									MEMORANDUM OF UNDERSTANDING
CAMPUS SAFETY ACT

This Memorandum of Understanding, entered into by and between the City of Saratoga Springs Police
Department and the Skidmore College Department of Campus Safety, sets forth the parties’ understanding of
the respective duties and obligations concerning the coordination of law enforcement efforts between the
College and the City pursuant to Chapter 22 of the Laws of 1999 (the “Campus Safety Act”).

The parties to this Memorandum of Understanding hereby agree as follows:

1.      The City of Saratoga Springs Police Department has primary law enforcement jurisdiction of all
        property owned, leased or under the control of Skidmore College which is in the City of Saratoga
        Springs and will provide police services on said property.

2.      The Skidmore College Department of Campus Safety will notify the Saratoga Springs Police
        Department and request that it investigate any serious criminal incident or situation which occurs on
        any property owned, leased, or under the control of the College within the jurisdiction of the City of
        Saratoga Springs. These incidents will include violent felony offenses, missing persons or other
        situations that may affect the safety of persons on the campus or in the city. Victims of crimes will be
        encouraged by the College to report all crimes and the Department of Campus Safety will assist
        victims in making reports to the police if requested. In accordance with the provisions of the Campus
        Safety Act, the following definitions shall apply:

        a.       “Missing Student” means any student of the College subject to the provisions of Section 355
                 (17) of the New York State Education Law, who resides in a facility owned or operated by the
                 College and who is reported to the College as missing from his or her residence.

        b.       “Violent Felony Offense” means a violent felony offense as defined in Section 70.02(1) of the
                 Penal Law of the State of New York.

3.      The Saratoga Springs Police Department will keep the Skidmore College Department of Campus
        Safety informed of any emergencies which may occur within the city that may affect the safety of the
        staff, students and guests or any property owned, leased, or under the control of the College.

4.      When the Saratoga Springs Police Department executes a warrant on any property owned, leased, or
        under the control of the college, the Police Department will contact the Skidmore College Department
        of Campus Safety and request a Campus Safety Officer to accompany the City police officer. Efforts
        will be taken to refrain from interrupting a class to effect an arrest or to execute a search warrant. In
        the event of continuous close pursuit beginning in the City of Saratoga Springs which continues to the
        Skidmore College Campus the Saratoga Springs Police Department communication unit will notify the
        Skidmore College Department of Campus Safety Department as soon as practical under the
        circumstances.

5.      Designees from the Saratoga Springs Police Department and the Skidmore College Department of
        Campus Safety will meet as needed to review and discuss various operational issues, interdepartmental
        objectives and all events impacting both communities.
