									              Canoe / Kayak Share Program Description
Goal:
To give Village of Shorewood Hills community members the opportunity for easy access to
kayak and canoe use on Lake Mendota at a low cost. To have Village of Shorewood Hills
residents take advantage of Lake Mendota and its beauty, an asset to Village living. To make the
Village facilities of the McKenna Boathouse and The Marina accessible to more Village
residents than single-family storage allows.

Who is eligible for membership:
Adult residents of the Village of Shorewood Hills are eligible for membership. Guests may use
the boats when accommodated by a member. Parents are fully responsible for children, and
children under the age of 18 cannot take out boats alone.

Equipment and Location:
  • 2 Manitou Sport kayaks (a yellow one and a red one) are located on rack #58 in the
     McKenna Boathouse.
  • 1 light gray Wilderness System double kayak located on rack # 40 in the McKenna Boat
     house.
  • The kayak paddles are hanging on the corner wall to the left of the single kayaks and the
     life jackets are on the right side of the wall behind the single kayaks.
  • 3 canoes (1 yellow & 2 silver) are padlocked to the racks on the lakeside of the Quonset
     Hut (racks #7, 8 & 9 are reserved for the canoe / kayak share program). The paddles and
     life jackets are inside locker number 4 (far end of the building).
  • Size and availability of life jackets may be limited.
  • Floating key rings with a key to McKenna Boathouse and Marina Quonset Hut, a key to
     the padlocks, a whistle, and an emergency contact information card are available for
     check out at the Village Hall.
  • Safety booklets are available at each location. Village Hall booklets can be checked out,
     but please do not remove booklets from the Boathouse or Marina.
  • Clipboards are located at McKenna and in the locker at the Marina Quonset Hut. These
     are for leaving messages for the next user.

Fee:
   •   $30 annual membership fee per household includes unlimited use (as available) for the
       season May 15 to October 15.
   •   No person will be permitted to participate until “The Village of Shorewood Hills Canoe /
       Kayak Share Program Agreement” forms are signed and the fee is received.
   •   Fee is waived for paid Village of Shorewood Hills staff, but forms must be filled out.

Program Management:
This program will start under the management of the Recreation Committee with coordination
with the Waterfront and Parks committees.

Policy/Procedure:
The committee relies on canoe and kayak donations from Village of Shorewood Hills residents.
More boats may be added to the program depending on donations and space.

Each household must submit a signed Village of Shorewood Hills Canoe / Kayak Share Program
Agreement to become members. These forms will include rules, responsibilities, privileges, and
liability waivers. A safety information book will be provided at each site. There will be an
annual orientation night. Orientation will include boat safety and boating techniques such as
entering and exiting boats, paddling techniques, tipping over the boats, safety tips, and sign out
procedure.

Members will be able to reserve a boat (or boats) at the Village Hall. This will be added to the
computer system that is available to Village personnel. Sign-up is possible up to two weeks in
advance for up to a 4-hour period, and is first come first serve. The reservation will be forfeited
if the member is more than one hour late in picking up the key (off-lake or full day usage needs
to be approved by the Canoe / Kayak Share subcommittee).

Members will be able to sign out the keys from the Village Hall during office hours. Weekend
usage will require members to pick up the keys by 4:00 pm on Friday (children will not be
allowed to pick up keys). Members will be given a numbered floatable key ring with a key to the
padlocks and a key to the Boathouse / Quonset Hut.

At the Boathouse and Marina the members will find several lifejackets, paddles and locked
boats. Life jacket usage is required of all boaters. It is the member’s responsibility to make sure
that there is a properly fitted life jacket (approved for canoeing and kayaking) available for every
member of his or her party. The members unlock the boat that they signed out, find life jackets
that fit properly, find the appropriate paddles, lock up the Boathouse or Quonset Hut, and then go
enjoy the lake. When they are done, they return all equipment to its proper place, and make sure
the boat and Boathouse / Quonset Hut are locked securely. The boats need to be returned before
sunset (state law), and the keys must be returned to the Village Hall or the Village Hall drop-box
on the day of use. The lost key fee is $20.00. Members are required to report any missing or
damaged property to the Village Hall.

Terms and Conditions:

The Village must receive payment and a contract signed by all adult members of the household
prior to boat use. Members agree to abide by all the terms and conditions of this contract,
including Appendix A. Member’s failure to do so may result in cancellation of the contract /
agreement by the Village.

All members must be residents of the Village of Shorewood Hills and be 18 year of age or older.

It is expressly agreed that the Village of Shorewood Hills and its officers, employees, committee
members, and assigns of any kind shall not be liable to Members or Member’s household
guest(s) for any loss, damage, or injury to person or property by reason of occupancy and use to
the premises covered by this agreement.

Release: I, the undersigned, do hereby release the Village of Shorewood Hills and the
Recreation / Waterfront / Parks Committee personnel for any claim of accidental injury or death
of any household member, or household guest during participation in the Village of Shorewood
Hills Canoe / Kayak Program.

                            Appendix A
This agreement is entered into between the undersigned and the Village of Shorewood Hills.
This Agreement sets forth the terms and conditions of obtaining the rights, responsibilities,
privileges of membership in the Village of Shorewood Hills Canoe / Kayak Share Program. It
includes rules, procedure, and liability and safety waivers.

Rules: The UNDERSIGNED agree to obey the rules of The Village of Shorewood Hills Canoe /
Kayak Share Program which are attached to this Agreement and are part of it and which may be
changed as required to ensure the safety of the members and responsible use of the program’s
equipment. Notice of rule changes shall be given to members through the newsletter, e-mail and
/ or posted at the Village Hall.

Violations: The UNDERSIGNED or his / her guest who violate the program rules shall be given
a written notice regarding compliance with the program rules. Subsequent violations of the rules
shall result in suspension of membership, and no refund of any portion of the membership fee
shall be given.

The UNDERSIGNED agrees to pay for any item he / she or his / her guest damages or loses.

Liability: The UNDERSIGNED person(s), being of lawful age, understands that, as in all
sporting activities, and particularly in water sports, there are hazards that pose risks of injury to
participants. These risks include, but are not limited to, accidental drowning, injury caused by
contact with hard or sharp objects in the water, collisions with others (participants, boaters, and
swimmers), hypothermia, infections from water borne substances, dangerous weather, or injury
from use of broken or damaged equipment (“Acknowledged Dangers”). In consideration of
being permitted to enter into this Agreement and to have access to The Village of Shorewood
Hills Canoe / Kayak Share Program Equipment under this Agreement, the UNDERSIGNED
agree(s) as follows:

   1. The UNDERSIGNED, for him / herself, any personal representatives, assigns, heirs,
      guests, next of kin including any child using the Equipment under this agreement and not
      of legal age (collectively, the “UNDERSIGNED”) release and covenant not to sue
      Village of Shorewood Hills and its officers, employees, committee members, and assigns
      of any kind for all claims, causes of action, rights, loss or damage of any kind, on account
      of injury to the person or property or resulting in death of the UNDERSIGNED,
      including any attorney’s fees or cost of litigation, regardless of whether caused by the
      negligence of Village of Shorewood Hills or Village of Shorewood Hills parties, or
      otherwise caused by the Acknowledged Dangers or otherwise arising out of (i) the
      UNDERSIGNED’S membership under this Agreement or (ii) the UNDERSIGNED’S use
      and utilization of the Equipment, with all of the foregoing being collectively referred to
      hereunder as the “UNDERSIGNED Claims.”

   2. The UNDERSIGNED shall indemnify the Village for and shall hold the Village harmless
      from and against, any loss, damage, injury, claim or action that arises in connection with
      the UNDERSIGNED’s occupancy or use to the facilities. The User shall hold the Village
      harmless for any loss, damage, injury, claim or action the Member or the Member’s
      guests incurs or the accrues to the Member or Member’s guests in connection with any
      action or omission of the Village of Shorewood Hills or of the Village of Shorewood
      Hills’s agents or employees in connection with the facilities.

   3. Further, the Undersigned agrees to indemnify the Village of Shorewood Hills and Village
      of Shorewood Hills Parties, from the UNDERSIGNED Claims whether caused by the
      negligence of the Village of Shorewood Hills, Village of Shorewood Hills Canoe / Kayak
      Program committee members, or Village of Shorewood Hills Parties or otherwise.

   4. Further, the UNDERSIGNED assume full responsibility for the UNDERSIGNED Claims
      whether caused by the negligence of the Village or The Village of Shorewood Hills
      Canoe / Kayak Share Program or otherwise.

   5. Further, the UNDERSIGNED agree that they will adequately inspect the Equipment
      (boats, life jackets, and paddles) under all circumstances and agree in advance as to the
      suitability of the Equipment being used on each occasion.

   6. Further, the UNDERSIGNED attests to having knowledge of canoe and kayak safety and
      to understanding that additional information about canoe and kayak safety is available at
      the Village Hall, the McKenna Boathouse, and the Marina.

The UNDERSIGNED agrees that this release, waiver, and indemnity agreement is intended to be
as broad and inclusive as permitted by the laws of the State of Wisconsin, and that if any portion
of the Agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in
full force and effect.

Member’s Responsibilities: The UNDERSIGNED agrees and represent that they and their party
will be responsible for doing the following:
    a. Acting within the limits of their boating and swimming ability;
    b. Maintaining control of themselves and any Equipment they may be using; and
    c. Refraining from acting in any manner that may cause or contribute to injuring himself or
        herself or other persons while using the Equipment.

The UNDERSIGNED further understand that a violation of any of the above listed
responsibilities constitutes negligence on their part and may subject the UNDERSIGNED to
losing certain equipment privileges during water sports season.

Program Rules: The following rules are part of the program membership. As part of that
agreement every member agrees to:
   1) Comply with all Federal, State, and Local laws pertaining to operating watercraft.
   2) Check-in at the Village Hall before using any Equipment. Sign-up is possible up to 2
       weeks in advance for up to a 4 hour period, and is first come, first serve.
   3) Use the boats on Lake Mendota only (off-lake or full day usage needs to be approved by
       the Canoe/Kayak Share subcommittee).
   4) Be responsible for the return of all Equipment checked out for the use. Return the key on
       the day of boat usage. Lost key fee is $20.00.
   5) Pay all fees when due including fees assessed due to damages to Equipment due to
       improper use or abuse.
   6) Never abuse the Equipment, and to inspect the Equipment prior to use and upon return
       and to report any defects or damage to the Village Hall.
   7) Never to leave Equipment unattended while in the water.
   8) Keep the Boathouse, the Quonset Hut, and the padlocks locked when out on the water
       and after usage.
   9) Be responsible for the cost of repairs or replacement of Equipment made necessary by the
       abuse, failure to return the Equipment, or permitting unauthorized use.
   10) Never damage other people’s boats and belongings at the McKenna boathouse, the
       Marina and The Quonset Hut. The member will be responsible for any damage.
   11) Agree that it is the member’s responsibility to make sure that there is a properly fitted life
       jacket (approved for canoeing and kayaking) worn by every member of his or her party.
       Life jackets may need to be supplied by the Member.
   12) Understand that there are risks with boating and being near water and should be
       conscientious of the weather. The User should immediately return to shore at the first
       sight of any lightening or hearing any sound of thunder or otherwise becoming aware of
       the approach of an impending storm or dangerous high winds. The User should consider
       wind and wave conditions, along with boating skill level, when choosing 1) whether it is
       safe to canoe or kayak on Lake Mendota and 2) how far to be from the shore.
   13) Not exceed the number of people or the weight restrictions in the boats as listed on the
       boat’s label.

I, the UNDERSIGNED, have read and understand all of the rules and agree to comply with
them, and further understand that failure to comply may subject my household to losing certain
equipment privileges during the season.

Additional Terms and Conditions
The Member and the Village agree to the following:
   1. The Village agrees to provide storage areas for the Equipment.
   2. The Member shall indemnify the Village for and shall hold the Village harmless from and
       against, any loss, damage, injury, claim or action that arises in connection with the
       Member’s occupancy or use of the facilities. The Member shall hold the Village
       harmless for any loss, damage, injury, claim or action the Member or the Member’s
       guests incurs or the accrues to the Member or Member’s guests in connection with any
       action or omission of the Village or of the Village’s agents or employees in connection
       with the facilities.

  3. The Member and the Village agree that this contract is for the 2010 boating season (May
     15 - October 15, weather permitting).
  4. The Member is encouraged to use the “buddy system” to help minimize vandalism and
     report any vandalism or suspicious behavior to the Village of Shorewood Hills Police
     department.
  5. The Member’s household will be notified of the Waterfront Cleanup Day and are
     required to participate.
  6. Parents should use their discretion on whether their child(ren) should use the equipment.
     Parents are fully responsible for children, and children cannot take out boats alone.
  7. The User represent that they are competent swimmers, able to swim a distance of at least
     75 yards without assistance of any kind.
