FSGLI BACKGROUND
PUBLIC LAW 107-14 instituted;
MANDATORY FSGLI coverage
effective 01 NOV 2001.
In order to comply with this mandate, DOD pays
FSGLI premiums then recoups those premiums
from members via monthly automatic payroll
deduction.
Payroll deductions are facilitated using spouse
and dependent children data (Name, DOB, DOM)
in Defense Enrollment Eligibility Reporting System
(DEERS).

INDEBTEDNESS
In 2007, DOD discovered that they
had paid over $25M more than they
had collected in FSGLI premiums.
Furthermore, DOD identified the military-
to-military married population as the
largest group where deductions were not
being taking out for FSGLI premiums
because of missing spouse data in
DEERS.
As of Mar 09 - Over 8,000 new incidents of
spouses not enrolled in DEERS

WHAT YOU NEED TO KNOW:
For FSGLI corrections, DEERS enrollment requirements include
members who may have divorced a military spouse. (i.e. previously
married MIL-to-MIL and subsequently divorced after Nov 2001).
This requires divorced members to produce a marriage certificate
and divorce decree so that the FSGLI debt can be computed.
FSGLI transactions can only be processed if spouse data is in DEERS.
MIL-to-MIL members may not understand the requirement to enroll
their spouses in DEERS.
To avoid an indebtedness, they must enroll in DEERS.
Changing the page 2 will not update DEERS, the only way to
update is through DEERS site.

acknowledging his/her requirement to update the DEERS
database with family member info.)

DISCREPANCY RESOLUTION
Original 8286A must be submitted in order to end/terminate
obligation for FSGLI coverage. (e.g. if 8286A signed
terminating coverage NOV 01 but not processed due to admin
error, terminate coverage effective current month and
scan/email the original 8286A to BUPERS 26).
- After validation of documentation, action will be taken to
correct termination date to coincide with member‟s election.
Backdating 8286A constitutes attempt to defraud U. S.
Government and will result in prosecution/UCMJ actions.
Cases involving a prior marriage and a current marriage
require BUPERS 26 intervention in order to resolve.

New Post-9/11 Veterans Educational Assistance Program (Chapter 33)
takes effect 1 August 2009.
• No „buy-in‟
• Maximum benefit not to exceed the most expensive in-state
undergraduate tuition of public institution of higher education in
the state of attendance. For example, if the University of “X”
tuition is $8K per year, that is the max payable amount.
• Payment is made to institution vice individual.
• Benefits payable include stipend for books and housing
allowance.
- Not payable while on active duty
- Housing allowance not payable for half-time or less or for
distance learning
Benefits are transferable to spouse or children, pending DoD
guidance.
• Must have 6 years of active duty and agree to serve 4 more years,
or the amount determined by DoD.

What this means to personnel and pay offices.
• Minimal personnel and disbursing involvement in new program.
• Members may be asking to stop MGIB (Chap 30) deduction.
DoD will issue guidance for „election‟ of Chap 33 and stoppage
of $100 per month deduction.
• Members may stop their “booster” deduction. It is their
prerogative. No refunds.
• Chapter 30 is still in effect and MGIB declinations must still be
processed.
What personnel and pay offices can do in the meantime.
• Monitor and refer members to the VA‟s website for information
and updates.
• As of 8 April 09, they have still not started to accept
applications for the Post-9/11 GI Bill
