            Service Selection

 Wait 28 days after your Form 470 is posted and
  your RFP is issued before:
   Selecting   your service provider, and
   Signing   a contract
     • Refer to 470 RNL for the allowable contract date
   Schools  must document how/why they selected a
    certain vendor and disqualified others
 Then file your Form 471
 File forms online to avoid many common
  problems

            Contract Issues

 FCC E-rate contract rules trump local policies
 Telecom and Internet may/may not be
  contracted services
 On Form 470, always check options a and b on
  question #7
 Caution on multiyear contracts and any bid
  document (RFP)

              Contract Issues
 In selecting service, price must be the primary
  factor
 Both school and provider must sign and date
  contract before filing Form 471
   Verbal   agreements are not acceptable
   Quotes   are not acceptable
 School must provide signed and dated contracts
  as Form 471 documentation
 State Master Contracts
   DPI will provide guidance on STS and cell phone
    contracts

             Contract Issues

 Consultants (not vendors) can assist schools
  with their bids and contracts
   Be certain LOA is signed before consultant starts
    working for school
 Be certain consultants have no conflicts or other
  interests that may interfere with their ability to
  provide impartial advice
 SLD does not intervene in contract disputes

               Budget Issues

 Need to show SLD that you can fund your (non-
  discounted) share
   Budget   documentation should clearly identify school’s
    share
 Budget (draft OK) has dates that cover the
  funding year
 Budget has a date (even on draft) that is before
  the Form 471 certification

                 Budget Issues

 Your budget documentation must:
   Identify   your share
   Identify   the funding source
   Include    authorized signatures & dates
 You cannot rely on grants that you haven’t
  received
 You cannot borrow your share, after getting a
  FCDL
 Funds cannot come from the service provider

         Document Retention

 FCC requires 5-year retention for all E-rate
  related documents
   Bills,   bids, contracts, forms, etc.
   Notes  (emails) from decisions on services, contacts to
    and from providers, no bids received, etc.
 Can be in electronic or paper form
 Issues with poor recordkeeping have been
  documented in audits and instances of W/F/A
 Keep copies of everything!

                     Appeals
 Funding denials can be appealed
 Can be filed electronically or on paper
   No   appeal form, DPI has template
 Must be received/postmarked within 60 days of
  the funding denial
 Recent major change: FCC now granting many
  appeals
 Contact DPI for appeal advice

                Update for 2007
 SLD will provide more guidance and outreach
 Can correct ministerial and clerical errors
    Contract   number and contract award date
    Discount    calculations
 Carefully review requests sent from PIA
    If   needed, respond within 15 days
 Online BEAR form will be offered
 Unfortunately, FCC will not act on program
  simplification/reform

FCC and Program Simplification

 FCC is taking a comprehensive review
  of the E-rate program
 DPI recommends
   Eliminating   the 470
   Get   FCC out of micromanaging the tech plan
   Discounts   go directly to applicants
   Reduce    the maximum discounts to 70% to combat
    W/F/A
   Allow   any Internet service to be E-rate eligible

                 2007 Timeline
 Can file 470 now
 Form 471 window to open about Nov. 15, 2006
 Form 471 window to close about February 7
   Form    470 drop dead deadline, about January 10
 DPI will collect lunch data in November
   Will   post out Excel file about Dec. 20
   Will   use 2005/06 enrollment and lunch data
 About mid-November DPI will hold several
  workshops via the dist ed network
