PREVIOUS ACTION
At the Boards November 28,2006 meeting, staff was directed to coordinatea selection
                                      from the Stateand Federal Public Defender's Office and
committee consisting of representatives
the Nevada StateBar Associationsto screencandidatesfor interview and possible appointment
by the Board.
BACKGROUND
On March 21,2006, the Board of County Commissionersdirected staff to proceedwith the
creation of an Alternate County Public Defender Office to replacethe existing conflict Attomey
                                               that presentsa conflict of interest for the Washoe
Contract currently used for legal representation
County Public Defender'sOffice.

On May 15,2006,the Board of County Commissioners        approvedthe FY 2006-07
Washoe County Budget including $712,604for the Office of the Alternate County Public
Defender and authorization of 15 new positions to staff the Office.

On December 12,2006, the Board approved an ordinance amending the Washoe County Code
by creating the Office of Alternative County Public Defender.

On November 28,2006 the Board approveda selection committee consisting of representatives
from the State and Federal Public Defender's Office and the Nevada State Bar Associations to
screencandidatesfor considerationby the Bqard.

The Nevada State Bar Association appointed the following members and the Federal Public
Defender and the Clark Countv Public Defender also servedon the committee:

Scott Freeman
John Springgate
Lany Digesti
Vito Delacruz
Phil Kohn

An extensive recruitment was conductedfor Altemate Public Defender. The committee met on
February 20thto screen the six resumesreceived and identified a top group of candidatesfor
further consideration consisting of Jennifer Lunt, Shelly O'Neill and Ken Ward. On March 2nd
the committee interviewed Jennifer Lunt and Shelly O'Neill. (Mr. Ward withdrew his candidacy
on March 1').      The committee conducted extensive interviews and following thorough
discussionand considerationof the candidates,  experienceand qualifications for the position, the
committee unanimously agreedthat Jennifer Lunt was the best candidate for consideration and
appointmentby the Board.

Jennifer Lunt, Chief Deputy Public Defender,has extensiveexperienceworking in the Public
Defender's Office for the past 15 years. Jenniferhas extensivetrial experience,and hasbeen in
a supervisoryposition for approximately 10 years. Ms. Lunt's legal experienceis in the criminal
field, both as a prosecutor and as a defenselawyer. Ms. Lunt is dedicatedand passionateabout
the opportunity to serve the community and the clients of the County.

Please find attached a copy of the resumesfor all candidateswho applied for consideration for
the Alternate Public Defender position along with a copy of the interview questionsused by the
committee.

    1. You have been the chief public defenderfor nine months. During this period the
        head of the juvenile unit has continually expressed concernsregarding their
                                                           her
        ever increasingcaseloadand their needto have additional staff at all levels. The
       juvenile caseloadincreasesare driven by a number of factors including police
       clampdown on gangsand drugs, county population increasesfor youth between
       the agesof I4-l7yrs., and an increasednumber of probation violation petitions.

        Today, when you return to your office from a meeting, you find that you received
        two messages   from thejuvenile courtjudge askingyou to call him
        IMMEDIATELY. Just then the phone rings, and it is the juvenile unit,s
        supervisingattorney. She informs you that three of her attorneys,without prior
       notice to her, have filed Motions to Withdraw as Counselin approximatety ISO
       pending caseson their assigneddockets. The motions allege that juveniles are
       being denied their Sixth Amendrnentand stateconstitutional right to effective
       assistance ofcounsel due to excessive,  unconstitutionalcaseloads. The attorneys
       claim that their caseioads violate nationalstandardsforjuvenile cases. Insteadof
       200 cases attorneyper year,they carry 800 to 1000. The motionspoint to the
                  per
       NLADA March 2003 report to affirm this position. The motions also iite to the
       Nevada Rules of ProfessionalConduct, alleging that the attorneysare neither
       competentnor diligent and that excessivecaseloads   prevent them from adequately
       communicating with their clients. Your juvenile unit chief tells you that a court
       hearing has been set on all750 motions two days from now, but her unit has been
       turned upside down and other lawyers threatento file similar motions.

       As chief public defender,how do you handle this situation? What do you sav and
       do?

   2. During your first year as chief public defenderyou have brought new energy and
      vision to the CCPDO. You have demonstrated desire to be fair and even handed
                                                       a
      with regard to all employees,but you have set a standardof work expectationfor
      an attorney that assumes that attorneyswill work more than the required eight
      hours a day and that they will make a full effort to provide zealousand quulity
      representation.You have also made it clear that attorneysare not "lone rangers"
      working on their own within the office, but that they are membersof the team that
      supporls the mission and goals of the Clark County Public Defender office.

       Throughout your first year, you, the team supervisor,and your human resources
       staff have been working with two long time attorneyswho continually disappear
       from the office without informing staff of their whereabouts. Clients have
       complained that the lawyers tt"rr.r rnet with them prior to the trial date,never
       cameto the jail to interview them, and never even wrote to them about their cases.
       Two of the judges in front of whom thesetwo lawyers appearhave also
       "informally''let you know that the lawyers have been late coming to their

        Their team members are frustratedbecausethe two attorneys

       Using a progressivediscipline process,human resourcesand

       have worked for a year with theseattorneys.They have exhausted
                                                                           all possible
       intervention strategies'The two attorneysare clearly not
                                                                willing to changeor even
       to modify their behavior which underminesthe entiie team.
                                                                     The supervi-sor and
       human resourcesstaff now strongly recommendthe termination

       attorneys. After ayear of trying, enoughis enough.

       Before you act one way or the other, office rumors start to
                                                                   fly. Suddenly,through
       phone calls, informal asidesafter courl and county meetings,
                                                                      and at community
       forums, you hear from two county commissioners,threejudges,
                                                                         a stateassembly
       woman, and a state senator,all of whom let you know how
                                                                    much they like these
       two attorneysand how much they appreciatetheir continued
                                                                      commitment to the
       public defenderoffice. They let you kno* how ..proud,'you
                                                                      shouldbe to have
       thesetwo gentlemenon your staff.

        their clients. The Director knows that the judges involved worked with other
        CCPDO lawyers to avoid listing their casesfor this day and that they actively
        agreedto support the one day DNA training program.

       The Director has "had it" with "these guys". He wants you to intervene,to let
       them know that times have changedat the CCPDO, that they are not individual
       practitioners within this public defenderoffice, and that their behavior and
       attitude underminesthe training program and the atmosphereof the entire office.

       What is your response? What do you say and do?

    4. As chief public defenderyou have worked with your operationsstaff to put
       together your budget submissionfor the next fiscal year. You feel that you have
       no other choice but to ask for a I0%obudget increaseabovi: the current fiscal
       year's budget. Your office desperately needsadditional attomey staff positions,
       more office space,especiallyfor your juvenile unit, and more overall operational
       resources,which include increasedfunding for expert witness services. you have
       told your managersand staff that you will do whatever you can through the
