  ORDER OF BUSINESS:

1. PLEDGE OF ALLEGIANCE

  The Mayor led the Pledge of Allegiance.

  The Mayor noted the fire exits.

3. MAYOR’S ANNOUNCEMENTS

  Carbon Monoxide Detectors are now a requirement – new law effective February 22,
     2010, implemented by NYS building Code.

4. APPROVAL OF BOARD MINUTES

     Motion made by Trustee Davis - Seconded by Trustee Balles to accept and
     place on file:
     Work Session and the Regular Board Meeting minutes of February 16, 2010.
             Motion made.

8. PRIVILEGE OF THE FLOOR – VISITORS

     Julie Deemie - 153 Zoa Ave., JC – Resolution #45 – What does the clean-up include other than
     tires?

     The Mayor answered that this day was a clean-up day for tires only.

     Bruce King – 19 First St., JC – Why is Fire Marshall Dempsey still on paid suspension?

     Mayor Hannon replied that it is a personnel matter and he cannot comment except to say that he
     is on administrative leave.

     Bruce King – 19 First St., JC – Asked regarding the recent article in the newspaper that stated
     there was an on-going two month investigation that resulted in the suspension of Chief Potts. I
     was on the board two months ago and I don’t remember an investigation being started. I am
     curious when this investigation started, when the board knew there was an actual investigation
     started, and if the board knew he was suspended or going to be suspended before he actually
     was? Were the attorneys involved prior to the suspension of Chief Pott’s?

     Mayor Hannon stated that he will not answer regarding the conversation that took place between
     him and the attorneys – as that is attorney client priviledge. He stated that he would have to look
     at the report as to how long the investigation was under way, but it was pretty much done in 2010.
     The actual claim may have been made in December. The board was fully apprised of any action
     that I took.

     Julie Deemie – 153 Zoa Ave., JC – Will there be in the near future more revealed on this matter
     to the public regarding Chief Potts?

     Mayor answered that it was unlikely that more would be revealed.

     Julie Deemie – 153 Zoa Ave., JC - Is it a possibility that we will never know what occurred or what
     the charges are? She asked why more details couldn’t be given under a general heading, such
     as theft, destruction of records, etc., etc.

     Mayor Hannon stated that was correct. He also stated that he has consulted with legal counsel on
     this matter, and their advice was, because of the laws, we are constrained and very limited on
     what can be released.

     Carol Laskowski – 37 Edwards St., JC - How many man hours were spent on this investigation?

     Mayor Hannon – Stated that he does not know exactly how many hours was spent on this, but it
     was many.

     Julie Deemie – 153 Zoa Ave., JC – Who was involved in this investigation besides yourself and
     the attorney?

     Mayor Hannon stated that he could not elaborate on whether anyone else was involved.

     Bruce King – 19 First St., JC – Was it JCPD or was it an outside agency.

     Mayor Hannon stated that he would decline to answer that.

     Bruce King – 19 First St., JC – I missed the last meeting, but I understand there was a resolution
     approved for $200 per hour for Federal Court for Attorney fees for a Federal Case for the Village
     and the Mayor. Can you tell me why we are going to Federal Court?

     Mayor Hannon stated that as it has been publicized, the Village is being sued by the Fire
     Fighters.

     Garo Kachadourian – 74 Oak St., Binghamton – Vehicle stored and was stolen and brought back.
     He spoke with the District Attorney’s office. The Police Department took a report. He didn’t feel
     that his matter was being properly taken care of.

     Mayor Hannon – stated that this sounded more like a civil matter. He stated that he could make a
     call at a later time if need be, but this was not a matter for this board to handle, but rather a Police
     Department issue.

  The Mayor closed this portion of the Privilege of the Floor.

9. COMMUNICATIONS

  Mayor Hannon directed to receive and file:

     Motion made by Trustee Silas – Seconded by Trustee Novobilski that the
     following Communications be accepted and filed:

     a) Letter from Town of Vestal Supervisor, Peter Andreasen, dated 2/4/10
        regarding Labor Law 240 Reform Assembly Bill.
     b) Office of the State Comptroller –regarding Governmental Accounting Training
     c) NYS Dept. of Environmental Conservation Division of Water – dated 2/11/10
        – regarding community Coordination Meetings.
     d) Broome County Youth Bureau – dated 2/15/10 – Village of Johnson City 2010
        Municipal Application/Eligibility.
     e) GIGP-ARRA-INFO dated 2/18/10 regarding EFC’s ARRA implementation
        program.
     f) Main Choice LLC, Ground Round Grill & Bar, Liquor License renewal dated
        2/8/10.
     g) Broome County Association of Towns&Villages-Next meeting March 4, 2010
     h) Broome County Legislature- dated 2/11/10 regarding Pro-Act Vision, Lasik,

         Resolution #41- Motion made by Trustee Silas - seconded by Trustee
  Novobilski to appoint Mona Steele to the Library Board effective March 2, 2010 to
  fill the current vacancy and will expire on December 31, 2014.

FIRE: BALLES & SILAS

  Resolution #42 - Motion made by Trustee Silas - seconded by Trustee Balles to
  authorize the sale and transfer of title of a 1990 Grumman Fire Engine to GBS
  Global Systems, Inc. for $10,000.00.

  Mayor Hannon stated that we have another Engine to use, so it was determined that it would be
  good to sell this one, and use some of those funds to up-grade the back-up engine.

  Resolution #43 - Motion made by Trustee Silas - seconded by Trustee Davis
  supporting an application to be submitted by the Village of Johnson City for the
  2009-2010 local government efficiency implementation grant program in the
  amount of $76,520.

  WHEREAS, The Village of Johnson City intends to authorize the submission of an application to
  the New York State Department of State under the 2009-2010 Local Government Efficiency
  Implementation Grant Program in the amount of $76,520.00.

   WHEREAS, the Village of Johnson City share is $7,652.00 and the purpose of the grant will be
  related to studying Fire and Emergency Medical Services in the Village,

  NOW THEREFORE BE IT RESOLVED, that the Village of Johnson City Board of Trustees fully
  supports the submission of an application by the Village of Johnson City for the 2009-2010 Local
  Government Efficiency Implementation Grant Program and that Mayor Dennis Hannon is
  authorized to act on behalf of the Village of Johnson City in relation to said Grant and Grant
  Application.

PUBLIC WORKS/PARKS: BALLES & DAVIS

  Resolution #44 - Motion made by Trustee Davis - seconded by Trustee Balles to
  authorize Ken Jennison and James Wallace to attend the STBOA Quarterly
  Meeting, Fire Sprinklers, General Components Water Supplies for Automatic Fire
  Protection on Wednesday, March 10, 2010 at the Holiday Inn Oneonta, Oneonta,
  NY. The class will account for 4 hours of the 24 hours of required mandatory
  yearly training. Total registration cost for both attendees is $70.00 from A3989.4.

  Resolution #45 – Motion made by Trustee Silas - Seconded by Trustee
  Novobilski to authorize Municipal Clean-up Day on May 1, 2010 from 7AM to
  11AM at 124 Brown Street (DPW Facility) free to Village residents only. There is
  a four tire limit, which cannot be more than 16” and no rims will be accepted.

  Resolution #46 - Motion made by Trustee Novobilski - Seconded by Trustee
  Silas to set a Public Hearing for Tuesday, March 16, 2010, for a request from
  David Cooley and the Binghamton-Johnson City Monument Co., for a special
  permit to expand a non-conforming use at 103 Burbank Avenue and authorizing
  publication of said notice.

15. PRIVILEGE OF THE FLOOR - VISITORS

  The Mayor opened the second privilege of the floor.

     Judi Furman – 175 Marie St., JC – Lives across from the property owned by Wegmans. They
     have pushed the snow into the road. In front of my house there is just a single lane. Are
     residents allowed to push the snow into the road?

     Mayor Hannon and Director of Services Bennett stated that they had been contacted on Friday,
     as this is a Code issue.

     Julie Deemie – 153 Zoa Ave., JC – Stated that she had noticed a similar issue in front of the
     NYPENN Trade Center.

     Mayor Hannon stated that any resident that has issues should please call, and they will get it
     taken care of.

     Mike Tugwell - 127 Greenridge St., JC – Resolution #46 – Asked what this resolution is for?

     Mayor Hannon stated that the resolution tonight is to set the public hearing for March 2, 2010.

     Cindy Novobilski stated that it is for the Monument company and what they want to do is to add
     an additional expansion to the shop and a garage to the back. She also stated that if you want to
     see a copy of the plan, she would be happy to show you that as well after the meeting.
