I   Proceedings of a regular meeting of the Pittsford Town Board held in Pittsford Town Hall on
    Tuesday, July 6, 1993 at 7:00 P.M. local time.
    PRESENT:    Supervisor Freeman; Councilmen McNamara, Fyfe, Chapuran,
                Berggren; Town Attorney Reed; Staff persons Brewster and
                Beck.
    ABSENT:     None.
    ATTENDANCE: 9.
    PLEDGE OF ALLEGIANCE

    MINUTES OF .JUNE 15. 1993
    A resolution was offered by Berggren, seconded by Chapuran,
    RESOLVED, that the minutes of June 15, 1993 are approved with corrections.
    ROLL CALL:        Ayes, McNamara, Fyfe, Chapuran, Berggren.
                      Abstain, Freeman. Nays, none. Declared carried.
    INTERIM REPORT: FISCAL IMPACT OF DEVEWPMENT STUDY
    Kent Gardner, Center for Governmental Research, reported to the Board on his progress on
    the Fiscal Impact of Development Study. It was agreed that he would report back to the Board
    at the meeting of September 7 after completing his fiscal impact model.
    PUBLIC HEARING CANCELED: ARLINGTON SEWER DISTRICT EXT. 5
    A resolution was offered by McNamara, seconded by Fyfe,
    RESOLVED, that the public hearing scheduled for Tuesday, July 20, 1993 at 8:00 P.M. local

I   time in Pittsford Town Hall to consider Arlington Sewer District Ext. 5 is canceled.

    PUBLIC HEARING SET: ARLINGTON SEWER DISTRICT EXT. 5
    A resolution was offered by Chapuran, seconded by Berggren,
    RESOLVED, that a public hearing is set for Tuesday, July 27, 1993 at 7:00 P.M. local time
    at the Pittsford Sewer District Administration Building, 3899 Monroe Ave., to consider the ap-
    proval of Ext. 5 to the Arlington Sewer District. (Lands of Wendy's Restaurant, Kowlowski
    and Walter)
    ROLL CALL: Ayes, all. Nays, none. Declared carried.

    CITIZEN CONCERN: MONOCO OIL CO. ODOR EMISSIONS
    Ray Batz, 9 Brook Rd., addressed the Board about his concerns about the odors emanating
    from asphalt stored and hauled from Monoco Oil Co. on Monroe Ave. He described the five-
    year history of the problem and his frustration with the inaction of the Department of Environ-
    mental Conservation. The Board assured him that the town law suit against Monoco addresses
    his concerns.
    RESOLUTION OF COMMENDATION: DEPARTMENT OF PARKS AND RECREATION
    A resolution was offered by Berggren, seconded by Fyfe,
    RESOLVED, that the Board commends the staff of the Department of Parks and Recreation
    for the outstanding job in maintaining the town playing fields during the Mustangs' Soccer
    Tournament over the July 4th weekend.
    ROLL CALL: Ayes, all. Nays, none. Declared carried.

    JULY PROCLAIMED DRIVER COURTESY MONTH IN PITTSFORD
    A resolution was offered by McNamara, seconded by Chapuran,
    RESOLVED, that July is proclaimed as Driver Courtesy Month in Pittsford.

      LGRMIF GRANT AUTHORIZED
      A resolution was offered by McNamara, seconded by Fyfe,
      RESOLVED, that the Supervisor is authorized to sign the 1993-94 Local Government Records
      Management Improvement Fund Grant in the amount of $22,046.00.
      ROLL CALL: Ayes, all. Nays, none. Declared carried.

      PERSONNEL RULES CHANGE: WORKERS' COMPENSATION
      A resolution was offered by Freeman, seconded by Chapuran,
      RESOLVED, that Section 19 C of the Town of Pittsford Personnel Rules is amended as fol-
      lows: "Additional charges to compensate the town for deductions from insurance reimburse-
      ment may be considered in the allocation of sick time when employees are on Workers' Com-
      pensation. "
      ROLL CALL: Ayes, all. Nays, none. Declared carried.

      CALCULATOR DECLARED SURPLUS PROPERTY
      A resolution was offered by Fyfe, seconded by Chapuran,
      RESOLVED, that a Royal 300PD calculator in the Town Clerk's Office purchased in 1985
      for $98.00 is declared surplus property and may be disposed of.
      ROLL CALL: Ayes, all. Nays, none. Declared carried.

      ADDITIONAL FUNDING FOR SUTHERLAND SHOW CHOm/JAZZ
      A resolution was offered by McNamara, seconded by Berggren,             .

      RESOLVED, that the total fee paid to the Sutherland High School Show Choir and Jazz
      Ensemble for their performance on Friday, June 25, 1993 as part of the Summer Concert
      Series is increased to $400.00.

      PUBLIC HEARING: LOCAL LAW NO.7 OF 1993; PONDS LAW
      Supervisor Freeman opened the hearing. She explained that the law before the Board has
      evolved from a series of discussions with citizens concerned about safety and landscape profes-
      sionals who install garden ponds. On the advice of Deputy Commissioner of Public Works
      Martin Brewster, the Law will be amended to define "open water pond" as any man-made
      body of water with a surface area no greater than 12,000 square feet rather than the 10,000
      square feet as originally proposed.

      George Morgenstern, 35 Split Rock Rd., spoke in opposition to any regulation of ponds.
      Patrick Burke, 5 Grey Fawn, also spoke.
      As there were no other speakers, the Supervisor closed the hearing.

      SEOR DETERMINATION:             PONDS LAW
      A resolution was offered by Berggren, seconded by Chapuran,
      RESOLVED, that the Town Board of the Town of Pittsford for the purposes of SEQR
      declares this action to be a single agency, unlisted action, and upon preparation and review of
      the Environmental Assessment Form, the Town Board issues a negative declaration since the

    A resolution was offered by Fyfe, seconded by McNamara,
    RESOLVED, that Local Law No.7 of 1993; Ponds Law is adopted with the definition for
    ·open ponds" amended to increase the surface area to "no greater than 12,000 square feet."

    CONFERENCE AITENDANCE AUTHORIZED: TOWN CLERK
    A resolution was offered by McNamara, seconded by Berggren,
    RESOLVED, that Town Clerk Margaret Beck is authorized to attend a records management
    workshop in Penfield on Wednesday, July 14, 1993.

    BID AWARD; TWO NEW SIDE BODY DUMP TRUCKS WITH AITACHMENTS
    A resolution was offered by Berggren, seconded by Chapuran,
    RESOLVED, that on the advice of Commissioner of Public Works William Carpenter, the bid
    of $66,666.00 for two new side body dump trucks with attachments is awarded to Roberts
    Equipment, Inc. being the lowest qualified bidder meeting or exceeding the bid specifications.

    INSTALLA TION OF LIGHTS ON VAN VOORHIS RD. APPROVED                      "

    stallation of two overhead lights on Van Voorhis Rd.

    AGREEMENT WITH COUNTY FOR EMERGENCY SNOW AND ICE SERVICES
    AUTHORIZED
    A resolution was offered by Fyfe, seconded by Chapuran,
    RESOLVED, that the Supervisor is authorized to sign an agreement with Monroe County for
    reimbursement for emergency snow and ice services for the March, 1993 blizzard.
    ROLL CALL: Ayes, all. Nays, none. Declared carried.

    ADDITIONAL EOUIPMENT AND MANPOWER AGREEMENT WITH MONROE
    COUNTY AUTHORIZED
    A resolution was offered by Fyfe, seconded by Chapuran,
    RESOLVED, that the Supervisor is authorized to request additional funds for emergency man-
    power and equipment provided to Monroe County by the Town of Pittsford on March 5, 1993.
    ROLL CALL: Ayes, all. Nays, none. Declared carried.
    BILLING FOR MOWING ON HARRISON CIRCLE APPROVED
    A resolution was offered by Berggren, seconded by Fyfe,
    RESOLVED, that Building Inspector William Frohm is authorized to bill the owners of 15
    Harrison Circle for the mowing of grass by the town at that address, and, it is FURTHER
    RESOLVED that if the owners do not pay the bill, that amount will be levied onto their 1994
    Town and County tax bill.

       WOMEN'S LACROSSE PROGRAM AUTHORIZED

        Carpenter are authorized to attend a Total Quality Management Seminar at the Center for
        Governmental Research on July 15, 1993.

       CONSOLIDATION OF FUNDS FOR BUILDERS' CASH DEPOSITS AUTHORIZED
       A resolution was offered by Chapuran, seconded by Berggren,
       RESOLVED, that as of this date (July 6, 1993), the consolidation of builders' cash deposits in
       a non-interest bearing account in lieu of letters of credit is authorized.

       BID OPENING DATE SET; TWO TRAILER-MOUNTED VACUUM LEAF WADERS
       A resolution was offered by Chapuran, seconded by Berggren,
       RESOLVED, that a bid opening date is set for Monday, July 26, 1993 at II :00 A.M. local
       time in the Department of Public Works for two new 1993 trailer-mounted vacuum leaf
       loaders.

       PARKS BUILDING TOUR SET
       The Town Board will tour the Parks Building on East St. on Tuesday, July 27th at 7:30 A.M.

       RESOLVED, that the Board will go into executive session to discuss personnel matters and a
       law suit with the town attorney.

       As there was no further business, the meeting was adjourned at 8:35 P.M.

      A resolution was offered by McNamara, seconded by Berggren,
      R~OLVED, that the town will vigorously pursue the lawsuit against Monoco Oil Co.
      Withoutdelay in order to eliminate the noxious odors emanating from that facility.

                                TOWN BOARD OF THE

                                TOWN OF PITTSFORD

                                       NEW YORK

                                      AS FOLLOWS:

                             LOCAL LAW NO.7    OF 1993:

                                       PONDS LAW



    Sec. 1.   Purpose.
        The purpose of this law is to enact Section 25-917. Ponds. to
    the Town's Municipal Code. The purpose for that section is stated
    therein.

    Sec. 2.   Section 25-917, Ponds.       Enacted.


I      The text of section 25-917.

        "Section 25-917.     Ponds.
                                           Ponds. shall read as follows;



        (a)   Purpose.
             It is the purpose of this law to define and regulate all
    ponds in residential zoning districts in the Town in order to
    protect the environment, protect the rights of others to natural
    water flows and to prevent health and safety hazards that may
    occur by reason of the existence of ponds.

        (b)   Definitions.

              (1) Decorative pond - any man-made body of water with a
                  surface area no greater than one hundred (100)
                  square feet, and a maximum depth of eighteen (18)
                  inches.
              (2)   Garden pond    any man-made body of water with a
                    surface area no greater than five hundred (500)
                    square feet, and/or with a depth greater than
                    eighteen (18) inches but no more than thirty-six
                    (36) inches.

            (3)   Open water pond - any man-made b(dY of water with a
                  surface area no greater than ~     thousand (10,01l8)--,
                  square   feet,  and/or with   a   depth   more  than
                  thirty-six (36) inches.

      (c)   Exemptions.
            (1)   Ponds constructed as part of active agricultural
                  operations are exempt from this section.
            (2)   Retention and detention ponds mandated and/or owned
                  by the Town are exempt from this section.

            (3)   Natural ponds left in their natural state are exempt
                  from this section.

      (d)   Regulations.
            (1)   General.
                  (A)   All ponds must be maintained so as to assure
                        that   they   do   not    become offensive   to
                        neighboring properties by reason of stagnation,
                        algae,    mosquito    breeding,   and   similar
                        conditions.
                  (8)   No pond can interfere with or impede the
                        natural flow of water nor adversely impact any
                        flood plain or wetland area.
                                                                             I
            (2)   Decorative Ponds.
                  May be constructed on any residential property
                  subject to the applicable setback requirements and
                  without the necessity of obtaining a building permit
                  or landscape alteration permit.

            (3)   Garden Ponds.      .
                  May be constructed on any residential property
                  subject   to  all of the     provisions of Section
                  25-906(a) of this Code regulating swimming pools,
                  including obtaining a building permit.
            (4)   Open water ponds.
                  No open water pond may be       constructed   on   any
                  residential property unless:
                  (A)   the property on which the pond is to be
                        constructed is five (5) acres or more in size;
                        and

                             Service     of  the   united   States    Department     of
                             Agriculture    or its successor    agency;  and

                       (D)   a landscape    alteration     permit   has been issued
                             therefor,   except    that  such permit    shall   not be
                             required  where the Planning        Board has approved
                             such pond as part        of the subdivision      approval
                             process."


    Sec.   3.   Effective    Date.

         This   law shall      become effective  twenty       (20)  days   after   its
    enactment    and after    filing with the Secretary      of State.
