          BE IT ENACTED BY THE NORTHERN MARIANAS C M O W A T LEGISLATURE:


               S e c t i o n 1.     Short T i t l e .      T h i s Act may b e known and c i t e d a s t h e

       Commonwealth of t h e Northern Mariana I s l a n d s D i s a s t e r R e l i e f Act of 1979.

               S e c t i o n 2.     F i n d i n g s and I n t e n t .

                       (a)        The L e g i s l a t u r e of t h e Northern Mariana I s l a n d s f i n d s

       and d e c l a r e s t h a t :

                                  (1)    P u b l i c Law 93-288,        enacted by t h e 93rd Congress of

       t h e United S t a t e s , p r o v i d e s f o r a s s i s t a n c e t o t h e Commonwealth of t h e

       Northern Mariana I s l a n d s i n t h e e v e n t an emergency o r a major d i s a s t e r

       should s t r i k e t h e Northern Mariana I s l a n d s a s determined by t h e

       P r e s i d e n t of t h e United S t a t e s ;

                                  (2)    Emergency and d i s a s t e r may i n c l u d e t h e l o s s of l i f e ,

       human s u f f e r i n g , l o s s of income, and p r o p e r t y damage r e s u l t i n g from

       typhoons, t o r n a d o e s , s t o r m s , f l o o d s , h i g h w a t e r s , wind-driven w a t e r s ,

       t i d a l waves, e a r t h q u a k e s , d r o u g h t s , f i r e s , and o t h e r c a t a s t r o p h e s ;

                                  (3)    Due, however, t o t h e l i m i t e d l a n d area of t h e s e

       s m a l l i s l a n d s , d i s a s t e r s f r e q u e n t l y occur which may be of i n s u f f i c i e n t

       magnitude t o w a r r a n t being d e s i g n a t e d by t h e P r e s i d e n t a s an "emergency"

       o r a "major d i s a s t e r " a s d e f i n e d w i t h i n t h e p r o v i s i o n s of P u b l i c Law

       93-288,      and may, t h e r e f o r e , b e of i n s u f f i c i e n t s e v e r i t y t o w a r r a n t

       d i r e c t a s s i s t a n c e from t h e Federal. Government t o t h e Commonwealth of

       t h e Northern Mariana I s l a n d s ; and

                  (4) Because such disasters disrupt the normal functions
of the government and the communities, and adversely affect individual

persons and families with great severity, special measures are required

by the Commonwealth of the Northern Mariana Islands to assist the people

of the Northern Mariana Islands to expedite the rendering of aid,

assistance and emergency welfare services, and the reconstruction and

rehabilitation of devastated areas.

            (b)   It is therefore, the intent of the Legislature of the

Northern Mariana Islands by this Act to:

                  (1)   Establish and provide for an orderly and continuing

program of assistance by the Commonwealth of the Northern Mariana

Islands to alleviate the suffering and damage which may result from

disasters outlined above, which may not be of sufficient severity or

scope to warrant assistance by the United States Government under the

provisions of Public Law 93-288;

                  (2)   Clarify and strengthen the roles of the Governor

and the mayors in the prevention of, preparation for, and response to,

and recovery from disasters;

                  (3)   Provide a disaster management system embodying all

aspects of pre-disaster preparedness and post-disaster responses;

                  (4) Supplement and augment assistance which may be
provided by the Federal Government to the Commonwealth of the Northern

Mariana Islands in the event of an emergency or major disaster

declaration by the President pursuant to the provisions of Public Law

93-288;   and

                          (5)      Authorize and p r o v i d e f o r c o o r d i n a t i o n of

a c t i v i t i e s r e l a t i n g t o d i s a s t e r p r e v e n t i o n , p r e p a r e d n e s s , r e s p o n s e , and

r e c o v e r y by a g e n c i e s and o f f i c e r s of t h e Commonwealth of t h e Northern

Mariana I s l a n d s , and s i m i l a r United S t a t e s i n t e r g o v e r n m e n t a l and

f o r e i g n a c t i v i t i e s i n which t h e Commonwealth of t h e Northern Mariana

I s l a n d s and i t s p o l i t i c a l s u b d i v i s i o n s may p a r t i c i p a t e .

        Section 3.            Limitations.            Nothing i n t h i s Act s h a l l b e c o n s t r u e d t o :

                  (a)     I n t e r f e r e w i t h d i s s e m i n a t i o n of news o r comments on

p u b l i c a f f a i r s ; b u t any c o m u n i c a t i o n s f a c i l i t y o r o r g a n i z a t i o n

( i n c l u d i n g b u t n o t l i m i t e d t o r a d i o and t e l e v i s i o n s t a t i o n s , w i r e

s e r v i c e s , and newspapers) may b e r e q u i r e d t o t r a n s m i t o r p r i n t p u b l i c

s e r v i c e messages f u r n i s h i n g i n f o r m a t i o n o r i n s t r u c t i o n s i n connection

w i t h a d i s a s t e r emergency;

                  (b)     A f f e c t t h e j u r i s d i c t i o n o r r e s p o n s i b i l i t i e s of t h e

Commonwealth of t h e Northern Mariana I s l a n d s , o r t h e Department of

P u b l i c S a f e t y , and f i r e f i g h t i n g f o r c e s , and u n i t s of t h e armed f o r c e s

of t h e United S t a t e s , o r of any p e r s o n n e l t h e r e o f , when on a c t i v e d u t y ;

                  (c)     I n t e r f e r e w i t h t h e c o u r s e o r conduct of a l a b o r d i s p u t e ,

e x c e p t t h a t a c t i o n s o t h e r w i s e a u t h o r i z e d by t h i s Act may be t a k e n when

n e c e s s a r y t o f o r e s t a l l o r m i t i g a t e imminent o r e x i s t i n g d i s a s t e r s t h a t

pose a danger t o p u b l i c h e a l t h o r s a f e t y ; o r

                  (d)     L i m i t , modify, o r a b r i d g e t h e a u t h o r i t y of t h e Governor

t o respond t o emergencies o r t o e x e r c i s e any o t h e r powers v e s t e d i n him

by t h e laws of t h e Commonwealth of t h e Northern Marianas, independent

o f , o r i n c o n j u n c t i o n w i t h , any p r o v i s i o n s of t h i s Act.

        S e c t i o n 4.     Definitions.            A s used i n t h i s Act, u n l e s s t h e c o n t e x t

otherwise r e q u i r e s , t h e following d e f i n i t i o n s s h a l l apply:

                 (a)       " D i s a s t e r " means o c c u r r e n c e o r imminent t h r e a t of a

widespread o r s e v e r e damage, i n j u r y , o r l o s s of l i f e o r p r o p e r t y

r e s u l t i n g from any n a t u r a l o r man-made c a u s e , i n c l u d i n g , b u t n o t

l i m i t e d t o , typhoons, tornadoes, s t o r m s , f l o o d s , h i g h w a t e r s , wind-driven

w a t e r s , t i d a l waves, e a r t h q u a k e s , f i r e s , o i l s p i l l s , o r o t h e r water

contamination r e q u i r i n g emergency a c t i o n t o a v e r t danger o r damage,

v o l c a n i c a c t i v i t y , epidemic, a i r c o n t a m i n a t i o n , b l i g h t , drought,

i n f e s t a t i o n , o r e x p l o s i o n , o c c u r r i n g i n any p a r t of t h e Comonwealth

of t h e Northern Mariana I s l a n d s which, i n t h e d e t e r m i n a t i o n of t h e

Governor i s of s u f f i c i e n t s e v e r i t y and magnitude t o w a r r a n t a s s i s t a n c e

by t h e Commonwealth of t h e Northern Mariana I s l a n d s t o supplement t h e

e f f o r t s and a v a i l a b l e r e s o u r c e s of t h e p o l i t i c a l s u b d i v i s i o n s t h e r e o f

and r e l i e f o r g a n i z a t i o n s i n a l l e v i a t i n g t h e damage, l o s s , h a r d s h i p o r

s u f f e r i n g caused t h e r e b y .

                 (b)       "Emergency1' means any typhoon, t o r n a d o , storm, f l o o d ,

h i g h w a t e r , wind-driven w a t e r , t i d a l wave, tsunami, earthquake, v o l c a n i c

eruption, l a n d s l i d e , drought, f i r e , explosion, o r o t h e r catastrophe i n

any p a r t of t h e Commonwealth of t h e Northern Mariana I s l a n d s which

r e q u i r e s F e d e r a l emergency a s s i s t a n c e t o supplement t h e Comonwealth

of t h e Northern Mariana I s l a n d s and l o c a l e f f o r t s t o s a v e l i v e s and

p r o t e c t p r o p e r t y , p u b l i c h e a l t h and s a f e t y o r t o a v e r t o r l e s s e n t h e

t h r e a t of a d i s a s t e r .

           (c)   "Major Disastert'means any typhoon, tornado, storm,

floods, high water, wind-driven water, tidal wave, earthquake, volcanic

eruption, landslide, mudslide, drought, fire or other catastrophe in

any part of the Commonwealth of the Northern Mariana Islands which, in

the determination of the President of the United States, cause damage of

sufficient severity and magnitude to warrant major disaster assistance

under Public Law 93-288, above and beyond emergency services by the

Federal Government to supplement the efforts and available resources of

the Commonwealth of the Northern Mariana Islands and its political

subdivisions.

           (d)   "Local Disaster Emergency" means occurrence or imminent

threat of a widespread or severe damage, injury, or loss of life or

property resulting from any natural or man-made cause, including, but

not limited to, typhoons, tornadoes, storms, floods, highwaters,

wind-driven waters, tidal waves, earthquakes, fires, oil spills, water

contamination requiring emergency action to avert danger or damage,

volcanic activity, epidemic, air contamination, blight, drought,

infestation, or explosion, occurring in one particular political

subdivision.

           (e)   "Political Subdivision" means any district, municipality,

town, village, community or other unit of local government recognized as

such by laws or customs of the Commonwealth of the Northern Mariana

Islands.

     Section 5. The Governor and Disaster Emergencies.

           (a)   The Governor is responsible for meeting the dangers to

a f f e c t e d by d i s a s t e r s .

                  (b)     Under t h i s Act, t h e Governor may i s s u e e x e c u t i v e o r d e r s

and r e g u l a t i o n s and may amend o r r e s c i n d them.                 Executive o r d e r s s h a l l

have t h e f o r c e and e f f e c t of law when promulgated i n accordance w i t h t h e

procedures s e t f o r t h i n t h i s Act.                The Governor s h a l l i s s u e r e g u l a t i o n s

a s provided by law, f o r t h e a d m i n i s t r a t i o n and enforcement of t h i s Act,

and such r e g u l a t i o n s s h a l l have t h e f o r c e and e f f e c t of law i f t h e y a r e

n o t i n c o n f l i c t w i t h t h e expressed p r o v i s i o n s of t h i s Act o r o t h e r laws

of t h e Commonwealth of t h e Northern Mariana I s l a n d s .

                  (c)     A d i s a s t e r emergency s h a l l b e d e c l a r e d by e x e c u t i v e o r d e r

of t h e Governor i f h e f i n d s a d i s a s t e r h a s o c c u r r e d o r t h a t o c c u r r e n c e

o r t h e t h r e a t t h e r e o f i s imminent.           The s t a t e of d i s a s t e r emergency w i l l

remain i n e f f e c t u n t i l t h e Governor f i n d s t h a t t h e t h r e a t o r danger h a s

passed o r t h a t t h e d i s a s t e r h a s been d e a l t w i t h t o t h e e x t e n t t h a t

emergency c o n d i t i o n s no l o n g e r e x i s t and t e r m i n a t e s t h e s t a t e of d i s a s t e r

emergency by e x e c u t i v e o r d e r , b u t no s t a t e of d i s a s t e r emergency may

c o n t i n u e f o r l o n g e r than t h i r t y (30) days u n l e s s renewed by t h e Governor.

The Governor s h a l l i s s u e a n e x e c u t i v e o r d e r which may t e r m i n a t e a s t a t e

of d i s a s t e r emergency a t any time.                  An e x e c u t i v e o r d e r i s s u e d under t h i s

s u b s e c t i o n s h a l l b e f i l e d promptly w i t h t h e Commonwealth of t h e Northern

Mariana I s l a n d s D i s a s t e r C o n t r o l O f f i c e and t h e Attorney G e n e r a l ' s

o f f i c e , and s h a l l immediately b e d i s s e m i n a t e d t o t h e g e n e r a l p u b l i c .

                  (d)     An e x e c u t i v e o r d e r d e c l a r i n g a s t a t e of d i s a s t e r

emergency s h a l l s e r v e t o a c t i v a t e t h e d i s a s t e r r e s p o n s e and recovery

a s p e c t s of t h e Commonwealth of t h e Northern Mariana I s l a n d s , l o c a l

and i n t e r j u r i s d i c t i o n a l d i s a s t e r emergency p l a n s a p p l i c a b l e t o t h e

p o l i t i c a l s u b d i v i s i o n s o r a r e a i n q u e s t i o n , and t h e a u t h o r i t y f o r t h e

deployment and u s e of any f o r c e s t o which t h e p l a n o r p l a n s a p p l y , and

f o r u s e o r d i s t r i b u t i o n of any s u p p l i e s , equipment and m a t e r i a l s and

f a c i l i t i e s assembled, s t o c k p i l e d o r a r r a n g e d , t o b e made a v a i l a b l e

p u r s u a n t t o t h i s Act o r any o t h e r p r o v i s i o n of law r e l a t i n g t o

d i s a s t e r emergencies.

                 (e)     During t h e continuance of any s t a t e of d i s a s t e r

emergency, t h e Governor s h a l l be i n c h a r g e of a l l f o r c e s and p e r s o n n e l ,

and h e s h a l l d e l e g a t e o r a s s i g n command a u t h o r i t y by p r i o r arrangement

embodied i n a p p r o p r i a t e r e g u l a t i o n s , b u t n o t h i n g h e r e i n r e s t r i c t s h i s

a u t h o r i t y t o do s o by e x e c u t i v e o r d e r s i s s u e d a t t h e t i m e of t h e

d i s a s t e r emergency.

                 (f)     I n a d d i t i o n t o any o t h e r powers c o n f e r r e d upon t h e

Governor by law, h e may, d u r i n g a s t a t e of d i s a s t e r emergency:

                         (1) Suspend t h e p r o v i s i o n s of any r e g u l a t o r y s t a t u t e
p r e s c r i b i n g t h e procedures f o r conduct of t h e Commonwealth of t h e

Northern Mariana I s l a n d s ' b u s i n e s s , o r t h e o r d e r s , r u l e s , o r r e g u l a t i o n s

of any Commonwealth of t h e Northern Mariana I s l a n d s a c t i v i t y o r agency,

i f s t r i c t compliance w i t h t h e p r o v i s i o n of any s u c h s t a t u t e , o r d e r ,

r u l e o r r e g u l a t i o n would i n any way p r e v e n t , h i n d e r , o r d e l a y n e c e s s a r y

a c t i o n i n coping w i t h t h e emergency;

                         (2)     U t i l i z e a l l a v a i l a b l e r e s o u r c e s of t h e Commonwealth

of t h e Northern Mariana I s l a n d s a s r e a s o n a b l y n e c e s s a r y t o cope w i t h t h e

disaster emergency of the Commonwealth of the Northern Mariana Islands;

               (3)    Transfer the direction, personnel, or functions of

the Commonwealth of the Northern Mariana Islands' departments and

agencies or units thereof for the purpose of performing or facilitating

emergency services;

               (4) Subject to any applicable requirements for
compensation under Section 10 of this Act, utilize any private property

if he finds this necessary to cope with the disaster emergency; PROVIDED,

however, that any such property that is not destroyed or totally damaged

shall be returned to the owner immediately following the termination of

the disaster emergency;

               (5)    Direct and compel the evacuation of all or part

of the population from any stricken or threatened area within the

Commonwealth of the Northern Mariana Islands if he deems this action

is necessary for the preservation of life or public health or safety;

PROVIDED, however, that any person so evacuated shall be permitted to

return to the place from which he or she was evacuated immediately

following the tamination of the disaster emergency;

               (6) Prescribe routes, modes of transportation, and
destination in connection with evacuation;

               (7)    Control ingress and engress to and from a disaster

area, the movement of persons within the area, and the occupancy of

premises therein;

               (8) Suspend or limit the sale, dispensing or

transportation of alcoholic beverages, firearms, explosives, and

combustibles; and

                           (9)     Make p r o v i s i o n s f o r t h e a v a i l a b i l i t y and use of

temporary emergency housing.

        S e c t i o n 6.       The Commonwealth of t h e Northern Mariana I s l a n d s

Disaster Control Office.

                 (a)       There i s hereby e s t a b l i s h e d t h e D i s a s t e r Control O f f i c e ,

which f o r a d m i n i s t r a t i v e purposes o n l y , s h a l l b e w i t h i n t h e Department

of P u b l i c S a f e t y .     The O f f i c e s h a l l b e s u p e r v i s e d by a D i s a s t e r Control

O f f i c e r t o b e a p p o i n t e d by t h e Governor w i t h t h e a d v i c e and consent of

t h e Senate.          The O f f i c e r s h a l l b e under t h e g e n e r a l s u p e r v i s i o n of t h e

Governor and s h a l l c o o r d i n a t e h i s a c t i v i t i e s w i t h t h e D i r e c t o r of

Public Safety.              The O f f i c e r s h a l l have a p l a n n i n g o f f i c e r , and o t h e r

p r o f e s s i o n a l , t e c h n i c a l , s e c r e t a r i a l , and c l e r i c a l employees a s may be

n e c e s s a r y f o r t h e performance of h i s f u n c t i o n s , p u r s u a n t t o budgetary

appropriations.

                 (b)       The D i s a s t e r C o n t r o l O f f i c e r s h a l l p r e p a r e and m a i n t a i n

t h e Commonwealth of t h e Northern Mariana I s l a n d s ' d i s a s t e r p l a n and

keep i t c u r r e n t , which p l a n may i n c l u d e :

                           (1)     P r e v e n t i o n and minimization of i n j u r y and damage

caused by d i s a s t e r ;

                           (2)     Prompt and e f f e c t i v e r e s p o n s e t o d i s a s t e r ;

                           (3)     Emergency r e l i e f ;

                           (4)     I d e n t i f i c a t i o n of a r e a s p a r t i c u l a r l y v u l n e r a b l e

to disaster;

                       (5)    Recommendations f o r zoning, b u i l d i n g codes, and

o t h e r land-use c o n t r o l s , s a f e t y measures f o r s e c u r i n g mobile homes o r

o t h e r nonpermanent o r semipermanent s t r u c t u r e s , and o t h e r p r e v e n t a t i v e

and preparedness measures designed t o e l i m i n a t e o r reduce d i s a s t e r s o r

t h e i r impacts;

                       (6)    Assistance t o l o c a l o f f i c i a l s i n designing l o c a l

emergency a c t i o n p l a n s ;

                       (7)    A u t h o r i z a t i o n and procedures f o r t h e e r e c t i o n o r

o t h e r c o n s t r u c t i o n of temporary works designed t o p r o t e c t a g a i n s t o r

m i t i g a t e danger, damage, o r l o s s from f l o o d , c o n f l a g r a t i o n , o r o t h e r

disasters;

                       (8)    P r e p a r a t i o n and d i s t r i b u t i o n t o t h e a p p r o p r i a t e

Commonwealth of t h e Northern Mariana I s l a n d s o f f i c i a l s of c a t a l o g s of

F e d e r a l , governmental, and p r i v a t e a s s i s t a n c e programs;

                       (9) O r g a n i z a t i o n of manpower and c h a i n of command;

                      (10)     Coordination of F e d e r a l , governmental and l o c a l

disaster activities;

                      (11)     Coordination of t h e Commonwealth of t h e Northern

Mariana I s l a n d s ' d i s a s t e r p l a n w i t h t h e d i s a s t e r p l a n s f o r t h e United

S t a t e s Government; and

                      (12)     Other n e c e s s a r y and a p p r o p r i a t e m a t t e r s r e l a t i n g

t o d i s a s t e r r e l i e f and a s s i s t a n c e and t o t h e maintenance and upkeep of

t h e d i s a s t e r preparedness s t a t e emergency p l a n .

                (c)    The D i s a s t e r C o n t r o l O f f i c e s h a l l t a k e a n i n t e g r a l p a r t

i n t h e development and r e v i s i o n of l o c a l d i s a s t e r p l a n s prepared under

S e c t i o n 7 of t h i s Act.           To t h i s end i t s h a l l employ o r o t h e r w i s e s e c u r e

s e r v i c e s of p r o f e s s i o n a l and t e c h n i c a l p e r s o n n e l c a p a b l e of p r o v i d i n g

expert a s s i s t a n c e t o p o l i t i c a l subdivisions, t h e i r d i s a s t e r agencies,

and i n t e r j u r i s d i c t i o n a l p l a n n i n g and d i s a s t e r a g e n c i e s .     These

p e r s o n n e l s h a l l c o n s u l t w i t h t h e Governor and l o c a l a g e n c i e s on a

r e g u l a r l y scheduled b a s i s and s h a l l make f i e l d examinations of t h e

a r e a s , circumstances and c o n d i t i o n s t o which p a r t i c u l a r l o c a l and

i n t e r j u r i s d i c t i o n a l d i s a s t e r p l a n s a r e i n t e n d e d t o a p p l y , and may

suggest revisions.

                  (d)     I n p r e p a r i n g and r e v i s i n g t h e Commonwealth of t h e

Northern Mariana I s l a n d s ' d i s a s t e r p l a n , t h e D i s a s t e r Control O f f i c e

s h a l l s e e k t h e a d v i c e and a s s i s t a n c e of l o c a l government, b u s i n e s s ,

l a b o r , i n d u s t r y , a g r i c u l t u r e , c i v i c and v o l u n t e e r o r g a n i z a t i o n s , and

community l e a d e r s .          I n advising l o c a l agencies, t h e Disaster Control

O f f i c e s h a l l encourage them a l s o t o s e e k a d v i c e from t h e s e s o u r c e s .

                  (e)     The Commonwealth of t h e Northern Mariana I s l a n d s '

d i s a s t e r p l a n , o r any p a r t t h e r e o f , may b e i n c o r p o r a t e d i n r e g u l a t i o n s

of t h e Governor o r e x e c u t i v e o r d e r s which have t h e f o r c e and e f f e c t of

law.

                  (f)     The D i s a s t e r C o n t r o l O f f i c e s h a l l :

                           (1)     Determine requirements f o r t h e Commonwealth of t h e

Northern Mariana I s l a n d s and t h e p o l i t i c a l s u b d i v i s i o n s t h e r e o f f o r

food, c l o t h i n g and o t h e r n e c e s s i t i e s i n t h e e v e n t of a n emergency;

                           (2)     Coordinate w i t h a p p r o p r i a t e government a g e n c i e s t o

p r o c u r e , and p r e - p o s i t i o n   s u p p l i e s , medicines, m a t e r i a l s , and equipment;

                         (3)     Promulgate g e n e r a l s t a n d a r d s and requirements

f o r l o c a l d i s a s t e r plans;

                         (4)     P e r i o d i c a l l y review l o c a l d i s a s t e r p l a n s ;

     Section 9. Disaster Prevention.

          (a)   In addition to disaster prevention measures as included

in the Commonwealth of the Northern Mariana Islands1 disaster plan, the

Governor shall consider, on a continuing basis, steps that could be

taken to prevent or reduce the-harmfulconsequences of disaster.     At

his direction, and pursuant to any other authority and competence they

have, the Commonwealth of the Northern Mariana Islands1 agencies,

including but not limited to those charged with responsibilities in

connection with floodplain management, stream encroachment and flow

regulations, weather modification, fire prevention and control, air

quality, public works, land use and land-use planning, and construction

standards, shall make studies of disaster prevention related matters.

The Governor, from time to time, shall make recommendations to the

Legislature of the Northern Mariana Islands, local government and other

appropriate public and private entities as may facilitate measures for

prevention or reduction of the harmful consequences of disasters.

          (b)   The Marianas Public Land Corporation of the Commonwealth

of the Northern Mariana Islands in conjunction with the Disaster

Control Office, shall keep land uses and construction of structures and

other facilities under continuing study and identify areas which are

particularly susceptible to severe land shifting, subsidence, flood or

other catastrophic occurrences.   The studies under this subsection shall

concentrate on means of reducing or avoiding the danger caused by these

occurrences or the consequences thereof.

                 (c)     I f t h e D i s a s t e r C o n t r o l O f f i c e b e l i e v e , on t h e b a s i s of

t h e s t u d i e s o r o t h e r competent evidence, t h a t an a r e a i s s u s c e p t i b l e

t o a d i s a s t e r of c a t a s t r o p h i c p r o p o r t i o n s w i t h o u t a d e q u a t e warning,

t h a t e x i s t i n g b u i l d i n g s t a n d a r d s and land-use       controls i n that area

a r e i n a d e q u a t e and could add s u b s t a n t i a l l y t o t h e magnitude of t h e

d i s a s t e r , and t h a t changes i n zoning r e g u l a t i o n s , o t h e r land-use

r e g u l a t i o n s o r b u i l d i n g requirements a r e e s s e n t i a l i n o r d e r t o f u r t h e r

t h e purposes of t h i s S e c t i o n , i t s h a l l s p e c i f y t h e e s s e n t i a l changes

t o t h e Governor.           I f t h e Governor's review of t h e recommendation f i n d s

t h a t t h e changes a r e e s s e n t i a l , he s h a l l s o recommend t o t h e a g e n c i e s

w i t h j u r i s d i c t i o n o v e r t h e a r e a and s u b j e c t m a t t e r .   I f no a c t i o n o r

i n s u f f i c i e n t a c t i o n p u r s u a n t t o t h i s recommendation is taken w i t h i n t h e

t i m e s p e c i f i e d by t h e Governor, h e s h a l l s o inform t h e L e g i s l a t u r e o f

t h e Northern Mariana I s l a n d s and r e q u e s t l e g i s l a t i v e a c t i o n a p p r o p r i a t e

t o m i t i g a t e t h e impact of d i s a s t e r .

        S e c t i o n 10.     Compensation.

                 (a)     Each p e r s o n w i t h t h e Commonwealth of t h e Northern

Mariana I s l a n d s s h a l l conduct himself and keep and manage h i s a f f a i r s

and p r o p e r t y i n ways t h a t w i l l r e a s o n a b l y a s s i s t and w i l l n o t

unreasonably d e t r a c t from t h e a b i l i t y of t h e Government and t h e p u b l i c

s u c c e s s f u l l y t o meet d i s a s t e r emergencies.

                 (b)     No p e r s o n a l s e r v i c e s v o l u n t a r i l y rendered f o r emergency

d i s a s t e r a s s i s t a n c e , r e l i e f p r e p a r e d n e s s o r r e s p o n s e may be compensated

by t h e Commonwealth of t h e Northern Mariana I s l a n d s o r any s u b d i v i s i o n

o r agency t h e r e o f , e x c e p t p u r s u a n t t o s t a t u t e o r l o c a l law o r o r d i n a n c e .

            (c)   Compensation for property shall be only if the property

was commandeered or otherwise used in coping with a disaster emergency

and its use or destruction was ordered by the Governor or a member of

the disaster emergency forces of the Commonwealth of the Northern

Mariana Islands.

            (d) Any person claiming compensation for the use, damage,

loss or destruction of property under this Act shall file a claim

therefor within one (1) year after the claim first arose with the

Office of the Attorney General who shall promulgate regulations

governing procedures for such compensation.

            (e) Unless the amount of compensation on account of property

damaged, lost or destroyed is agreed upon between the claimant and the

Office of the Attorney General, the amount of compensation shall be

calculated according to fair market value as determined by three

uninterested assessors to be selected in the following manner:     One by

the claimant, one by the Attorney General and the third by the first

two.

       Section 11.   Communications. The Disaster Control Office shall

ascertain what means exist for rapid and efficient communications in

times of disaster emergencies.     The Office shall consider the

desirability of supplementing these communications resources or of

integrating them into comprehensive Commonwealth of the Northern

Mariana Islands or Commonwealth of the Northern Mariana Islands-Federal

telecommunications systems or networks.     In studying the character and

feasibility of any system or its several parts, the Office shall

        S e c t i o n 12.     Weather M o d i f i c a t i o n .       The D i s a s t e r Control O f f i c e

s h a l l c o n t i n u o u s l y a p p r a i s e weather c o n d i t i o n s which p r e s e n t danger o r

p r e c i p i t a t i o n o r o t h e r c l i m a t i c a c t i v i t y s e v e r e enough t o c o n s t i t u t e a

disaster.          I f t h e O f f i c e determines t h a t p r e c i p i t a t i o n which may r e s u l t

from weather m o d i f i c a t i o n o p e r a t i o n s , e i t h e r by i t s e l f o r i n c o n j u n c t i o n

w i t h o t h e r p r e c i p i t a t i o n o r c l i m a t i c c o n d i t i o n s o r a c t i v i t i e s , would

c r e a t e o r c o n t r i b u t e t o t h e s e v e r i t y of a d i s a s t e r , i t s h a l l d i r e c t t h e

o f f i c e r o r agency empowered t o i s s u e p e r m i t s f o r weather m o d i f i c a t i o n

o p e r a t i o n s t o suspend t h e i s s u a n c e of t h e p e r m i t s .           Thereupon, no

p e r m i t s may b e i s s u e d u n t i l t h e O f f i c e informs t h e o f f i c e s o r agency

t h a t danger h a s passed.

        S e c t i o n 13.      E f f e c t i v e Date.      T h i s Act s h a l l t a k e e f f e c t upon i t s

a p p r o v a l by t h e Governor, o r upon i t s becoming law w i t h o u t such a p p r o v a l .
