SUBJECT:    a. Approve and authorize the Contracts/Purchasing Officer to execute a
               Service Agreement with Verizon Business Network Services Inc., to
               provide the County with a High Speed Digital Link Internet access for the
               period of June 1, 2009 through May 31, 2012 in an amount not to exceed
               $98,500.00 per year; and
            b. Accept non-standard terms as recommended by the Director of Information
               Technology; and
            c. Authorize the Contracts/Purchasing Officer to sign extensions for up to two
               additional years of service.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
 a. Approve and authorize the Contracts / Purchasing Officer to execute a Service Agreement
    with Verizon Business Network Services Inc., to provide the County with a High Speed
    Digital Link Internet access for the period of June 1, 2009 through May 31, 2012 in an
    amount not to exceed $98,500.00 per year; and
 b. Accept non-standard terms as recommended by the Director of Information Technology;
    and
 c. Authorize the Contracts / Purchasing Officer to sign extensions for up to two additional
    years of service.
SUMMARY / DISCUSSION:
This Verizon Business Service Agreement will continue and expand the internet services
provided to the County by Verizon. Verizon Business Network Services Inc., is offering the
county a 52% discount for the service provided that an agreement is executed before May 31,
2009. The Information Technology Department is requesting that this agreement be accepted
despite non-standard provisions, including those related to: late payment charges, assignment,
and arbitration. The County has used this service since 6/2004 with similar terms without
incurring any liability or financial consequence. Changing Internet services providers would
take an extensive amount of time, cost, and labor and further modifying this agreement subjects
the County to a significant increase in cost of service. Therefore the Information Technology
Director recommends the approval of this agreement as a business necessity.

This Agreement replaces a Verizon Business Services Agreement approved by the Board of
Supervisors on June 5, 2007 which provided for a high speed dual DS-3 link to Verizon’s Frame
Relay Network. The County of Monterey has specific requirements for a reliable, scalable,
burstable Internet connection. The scalable and burstable features permit the County to exceed
its planned Internet usage capacity and be billed based on average usage. This benefits the
County as there are periods such as weekends with very low internet usage. The service
provided is based on Verizon’s premier Internet technology for best in class reliability. Since
2004, MCI has provided this service to the County. In 2006, MCI was purchased by Verizon
who is now responsible for providing this service.

OTHER AGENCY INVOLVEMENT:
The agreement has been generally approved by County Counsel as to legal form. County
Counsel does not approve the non-standard assignment provisions or the limitations of liability
and disclaimer of warranties and, therefore, requires that these non-standard terms be approved
by the Board. In addition, the Auditor-Controller does not approve the non-standard payment
provisions including the late charges.

FINANCING:
Funds were included in the FY 2009-10 Information Technology Department Budget Unit 151
for this service. There is no impact to the County General Fund.
