                                                   COUNCIL MEETING MINUTES
                                                        JUNE 11, 2007



1. Call to Order

2. Adequate notice of this meeting of the Mayor and Borough Council of the Borough of Mount
   Arlington was given as required by the Open Public Meetings Act as follows: Notice was
   published in the Roxbury Register and the Daily Record on January 18, 2007; notice was
   posted on the bulletin board in the main hallway of the Municipal Building on
   January 8, 2007 and said notice is on file in the office of the Borough Clerk.

3. Flag Salute
   The Mayor asked for a moment of silence to think about our soldiers and their families.

4. Roll Call
   Councilman Doran, Councilwoman Cerasoli, Council President Driscoll, Councilman Stone,
   Mayor Ondish. JoAnne Sendler, Borough Administrator, and Joseph Bell, Borough Attorney,
   were also present. Councilwoman Mulligan was absent due to vacation and Councilman
   Sorge was absent due to illness.

5. Presentations/Mayor’s Appointments
   - The Mayor read the Proclamations to those assisting in the opening of the Mount
      Arlington Public Library into the record, distributing the plaques to those in attendance:

6. Old Business
   1. Clerk’s Follow-Up Report Memorandum, dated June 6, 2007.
       - The Clerk discussed the items on the follow-up list, noting further follow-up
       direction/status of any open items.

8. Utility Receipt Report and Tax Collector’s Report for the Month of May, 2007.
   The Clerk read the Utility Report for the Month of May, 2007 into the record:
   Grand Total: $198,303.20.
   The Clerk read the Tax Collector’s Report for the Month of May, 2007 into the record:
   Total Receipts: $1,939,938.15.

9. Finance Report for the Month of April, 2007.
   The Clerk read the Finance Report for the Month of April, 2007 into the record:
   Total Available: $203,215.00.

10. Approval of Minutes

11. Open to Public
    - The Mayor welcomed Council Member Elect Nita Galate who was present during the Open
    Session of the meeting.

                           Motion to Amend the Agenda and Move the Executive Session to the End of the
                           Meeting: Council President Driscoll.
                           Second: Councilman Stone.
                           All in Favor – Aye; None Opposed.
                           Motion Approved.

13. Resolutions
    2007-82   Resolution of the Mayor and Borough Council of the Borough of Mount Arlington,
              in the County of Morris, New Jersey, Approving the Check Register Dated June
              11, 2007.

                           Motion to Approve: Councilwoman Cerasoli.
                           Second: Council President Driscoll.
                           Roll Call: Doran, Cerasoli, Council President Driscoll, Stone.
                           Motion Approved.

      2007-83              Resolution of the Mayor and Borough Council of the Borough of Mount Arlington, in the
                           County of Morris, State of New Jersey, Authorizing the Renewal of Plenary Retail
                           Consumption/Distribution and Club Licenses for the Licensing Period Commencing
                           July 1, 2007.

                           Motion to Approve: Councilwoman Cerasoli.
                           Second: Councilman Stone.
                           Roll Call: Doran, Cerasoli, Council President Driscoll, Stone.
                           Motion Approved.

      2007-84              Resolution of the Mayor and Borough Council of the Borough of Mount Arlington,
                           in the County of Morris, State of New Jersey, Appointing a Lifeguard for the 2007
                           Summer Season.

      2007-87              Resolution of the Mayor and Borough Council of the Borough of Mount Arlington,
                           in the County of Morris, State of New Jersey, Authorizing Release of Letter of
                           Credit to Chaplin Homes, Inc.

                           Motion to Approve: Council President Driscoll.
                           Second: Councilwoman Cerasoli.
                           Roll Call: Doran, Cerasoli, Council President Driscoll, Stone.
                           Motion Approved.

14. Ordinances – Introduction
    None.

15. Ordinances – Second Reading
    14-07     An Ordinance of the Mayor and Borough Council of the Borough of Mount
              Arlington, in the County of Morris, State of New Jersey, Amending Chapter 67,
              Construction Codes, Uniform, of the Code of the Borough of Mount Arlington To
              Establish Fees for Reinstatement of Expired Permits.

                           The Mayor opened the Hearing to the Public on Ordinance #14-07 and read the
                           Ordinance by title.
                           Councilwoman Cerasoli stated, I move for adoption and final passage of
                           Ordinance #14-07.
                           Second: Councilman Stone.
                           Council confirmed that permits are valid for three years.
                           Roll Call: Doran, Cerasoli, Council President Driscoll, Stone.
                           The Mayor declared that Ordinance #14-07 is passed on second reading and
                           directed the Clerk to publish the notice of adoption as required by law.

      15-07                An Ordinance of the Mayor and Borough Council of the Borough of Mount
                           Arlington, in the County of Morris, State of New Jersey, Amending and
                           Supplementing Chapter 123, Parks and Recreation Areas, of the Code of the
                           Borough of Mount Arlington, County of Morris, New Jersey, To Revise and Adopt
                           New Procedures Relating to Rental of Civic Center.

                           The Mayor opened the Hearing to the Public on Ordinance #15-07 and read the
                           Ordinance by title.
                           Councilman Doran stated, I move for adoption and final passage of Ordinance
                           #15-07.
                           Second: Council President Driscoll.
                           Roll Call: Doran, Cerasoli, Council President Driscoll, Stone.
                           The Mayor declared that Ordinance #15-07 is passed on second reading and
                           directed the Clerk to publish the notice of adoption as required by law.

      16-07                An Ordinance of the Mayor and Borough Council of the Borough of Mount
                           Arlington, in the County of Morris, State of New Jersey, Accepting the Dedication
                           of Utility Easement.

                           The Mayor opened the Hearing to the Public on Ordinance #16-07 and read the
                           Ordinance by title.
                           Councilman Stone stated, I move for adoption and final passage of Ordinance
                           #16-07.
                           Second: Councilwoman Cerasoli.
                           Roll Call: Doran, Cerasoli, Council President Driscoll, Stone.
                           The Mayor declared that Ordinance #16-07 is passed on second reading and
                           directed the Clerk to publish the notice of adoption as required by law.

16. Motions
    1. Civic Center Application – Permission to Waive Fee and Security Deposit:
        - Lisa Miller, Mount Arlington Recreation Soccer, for Sign-Ups on June 19, 2007 and
        June 25, 2007 from 5:00 p.m. to 9:30 p.m.
        - Lisa Miller, Mount Arlington Recreation Soccer, for Sign-Ups on June 26, 2007 from
        6:00 p.m. to 9:30 p.m.

                           Motion to Approve with Waiver of Fee and Security Deposit: Councilman Doran.
                           Second: Councilwoman Cerasoli.
                           Roll Call: Doran, Cerasoli, Council President Driscoll, Stone.
                           Motion Approved.

      2. Donations:
          - Letter from Lake Hopatcong Yacht Club, received June 4, 2007.

                           Motion to Approve: Councilwoman Cerasoli.
                           Second: Councilman Stone.
                           Roll Call: Doran, Cerasoli, Council President Driscoll, Stone.
                           Motion Approved.

             - Letter from Knee Deep Club, received June 4, 2007.

                           Motion to Approve: Councilman Stone.
                           Second: Council President Driscoll.
                           Councilman Doran opposed donating toward general fish stocking of Lake
                           Hopatcong but supported stocking Memorial Park Pond; the Borough has
                           donated $500 a year for the past eight years.
                           Roll Call: Doran - No, Cerasoli, Council President Driscoll, Stone.
                           Motion Approved.

      Added Motion:
         - Vendor’s Permit for Chilly Willy’s Ice Cream Co.; background check completed by
         Chief Peterson.

                           Motion to Approve: Councilman Stone.
                           Second: Council President Driscoll.
                           Roll Call: Doran, Cerasoli, Council President Driscoll, Stone.
                           Motion Approved.

      Presentations/Mayor’s Appointments
         - Rich Allocca – Insurance Presentation
           - The Borough is currently under a three-year contract with the NJ Inter-Governmental
         Insurance Fund, expiring on December 31, 2007. The Borough has sent a letter to our
         current JIF advising of out intent to shop around before renewal; Mr. Allocca would like to
         receive two new quotes and one from the incumbent JIF and perform a comparative
         review in October, to be effective January 1, 2008.

             With reference to a letter from a Southard Road resident regarding a tree falling on his
             car, Mr. Allocca described in detail the points of Title 59 and stressed that insurance rates
             cannot increase due to an Act of God. Mr. Allocca will respond to the resident on behalf
             of the Borough.

                           Motion to Move Forward to Mayor’s Report: Council President Driscoll.
                           Second: Councilman Doran.
                           All in Favor – Aye; None Opposed.
                           Motion Approved.

17. Mayor’s Report
    - The Mayor commended everyone involved in the Memorial Day Parade.
    - The Mayor attended General Izzo’s Farewell Luncheon.
    - The Mayor attended the Transfer of Power Ceremony at Picatinny.
    - The Mayor attended the first meeting of the Supplemental Funding Committee of the Lake
    Hopatcong Commission.
    - The Mayor attended the Change of Garrison Command at Picatinny.
    - The Mayor attended a Morris Tomorrow meeting at Jockey Hollow Girl Scout Camp.
    - The Mayor’s Wellness Cook-Off was in Parsippany but the Mayor could not attend; Council
    Member Elect Nita Galate represented the Mayor at the event.
    - The Mayor participated in the Mount Arlington FOP Golf Outing.
    - The Mayor attended the Knee Deep Club event at Memorial Pond.
    - The Mayor performed a wedding.
    - The Mayor attended the Mount Arlington Fire Department Beefsteak Dinner.
    - The Mayor spoke to Decker School second graders about lake issues during their field trip
    to Carol Kitchins’ home.
    - The Mayor referred to a memorandum from the Township of Woodbridge regarding NJ
    Senior Olympics and asked Councilman Doran to bring the information to the Seniors Club.
    - The Mayor asked Council for a representative to attend the MAPS eighth grade graduation
    in his absence; Councilman Doran will attend and distribute the Borough gifts to a male and
    female graduating student.

18. Borough Administrator’s Report
    - Saint Clare’s will be using our second ambulance; it will be lettered this week and undergo
    State inspection.

12. Executive Session
    2007-81    Resolution of the Mayor and Borough Council of the Borough of Mount Arlington,
               in the County of Morris, New Jersey, Authorizing Conference of the Mayor and
               Borough Council with the Public Excluded.

                           Motion to Go Into Executive Session: Councilman Doran.
                           Second: Council President Driscoll.
                           All in Favor – Aye; None Opposed.
                           Motion Approved.

                           Motion to Return to Open Session: Council President Driscoll.
                           Second: Councilman Doran.
                           All in Favor – Aye; None Opposed.
                           Motion Approved.


      Council discussed possibly canceling the June 25, 2007 Council Meeting; if the Clerk does
      not have any items for that agenda by Friday, June 15, 2007, the meeting can be cancelled
      and she can publish the notice of cancellation.

                           Motion to Return to Executive Session: Council President Driscoll.
                           Second: Councilman Doran.
                           All in Favor – Aye; None Opposed.
                           Motion Approved.
