Performance Estimate
Many factors affect the annual energy production of a small wind turbine, including: variability in actual wind speeds,
terrain and site conditions, rapid or frequent changes in wind speed/direction, turbulence, wire losses and overall
turbine efficiency. The following range is an estimate only. Actual annual energy production may differ.

Wind Monitoring Equipment Bonus Incentive (OPTIONAL)
Energy Trust is currently making an additional incentive of up to $500 available towards the costs of certain eligible wind
monitoring equipment purchased and installed by your Trade Ally Contractor as part of your System installation. Requesting the
bonus incentive is entirely optional; however, if System Owner requests and receives the bonus incentive for wind monitoring
equipment for its System, System Owner will be subject to additional data reporting requirements (see Section 8 in the
Additional Terms and Conditions). In the event that the Wind Monitoring Equipment Purchase and Install Cost is less than
$500, the maximum bonus incentive that Energy Trust will provide will be limited to 100% of the Wind Monitoring Equipment
Purchase and Install Cost.

Additional Terms and Conditions
1. PROPERTY RIGHTS: System Owner must be eligible to participate in this Energy Trust program. System Owner represents to Energy Trust
that it is the owner of, or otherwise has legal rights to occupy, the entirety of any structures and underlying real property located at the
installation site address identified in this application. If System Owner is not the owner of the site property, then Energy Trust requires that you
submit a Owner/Lessor Confirmation Addendum with this Form 720C . Final determination of eligibility rests solely with Energy Trust.

2. INSURANCE: Energy Trust requires that System Owner maintain the following minimum types and amounts of insurance: workers'
compensation insurance in compliance with statutory requirements, occurrence-based commercial general liability insurance of at least
$1,000,000 per occurrence and aggregate, and all-risk property liability insurance covering the replacement value of the System during the
System installation and operation time period. It is the System Owner's responsibility to ensure that it is in compliance with the above insurance
requirements. Energy Trust recognizes that some System Owners are self-insured and/or have blanket coverage or are covered
by the State of Oregon Insurance Fund (and subject to its limitations). Energy Trust will accept such coverage as long as the System Owner
meets the levels of insurance required herein or, with respect to entities covered by the State of Oregon Insurance Fund, such coverage shall
be to the fullest extent provided consistent withy the Oregon Tort Claims Act and Article XI, Section 7 of the Oregon Constitution. Energy Trust
may request proof of any of the required insurance coverages (including evidence of self-insurance) from System Owner at any time.

3. SYSTEM INSTALLATION AND INSPECTION: The System must be a net-metered, grid-tied small wind system delivering power to the
Oregon electric service territory of Portland General Electric or Pacific Power. System Owner is solely responsible for ensuring that all
equipment purchased and work performed related to the System complies with all federal, state, local, and utility specifications and
requirements. In addition, the System must be installed by your Trade Ally Contractor in accordance with Energy Trust's Small Wind System
Installation Requirements and must pass an Energy Trust inspection, before Energy Trust will be obligated to pay any incentive. Energy
Trust's inspection is for program purposes only; it is not a code inspection, and no warranty is implied.

4. SYSTEM OPERATION AND MAINTENANCE: Energy Trust has calculated the incentive amount based upon the assumption that the
System will operate continuously for a period of fifteen (15) years from the System approval date. System Owner agrees that, during this time
period, the System will be properly operated and maintained in good working order and will not be permanently removed from service or from
the property. If it is necessary for System Owner to temporarily disable the System (e.g. maintenance to the System, tower, or other supporting
structure) during this time period, System Owner agrees to restore the System to full operation within 90 days from the date the System is
disabled; otherwise, Energy Trust may deem the System shut down. In addition, prior to any sale of the site property, System Owner must
receive prior written consent from Energy Trust which will be contingent on System Owner transferring, in writing and to Energy Trust’s
satisfaction, the terms of this agreement to the new owner.
5. INCENTIVE RESERVATION: Funding for Energy Trust incentives is limited and available subject to our Small Wind program requirements
and on a first-come first-served basis. Energy Trust's program requirements and incentive levels are subject to change and vary by utility
service area, depending on the pace of small wind system demand in each utility territory and the available incentive budget.
Energy Trust will reserve incentives in accordance with its program requirements. Energy Trust will notify System Owner and Trade Ally
Contractor, via an emailed Notice of Incentive Reservation , of (i) the incentive amount it will reserve for the System, and (ii) the "Reservation
Period". If the System is not installed, inspected and approved by Energy Trust within the Reservation Period, or if Energy Trust determines that
System Owner is not progressing appropriately towards a timely installation during the Reservation Period, the reserved incentives may be
withdrawn. If System Owner and its Trade Ally Contractor decide to make any change to the System design or the site where the System will be
installed, as described in this application, during the Reservation Period, then the Trade Ally Contractor must notify Energy Trust and the
System Owner before making the proposed changes. Energy Trust will review the proposed changes and will, at Energy Trust's sole discretion,
provide notice of approval via an email Notice of Revised Incentive Reservation .

6. INCENTIVE PAYMENT: System Owner understands and agrees that the Energy Trust incentives provided may vary from amounts listed in
this Form 720C depending on the final System installed; provided, however, that in no case will the Energy Trust incentive exceed the
estimated amount reserved by Energy Trust for the approved Form 720C . Energy Trust will pay incentive amounts directly to System Owner at
the mailing address listed unless System Owner and Trade Ally Contractor both sign the section entitled Option to Assign Payment to
Contractor located at the end of this Form 720C . System Owner understands and agrees that regardless of whether or not the incentive
payment is assigned to Trade Ally Contractor, System Owner will be responsible for performing System Owner's obligations under this
agreement, including but not limited to any repayment obligations. System Owner is advised to retain a copy of this application and any
accompanying documentation submitted to Energy Trust. Energy Trust will not be responsible for any lost documentation related to this
application.

7. REPAYMENT OF ENERGY TRUST INCENTIVE: Following Energy Trust's payment of an incentive for the System, if the System is sold,
shut down or otherwise operated in violation of this agreement during the fifteen year time period (see SYSTEM OPERATION AND
MAINTENANCE), then System Owner will immediately repay (in the form of a cashiers check) a portion of the incentive amount to Energy
Trust, calculated as follows: Total Energy Trust incentive paid multiplied by the fraction of (15 minus the number of anniversaries of the Energy
Trust System approval date divided by 15).

8. ADDITIONAL REQUIREMENTS FOR WIND MONITORING EQUIPMENT BONUS INCENTIVE: If System Owner chooses to purchase and
install eligible wind monitoring equipment and receives the Energy Trust bonus incentive, System Owner agrees (i) that Energy Trust will pay
the bonus incentive directly to the Trade Ally Contractor to reduce the amount System Owner owes Trade Ally Contractor; (ii) System Owner will
allow Energy Trust to verify the equipment installation prior to its incentive payment; and (iii) System Owner will provide Energy Trust with
average monthly wind speed and maximum wind speed collected by the wind monitoring equipment on a monthly basis for a period of one year
from the System's installation date. System Owner further agrees that Energy Trust may use the data to benefit its Small Wind program.

9. ENERGY INFORMATION RELEASE: System Owner authorizes Energy Trust to access energy usage data for the System’s specified
electric and natural gas accounts at the physical address of the project. System Owner agrees to provide other reasonable assistance to
Energy Trust to obtain such information.
10. INFORMATION RELEASE: System Owner agrees that Energy Trust may include the following information in reports or other
documentation submitted to the Energy Trust Board of Directors, the Oregon Public Utility Commission, the Oregon Department of Energy,
Oregon Housing and Community Services, or the Oregon Legislature: System Owner’s name, a description and location of the System, the
amount of any Energy Trust services or incentive payments provided to System Owner, and any resulting System energy savings or generation.
Energy Trust will treat all other information gathered as confidential and report it only in the aggregate.

11. TAX LIABILITY: Energy Trust is not responsible for any tax liability which may be imposed as a result of payment of any incentives. Energy
Trust is not providing tax advice, and any communication by Energy Trust is not intended or written to be used, and cannot be used, for the
purpose of avoiding penalties under the Internal Revenue Code.
12. ACCESS AND EVALUATION: System Owner agrees to allow Energy Trust reasonable access to the property where the System is
installed in order to: (i) read the meter(s), (ii) inspect and review the project during and after completion, and/or (iii) evaluate the operation of the
System. In addition, System Owner agrees to cooperate when contacted by Energy Trust to request meter readings or other information related
to the System.

13. ENVIRONMENTAL ATTRIBUTES: Environmental Attributes (as defined herein) may also be referred to as "green tags", "renewable
energy certificates", "tradable renewable certificates" or otherwise. Environmental Attributes (as defined herein) do not include any energy,
capacity, reliability or other power attributes associated with the generation of electricity, or any liabilities associated with such generation, and
do not include any tax credits which may accrue as a result of implementing the System. "Environmental Attributes" means the non-energy
environmental and/or social characteristics, credits, benefits, reductions, offsets, and/or allowances, howsoever entitled, attributable to the
System, including without limitation any avoided emissions of substances to air, soil, or water, such as nitrous oxide (NOx), carbon monoxide
(CO), mercury (Hg), carbon dioxide (CO2), methane (CH4),or other greenhouse gases (GHGs) designated by the United Nations
Intergovernmental Panel on Climate Change, and any other pollutant that is now or may be in the future regulated and tradable, whether or not
such legislation, regulation or trading program is ever implemented.

14. OWNERSHIP OF ENVIRONMENTAL ATTRIBUTES: System Owner agrees that System Owner's ownership of the Environmental
Attributes asociated with the System as calculated for the purposes of this agreement shall begin on the date Energy Trust approves the
System (the Start Date) and will run for a time period ending at 11:59:59 pm (Pacific time zone) on the day before the second anniversary of the
Start Date (the System Owner Ownership Period). Energy Trust's ownership rights of the Environmental Attributes associated with the
System shall begin at 12:00:00 am (Pacific time zone) on the second anniversary of the Start Date and will run for a time period ending at
11:59:59pm (Pacific time zone) on the day before the fifteenth anniversary of the Start Date (the Energy Trust Ownership Period). System
Owner understands and agrees to the Environmental Attributes ownership arrangement as set forth herein and will fully comply with such
ownership arrangement in consideration of the incentives provided to System Owner pursuant to this agreement. System Owner agrees that,
during the Energy Trust Ownership Period, System Owner will cooperate fully with Energy Trust to (i) register or otherwise perfect Energy
Trust's rights in the Environmental Attributes, and (ii) report such rights. If System Owner determines to sell the Environmental Attributes to a
third party during the System Owner Ownership Period, System Owner will ensure that any third party purchaser of System Owner's
Environmental Attributes acknowledges the date when ownership of the Environmental Attributes transfers to Energy Trust in accordance with
this agreement.

15. GOVERNING LAW: This agreement shall be exclusively governed by and construed in accordance with the laws of the state of Oregon,
without regard to any conflicts of laws rules thereof.

16. ASSIGNMENT: This agreement may not be assigned by Trade Ally Contractor or System Owner without Energy Trust's written consent.
Energy Trust may assign its rights under this agreement to a third party if requested by the Oregon Public Utility Commission under its grant
agreeement with Energy Trust. This agreement will be binding on the parties' permitted assigns and successors in interest.

17. DISCLAIMER OF WARRANTIES: System Owner hereby acknowledges that Energy Trust has not made any representations and
has specifically DISCLAIMED any and all warranties, express or implied, with respect to the System to be installed or the Trade Ally
Contractor, including but not limited to those concerning Trade Ally Contractor's experience, qualification, or background, the amount
of any energy savings or energy generation, if any, to be realized by System Owner from use of the System, the quality of specific
materials, components, or workmanship utilized in the installation, or the nature of or whether building permit(s) or governmental
approval(s) may be required.
18. LIMITATION OF LIABILITY: Energy Trust's liability to System Owner is limited to recovery of amounts due for the incentive
payment described and under no circumstances will Energy Trust be liable for any further amount whatsoever. In no event will Energy
Trust be liable pursuant to this agreement to System Owner or any third party for any damages, whether characterized as general,
special, direct, indirect, punitive, consequential or otherwise.

Do you want Trade Ally Contractor to take direct payment of the incentives in partial payment of its invoice? If so, both System

issued directly to the Trade Ally Contractor listed on this Form 720C within thirty (30) days after the installation is approved by
Energy Trust and Energy Trust is not responsible for any tax liabilities that may be associated with the incentive payment. If
Trade Ally Contractor accepts assignment of System Owner's incentive payment in partial payment of its invoice, Trade Ally
Contractor agrees to waive its right to perfect or foreclose any lien or encumbrance against System Owner's property (including
without limitation claims of construction lien under Oregon's Construction Lien Law) for the amount of the incentive payment due
or alleged to be due by Energy Trust.

  Purpose
  Energy Trust typically requires that commercial entities participating in its Small Wind Program own the installation Site (the
  entirety of any structures and the underlying real property located at address described on the Participant's submitted Form
  720C ) where the small wind system ("System") will be located. Energy Trust requires this because, among other things, it
  needs assurance that the System will be in place and operational at the Site for a period of 15 years. Energy Trust will allow
  a Host who is not the owner of the Site property to submit a Form 720C application to Energy Trust for incentives provided
  that Host submits this Owner/Lessor Confirmation Addendum in addition to its Form 720C application.


  Agreement
  Owner/Lessor is the owner of the installation Site property, as described on the Form 720C . The Site is leased to
  Participant by a lease dated                     and having a term of            years from the lease date.
  Owner/Lessor has received a complete copy of the Form 720C application that Participant is submitting to Energy Trust.
  Owner/Lessor is providing this Owner/Lessor Confirmation Addendum to Energy Trust pursuant to the requirements
  set forth in the Form 720C . In addition to providing its own assurances pursuant to this Owner/Lessor
  Confirmation Addendum , if the Owner/Lessor listed herein is not the sole owner of the real property where the System
  will be located, Owner/Lessor represents and warrants to Energy Trust that it has the authority to bind all owners to the
  following terms:

  For the duration of the term of the Form 720C agreement (i) Owner/Lessor and co-owners, if any, have granted Participant
  an absolute right to install, operate, maintain, and if necessary, remove, the System at the Site; (ii) no lease, covenant,
  restriction, lien, financing agreement or security agreement or other interest or lien exists upon the Site that could prevent the
  the installation, operation, maintenance or, if necessary, removal of the System; (iii) Owner/Lessor will provide Energy Trust
  with at least 30 days' advance notice prior to any sale of the Site property or any intent to terminate Participant's lease as
  described herein; (iv) Owner/Lessor and co-owners, if any, hereby grant Energy Trust reasonable access to the Site property
  in order to read the System's meter, inspect and review the System during and after completion, and/or evaluate the operation
  of the System; and (v) Owner/Lessor and co-owners, if any, hereby grant Energy Trust permission to include the Site location
  in reports or other documentation submitted to the Energy Trust Board of Directors, the Oregon Public Utility Commission,
  Oregon Department of Energy, Oregon Housing and Community Services, the Oregon Legislature, or others. In addition, if
  Owner/Lessor owns the utility account associated with the System, Owner/Lessor hereby authorizes Energy Trust to access
  the energy usage data for the System's specified electric and/or natural gas accounts at the physical address of the project.

  Notwithstanding its provision of incentive funding for the System, Energy Trust is not supervising work performed nor is
  Energy Trust responsible for proper completion of that work or proper performance of any System equipment purchased. In
  no event will Energy Trust be liable to Owner/Lessor for any damages as a result of Participant's installation, operation or
  maintenance of the System or for any damages otherwise related to the System.
