 Business Issue
 Some courts do not routinely receive paper Discharges from Probation from supervising
 agencies. This may lead to inaccurate and incomplete records for the Court and BCA. For
 example, when a Stay of Imposition is ordered, the level of sentence should be reduced upon
 filing of a Discharge from Probation. If the document is not received for filing, the reduced level
 will never be reflected in the Court’s record or the BCA’s Criminal History file.

 Options Considered
        Notify probation that discharge is overdue.
        No follow-up if Discharge from Probation is not filed.
        Court directs discharge (administrative).
 Recommended Process Change
 MNCIS will generate an administrative Order for Discharge if, at the end of the designated
 probation period, no action for revocation of probation or early discharge has been filed.

 Impact Within Judicial Branch
 This process would be less of an administrative burden for the Courts and would help to
 accurately complete the Courts record.
 Impact On Other Agencies
 This will result in more accurate information for consumers of court information and other
 agencies. The administrative Order for Discharge will facilitate a change in the level of sentence
 when appropriate (see UCP #144).
 Additional Information
 This process will provide important information needed for future integrations with our criminal
 justice partners. A separate UCP will address juvenile cases and the specific issue of
 indeterminate probation until the age of 19.
