Recommendation:

              That Council give consideration to fourth and final reading of "City of
              Coquitlam Business License Bylaw No. 3882,2007."

Background:
         The above noted bylaw was given first three readings at the November 19,
         2007 Regular Council Meeting.

             The intent of Bylaw No. 3882, 2007 is to provide for the licensing and
             regulation of businesses in the City of Coquitlam.

             It is now in order for Council to give consideration to fourth and final
             reading of "City of Coquitlam Business License Bylaw No. 3882,2007."

                                   BYLAW NO. 3882. 2007

            A Bylaw to Provide for the Licensing and Regulation of Businesses
                                 in the City of Coquitlam

     (a)    WHEREAS Council wishes to improve the general welfare of the community
            through the licensing and regulation of businesses in the City;

     (b)    WHEREAS Council is authorized pursuant to the Community Charter to provide
            for a system of Licences, permits or approvals;

     (c)    WHEREAS Council may, pursuant to the Community Charter, delegate its
            powers, duties and functions to an officer or employee of the City, which
            delegation may include the authority to suspend a business Licence and;

     (d)    WHEREAS Council has provided an opportunity for persons who consider they
            are affected by this Bylaw to make representations to Council at a hearing
            pursuant to s. 59 of the Community Charter.

NOW THEREFORE Council of the City of Coquitlam, in open meeting assembled, ENACTS
AS FOLLOWS:

                                             Parti

                                         Introduction

Name of Bylaw

1.         This Bylaw may be cited as "City of Coquitlam Business Licence Bylaw No. 3882,
           2007."

Definitions
2.      In this Bylaw,



AUTHORIZED IDENTIFICATION


           means any one or more of the following:

             (a)   a valid driver's Licence integrated with a photograph of the bearer
                   issued by the government of a Province or Territory of Canada;
             (b)   a valid driver's Licence integrated with a photograph of the bearer
                   issued by the government of a state of the United States;
                  (c)     an identification card issued by the government of a Province of Canada
                          to the bearer within five (5) years of the date it is produced by the
                          bearer as evidence of identification;
                  (d)     a valid passport issued by the Government of Canada;
                  (e)     a valid passport integrated with a photograph of the bearer issued by a
                          government of a foreign state recognized by Canada; or
                  (f)     any other form of valid provincial or federal identification integrated
                          with a photograph of the bearer including a Certificate of Indian Status,
                          or a Certificate of Canadian citizenship.



 AUTOMATIC VENDING MACHINE

             means any machine or device that:

                         (a) is operated by or requires for the operation thereof the insertion of a
                             coin, token, currency of any kind, credit card or bank card, and
                         (b) sells or dispenses money, a service or goods, or provides music,
                             recreation, or amusement of any kind whatsoever.


BUSINESS

            means the carrying on of a commercial or industrial undertaking of any kind or
            nature or the providing of professional, personal or other services for the
            purpose of gain or profit.


CHIEF OF POLICE


            means the senior resident member of the R.C.M.P. responsible for policing of the
            City for the time being or a person designated in writing by the Chief of Police to
            carry out any act or function under this Bylaw.



CITY

            means the City of Coquitlam.



CONTRACTOR


            shall mean a person who carries on the business of performing work upon an
            improvement or of placing or furnishing materials therefore, or both.

 DATING SERVICE


              means any person carrying on the business of providing information to persons
               desirous of meeting other persons for the purpose of social outings.


 ELECTRONIC GAMING


             means any activity or game of chance for money or other valuable consideration
             carried out or played on an electronic or mechanical device or machine, but
             excluding the purchase and sale of lottery tickets pursuant to a government
             lottery scheme.



 IMPROVEMENT

            shall include anything made, constructed, erected, built, altered, repaired, or
            added to, in, upon, or under land, and attached thereto, or intended to become
            part thereof, and also any clearing, excavating, digging, drilling, tunnelling,
            filling, grading, or ditching of, in, upon, or under land.



 LICENCE

            means a valid and subsisting business Licence to carry on a business, trade,
            profession and or other occupation, issued and approved pursuant to this Bylaw.



LICENCEE

            means a person to whom a current Licence has been issued under this Bylaw.


LICENCE INSPECTOR

           .means a person from time to time appointed by the City as a Property Use
            Supervisor, Property Use Inspector, Bylaw Inspector or Licence Inspector.



NON-PROFIT SOCIETY

            means a registered charitable society or organization which is:

                (a)      incorporated and in good standing under the Society Act, R.S.B.C. 1996,
                         c. 433; and
                (b)      registered as such under the Income Tax Act of Canada and qualified to
                         issue tax receipts to its donors.

 OFFICER

            includes:

                 (a)    every member of the Royal Canadian Mounted Police responsible for
                        the policing of the City; and
                 (b)    every Licence Inspector.


 SOCIAL ESCORT SERVICE

            means any person carrying on the business of providing or furnishing the
            services of male escorts or female escorts for social occasions.


                                                    Part 2

                                              General Provisions

 Licence Requirement

 3.         Except as otherwise provided in this Bylaw, no person will carry on, maintain,
            own or operate a business in the City without holding a valid and subsisting
            Licence.

4.         Where a business is carried on in or from more than one premise in the City, the
           business carried on in or from each premise is deemed to be a separate
           business.


Licence Exemptions

5.         Every Non-Profit Society is required to hold a valid and subsisting Licence under
           Section 3, and as per Schedule "A" there is no fee for such Licence.

6.         This Bylaw shall not apply to any Business Licenced and paying a fee under the
           following Bylaws:
           Bylaw No. 38 - District of Coquitlam Taxi-Cab Bylaw No.38,1972
           BylawNo.2851 - City of Coquitlam Animal Protection Bylaw No.2851,1994
           and amendments thereto.

7.         The holder of a valid and subsisting Home Occupation Licence is permitted to
           hold a commercial display, subject to compliance with other City Bylaws, for up
           to l month without obtaining a separate Licence as required in Section 4.

 Licence Application

 8.         All Applications for a Licence pursuant to this Bylaw must:

            (a) be made in the form provided by the Licence Inspector for that purpose;
            (b) be signed by the owner or operator of the Business or his duly authorized
                agent;
            (c) contain a true and accurate description of the following information:

                       (i)        the nature of the Business;
                       (ii)       the Premises, including the civic address, from which the
                                  Business is conducted; and
                       (iii)      any other information the Licence Inspector may require with
                                  respect to the operation of the Business and its location.

 9.         The Licence Inspector may review the Application to verify general compliance
            with this Bylaw and other applicable enactments. Any errors or omissions in the
            information provided by the Applicant on the Application will be the sole
            responsibility of the Applicant.

 10.       All premises in or upon which the applicant proposes to carry on business and or
           all vehicles used in connection therewith shall, before any such Licence is
           granted for such premise or for such vehicle, first be approved by the Licence
           Inspector who may in his or her discretion also require such premises or vehicles
           to be approved by the Building Inspector, Plumbing Inspector, Fire Prevention
           Officer, Chief of Police, Health Officer or any City official, as the Licence
           Inspector deems necessary.

 11.       No Licence shall be issued to any applicant if the use for which the Licence is
           sought would be in violation of any provisions of any of the bylaws of the City or
           Federal or Provincial enactments.


Licence Fees

12.        Every applicant must, at the time of making the application, pay to the City the
           Licence fee set out for his or her Business in Schedule "A" to this Bylaw. No
           Licence shall be issued until the payment of the fee is made.


Refund of Licence Fees

13.        No reduction or refund of the annual Licence fee paid pursuant to this Bylaw,
           will be made by the City due to any Licence holder ceasing to own or operate the
           business for which the Licence was issued during the Licence year.

14.       If an applicant for a business Licence who has paid a Licence fee in accordance
          with Schedule "A" requests a refund of the fee before the business Licence has

             been issued, then the City will retain 50% of the fee so paid to a maximum of
             $200.00 and the balance paid will be refunded to the applicant provided that
             the City has made no inspection with respect to the business Licence
             application. If the City has made an inspection with respect to the business
             Licence application, then the City will retain 50% of the fee paid to a maximum
             of $400.00 and the balance paid will be refunded to the applicant.


 Form of Licence

 15.        Every Licence issued under this Bylaw will state that the holder is Licenced to
            carry on the business stipulated in the Licence in a lawful manner for the
            periods specified in the Licence at the premise specified in the Licence, subject to
            the terms and conditions specified on the Licence.

 16.         Every Licence issued under this Bylaw will be made out in duplicate and one
             copy will be delivered by the City to the owner of the business being Licenced.


 Posting of Licence

 17.        Every Licencee shall post the Licence in a conspicuous place on the premises or
            on the thing or article in respect of which the Licence is issued, and in the case
            where the holder thereof has no business premises in the City such Licence shall
            be carried upon his person at all times when he is engaged in the business for
            which the Licence was issued.


Licence Periods

18.         All Licences issued under this Bylaw will be granted as annual Licences, unless
            stated otherwise in Schedule "A", commencing on the earlier of:

             (a)        the date on which the applicant for the Licence commenced carrying on
                        the business for which the Licence is sought; or
            (b)         the date of issuance of the Licence;

            and expiring one year later.


Licence Changes

19.         No Licencee shall make a change to a Business, including but not limited to:

           (a)         a change in location of the Business premises,
           (b)         a change to the Business name,
           (c)         a change to any term or condition on which the Licence was issued, or

             (d)         a change that would increase the Licence fee prescribed for the Business
                         in Schedule "A"

             without first applying to the Licence Inspector to have the Licence changed. The
             powers, conditions, requirements and procedures relating to the granting or
             refusal of a Licence shall apply to all such applications for a Licence change.

 20.         A person applying for a Licence change must, at the time of making the
             Application, pay to the City the amount by which the Licence fee under Schedule
             "A" will increase.

 21.         In addition to the fee set out in section 20, a Licencee applying for a change of
             location of the premises in which the Business is carried on must pay the
             transfer fee listed in Schedule "A".


 Inpsection

 22.        Every Licencee shall permit reasonable access by the Licence Inspector to any
            premises for which a Licence is sought or has been granted, and shall provide
            such information with respect to the Business as the Licence Inspector
            reasonably requests for the purpose of ensuring that the requirements of this
            Bylaw are being fulfilled.


Granting of a Licence

23.         The Licence Inspector may grant or transfer a Licence under this Bylaw where
            the Inspector is satisfied that the applicant has complied with the requirements
            of this Bylaw and any of the City's other bylaws.


Terms and Conditions of a Licence

24.         The Licence Inspector or Council may impose terms and conditions on a Licence
            granted under this Bylaw in addition to the terms and conditions imposed by
            this Bylaw.

25.        The terms and conditions imposed on a Licence may include any one or more of
           the following:

           (a) a requirement that the holder comply with a particular provision of a City
               bylaw or any other provincial or federal enactment within a specified period
               of time;
           (b) a requirement that the holder provide to the Licence Inspector within a
               specified period of time evidence satisfactory to the Licence Inspector of
               compliance with a particular provision of a City bylaw or any other
               provincial or federal enactment.

  Refusal of a Licence

  26.        An application for a Licence or renewal of a Licence may be refused by Council or
             the Licence Inspector in any specific case, provided that:

             (a)         the application must not be unreasonably refused; and
             (b)         Council or the Licence Inspector must give reasons for the refusal.

 27.         If the Licence Inspector has refused to grant a Licence, the applicant who is
             subject to the decision is entitled to have Council reconsider the matter.


 Suspension or Cancellation of a Licence

 28.         A Licence may be suspended or cancelled by Council or the Licence Inspector for
             reasonable cause.

 29.        Without limiting what constitutes reasonable cause, any one or more of the
            following circumstances may constitute reasonable cause:

            (a) the Licencee fails to comply with this Bylaw or a term or condition of the
                 Licence;
            (b) the Licencee is convicted of an indictable offence in Canada, which offence
                 is, in the opinion of the Council or the Licence Inspector, directly related to
                the Business;
            (c) the Licencee is found to have committed a violation of any City bylaw or
                convicted of an offence under Provincial or Federal enactment in respect of
                the Business for which the Licencee is Licenced or with respect to the
                premises for which the Licence was issued;
            (d) the Licencee has ceased to meet the lawful requirements to carry on the
                Business for which the Licencee is Licenced or with respect to the premises
                for which the Licence was issued; or
            (e) in the opinion of the Council or the Licence Inspector, the Licencee has
                engaged in misconduct that warrants the suspension or cancellation of the
                Licence, if the misconduct is.-

                        (i)         in respect of the Business, or
                        (ii)        in or with respect to the premises named in the Licence.

30.         A suspension under Section 28 is for the period determined by the Council or the
            Licence Inspector, and the Council or the Licence Inspector may impose
            additional conditions on the Licence that relate to the reasons for the
            suspension and apply after the period of suspension.

31.        In the case of a suspension or cancellation of a Licence by the Licence Inspector,
           the Licencee has the right to a reconsideration by Council.

                                                       PART 3

                                                 Specific Provisions

 Carnival Insurance

 32.         Before a Licence may be granted to any person for the purpose of operating a
             carnival or show having any mechanical riding device, such person shall show
             proof of comprehensive general liability insurance on terms and in form and
             substance satisfactory to the City. Such policy or policies will be written on a
             comprehensive basis with inclusive limits of not less than ($5,000,000.00) per
             occurrence including ($5,000,000.00) for bodily injury or death to one or more
             persons or for property damage, naming the City as an insured, containing a
             cross liability clause and providing that the insurer will give the City at least (30)
             days prior written notice of cancellation of, or material alteration to the policy.



 Contractors

 33.        Every person Licenced as a contractor must, within two weeks of a request by a
            Licence Inspector, provide the Licence Inspector with a list of all sub-trades
            engaged on each specific job, on a form prescribed by the Licence Inspector.



 Dating Services

 34.        Every person operating or applying for a Licence to operate a Dating Service
            shall, at the time of applying for a Licence for such operation:


               (a)      supply the Licence Inspector with the name, age, address and a copy of
                        Authorized Identification of every individual proposed to be employed or
                        engaged in the said business; and thereafter
               (b)      notify the Licence Inspector within seventy-two hours of any change in
                        the personnel employed or engaged in the said business; and
               (c)     maintain a written record of all individuals registered with the dating
                       service showing their name and address and the individual to whom
                       they have been referred for a social engagement and shall upon request
                       make such list available for inspection by the Licence Inspector or the
                       Chief of Police.


Massage (Non-Registered)/Body Rub Parlours

35.        Any business Licenced under the category of "massage (non-registered)/body
           rub parlour" in Section 4 "Personal Service Businesses" in Schedule "A" to this
           Bylaw may operate only between the hours of 0900 hours and 2200 hours on
           any day of the week.

 36.         Any applicant for a business Licence for a business that will offer massage and
             body rub services, or either of them, to be performed by one or more individuals
             who are not registered massage therapists in the Province of British Columbia
             (the "Massage Parlour") must satisfy each of the following conditions prior to
             issuance of a business Licence under this Bylaw:

             (a)         submit all documentation as required of any other business under this
                         Bylaw;
             (b)         remit the fee for Massage Parlours set out in Schedule "A" under the
                         heading "massage (non-registered)/body rub parlour;
             (c)         provide evidence satisfactory to the Licence Inspector that the premises
                         at which the Massage Parlour will operate meet the following criteria

                      (i)        the public entrance fronts onto a public place and has a glass door
                                 and a transparent glass window that is not less than 2 metres
                                 wide by two metres high, with both the door and window to be
                                 unobscured by signage, coverings or other materials,
                      (ii)       any room within the premises that is used for massages or body
                                 rubs must

                                  (A)          have a transparent or translucent window with
                                               dimensions of not less than l metre wide by l metre high
                                               that is visible to the public reception area of the Massage
                                               Parlour, such windows to remain unobscured at all times
                                               when any room is in use,

                                 (B)           have a level of illumination which is not less than that
                                               used in standard business offices, which illumination
                                               must be on at all times when any room is in use,

                                 (C)           contain a massage table that is made of metal, is not less
                                               than l metre in height and is supplied with single use,
                                               disposable coverings, and

                                 (D)           not contain any mattress, futon, bed, couch, chair or other
                                               item of furniture that could reasonably be used as a bed;

            (d)        in the case of a

                        (i)        sole proprietorship, provide a copy of Authorized Identification
                                   and provide a copy of a criminal records search for the
                                   proprietor of the Massage Parlour,
                        (ii)       partnership, provide a copy of Authorized Identification and
                                   provide a copy of a criminal records search for each partner with
                                   an ownership interest in the Massage Parlour,

                         (iii)       corporate owner, provide a copy of Authorized Identification and
                                     provide a copy of a criminal records search for each director and
                                     officer of the corporation,

                        to the Licence Inspector, each such search to have been completed by
                        the Police within 30 days of the application date and confirming that
                        the sole proprietor or each of the partners or directors and officers, as
                        applicable, has not been convicted of any offence related to the keeping
                        of a common bawdy house, prostitution, drug possession or dealing,
                        pornography or violent crimes against any person;

             (e)        for each employee or independent contractor who will be providing
                        massage or body rub services as part of the business of the Massage
                        Parlour, provide a copy of Authorized Identification and provide a copy of
                        a criminal records search for such individual or individuals to the Licence
                        Inspector, each such search to have been completed by the Police within
                        30 days of the application date and confirming that each employee or
                        independent contractor, as applicable, has not been convicted of any
                        offence related to the keeping of a common bawdy house, prostitution,
                        drug possession or dealing, pornography or violent crimes against any
                        person;

             (f)        in the case of a partnership or corporate owner, provide to the Licence
                        Inspector the name of the partner or the name of the director or officer
                        who will provide day to day management of the Massage Parlour;

             (g)       not employ any person under 19 years of age.

37.        The Licence Inspector may, upon receipt of all materials required by this Bylaw
           for a business Licence for a Massage Parlour, issue a business Licence for the
           following durations:

            (a)        the first business Licence for a Massage Parlour will have a duration of 3
             ^         months from the date of issuance;
            (b)        provided that all of the terms and conditions applicable to the operation
                       of a Massage Parlour as set out in section 38 of this Bylaw have been
                       met during the initial 3 month term, the second business Licence for a
                       Massage Parlour will have a duration of 6 months from the date of
                       issuance;

            (c)        provided that all of the terms and conditions applicable to the operation
                       of a Massage Parlour as set out in section 38 of this Bylaw have been
                       met during the subsequent 6 month term, the third business Licence
                       and all subsequent business Licences for a Massage Parlour will have a
                       duration of one year from the date of issuance.

38.        Every Massage Parlour must meet the following terms and conditions while it is
           operating in the City under a validly issued business Licence:

               (a)         the requirements set out in section 35 (hours of operations) must be
                           met;
               (b)        the requirements of section 36 must be met during all hours when the
                           Massage Parlour is open for business;
               (c)        the proprietor or the individual identified in section 36(f) must provide
                          day to day management of the Massage Parlour;
              (d)         the proprietor or the individual identified in section 38(f) is responsible
                          for ensuring that a written record is kept of the full name, address and
                          telephone number of every person to whom the Massage Parlour
                          provides services, together with the date, time, nature and cost of every
                          service performed for each person and the method of payment and
                          must make such written records immediately available for inspection by
                          the Licence Inspector or his or her delegate at any time upon request;
              (e)         prior to permitting any employee or independent contractor to provide
                          massage or body rub services at the Massage Parlour, comply with the
                          provisions of section 36(e)and 36(g)in respect of that employee or
                          independent contractor.
              (f)          all persons hired to provide massage or body rub services or the person
                          providing day to day management are required upon request, by any
                          Officer, to produce Authorized Identification.


             A failure to comply with any or all of the foregoing terms and conditions will be
             a sufficient basis for the Licence Inspector to refuse to issue any further
             business Licence to the Massage Parlour.


Social Escort Services

39.         Every person operating or applying for a Licence to operate an Escort Service
            shall, at the time of applying for a Licence for such operation:

          (a) (i)       provide a list showing the name, age, birthdate, address arid a copy of
                        Authorized Identification of every person proposed to be employed or
                        engaged in the said business, together with such additional information
                        as the Licence Inspector or Chief of Police may require; and thereafter
               (ii)     notify the Licence Inspector within twenty-four (24) hours of any
                        changes in the personnel employed or engaged in the said business, and
                        the provisions of paragraph (i) above shall apply to any new persons
                        proposed to be engaged or employed by the said Social Escort Service;
                        and
               (iii)    maintain to the satisfaction of the Licence Inspector and Chief of Police
                        a written record of every request to provide or furnish an escort or
                        partner, giving the name and address of the person requesting the
                        service together with the name of the escort or partner recommended
                        and the function or functions to be attended;

           (b) It shall be unlawful for any person carrying on the business of operating a
               Social Escort Service to employ or engage any person in the said business
               without first having obtained the approval of the Licence Inspector or Chief of
               Police to the employment or engagement of any such person.
          (c) Any Licence Inspector or any Police Constable whose duties include the
              administration and enforcement of this Bylaw is hereby authorized to enter
              the premises of a Social Escort Service at any time to ascertain whether the
              regulations contained in this section are being, or have been complied with;
              and it shall be unlawful for any person to prevent or obstruct any such official
              or Police Constable from the carrying out of any of his duties with respect to
              the administration and enforcement of this Bylaw.
          (d) The provisions of this Bylaw shall be deemed to be the conditions of every
              Licence issued to any person to carry on the business of, or operate a Social
              Escort Service within the City; and the failure on the part of any such person to
              comply with any of the provisions of this Bylaw in that behalf shall be deemed
              to be grounds for the immediate suspension, by the Licence Inspector, of the
              Licence of such person so failing to comply with the said provisions.



                                                        PART 4

                                                 Offences and Penalties

Offences

40.         Every person who violates any of the provisions of this bylaw or who suffers or
            permits any act or thing to be done in contravention of any of such provisions or
            who neglects to do or refrains from doing any thing required to be done by any
            of the provisions of this by-law shall be deemed to be guilty of an offence
            against this Bylaw and is liable to a fine not exceeding $10,000.00. Every
            infraction shall be deemed to be a continuing, new and separate offence, for
            each day during which the same shall continue.

                                                   PART 5

                                               Other Provisions

 Repeal

 41.        City of Coquitlam Trades Licensing Bylaw No.49,1972 and City of Coquitlam
            Automatic Vending Machine Bylaw No.1809,1987 is hereby repealed in its
            entirety.


 Commencement

 42.        This Bylaw will come into force on the date of final adoption hereof.


 Severability

 43.        If any section, subsection, clause or phrase of this Bylaw is, for any reason, held
            to be invalid by a court of competent jurisdiction, it will be deemed to be
            severed and the remainder of the Bylaw will remain valid and enforceable in
            accordance with its terms.

                                                        SCHEDULE 'A'

                                                 Annual Business Licence Fees




 The following is a list of business types and categories and the Licence fee for each. All
 Licences are for a year unless otherwise specified.
 l.    Professionals - Annual Licence Fee for all Categories $205.00


       (a)      Accountant
       (b)      Architect

  11. Unclassified Businesses


       Any business not otherwise provided for in this Schedule "A" will be categorized as
       "unclassified" and will pay an Annual Licence Fee of $170.00.


  12. Transfer and Name Change Administration Fees


       Any business with a valid business Licence may, at any time during a Licence year,
       apply to:


       (a) transfer its business Licence from one location to another within the City upon
           payment of a $30.00 administration fee;


       (b) change the name of the business upon payment of a $30.00 administration fee,
           provided that, for corporations, a true copy of the name change certificate
           issued by the Company Office (Victoria) must accompany the name change
           request.




 13. Late Payment Charge

             Each of the business Licence fees set out in sections 1 through to and including
             11 of this Schedule "A" will be subject to a 25% late payment charge if:

             (a)        in the case of a new business Licence application, the business for which
                        the business Licence is sought has already commenced operating in the
                        City before making application for a Licence; or

             (b)        in the case of an existing business renewing its business Licence
                        application for a successive year, the annual business Licence renewal
                        fee is not paid on or before the expiry of the current business Licence for
                        the business.

            Where a late payment charge is applicable pursuant to this section 13, business
            Licences will not be issued until payment of both the Licence fees otherwise
            prescribed in this Schedule "A" and the 25% late payment charge have been
            received by the City.

Re; Proposed licence fee for Pawn Brokers

Please accept this letter as our request to appear before council on the proposed Licence
Fee for Pawnbrokers.

Common Exchange is a specialty financial institution that provides British Columbians
with small collateral loans, commonly known as pawn loans. We currently operate nine
locations in the lower mainland. For the past 12 years one of these locations has been in
The City of Coquitlam. Common Exchange Coquitlam changed locations this spring
onto it's own property on Brunette Avenue.

Over the past twelve years we have an exemplary record of corporate citizenship and
have established a good working relationship with local law enforcement in the City of
Coquitlam. Furthermore, we uphold business practices that easily exceed most municipal
bylaw requirements. Over the past twelve years there has never been an incident that
called into question our business practices.

We are of the opinion that our business is greatly misunderstood due to inaccurate
perceptions perpetuated by a headline happy media.

Common Exchange leads the industry by example and works very hard on maintaining
open and good relationships with RCMP and City Bylaw Officers. We feel that the
proposed licence fee increase is totally unreasonable and will reflect badly on the
relationships that we worked very hard to establish.

The premise of a business licence fee increase of this magnitude is proof that our
business is greatly misunderstood and therefore destroys the bridges of co-operation
instead of building these bridges.

We encourage Council to either cancel this proposed change or at the very least put off
making a decision until such time that Mayor and Council have been fully informed with
solid facts that address our side of this proposed action. We feel that a decision like this
should be based on hard facts and not emotions.

Common Exchange prides itself on having courteous and professional staff, as

While there is a commonly held belief that pawnshop consumers are destitute
and rely on pawnbrokers because they have no other alternatives, the truth is
that pawnbrokers are simply the most attractive option.
96 percent of Common Exchange customers repay their loans and redeem
their collateral.
Only l/70th of 1% percent of all the items Common Exchange takes in as
collateral turns out to be stolen property.
The notion that stolen goods are bought and sold by pawnshops is simply
untrue. Law enforcement agencies have no statistics to back up such claims.
When it comes to stolen goods, Common Exchange is part of the solution, not
part of the problem.
At Common Exchange we lead by example and have spent almost 15 years
educating the public on the misconceptions surrounding pawnshops. To this
end, Common Exchange encourages law enforcement officers, city councilors,
and bylaw officers to visit our business and learn more about who we are and
how we operate.
Some jurisdictions in British Columbia have attempted to enact legislation to
limit the number of pawnshops in their communities. The Credit Research
Center at Georgetown University found that:
     Competition is critical for the protection of consumers and the
     efficiency of credit markets. When competition is restricted in this
     manner, consumers find pawnshops less convenient and may also
     obtain less favorable terms than would be found in a fully competi-
     tive market. There is no economic support for such restrictions.
Common Exchange believes local politicians, bylaw officers, law enforcement
agencies, and indeed the pawn industry, all have a vested interest in working
together to make it increasingly difficult for corrupt establishments to continue
to operate. To that end we support the regulation of the pawn industry.
Banning successful, law-abiding pawnbrokers is not in the best interest of
consumers and does not serve the best interest of local citizens.
                          COMMON EXCHANGE is a specialty financial institution that provides British
                          Columbians with small collateral loans, commonly known as pawn loans.
                          Founded in 1993 by Henk Veldhuis and Adam Tobias, Common Exchange has
                          grown from a single Surrey location into the most well-known pawnbroker in the
                          Lower Mainland. There are currently eight Common Exchange locations in the
                          Lower Mainland, two of which are corporately owned and six which are operated
                          as franchises. In 2005, Common Exchange opened its first location outside the
                          Lower Mainland in Vernon, British Columbia.

                          Common Exchange is a unique business in that each location contains two
                          businesses under one roof: a pawn business and a retail business. While many
                          pawnshops combine their retail and lending functions, each Common Exchange
                          location is purposefully segregated into two separate areas to ensure that custom-
                          ers obtaining pawn-loans are afforded maximum privacy. At Common Exchange,
                          pawns-loans are our primary focus and constitutes the majority of our business
                          (see How the Pawn Process Works below). The retail component comprises only a
                          small portion of our business and is used to sell items that were pledged for a

                          Common Exchange was the first pawnbroker in British Columbia to establish a
                          large network of locations. From the outset, our goal was to provide a standardized

How the Pawn

               THE WORD PAWN is derived from the Latin word pignus, meaning property held as
               security for a debt. At Common Exchange customers pledge their property for a
               short-term cash loan. The value of the loan is based solely on the value of an item
               pledged as collateral. This means that all customers, regardless of their credit
               history, can obtain loans because only the value of the item being pawned is
               considered. It is important to note that customers are not selling their items; a
               pawnbroker provides loans which allow customers to redeem their property
               whenever they desire. The most common items used to obtain loans are jewelry,
               home electronics (TVs, stereos, cameras, etc.), tools, sporting equipment, musical
               equipment, and computers.

               When entering a Common Exchange store customers are greeted by courteous,
               professionally trained employees (called pawnbrokers or brokers). If the customer
               is there to obtain a loan, they proceed to the Loans Area which consists of numerous
               private booths or cubicles. In that respect, Common Exchange provides a high
               degree of privacy for its customers much the same way banks do for customers
               applying for loans and mortgages.

               Friendly personnel often greet customers by name as many people use Common
               Exchange as a source of temporary funds several times throughout the year. If the
               customer is new to Common Exchange or is unfamiliar with the pawn process,
               employees provide a detailed overview of the process.

               Once at the loan booth, customers present the item they wish to use as collateral
               to the broker. The Common Exchange employee then inspects the item that is
               offered as a pledge. For example, if the customer pledges a video camera, the
               broker will inspect the item, test to see if the camera is working properly, and
               check to ensure the item has a serial number. Next the Common Exchange broker
               determines the loan value by relying on experience and the help of an on-line
               database (bluebooks). Generally, Common Exchange will loan up to 50 percent of
               the value of the item being pledged. Loans are however made for as little as $20
               and as high as $15,000. At Common Exchange, the average loan is $125.

               Once the value of the loan is mutually agreed upon and the customer wishes to
               proceed with the loan, the broker will ask the customer for identification. Common
               Exchange requires current government-issued photo identification such as a
               BC driver's license, provincial government ID card or Canadian passport. The
               customer's name, address, ID number, birth date, descriptive details (height,
               weight, hair and eye colour), a detailed description of the goods including serial
               number is entered into Common Exchange's computer system. A pawn-receipt
               (typically called a pawn-ticket) is printed with all of the customer information,
                        value of the loan, finance charges for the loan, and due date. The Common
                        Exchange broker takes the item pledged and provides the customer with-the
                        agreed upon cash and a copy of pawn-ticket.

                        A typical pawn transaction at the Common Exchange takes only 5 to 10 minutes.
                        The item, tagged with a copy of the pawn-ticket, is then stored in a secured storage
                        area at the Common Exchange. Each location has a secured vault in which jewelry
                        and other high-valued items are stored. Each location also has an extensive
                        security system including cameras and 24-hour monitored alarms to protect
                        customer's pawned property.

                        Loan Duration & Finance Charges

                        The duration of Common Exchange loans (contractual period) varies from one
                        to three months depending on the customer's needs. Common Exchange also
                        provides an extended grace period at the end of the three month term. Finance
                        charges at Common exchange are comprised of an interest charge and a storage
                        charge which are combined on the pawn-receipt for purposes of full-disclosure.
                        Typically, the total finance charge for a $100 loan including interest, storage and
                        insurance amounts to $10 for a 30-day period.

                        Paying the loan and redeeming pawned-item

                        At any time during the three month contractual period Common Exchange
                        customers are able to repay their loan and receive the item(s) they pledged as
                        collateral. This process is typically called redeeming a pawn. Common Exchange
                        customers are able to redeem their items at any time because all items pledged are
                        stored at the location where the loan was given. Customers must present their
                        pawn-tickets in order to redeem their loans.

                        Most Common Exchange customers repay their loans and redeem the items pledged
                        as collateral. More specifically, since opening in 1993,96 percent of Common
                        Exchange customers repay their loans and redeem their collateral. The four
                        percent of items that are not redeemed are sold in the Retail Area in Common
                        Exchange locations.
                        It is important to reiterate that Common Exchange is first and foremost a financial
                        institution - like most other lending institutions our business depends on repeat
                        customers. Our goal is to make it as easy as possible for customers to redeem their
                        items. For example, we offer an extended grace period on all loans. Since most of
                        our long-term customers have a history of redeeming their items, we often hold
                        items for longer than three months if the customer contacts us before his or her
                        loan expires. Finally, we offer customers the option of paying down a portion of
                        their loan and renewing the remainder for an additional three months.

                        Preventing Stolen Items from being Pawned

                        At Common Exchange stolen property is our worst enemy and we work closely
                        with local police to catch and prosecute thieves. Each week we provide the law
                        enforcement authorities in each of the cities we operate in a detailed report of all
                        the loans that we have done in the past week. As a result of having highly compu-
                        terized operations for 1 3 years, we are able to provide law enforcement agencies
                        with concise and accurate reports which include the customer's name, address,
                        personal details, and a description of the item(s) pawned (including serial
                        numbers).

                        Police then review the reports both for stolen property and for suspected thieves.
                        If the police determine that a pawned item is stolen property, they will come to
                        the Common Exchange location and present the evidence to the store manager.
                        The store manager will then complete a stolen items report for our internal
                        records and provide the item to the law enforcement officer.


When it comes to stolen goods. Common Exchange is part of the solution, not part of the problem.



                        It is simply not in the best interest of the Common Exchange to accept stolen
                        merchandise because we lose the collateral and the loaned money when the police
                        confiscate stolen items. For this reason, the Common Exchange encourages local
                        police departments to inform our staff of suspected property crime criminals and
                        thieves. If informed, Common Exchange managers enter warnings into our
                        computer system barring employees from giving the suspected individuals loans.
                        When it comes to stolen goods, Common Exchange is part of the solution, not
                        part of the problem.

                               Most thieves are well aware that pawnshops are required to submit reports and
                               that the law enforcement agencies will have all of their personal information and
                               a full description of the item(s) pledged. In addition, most thieves are aware that
                               Common Exchange works closely with law enforcement. As a result, only 2 in
                               approximately 10,000 items pledged as collateral at Common Exchange locations

                               The notion that stolen goods are bought and sold by pawnshops and that they
                               have a negative impact on the community is simply untrue. Law enforcement
                               agencies have no statistics to back up such claims. That fact is that most stolen
                               property ends up being sold at unregulated outlets such as flea markets, second
                               hand stores, pubs and bars, and even online outlets.

                               In many communities new regulations are .being introduced that will require
                               pawnbrokers to electronically submit their transaction records to a database
                               administered by a third party. Law enforcement agencies can then search the
^^                             database for descriptions of all items pledged for collateral loans. If the law
                               enforcement agencies suspect that a pawned item is stolen property, they are
                               permitted access to the personal details of the person who pawned the merchan-
                               disc. Common Exchange fully supports the move to digital transaction reporting.

                                                                    COMMON EXCHANGE CUSTOMERS are working people like you and me. Most of
                                                                    our customers have regular jobs in a wide variety of industries including con-
                                                                    struction, health care, education, retail, and government.

                                                                    Like all British Columbians, our customers want the best for their children and
                                                                    families. Unfortunately, like most of us, they experience strained financial circum-
                                                                    stances from time-to-time which leaves them unable to pay bills or other unfore-
                                                                    seen expenses. Common Exchange helps these British Columbians meet their
                                                                    financial needs not being met by other financial institutions.

                                                                    In fact, a 1998 study published by the Credit Research Center at Georgetown
                                                                    University surveyed pawn shop customers and found that 45 percent of pawnshop
                                                                    customers borrow to meet pressing bills such as rent, hydro, and car expenses. In
                                                                    addition, pawnshop customers borrowed twice per year on average.



                                                                                    Characteristics of Pawnshop Customers:
                                                                                    • 78 percent of pawn customers are under the age of 45 years -
                                                                                      "an age group that typically faces expensive family demands"
                                                                                    • 83 percent of pawn customers have at least a high school equivalent degree
                                                                                    • 35 percent of pawn customers have some college education
                                                                                    • 45 percent of pawnshop customers borrow to pay bills
                                                                                    • 32 percent borrow money for personal reasons.

                                                                    In short, Common Exchange helps its customers meet their daily needs until the .
                                                                    next payday. Short-term loans provided by Common Exchange keep families fed
                                                                    as well as the rent and other bills paid.

                                                                    Do Pawnshop Customers Have Alternatives?

                                                                    While there is a commonly held belief that pawnshop consumers are destitute and
                                                                    rely on pawnbrokers because they have no other alternatives, the truth is that
                                                                    pawnbrokers are simply the most attractive option.

                                Researchers at the Credit Research Center at Georgetown University found that
                                the most frequently identified alternative to pawnshops was borrowing frpm a
^    .                          family member or friend (47.5 percent of respondents). Asking friends or rela-
                                tives for money, especially when one is unable to provide for their family, is a very
                                difficult thing to do. Pawnbrokers provide a discrete and non-judgmental method
                                to finance family expenses.

                                Another alternative to pawn loans is to liquidate (sell) personal assets. In fact, 15.6
                                percent of respondents in the Credit Research Center survey indicated that this
                                was their best alternative to a pawn loan. Selling personal items however, means
                                that individuals must repurchase their items in better times - pawn loans allow
                                people to temporarily forfeit the use of their items.

                                When customers do not have access to regulated pawnbrokers, their only alterna-
                                tive might be a unregulated lender that is not subject to rules and is often times
                                part of the underground economy. Unregulated lenders charge dramatically
                                higher fees and may involve a criminal element.

                                Finally, without access to pawnbrokers many individuals and families must do
                                without. Almost 20 percent of respondents on the Credit Research Center survey
                                indicated that "doing without" was their best alternative to a pawn loan. Since
                                most pawnshop customers borrow small amounts of money to pay bills, put food
                                on the table, and put gas in the car, "doing without" can lead to dire consequences.

    Misconceptions about Pawnbrokers

                             THE PAWN INDUSTRY is one of the most misunderstood industries. Unfortunately,
                             public perception of pawnshops has been shaped largely by TV and movies. These
                             mediums continue to portray pawnbrokers as shady characters, conducting business
                             in run-down shops, in unsavory parts of town, buying and selling stolen goods.

                             The typical stereotype of pawnshops however could not be further from the truth.
                             That many people have a poor image of pawnshops is testament to the lack of
                             accurate knowledge about how the industry operates. The majority of today's
                             pawnshops are clean, attractively maintained establishments, and are being accepted
                             as a valuable part of the community.

                             At Common Exchange we lead by example. We have spent almost 1 5 years edu-
                             eating the public on the misconceptions surrounding pawnshops. To this end,
                             Common Exchange encourages law enforcement officers, city councilors, and
^                            bylaw officers to visit our business and learn more about who we are and how
                             we operate.

                             We certainly would not disagree that some pawnbrokers have checkered reputations.
                             However, the pawn industry is like any other industry in that there are some
                             dishonest businesses among the majority of professional establishments. With the
                             right regulations and municipal bylaws, and a healthy amount of competition, the
                             few bad establishments can be weeded-out. While bylaw and law enforcement
                             officers have increasingly consulted with professional pawnbrokers such as Common
                             Exchange, we believe an even closer relationship would be in the best interest of
                             the industry and the community.

                 Regulations to Ban Pawnbrokers

                                          SOME JURISDICTIONS in British Columbia have attempted to enact legislation to
                                          limit the number of pawn shops in their communities. While Common Exchange
                           -              supports the regulation of the pawn industry, including the move towards digital
                                          transaction reporting (as noted above), research shows that banning pawnbrokers
                                          is not in the best interest of consumers and does not serve the best interest of
                                          local citizens. Such regulation unnecessarily paints all pawnbrokers with the same
                                  •       brush and feeds the public misconceptions of the pawnbrokers.

                                          The Credit Research Center at Georgetown University found that, "Competition is
                                          critical for the protection of consumers and the efficiency of credit markets. Some
                                          states and cities have "convenience and advantage" licensing statutes that place limits
                                          on the number of pawnshops in a geographical area. When competition is restricted
                                          in this manner, consumers find pawnshops less convenient and may also obtain less
                                          favorable terms than would be found in a fully competitive market. There is no more
                                          economic support for such restrictions"

                                          Local politicians, bylaw officers, law enforcement agencies, and indeed the pawn
                                          industry, all have a vested interest in working together to make it increasingly
                                          difficult for corrupt establishments to continue to operate. The answer however
                                          does not lie in shutting down legitimate and professionally managed businesses.


                 Banning pawnshops is not a solution. Common Exchange believes that local politicians and bylaw officers
                 should work with us to put the right regulations in place that make it impossible for corrupt establishments to
                 continue to operate.

Re:     Proposed Coquitlam business license fee.

We were completely surprised to see the proposed new license fee for our business at
$10,000.00 which represents a 100% increase over last year and I believe is the highest
license fee in the City. Since, I believe we are the only license issued in our category, we
consider the proposed increase to be punitive in the extreme and unjustifiable. The
justification given for the last increase was the high costs of policing - during the past
year the police attended our premises one time on a call that was not related to the
operation of our business. I'm sure that the number of calls to bars, malls and
convenience stores exceeds ours one-hundred fold and false alarms probably one-
thousand fold. We operate within the applicable by-laws, many of which are imposed
exclusively on our business, neighbouring businesses are pleased with our conduct and
our landlord has told us that we are his best tenant.

To meet payment of the last license fee the two owners of the company each had to
personally inject funds because the company didn't have sufficient earnings to cover.

Please forgive this brief and amateurish submission, but we did not have much time to
prepare and to hire legal representation is beyond our budget. We feel an increase is
neither necessary nor justified and hope that the already high license fee be at least left
where it is or at best reduced to a level of other lower mainland communities. Thank you
