST, on June 26, 2009.

2.4. Late Proposals: Proposals received after the date and hour established will be considered late
proposals and will be automatically disqualified. Late proposals will be returned unopened.
2.5. Unsigned Proposals: Pages 8, 12 and 13 of this RFP must be signed and included with
proposal to constitute a valid submission. The signature must be original (not stamped or
photocopied) and in ink. Unsigned and improperly signed proposals will be automatically
disqualified.
2.6. Assignment: No award resulting from this RFP may be assigned, sold, or transferred without
the prior written consent of the City. Furthermore, no obligation incurred pursuant to this RFP
and resulting contract may be delegated without prior written consent of the City.
2.7. Cancellation of Contract: The City reserves the right to cancel any award without recourse
upon written notice to the Appraiser.
2.8. Default and Remedies: Non-performance of any requirement, term or condition resulting from
this RFP shall constitute default. Upon default, the City shall issue a written notice of default

providing a period in which the Appraiser shall have seven (7) days to cure said default. If the
Appraiser remains in default beyond the seven (7) days, or if the default is repeated during the
term of the contract or any extension thereof, the City may, in its sole discretion, terminate the
contract(s) or remaining portion thereof and exercise any remedy provided by law.
2.9. References: Proposers shall submit a list of clients for whom Right-of-Way Appraisal Services
or similar services have been performed. Any references shall include a point of contact name,
address, and telephone number. Information obtained from reference contacts will be used in
determining the successful Appraiser.
Section 3.0 DISADVANTAGED BUSINESS ENTERPRISE PARTICIPATION
3.1. Disadvantaged Business Enterprise (DBE) Participation: Although no DBE percentage goal
is established for this project, the proposal shall include DBE participation to the extent practical.
Section 4.0 COST PROPOSAL
4.1. Cost Proposal: Proposers must submit a cost proposal using the form provided in Attachment
B. There will be no advance payment for start-up. In order to obtain the best value for the City,
modifications of the cost proposal may be allowed during contract negotiations.
Section 5.0 EVALUATION AND AWARD
5.1. Evaluation: In evaluating the qualifications of each firm, the review committee shall consider
the following (assigning point ranges for each element from 10% to 35%, so that the total for the
five elements combined equals 100%):
a. Qualifications in relation to specific project to be performed;
b. Experience, competence, and capacity of performance;
c. Proposed method of doing work;
d. Past performance; and
e. Price.
5.2. Award: Any award will be made based upon the evaluation of all proposals received in response
to this solicitation and the determination of the proposal or proposals considered to be the most
advantageous to the City. The City reserves the right to accept or reject in whole or in part any
and all proposals submitted, to award to more than one Proposer, to waive any minor
technicalities when it is in the best interest of the City, and to negotiate the terms of the contract,
including the award amount, with the selected Proposer(s).
5.3. Basis of Payment: Payment will be made based on the per tract cost for each service category
included on the Proposer’s Cost Proposal or negotiated amount as included in the executed
contract.

Proposed Work Plan
Purpose: The purpose of this RFP is to secure professional services for the appraisals of proposed
right-of-way from properties along Cato Springs Road from S. School Avenue to Razorback Road in
accordance with Public Law 91-646, the Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1970, as amended (Uniform Act), Federal and State laws and regulations,
and AHTD/City Right of Way policies and procedures. Right of way appraisal services are anticipated
for the Calendar Year 2009 with the expected completion in October, 2009.
Background: The proposed Cato Springs Road Improvements – S. School Avenue to Razorback
Road consists of widening the existing road to four lanes, with sidewalks and green space areas on
North and South sides. The project involves approximately 43 tracts from which additional right-of-
way is needed.
Appraiser’s Qualifications: All contract appraisers bidding on this project must be certified in
accordance with Title XI of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989
(FIRREA) Public Law 101-73, 103 Stat. 1895, 511 (Aug. 9, 1989) and must have a minimum of four
(4) years professional appraisal experience, the most current being during the year 2008. In the State
of Arkansas a General Certification License is necessary. A Qualifications and Experience Resume
must be submitted with the time and cost bid for this appraisal project. The City or AHTD has the

Appraiser’s Responsibilities: The Appraiser agrees to administer professional services for the
appraisal of right-of-way from properties for the proposed Cato Springs Road Improvements – S.
School to Razorback including, but not limited to:
1. Basis of Appraisals: The forty-three (43) properties along Cato Springs Road from S. School
Avenue west to Razorback Road are to be appraised utilizing the following basis:
a. The “Area of the Whole” as utilized in the attached appraisal form, shall include the title
parcel of land for right-of-way acquisition purposes as noted on the attached plats and
descriptions.
b. Only land will be used as the basis for these appraisals, i.e., any improvements on the
properties are not intended to be part of such evaluation, except and unless damages
occur to improvements as a result of the acquisitions acquired.
c. The Sales Comparison Approach (only) is to be used in all cases.
d. Appraisals are to be based on single ownership and may include one or more parcels.
2. Appraisal Services:
a. Review the City’s right-of-way and construction plans, as approved by the AHTD.

b. Follow the Uniform Act for contacting property owners and property owner’s inspection.
This includes inviting the property owners, preferably in writing, to accompany the appraiser
during the appraiser's inspection of the property, and maintain record of contact in file.
c. Notify property owners as soon as feasible of the City's interest in acquiring the real
property, including the City's obligation to secure an appraisal.
d. Prepare compensation estimates or appraisals in accordance with Federal regulations and
City/AHTD policies and procedures.
e. For on-premise signs, determine if cost to cure would be less than purchase and prepare
compensation estimate or appraisal accordingly.
f. Revise, update, or obtain new compensation estimates or appraisals as requested by the
City.
g. Appear and testify as an Expert Witness in eminent domain proceedings and be available
for pre-hearing or pre-trial meetings as directed by the City. This will be considered an
additional service to be charged at quoted hourly rate.
City’s Responsibilities:
1. Provide right-of-way and construction plans.
2. Provide legal descriptions of the property to be acquired and current ownership title
certificates.
3. Provide tract plats, including property parcel boundaries and proposed right-of-way
acquisition areas.
4. Provide legal opinions or recommendations that arise during the acquisition process, as
needed. Appraiser must notify the City if legal advice is needed.
5. Process and issue all warrants for payments.
6. Provide final approval for all payments including, but not limited to, compensation estimates
or appraisals and relocation assistance.
7. Process condemnation actions including legal document preparation, filing, settlement or
trial actions.
8. Prepare exhibits used in court cases on condemned tracts as needed.
AHTD Responsibilities: AHTD agrees to administer professional services for the right-of-way
acquisition of properties on the proposed Cato Springs Road Improvements including, but not limited
to:
1. Upon completion of right of way plans and environmental handling, prepare a request for
authority to appraise and acquire for submission to FHWA.

2. Provide any applicable conceptual stage relocation statement and plan.
3. Provide timely appraisal reviews and approval of submissions.
4. Forward right-of-way certifications to FHWA for review and approval.
Project Conditions of the Work: The Appraiser agrees to administer professional services for the
appraisal of right-of-way from properties for the proposed Cato Springs Road Improvements – S.
School to Razorback under the following conditions:
1. All right-of-way functions will comply with the Uniform Act, 23 CFR, 49 CFR and pertinent
Federal regulations.
2. Consistent with this policy, all programs and activities administered by the City shall comply
with Title VI of the Civil Rights Act of 1964 and related statutes and regulations to include the
Civil Rights Restoration Act of 1987 and the Americans with Disabilities Act of 1990
3. All compensation estimates and appraisals shall conform to the Uniform Act and appropriate
Federal regulations, State law and AHTD/City Right of Way policies and procedures. Detailed
appraisals shall reflect nationally recognized appraisal standards, including, to the extent
appropriate, the Uniform Appraisal Standards for Federal Land Acquisition and requirements
found in 49 CFR Part 24.
4. No appraiser shall have any interest, direct or indirect, in the real property being appraised and
must sign a certificate to that effect.
5. No appraiser shall act as a negotiator for real property which that person has appraised or
reviewed.
Appraisal Report:
1. A short form appraisal format is to be used for all tracts. Photographs will be necessary in
accordance with such format.
2. Comparable sales data used for adjustment should be listed on each appraisal. It is acceptable
to prepare a single supplemental report which includes all comparable land sales, objectives,
and use of the appraisals, general area and neighborhood analysis, general exhibit, and other
information applicable to all appraisals.
3. The contract appraiser will provide three (e) stapled copies of each tract appraisal plus three
(3) copies of any supplemental report, one copy being unbound.
