THE FOLLOWING ISSUES AND/OR DEFICIENCIES IN THE PAPERS ARE

  1. Notice of hearing filed on 11/29/07.
  2. Petitioner is the ex-wife of the decedent and a creditor. Decedent died on
     7-14-06. It appears that the current spouse has not filed a petition for
     probate. However, current spouse alleges that all assets are held in a
     Living Trust and thus, no assets to probate. An existing claim may be
     pursued through Pr.C. §19022 et seq if notice to trust creditors has been
     filed and published. However, in this case we have no evidence that this
        occurred. Such filing and publication appears to be a condition precedent
        to this procedure.
   3.   Section 6(a)(3) or 6(a)(4) of the petition is not completed. File verified
        supplement.
   4.   Petitioner has requested that bond be set at the minimum $20,000 as
        assets are unknown at this time. Court should order petitioner to notice
        court within 72 of receipt of assets in excess of $20,000.
   5.   Objections filed by Mary Malloy, surviving spouse of decedent. Objector
        alleges that decedent left a Will dated 9/9/1999, the original of which was
        lodged with the Clerk. Moreover, decedent and his surviving spouse also
        created a Joint Revocable Living Trust dated 9/9/1999 and the Will
        distributed all the property subject to probate to his living trust. Objector is
        the nominated executor of the will. Objector further alleges that she has
        not sought appointment as executor of the estate since there are no
        assets subject to probate administration and all assets are held in the
        Trust. The petitioner was mailed notifications by trustee per Pr.C.
        §16061.7 and no objections to the terms of the trust have been made.
        Finally, objector alleges that any creditor’s claim by petitioner should be
        directed towards the trustee of the Malloy Family Trust as there are no
        assets subject to probate administration which could satisfy any claims.
   6.   Per Pr.C. §8466, the court has discretion to appoint any other person
        when the petitioner’s only priority is that of a creditor, unless court would
        deem that any other person having priority has waived their right per Pr.C.
        §8468.

RECOMMENDATION:
Matter is contested. If petition granted court will have to set future dates. Set
hearing for filing of inventory and appraisal for 5-26-09. Set hearing for filing of
accounting and/or status report for 12-29-09. Any accounting to be filed 30 days
in advance.

  1. Petitioner is the beneficiary of a testamentary trust. The trustee is
     deceased, as of 3-5-07. The trustee was to have distributed the assets to
     the petitioner upon the petitioner reaching the age of 30. The trustee failed
     to make the distribution. Petitioner is now 56 years of age. The trust
     indicates that Security Pacific Bank was to be the successor trustee.
     Petitioner alleges that Security Pacific was acquired by another bank and
     petitioner contends that Security Pacific no longer exists. It appears Bank
     of America is successor in interest. See note 2. Based thereon petitioner
     requests that he be named successor trustee.
  2. Declination to act signed by Bank of America; Security Pacific’s successor
     in interest.
  3. Petitioner has failed to list all persons entitled to notice in the petition, as is
     required by Pr.C. § 17201.
  4. Notice of hearing and proof of service filed. However, notice is not timely
     per Pr. C. § 17203 nor is it clear whom is entitled to notice (see note 3).
  5. The court has the power to appoint and remove trustees. Pr.C. §
     17200(b)(10). The method for appointment will be found at Pr.C. § 15660.
      If the trust provides a practical method of appointment that is the method
      that shall be used. Pr.C. § 15660(b). A trust company may be appointed if
      the trust company agrees and all of the adult beneficiaries currently
      entitled receive income from the trust agree. Pr.C. § 15660(c). If the office
      cannot be filed as set forth in (b) or (c) then any interested person may
      petition for the appointment of the trustee and the court may appoint the
      trustee or trustees. Pr.C. § 15660(d). Here there is nothing in the trust that
      set forth the method for appointment past the second successor trustee.

RECOMMENDATION:

  3. Petitioner has checked box 4 indicating that the decedent’s will does not

        however, there is no will and the box appears to have been incorrectly

   4.   The decedent was a resident of Oregon until 6 days before her death.
        Court may have a jurisdiction problem, although none have been raised to
        date.

     1.  Petitioner requests bond be fixed in an undetermined amount. It
         would appear that the estimated value of estate is $72,957.12, so
         that bond should be fixed at $88,000 (or alternatively, $44,000 if
         property is community property). As of 1/1/08, bond must be
         increased to include a reasonable amount for the cost of recovery
         to collect on the bond. For estates less than $500,000, a 10%
         increase has been determined to be the reasonable amount of
         increase. Pr.C. 2320(c)(4), CRC Rule 7.207. Judge to decide.
         Supplemental filed indicating that all assets are community
         property and that in order to post bond the petitioner would
              have to pay 10%. Petitioner indicates that the parties live on a
              fixed income and this would cause a substantial hardship to
              post bond. If the assets are in fact community property then
              they are not a part of the estate per Pr.C. § 3051(b)(2). Hence,

       2.     Petitioner requests medical powers. Capacity declaration filed.
       3.     Petitioner requests 2590 powers. Specifically, the power to

   6. The following disbursements need further clarification:
          a. Newspaper publication advertisements for sale of 1998 Dodge
             truck from 01/24/06 – 03/25/08 total $2610. It appears that there is
             a monthly charge to Recycler and Orange County Register.
             Question the cost of the sale of the vehicle at $130 a month.
             Question what is the asking price? Is there a more economical way
             of selling the vehicle? Need to file verified supplement. In a
             supplement petitioner alleges that she is asking $8,500 truck
             and camper. While placing the vehicle in a location with good
             exposure with a for sale sign on it would be more economical,
             the truck is an older truck with low gas mileage and sale is
             difficult. Judge to decide.
          b. Additional costs in repairs and maintenance for the Dodge truck
             over two years total $2,848.11. Additionally, conservatee has been
             in a long term 24 hour care facility for over 5 years. Question what
             the vehicle is being used for and how many miles per year are
             being put on said vehicle. Need to file verified supplement. Vehicle
             was in storage until 1-06. Attorney told them to sell as soon as
             possible. Conservatee’s husband had an accident in the car
             and it required repairs. The majority of driving done in the
             vehicle now is for repairs or test driving by potential
             purchasers.
          c. On 04/18/06 there are additional combined repairs for Dodge truck
             and camper of $1084.16. Question the need for such costly
             repairs. Need to file verified supplement. Due to the accident of
             Conservatee’s husband the frame for the camper slide was
             broken and had to be repaired, as the vehicle and camper are
             being sold as a unit.
   7. Bond is currently set at $334,000. Petitioner requests that bond be
      reduced to $184,000 based on the current assets of $145,444.91,
      personal property of $10,000, annual income of $11,520 and bond
      recovery costs per California Rule of Court, rule 7.207 of $16,700. Amount
      requested appears to be adequate.
   8. Petitioner requests that this conservatorship be transferred to Orange
      County. The Conservatee resides in Westminster and Conservator resides
      in Garden Grove. Petitioner alleges that it would be in the best interests of
      the estate to transfer conservatorship to Orange County.

  1. Prior to the decedent’s death by suicide she neglected making payments
     on her property and in fact did major damage to the property through
     arson. As a result, the petitioner was forced to loan the estate $46,257.13
     for repairs, mortgage payments, etc, in order to sell the house. At the time
     she loaned the estate the money she was unaware of potential tax liens.
     Petitioner seeks reimbursement of the money loaned to the estate. It
     should be noted that debts to the United States and the State of California
     that have preference by laws of the United States and the State of
     California shall be given the preference required by law. Pr.C. § 11420.
     Please file verified supplement providing points and authorities showing
     why costs of administration should be paid prior to debts re tax liens.
     Petitioner contends that the claims of the IRS and Franchise Tax
     Board are claims and not liens at this point. Based thereon the
     petitioner contends that the IRS has ruled in IRS ruling 80-112 that
        claims, as opposed to liens, have a priority after costs of funeral,
        costs of administration and 1 year of family allowance. Petitioner has
        provided the court with a copy of the ruling.
   2.   After payment of all closing costs at the sale of the house all remaining
        assets of the estate amounted to $66,954.26. If petitioner is reimbursed
        the assets of the estate will be $20,697.13.
   3.   Statutory fees are $10,659.27. Petitioner waives all but $8,537.86.
        Attorney fees to be divided 75% to current counsel and 25% to former
        counsel Michael Balikian. Mr. Balikian has not filed a stipulation agreeing
        to this division, but has been noticed and has not objected. Petitioner has
        filed a copy of a letter from Mr. Balikian confirming an agreement to
        the division.
   4.   Attorney requests extra-ordinary fees of $1,500 representing 6 hours at
        $250 per hour. Judge to decide. Counsel contends that the supplement
        filed herein took an additional 6 hours to prepare this supplement.
        Petitioner does not appear to be requesting additional fees for this
        time.
   5.   There are claims filed by the IRS. Petitioner requests that the debts be
        discharged, as the estate is insolvent. Creditors have been noticed. Judge
        to decide.
   6.   There are no objections in this file at the time of this review.

  2. The Public Administrator requests fees of $600. There is no itemization,
     merely a statement indicating that the property was sold under their

  3. Attorney requests fees of $1,121.50. Of that amount $688.50 is for the
     filing of this motion. It should be noted that, as a general rule, the court
     does not authorize extra-ordinary fees until the final report and account
     are presented. Here, only a summary disposition statement is required.
     This statement does not require a hearing. It should be noted that attorney
     bills his paralegal at $165 per hour.
   4. It should also be noted that if the estate now has money the court is owed
      $180 in filing fees for the summary probate petition. While the Public
      Administrator is exempt from fees the estate is not. See Gov. C. § 70659.
      Court should order these fees paid forthwith.

  1. On 2-14-96 Riley B. Thompson and Beverly B. Thompson created
     Thompson Trust. The trust was amended on 7-10-02. Riley died on 3-18-
     06. Thereafter, pursuant to Article VIII, Section B of the primary trust Trust
     A and Trust B were created. The trusts became irrevocable at that time.
     The current co-trustees are Beverly Thompson and William Donnelly.
     Upon the death of the surviving settlor the remaining corpus and
     undistributed income from Trust A and Trust B are to be distributed to
     Donnelly and petitioner. Petitioner is a co-trustee of the Trust A and Trust
     B.
  2. Petitioner alleges that Beverly has been in possession of all assets and
     income from the assets since the death of Riley. Petitioner alleges that
    she has requested information and accounting and none has been
    provided. Petitioner has requested copies of the fiduciary income taxes
    and none were provided. Petitioner alleges that Beverly has refused to
    cooperate and has refused to disclose sufficient information to allow the
    petitioner to know if the property has been properly allocated to Trust A
    and Trust B as required.
3. Petitioner alleges that the Certification of Trust incorrectly indicates that
    Trust A is revocable by Beverly in violation of the terms of the principal
    trust. Petitioner alleges that she has requested a correction of this term
    but that Beverly has refused.
4. Petitioner requests that the court instruct the trustee Beverly Thompson to
    comply with her duties including providing financial information and an
    accounting regarding the affairs of the Principal Trust, Trust A and Trust B,
    make allocation and subtrust funding and providing copies of the pertinent
    tax returns regarding decedent and the trust.
5. Petitioner requests that the Court instruct Beverly Thompson to correct the
    Certification of Trust to reflect that Trust A is irrevocable.
6. In the alternative petitioner requests that Beverly Thompson be removed
    as trustee on the basis of hostility and lack of cooperation among the co-
    trustees, impairing administration of the trust and for failure to act.
7. Petitioner requests that she be reimbursed for the expenses of this
    litigation pursuant to Pr.C. § 15864.
8. The court has the power to compel the trustee to report information about
    the trust or to account if the trustee fails to submit the report within 60
    days after written demand and no report or account has been made within
    six months preceding the request. (Pr.C. § 17200(b)(7)). Here the
    petitioner merely indicates that demand has been made, but offers the
    court no specifics that would allow the court to find that an accounting can
    be ordered within the confines of Pr.C. § 17200. Require petitioner to
    amend pleading to allege facts in accord with the requirements of the
    code. Supp: Petitioner is not seeking to compel an accounting as a
    beneficiary of the trust. Instead, petitioner is seeking to gain
    cooperation from her co-trustee, Mrs. Thompson, in the
    administration of the trust which she is bound to do (Pr.C. §16013).
9. “(b) The grounds for removal of a trustee by the court include the
    following:
        (1) Where the trustee has committed a breach of the trust.
        (2) Where the trustee is insolvent or otherwise unfit to administer the
    trust.
        (3) Where hostility or lack of cooperation among co-trustees impairs the
    administration of the trust.
        (4) Where the trustee fails or declines to act.” (Pr.C. § 15642 in part).
10. The court may instruct a trustee pursuant to Pr.C. § 17200(b)(6).
11. A trustee is entitled to the repayment out of the trust property for the
    following:
     (a) Expenditures that were properly incurred in the administration of the
       trust.
        (b) To the extent that they benefited the trust, expenditures that were not
       properly incurred in the administration of the trust. (Pr.C. § 15864).
   12. Petitioner has supplied only a portion of the trust. Per Local Rules of
       Court, Rule 20-1502 a copy of the trust must be submitted with the
       pleading. Please file copy of entire trust and all amendments.
   13. Objections filed by Beverly Thompson.

RECOMMENDATION:
Set for contested hearing. There is another matter concerning this trust on
another page. That matter seeks to invalidate the trust in its entirety or in the
alternative to amend the trust. The court’s ruling on one matter would clearly

THE FOLLOWING ISSUES AND/OR DEFICIENCIES IN THE PAPERS ARE

  1.   Husband and wife trustors were married in 1960. Husband trustor
       became an attorney in 1971. Also in 1971, the couple executed wills
       naming each other as sole beneficiaries. (Exhibits B and C.) In 1996,
       the couple executed a living trust (Exhibit A) and new pour-over wills
       (Exhibits D and E). The couple amended the trust in 2002 to change
       contingent distributions not relevant here. (Exhibit F.) The husband
       trustor died in 2006, leaving wife trustor and two others as the named
       successor co-trustees.
  2.   Petitioner is the wife trustor/successor co-trustee. She proceeds per
       Pr.C. 17200.
3.   Petitioner alleges that the trust, in many ways, is the typical revocable
     living trust drafted for tax-avoidance purposes that splits into multiple
     sub-trusts upon the death of the first spouse trustor. She adds,
     however, that the trust contains an unusual provision making the
     survivor’s trust irrevocable upon the death of the first trustor and that
     the surviving spouse does not have the power to control the assets
     that are included in the survivor’s trust. She states that as a result, she
     states that she does not have the power to control the assets in the
     survivor’s trust, including the community property accumulated during
     the marriage. Petitioner also complains that she has lost the power to
     bequeath the property upon her death. She adds that another unusual
     feature is that she was named as one of three successor co-trustees,
     further diminishing her control over marital assets. Petitioner states
     that she relied upon her husband when he represented that the
     distributions specified in the trust instrument were just like their prior
     wills which contains reciprocal sole beneficiary provisions. She also
     states that she tried to read the 35 page trust instrument but could not
     get through it or understand the terms (and that she is not an attorney
     like he was). She alleges that she asked on multiple occasions for her
     husband to explain the trust but that he never did. She concludes that
     only after her husband’s death did not discover the unusual and
     limiting terms of the trust.
4.   Petitioner seeks revocation of the trust, stating theories that her
     consent to the trust was obtained by the fraud of her husband (actual
     fraud, see p. 7 of brief, and constructive fraud, see p. 9 of brief); that
     the trust is a waiver that is not enforceable to the extent that it alters
     the rights that petitioner had under the husband’s will before the trust
     was signed (p. 11 of brief); and that the court should refuse to enforce
     the trust, effectively a waiver, because of unconscionability (p. 12 of
     brief). Alternatively, petitioner argues that the court could modify the
     trust to reflect the agreement that petitioner was led to believe she was
     entering into with her husband when sighing the trust - mutual sole
     beneficiary distributions that would have left her in control of marital
     assets (p. 14 of brief). Petitioner also alleges that the trust should be
     terminated or modified based upon the fact that it is an invalid
     agreement (p. 15) or based upon mistake (p. 17).
5.   The petition is verified but there is no declaration laying a foundation to
     authenticate the many attached exhibits upon which the petition relies
     (and the content of the verified petition itself does not provide that
     foundation). Suggest court require declaration authenticating the
     exhibits or set for evidentiary hearing. JTD.
6.   Need notice of hearing and proof of service.
7.   A petition for instructions to compel the successor co-trustee wife to

THE FOLLOWING ISSUES AND/OR DEFICIENCIES IN THE PAPERS ARE
NOTED:
  1. File notice of hearing and proof of service in accord with Pr.C. § 17203.
  2. Petitioner, Romania Outreach to Christ’s Kids, is a beneficiary of the Luis
     Flores Trust.
  3. Luis Flores died on 10-23-06, at which time the trust became irrevocable.
     The trust indicates that upon the death of Flores the trust is to be
     distributed. The real property of the estate is to be sold and 25% of the
     proceeds of the sale are to go to petitioner herein.
  4. Petitioner alleges that the real property was sold over a year ago and has
     not yet been distributed. Petitioner alleges that the Successor Trustee,
     Global Estate Services, has sold the property, but has failed to distribute.
     Petitioner further alleges that while the trust specifically sets forth Global’s
     compensation (See pink tab 1), Global is attempting to take much more
     than is allowed under the terms of the trust (see pink tab 2). It is alleged
     that Global held the assets for an entire additional year for the sole
     purpose of generating additional fees.
  5. Petitioner requests a complete accounting. The court has the power to
     compel the trustee to report information about the trust or to account if the
       trustee fails to submit the report within 60 days after written demand and
       no report or account has been made within six months preceding the
       request. (Pr.C. § 17200(b)(7)) Petitioner has failed to set forth any of the
       elements required to allow the court to order an accounting. File verified
       supplement.
   6. Petitioner requests that the court set the compensation of Global in accord
       with the trust at 2% for the year that they managed the $253,421.49. and
       in amount that the court deems reasonable for 1 year of managing the
       reserve that is deemed necessary to have held back to deal with trust
       liabilities. The court has the power to fix or allow compensation of the
       trustee and/or review the reasonableness of the trustee’s compensation.
       Pr.C. § 17200(b)(9).
   7. Petitioner requests $3,000 in attorney fees and requests that be
       authorized as an expense of the trust. The petitioner offers no authority for
       this request. Pr.C. §17200 provides no authority for such action. File
       verified supplement setting forth the court’s authority to make such an
       order.
   8. Petitioner requests that the court remove Global as the successor trustee
       and allow the majority of the beneficiaries to elect a new successor
       trustee. Petitioner appears to be arguing that grounds exist for removal
       based on breach of trust and failure to act. Pr.C. § 15642(b)(1) and (4).
       The court has the power to remove a trustee under Pr.C. § 17200(b)(10).
   9. The court has the power to appoint and remove trustees. Pr.C. §
       17200(b)(10). The method for appointment will be found at Pr.C. § 15660.
       If the trust provides a practical method of appointment that is the method
       that shall be used. Pr.C. § 15660(b). A trust company may be appointed if
       the trust company agrees and all of the adult beneficiaries currently
       entitled receive income from the trust agree. Pr.C. § 15660(c). If the office
       cannot be filed as set forth in (b) or (c) then any interested person may
       petition for the appointment of the trustee and the court may appoint the
       trustee or trustees. Pr.C. § 15660(d). Here the trust contains no method
       for appointment of other successor trustees. In light of the amount of
       money left in the estate it is unlikely that a trust company will agree to
       handle the estate. Therefore any interested person may apply for the
       position or the court may exercise its discretion in the appointment of a
       successor trustee.
   10. Petitioner has failed to list all persons entitled to notice in the petition, as is
       required in Pr.C. § 17201. File verified supplement.

  1. Petitioner requests bond be set in the amount of $130,000. Based on
     information in the file amount appears adequate.
  2. Petitioner has submitted a letter allegedly written by the decedent
     indicating that the document is a holographic will. All the document
     indicates is, “Please release my computer to Chris W. Van Winkle (my ex-
     husband and Executor of my will).” See attachment 3(e)(2). In order for
     this to be a will there must a clear showing that the testator intended by
     the particular instrument to create a disposition of property effective only
     upon death. It is clear that the decedent was saying good-bye to a friend.
     It is not quite so clear that this was intended as a disposition of her
     property. The statement implies that they may be another document
     wherein Mr. Van Winkle is named executor. The only thing that is
     disposed of here is the decedent’s computer. The wording concerning the
     computer is not clearly a disposition of property. It doesn’t say. “ I leave
     my computer. . .” or “I give my computer. . .” It is more like someone is
     holding it and it should be released. While no “magic words” are required it
        does not appear that this document contains testamentary intent. Judge to
        decide. Petitioner has filed a supplement indicating that the “will” is
        offered solely for the purpose of appointment of the executor.
        Petitioner contends that if the court finds that the “will” is not a will
        then the petitioner contends that Maynell Wackwitz is the person
        with priority and the court should deem her failure to file as a waiver.
        The next person with priority is Saran Winkle and she has nominated
        the petitioner. There is another with priority equal to Saran, but this
        child of decedent is a minor and therefore precluded from acting. It
        should be noted that if the court should determine that the “will”
        does not constitute a will, petitioner will have to file an amended
        petition as a petition to administer, rather than a petition for probate.
        The court should also advise the petitioner that this will necessitate
        all new notice, including publication.
   3.   In the event that the court determines that the document does not
        constitute a will it will be necessary to file an amended petition requesting
        that the petitioner be named administrator, rather than executor.
   4.   File proof of publication.
   5.   File Notice of Petition to Administer Estate with proof of service.
   6.   Decedent had a Registered Domestic Partner, Maynell Wackwitz. This
        individual would have priority of appointment over the former spouse, in
        the absence of a valid will. The petitioner has been nominated by his
        daughter, but the Registered Domestic Partner would have priority over
        the daughter. File declination to act. See note 2.

RECOMMENDATION:
Court will have to determine if the document constitutes a will before proceeding.
Also one of the heirs is a minor, court may wish to require the appointment of a

  2. The court has the power to appoint and remove trustees. Pr.C. §
     17200(b)(10). The method for appointment will be found at Pr.C. § 15660.
     If the trust provides a practical method of appointment that is the method
     that shall be used. Pr.C. § 15660(b). A trust company may be appointed if
     the trust company agrees and all of the adult beneficiaries currently
     entitled receive income from the trust agree. Pr.C. § 15660(c). If the office
     cannot be filed as set forth in (b) or (c) then any interested person may
     petition for the appointment of the trustee and the court may appoint the
      trustee or trustees. Pr.C. § 15660(d). Here the only method of
      appointment that can be employed is the last method. The beneficiaries
      have applied for appointment of a successor.
   3. Petitioner further requests that the successor trustee be permitted to
      distribute per the trust. Ok.

     this estate it turns out that the majority either had no value, were
     repossessed, or belonged to someone else. Petitioner contends that the
     business of the decedent did not exist. Petitioner alleges that the real
     property was encumbered to the extent that it had no value. Based
     thereon the petitioner alleges that there are no assets subject to
     distribution in this estate.
  3. I do find one creditor’s claim filed by Citibank in the amount of $251.68. It
     is unknown if this claim was rejected or allowed. Notice has now been
     given to this creditor and no objection has been received.
  4. There is no objection in the file at the time of this review.
  5. Declaration of Jeffrey E. Karpel filed 06-20-08. Petitioner asserts that
     decedent was added to title only as an accommodation to Maria Miranda
     as a borrower to facilitate the refinancing of the property, for which, the
     decedent received substantial funds for the accommodation and his
     interest in the property was satisfied. Prior to refinancing, Maria Miranda
     held sole title to the property. Petitioner further asserts that Glenda
     Miranda executed an inter-spousal transfer by quitclaim deed of any and
     all rights to the property to the decedent in support of the shared
     understanding of the parties that true title to the property was held by
     Maria Miranda. Petitioner contends that it was always the understanding
     and the intent of the parties that Maria Miranda was and remains the sole
     owner of the property.

1.   Final I&A filed indicating $151,000 estate value including $145,000 real
     property and $6,000 personal property on 12/31/02 date of death.
2.   Decedent’s will leaves a life estate in decedent’s Hesperia, CA real
     property to the spouse, then the property to decedent’s four children
     upon death of spouse. All other assets were left to the spouse.
3.   Personal representative (son) now reports the he moved into the
     estate real property in 12/05 to protect it, that he then transferred title
     to himself and his wife (stating that he believed he had authority to do
     so), that he and his wife then took an adjustable rate mortgage “to
     facilitate the closing of probate,” that he paid $50,000 each to his three
     sisters/co-beneficiaries out of escrow, that surviving spouse has all of
     the furnishings, that petitioner has since had a major car accident and
     is now permanently disabled, that the hospitalized petitioner was in
     danger of losing the home to foreclosure so he instead deeded the
     property back to the mortgage company in lieu of foreclosure, that
     petitioner ended up with nothing and is continuing to pay the deficit on
     the mortgage, and that there is now nothing to probate and that this
     estate should be closed.
4.   Petitioner’s claim that the estate should be closed does not take into
     account the following concerns (petitioner is invited to present verified
     supplement):
     a. There was no consideration of the surviving spouse’s life estate
         when petitioner moved into the property, refinanced it, and lost it to
         a deed in lieu of foreclosure. No compensation apparently has
         been paid to the surviving spouse re the value of the lost life estate.
         Supp: Surviving spouse chose to move away from the
         property. Also, petitioner has been paying $1,200/yr to her for
         five years ($6,000). Receipt filed re $6,000 payment schedule.
         Does Court wish to deem this as an agreement? Judge to
         decide
     b. Petitioner assumes that the other three co-beneficiaries of the real
         property have received the full value of the bequest yet there is no
         indication that the I&A value of the property as of the 2002 date of
         death is the appropriate value as of distribution. Supp: Everyone
         agreed to the amounts and they will write sworn affidavits if
         necessary.
     c. Petitioner alleges that he received nothing from estate in light of
         loss of the property. However, escrow closing statement attached
         to the petition shows that over $63,000 in credit card payments
         were made directly out of escrow. (See bottom of page two of
         closing statement, tabbed.) It is unknown whether these were
         decedent’s credit cards or petitioner’s. Closing statement also
         shows $69,294.67 cash to borrower (see bottom of page one).
         Supp: Petitioner upgraded the home and paid for the repairs
         with credits cards and cash. This was part of the $63,000 paid
         out of escrow. Petitioner also paid off two of his cars.
         Petitioner states that his share came to $69,294.67 and any
         leftover money was used on living expenses after petitioner’s
         auto accident. Petitioner states that his share was larger by
         $19,294.67 ($50,000 + $19,294.67 = $69,294.67) because of the
         money he spent to restore the house for attempted sale prior
         to its loss. Petitioner adds that he has paid $133.33/mo for five
         years ($8,000) per an agreement with the mortgage company
         to cover the deficit balance after the deed in lieu of

         this whole process was him. Petitioner reiterates that there
         are no assets in the estate to warrant continued
         administration. Note that there are no itemizations or receipts
         filed for any claimed expenses. All expenses are per

         notice to the other beneficiaries and no actual written
         consents.
     d. Petitioner is required to file a full and final accounting for the period

             references sale of the property when apparently no sale was
             ever made (per petitioner, the house was refinanced then

     petitioner did a preliminary distribution with the funds of the refinance by
     paying himself $68,749.14 and $50,000 to each of the other three heirs.
     Petitioner also took title to the estate’s real property. Petitioner received a
     larger gross distribution that the other heirs, however, no objections have
     been filed by the other three residual heirs. Additionally, petitioner later
     was in a severe automobile accident and is now permanently disabled.
     Therefore, he was unable to make the mortgage payment and was forced
     to return the property to the mortgage company by deeding it back to them
      in lieu of foreclosure. Petitioner is currently paying the deficit balance of
      $8,000.00 owed to the mortgage company and alleges that this deficit
      balance has no impact on the decedent’s estate. Receipts have been filed
      by all heirs re their share of the estate. It does not appear there is any
      harm to the estate. However, Court may wish heirs to stipulate to the
      distributions received as acknowledging that they are their full distributions
      representing their one-fourth residual share. JTD
   4. The receipt from the surviving spouse, Lois Bradley states that cash of
      $6,000 will be received for her distributive share payable for five years at
      $1,200/her to be paid off by July 2010. Question if petitioner is taking this
      liability personally or whether the other heirs will also contribute? File
