The ninth meeting of the Trent Central Student Association occurred on Sunday, 21 February 2010 at
1.18 pm in the AJM Smith Conference Room, Trent University, Peterborough, Ontario.

   1) Speaker’s Remarks

       Speaker MacLean advises that the meeting is running behind by fifteen minutes, as this is an
       emergency meeting, nothing else will be added to the agenda. Everyone will have a chance to
       speak on the Canadian Federation of Students referendum. MacLean reminds Board that earlier
       this year the Trent Central Student Association decided to stay neutral on the Canadian
       Federation of Students referendum. Any discussion on whether or not membership should
       continue will be stopped.

               Motion: Be it resolved that the Trent Central Student Association undertook the
               process of validating the Canadian Federation of Students membership petition
               through the registrar without prejudice, and any discussion on the validation
               process in this meeting will be entered into the minutes without prejudice.

        Otonabee Senator Murphy advises that according to the Canadian Federation of Students’
        bylaws, the petitions do not have to be validated. However, this was done by the Association as
        an act of good faith; this does not mean that it was the Association’s responsibility.

     3) President’s Remarks

        No remarks.

     4) Canadian Federation of Students Membership Referendum

        Murphy advises that in September petitions requesting a referendum were submitted to both the
        Canadian Federation of Students Ontario as well as the Canadian Federation of Students
        National. Shows a list of emails starting in October, were ignored until February. According to
        the Canadian Federation of Students’ bylaws, they must set a referendum date within 90 days of
        receiving a petition. While they did reply to the Association within 90 days, they asked for the
        petition to be validated; this took a substantial amount of time to complete, and could not be
        sent back until February 15. As a result, a referendum cannot be called, as it can be no sooner
        than 60 days from petition receipt, and this pushes outside of the academic year.
        However, Murphy argues that the Canadian Federation of Students National did not call a
        referendum within 90 days as they are required to, breaking their contract. Thus, the
        Association should no longer have to follow their bylaws. Similar cases in Saskatchewan were
        advised by a judge to handle the case with own bylaws.

       Lady Eaton College Prime Minister Mountenay questions why petitions were validated when it
       was not required. Gender Issues Commissioner Hutchison agrees this should be addressed,
       there are accountability issues here. President Kombani advises that he received a letter from
       the Canadian Federation of Students in December requesting that the petitions be validated. He
       approached Meri Kim to ask if this could be done through the registrar, she agreed and he
       wrote back to advise this request would be fulfilled. Mountenay argues that if Association did
       not have to validate petitions and chose to do so, then the contract is not broken, as the
       Canadian Federation of Students did contact within 90 days of receiving the petition.
       Murphy agrees there are some questions to be asked of the Executives. However, the
       unanswered emails show the Canadian Federation of Students’ inability to properly
       communicate with the Association.
       Mountenay disagrees, as communication with Kombani was within 90 days, as a spokesperson
       for the Trent Central Student Association he agreed to validate the petitions. Then they were
       obligated to do so before a referendum date could be set.
       Hutchison concerned, as Canadian Federation of Students did reply soon after receiving the
       petition, yet the Association took until February 15 to send it back validated. Vice President
       Membership Services Khederlarian advises that the letter was received right before winter
       break, the registrar office was closed, so validation process could not start until January, this
       takes a few weeks to complete.

              1:55 pm.

       2:00 pm Call to Order

       MacLean advises that according to Robert’s Rules, the Association’s bylaws cannot be
       suspended, and by not following the Canadian Federation of Students’ bylaws this would be
       breaking the Association’s.

              Motion: Be it resolved that the Trent Central Student Association confirms that the
              Canadian Federation of Students is in receipt of a valid petition mandating a
              referendum, on the issue of continued membership in the Canadian Federation of
              Students, of the students collectively represented by the Trent Central Student
              Association.
              Be it further resolved that the Trent Central Student Association requests that the
              Canadian Federation of Students confirm in writing, no later than February 26, its
              intention to hold said referendum in September and/or October 2010.

       Hutchison notes that if they ask for re-validation of students, there may not be enough current
       students listed for a fall referendum.
       Mountenay suggests adding: Be it further resolved that the Trent Central Student Association
       will not make any further attempts to validate said petition, as there is no requirement to do so
       in the Canadian Federation of Students’ bylaws. Friendly Amendment.

       Hutchison would like to amend the date of expected response, should give the Canadian
       Federation of Students two business weeks, making the new date March 5, 2010. Friendly
       Amendment.

              Motion Carried.

       Murphy notes that a second petition was sent to the Canadian Federation of Students Ontario,
       they have yet to reply. Hutchison advises this is because it was not sent following the rules, was
       not submitted by registered mail. Murphy argues that a process server is recognized as a form
       of registered mail, is a higher form of proof as delivered by a bailiff. Khederlarian asks why
       registered mail has not worked in the past, Murphy advises that people can claim they did not
       receive it, but with a process server an affidavit is provided. Mountenay asks how long
       members of the Board have known that the petition was not accepted, and why it was not sent
       by registered mail after learning this. Murphy argues they have exceeded the requirements.
       Hutchison defends that she informed members of the Board on December 1 that the petition
       would not be recognized unless sent by registered mail.
       Murphy agrees to now send it again by registered mail, although thinks that the process server
       was more than enough. Khederlarian agrees this should have been enough, Board holds an
       affidavit showing petition received, yet the Canadian Federation of Students Ontario claims it
       was not.
       MacLean recommends that it be noted the Trent Central Student Association is very
       disappointed that utilizing a bailiff was not accepted, but Board is willing to follow exact rules
       if it will result in a referendum in the fall.

              Motion: Be it resolved that the Trent Central Student Association will submit the
              petition for questioning membership in the Canadian Federation of Students
              Monday morning via registered mail.
              Moved by: Brea Hutchison; Seconded by: Greg Mountenay

       Mountenay wishes to add that: if a referendum question can be called following the Canadian
       Federation of Students’ bylaws by the end of the academic year we request that it be done, if
       not, we request it be held in the fall. Friendly Amendment.

                Motion: Be it resolved that the Trent Central Student Association confirms that the
                Canadian Federation of Students Ontario is in receipt of a valid petition requesting a
                referendum, on the issue of continued membership in the Canadian Federation of
                Students Ontario, of students collectively represented by the Trent Central Student
                Association.
                Be it further resolved that the Trent Central Student Association requests that the
                Canadian Federation of Students Ontario confirm in writing, no later than March 5,
                2010, its intention to hold said referendum in September and/or October 2010.
                Be it further resolved that the Trent Central Student Association will submit this
                petition, without prejudice, by registered mail, on the morning of February 22, 2010.
                Be it further resolved that the Trent Central Student Association is disappointed in
                the Canadian Federation of Students’ refusal to recognize delivery by process
                server, as satisfied the registered mail requirements spelled out in the Canadian
                Federation of Students Ontario bylaws.
