STATE ACTIVITY INFORMATION

Wisconsin Commissioner adopts permanent rule in response to recent Supreme Court decisions involving
Uninsured Motorists coverage. ACORD will change commercial auto and umbrella applications as a
result.

In the case of Rebernick vs. American Family Mutual Insurance Company, the Wisconsin Supreme Court ruled
that "auto insurance" includes umbrella policies when auto liability is being covered under the policy, and
therefore Underinsured Motorist coverage must be offered. In another case, Rocker vs. USAA Casualty Ins.
Co., the court ruled that insurers must give the insured notice of the availability of Underinsured Motorist
coverage.

In response, the Wisconsin Insurance Commissioner has adopted a permanent rule amending WI Adm. Code
Ins. 6.77, referencing the Supreme Court rulings in these cases. The amended Rule exempts umbrella, excess
liability and commercial auto liability from the requirement to offer UIM coverage, but does require that
insureds must be advised whether or not UIM coverage is available from the insurer.

As a result, ACORD will revise ACORD 83, Personal Umbrella Liability Application, ACORD 131, Commercial
Umbrella Liability Section, ACORD 137WI, Commercial Auto Section, and ACORD 138WI, Garage and
Dealers Section. Each form will include check boxes to indicate whether or not UIM coverage is offered in
the policy being applied for. The disclosure requirements for new policies begin to apply November 28, 2007.
Therefore, ACORD will release the revised forms in September.

New Kansas law requires filing of certificates of insurance. ACORD will respond.

Kansas law, K.S.A. 2006 Supp. 40-955 has been amended effective July 1, 2007 to require the filing of
certificates of Insurance with the Kansas Insurance Department. In response, ACORD has filed all of its
certificates/evidence forms. As of yet the Kansas Insurance Department has not responded.

ACORD filed revised auto ID card ACORD 50 WM and a new state-specific ID card in New Jersey.
Approval has been granted. Insurers who will use these forms must notify the NJ DOBI.

ACORD 50 WM (2/95), Insurance Identification Card, has been approved for many years in New Jersey as a
permanent auto ID card. In March ACORD revised ACORD 50 WM, new edition date 2007/03, by adding
check boxes for "Commercial" and "Personal", to indicate whether the motor vehicle is covered under a
commercial policy or a personal policy.

The New Jersey Department of Banking and Insurance (NJDOBI) asked ACORD to submit
ACORD 50 WM (2007/03) for approval. ACORD made this submission, and the revised ID card was
approved.

In addition, ACORD developed ACORD 51 NJ (2007/06) Permanent State of New Jersey Insurance
Identification Card, and submitted this form to the NJDOBI for approval as an alternative to
ACORD 50 WM (2007/03). This new form was also approved. This new state-specific form will not replace
ACORD 50 WM (2007/03). Insurers may use either form.

However, insurers intending to use either ACORD 50WM (2007/03) or ACORD 51 NJ (2007/06), must
submit a specimen copy of the ID card to the New Jersey Department of Banking and Insurance,
Identification Card Unit , before use. All fields must be completed, so the NJDOBI can be sure that all
required information will appear on the form.

Florida regulator requires change in fraud warning statement in all ACORD Property and Casualty
applications

The Florida Office of Insurance Regulation (OIR) has decided that the ACORD "standard" fraud warning
statement currently included in all Property and Casualty applications does not match the statement provided
in Florida law. This decision has been made regardless of the fact that more than ten years ago ACORD
requested and received written approval of its "standard" fraud warning statement, on the basis that it was
in substance (as allowed under Florida law) similar to the Florida-specific statement. The relevant law has
not changed; only the opinion of the Florida OIR.

In response, ACORD will expeditiously revise each of its Property and Casualty applications to include the
Florida-specific statement.

Georgia Court of Appeals decision regarding the offering of uninsured motorists coverage in umbrella
policies affects umbrella applications. Decision was appealed to the Supreme Court, who declined to
hear the appeal. ACORD has responded.

The Georgia Court of Appeals ruled in Abrohams vs. Atlantic Mutual Insurance Co. that Uninsured Motorists
coverage must be offered in umbrella policies that include auto coverage. This decision could affect ACORD
umbrella applications.

This decision was appealed to the Georgia Supreme Court, but that court declined to hear the appeal. As a
result, ACORD added Georgia to the UM disclosure statement in ACORD 83, Personal Umbrella Application,
and ACORD 131, Commercial Umbrella Application.



Oklahoma Insurance Department determines that applications must be filed. ACORD is responding

The Oklahoma Insurance Department notified ACORD that as a result of a recent change in Oklahoma law,
applications for Property and Casualty lines of insurance must be filed with the Department. In response,
ACORD applied for and received an Advisory Organization license..

ACORD has filed all necessary ACORD applications in Oklahoma on behalf of ACORD Forms Pool participants.
As of yet the Oklahoma Insurance Department has not responded.

Missouri Department of Insurance has accepted all ACORD Property & Casualty applications that were
filed on behalf of ACORD Forms Pool Participants.

Last year the Missouri Department of Insurance decided that Property and Casualty applications for
insurance are extensions of the policy contract and must be filed. In response, ACORD applied for an
advisory organization license, which was granted in late September. Filing of applications began immediately.
All necessary ACORD applications have now been filed on behalf of all ACORD Forms Pool Participants;
therefore these Participant insurers need do nothing.
