                                      Waiver Committee – Meeting Minutes

                                                     May 21, 2008

       Members present: Glenn Cutting, Donald Isabelle, James Krakoweicki (Vice-Chair), and Don Patch

       Unable to attend: Mike Chamberlain, Gary Forrest, Stephen McQueen (Chair), and Trevor Whipple

       Staff: June Kelly, Assistant Director

       Meeting called to order at: 1010 hrs.

       1. Rule 7 (Basic Training Standards for PT LEOs) - No requests this quarter.

       2. Rule 8 (Basic Training Standards for FT LEOs - 6 Month Rule) - No requests this quarter.

       3. Rule 8 (Basic Training Standards for FT LEOs - Out of State LEOs)
       Jeffrey A. Pearson, Northfield Police Department. Chief Jeffrey Shaw at the last meeting of the waiver
       committee and approved by the Council. Pearson was granted a full-time waiver based on his
       approximately 6 years experience and training in policing in North Carolina. Chief Shaw asked that
       Pearson be given until December 31, 2008 to complete the waiver prescription instead of the June 30,
       2008 deadline to allow Pearson to complete Criminal and Motor Vehicle Law classes with the next basic
       class which is the 86th Basic Class. This will allow ample time to complete the waiver requirements.
       Action: Motion made by Don Patch to recommend extending waiver completion date to Dec. 31, 2008,
       2nd by Don Isabelle, MOTION – Passed.

       4. Rule 13 (Annual Mandatory In-Service Training for LEOs)

       Rule 13 Audit - Northfield Police Department. Discussion: Committee talked at length about the nature of
       the rule 13 audit. The committee felt that they were responsible for handling individual waiver requests,
       but something of this scope was a matter for council.

       Jeffrey L. Shaw, Northfield Police Department. Chief Shaw requests in-service training waiver for
       himself for first aid since 2002…, firearms training for 2004 and 2006. See waiver request attached.
       His plan to complete requirements is to complete firearms twice in 2008 and he attended first aid training
       in April and May 2008. Action: Motion made by Patch to recommend Shaw to make up firearms in
       2008 on 3 separate dates, along with First aid, and First Aid training which was noted as being
       accomplished on May 5, 2008, 2nd by Jim Krakoweicki, MOTION – Passed.

       Chad J. Bassette, Northfield Police Department. Chief Shaw requests in-service training waiver for
       Bassette for first aid training requirements for 2007. Action: Motion made by Patch to recommend
       approving waiver with deadline of August 1, 2008, 2nd by Isabelle, MOTION – Passed.
Stephen J. Clark, Northfield Police Department. Chief Shaw requests a Rule 13 waiver for in-service
training for first aid training requirement for 2007 for Clark. Officer Clark is scheduled to complete first
aid training on May 24, 2008. Action: Motion made by Patch to recommend approving waiver with
deadline of August 1, 2008, 2nd by Krakoweicki, MOTION – Passed.

Martin E. Davis, Orleans County Sheriff’s Department. Chief Deputy Kirk Martin requests in-service
training waiver for Davis for 2007. Davis completed 20 hours out of the required annual 30 hours for
part-time certified officers. He has since made up the additional hours by completing an additional 8
hours of training in January and April 2008. See waiver request letter for details. Action: Motion made
by Patch to table pending more information on hours completed due to two hour difference in
documentation provided, 2nd by Isabelle, MOTION – to table PASSED. Correction-Davis had
completed all additional hours needed.

Douglas Roberts, Hartford Police Department. Chief Glenn Cutting requests in-service training waiver
for Roberts’ firearms training requirement for 2007. Roberts completed firearms training on March 27,
2008 and will attend two additional firearms trainings in 2008. See waiver request letter for details.
Action: Motion made by Don Patch to recommend supporting waiver request, 2nd by Krakoweicki,
MOTION – Passed.

Dana W. Kallahan, Caledonia County Sheriff’s Department. Sheriff Michael Bergeron requests in-
service training waiver for Kallahan for 2005. Kallahan has completed 8 hours out of the required annual
25 hours for full-time certified officers. The plan is to make up the additional 17 hours in 2008. See
waiver request letter for details. Action: Motion made by Don Patch to recommend granting waiver
with makeup of all 2005 hours by Sept 1, 2008, 2nd by Isabelle, MOTION – Passed.

Jamie A. Palmisano, Barre City Police Department. Deputy Chief Andrew Marceau requests in-service
training waiver for Palmisano’s first aid training requirement for 2007. Palmisano completed 31 hours
out of the required annual 25 hours for full-time certified officers. He has since made up the first aid
training on March 31, 2008. See waiver request letter for details. Action: Motion made by Patch to
recommend granting waiver, 2nd by Cutting, MOTION – Passed .

Steven Dumas, Burlington Police Department. Lt. Stubbing requests in-service training waiver for
Dumas’ first aid training requirement for 2007. He has since made up the first aid training on May 16,
2008. See waiver request letter for details. Action: Motion made by Isabelle to recommend granting
waiver, 2nd by Jim Krakoweicki, MOTION – Passed.

Ethan Thibault, Burlington Police Department. Lt. Stubbing requests in-service training waiver for
Thibault’s firearms and first aid training requirement for 2007. He has since made up the first aid training
on May 19, 2008 and firearms’ training is scheduled to be made up on 6/13/08. See waiver request letter
for details. Action: Motion made by Patch to recommend approving waiver with understanding Thibault
must complete firearms for 2008, too, 2nd by Isabelle, MOTION – Passed.

Lance Taylor, Burlington Police Department. Lt. Stubbing requests in-service training waiver for
Taylor’s firearms training requirement for 2007 and lack of hours for 2007 he completed 15.5 hours and
needs 25 hours. He has since made up the firearms training on May 1, 2008, and the rest of his 25 hours.
See waiver request letter for details. Action: Motion made by Krakoweicki to recommend approving
waiver with understanding Taylor must complete firearms & additional 25 hours inclusive for 2008, 2nd
by Patch, MOTION – Passed.

5. Rule 14 (Re-certification of LEOs) - No requests this quarter.
6. Rule 19 (Other waivers) - No requests this quarter.
