                                    CHARITABLE TRUSTS

                    REPORT BY DIRECTOR OF CORPORATE SERVICES

ABSTRACT

To inform members of the existence of various Charitable Trusts in Angus and to seek the
appointment of Trustees to administer these funds.

1.    RECOMMENDATIONS

      The Council is asked to agree to appoint, as Trustees, the members representing the wards
      affected by the operation of the Trusts.

2.    INTRODUCTION

      This Report deals with Charitable Trusts where the Council appoints the Trustees and is
      responsible for administration of the funds. In terms of Section 16 of the Local Government
      etc (Scotland) Act 1994, these Trusts became Angus Council’s responsibility as from 1 April
      1996. Most of them were administered up to 1996 by Angus District Council, who had in turn
      inherited them from either the Town Councils of the burghs or the County Council of Angus in
      1975.

      There are 134 Trusts with a total value at 1 April 2007 of £1.462m and £0.381m in capital and
      revenue balances respectively. Although their funds have become the property of Angus
      Council, in terms of the above Act, the management of each Trust is delegated to specified
      Trustees. The financial care of the funds is entrusted to the Head of Finance and the
      administrative arrangements for disbursements are dealt with by the Head of Law and
      Administration.

3.    APPOINTMENT OF TRUSTEES

      The Council is asked to consider the appointment of Trustees of the Trusts listed in the
      Appendix.

      The Appendix lists the Trusts by each burgh, with those covering landward areas shown
      separately. The last two columns of the Appendix show the most recent balance on the
      Capital and Revenue accounts of each Trust (ie as at 1 April 2006). The terms “capital” and
      “revenue” are explained below.

      Capital Account

      This represents in respect of any financial year the original bequest adjusted by any re-
      valuation of assets less any capital related expenses.

      Generally, the Capital Account is preserved and no distributions are made from the Capital
      Account in order to maintain the income for distribution although the real value may be eroded
      by inflation. In many cases, the Trustees are precluded by the terms of the original gift from
      distributing capital.

      Revenue Account

      The Revenue Account is kept separate from the Capital Account and represents the total
      annual income generated on the capital and on any accrued revenue balances and this
      income meets the cost of all disbursements and all administrative charges.

      Generally, the income distributed in any year equates roughly with the income on the
      Revenue Account since to distribute substantial accrued revenue balances would seriously
      affect the income available in future years.

4.        HUMAN RIGHTS

          There are no direct human rights implications in connection with this Report.

5.        CONSULTATION

          The Chief Executive, the Head of Finance and the Head of Law and Administration have been
          consulted during the preparation of this Report and are in agreement with its contents.

                                 was used to reduce the amounts used
                                 under assessment.

                                 In 1878 James Smart, Grocer, Arbroath
                                 made over to Arbirlot Parochial Board two
                                 6% bonds of £200 each of the
                                 Pennsylvanian Railway Railroad Co under
                                 certain life rent charges. Income now
                                 applied to relief of the poor in the Parish.
