     known as         "Eddy," possessed the aforesaid firearms,               he had be'en

     convicted of crimes, each of which was                  punishabl~   by imprisonment

     for   a        term    exceeding   one   year,     as   defined    in   18   U.S.C.     §

     921 (a) (20), that is:

                 a.    Convicted on        or about April 10, 2003, in the
                       Circuit Court       of Mason County, West Virginia of
                       Pelivery of a      Controlled Substance in violation of
                       W. Va. Code §      60A-4-401;

                 b.    Convicted on or about April 10, 2003, in the
                       Circuit Court of Mason County, West Virginia of
                       Third Offense PUI in violation of W. Va. Code §
                       17C-S-2; and

                 c.    Convicted on or about October 27, 1976, in the
                       United States Pistrict Court for the Southern
                       Pistrict of West Virginia of Possession of an
                       Unregistered Firearm· in violation of Title 26,
                       United States Code, Sections 5861(d) and 5871 and
                       Aiding and Abetting in· violation of Title 18,.
                       United States Code, Section 2.

                                       COUNT TWO·

           L      On or about January 16,· 2009, at or near Apple GrOve,

     Mason County, West Virginia, and within the Southern District of

     West Virginia, defendant SIDNEY EDWARD HuDDLESTON, III; also known

     as UEddy," did knowingly possess a firearm,              that is,   a Taurus,

     model 38 Special,    .38 pistol, which had the manufacturer's serial

     number     obliterated,   .and   which   firearm   had    been   shipped   and

     transported in interstate commerce.

           2.     At the time defendant SIDNEY EDWARD HuDDLESTON, III, also

     known as UEddy," possessed said firearm, he knew the manufacturer's

     serial number had been obliterated.

           In violation of Title 18, United States Code, Sections 922(k)

     and 924 (a) (2) .

                       1.     ,On or about January 25, 2010, at or near Apple Grove,

             Masqn County, West Virginia, ,and within the Southern District of

             West Virginia, defendant SIDNEY EDWARD HUDDLESTON, III, also known

             as    "Eddy ," did knowingly possess the following ,firearms in and

             affecting interstate commerce:

                    a.        Harrington   &   Richardson, model 088, 20 gauge shotgun;"

                    b.        Remington, model 870 Express Super Mag, 12 gauge shotgun;

                    c.        Mossberg, model 190, 16' gauge shotgun;

                    d.        Jennings, model Bryco 59, 9mm pistol;

                    e.        Champion Iver Johnson, 20 gauge shotgun;

                    f.        Harrington   &   Richardson; model 088, 410 gauge shotgun;

                    g.        Winchester, model 68,       .22 rifle;

                    h.        Sport King Pump, model P1011,         .22 rifle;

                    i.        Marlin, model 81,       .22 rifle; and

                    j.        Winchester, model 70,       .22-250 rifle.

                    2.        At the time defendant SIDNEY EDWARD HUDDLESTON, III, also,

             known as         "Eddy," possessed the aforesaid firearms,             he had been

    computer,child pornography, as defined inSection 2256 of Title 18

    of the United States Code, that is, visual depictions of children

    under ,the    age of     eighteen years            engaged      in sexually explicit

    conduct.

    2252A(a) (1) and 2252A(b) (1) .

           On or about· October 13,' 2009, at or near Bluefield,                   Mercer

     knowingly possess material containing images and videos of child

     pornography,      as   defined in 18 U.S.C.        §   2256,    that    is,   visual

     depictions of children under the age of eighteen years engaged in

     sexually explicit conduct, that has been shipped and transported

     using a means and facility of interstate and foreign commerce and

     that has been shipped and transported in and affecting interstate

     and foreign commerce by any means, incluqing by computer.

          In       violation   of .Title    18,   United    States    Code,    Sections

     2252A(a) (5) (B) and 2252A(b) (2) .

               FORFEITURE RELATING TO CHILD PORNOGRAPHY OFFENSES

           In accordance with 18 U.S.C.             §   2253 (al, and Rule 32.2(al of

     the Federal Rules of Criminal Procedure,                   and premised upon the

     . conviction of· the defendant WOLFGANG KARL GOTTFRIED WERNER HUBER of

     particularly described in that certain deed dated January 2, 2007,

     and recorded in the Office of Clerk of the County Commission for

     Mercer County,   West Virginia,            in Deed Book 905 at 673.         Said

     property is presently titled solely in               t~e   name of the defendant

     WOLFGANG K; HUBER;
           2.· One 2010 Chevrolet Camaro 2LTCoupe, yellow in color, VIN

     2G1FC1EV1A9100958, which was seized from the defendant's possession

     on or about      October    23 ,   2009,   pursuant    to     a    federal     seizure

     warrant, and is presently Undergoing administrative forfeiture·by

     the Federal Bureau of Investigation (FBI),.reference CATS No. 10-

     FBI-000231.      Said vehicle is presently titled with the Florida

     Department of Highway Safety solely in the name of the defendant

     .WOLFGANG KARL GW HUBER; and

          ·3.   Certain computer and            other electronic              equipment and

     accessories,     which were· seized on or about             October 13,             2009,

     pursuant to a state search warrant         execut~d   on the residence of the

     Model JA 9 millimeter pistol,           during and in relation to a     drug

     trafficking crime for which the defendant may be prosecuted ina.

     court of the United States, that is, distribution of a quantity of

     morphine, a Schedule II controlled s~stance, in violation of 21

     u.S.C,     §   841(a) (1).

                          FORFEITURE FOR FIREARMS OFFENSE

            In accordance with 28 U. S. C.           §   2461(c) ,18   u. s. C.   §   924 (d) (1) ,

     and Rule 32.2(a) of the Federal Rules of Criminal                       Procedur~,        and

     premised upon the conviction of the defendant JERRY AUSTIN JUSTUS,

     also    known   as   "Nut,"    ·of    a    knowing       violation      of       18   U.S.C.

     §   924 (c) (1) (A), as set forth in Count Two of this Indictment, the·

     defendant    shall   forfeit     to       the       United States     any        firearm Or

     ammunition involved in or used in such firearm offense including;

     but not limited to, the following:

            1.   Jimenez Arms, Inc. Model JA 9 millimeter pistol, serial

            2.   Phoenix Arms Model HP 22A .22LR pistol, serial number

                 On or about May 27, 2009, at or near South Charleston,· Kanawha

          County, West Virginia,      and within the Southern District of West

          Virginia, defendant DANA NIDA knowingly and intentionally possessed

          with intent to distribute· a quantity of cocaine,           a Schedule II

          controlled substance.

                In   violation   of   Title   21,   United   States   Code,   Sectlbn

          841 (a) (1) .

                                       COUNT THREE

            1.     On or about May 27, 2009, at or near South Charleston,

     Kanawha County, West Virginia, and within the Southern               Dist~ict   of

     West Virginia,. defendant DANA NIDA did knowingiy possess a firearm,

     that   is,    a   Kel-Tec,    Model   P3AT,    .380    caliber pistol,    in and

     affecting interstate commerce.

            2.     At the time defendant DANA NIDA possessed the aforeiaid

     firearm, he had been convicted of a crime punishable by a term of

     imprisonment exceeding one year, as defined in 18 U.S.C. Section

     921(a) (20), that is, convicted on or about November 16, 1998, in

     the Circuit Court of Kanawha county, West Virginia, of breaking and

     entering, in violation of W.Va. Code            §   61-3-12.

            In    violation   of   Title   18,     United    States   Code,   Sections

     922 (g) (1) and 924(a) (2).
