Juvenile court intake is a process through which the court reviews information in order to determine whether it has authority to intervene in a child’s life and in what manner it will administer its authority. The components of the intake process are referral to intake, detention screening, and assessment of how to handle the complaint. Referral to intake involves the filing of a complaint by law enforcement, parents, or other individuals or agencies requesting the court exercise its authority. If detention is requested by the complainant, the intake officer performs a detention screening to determine if there is probable cause (legal sufficiency) that the child committed the alleged offense and is subject to detention in accordance with statute. Lastly, an assessment is made to determine if the complaint should be executed, if informal adjustment (a voluntary agreement between the intake officer, the child and the parents) should be pursued, or if a petition should be filed. In most instances if a petition is filed, the case goes into the adjudicatory phase. In this phase the case is heard by the juvenile court judge to determine if the allegations of the petition are true. In making its decision, the court considers only the child’s juvenile court record and the evidence that has been formally admitted. If the allegations are not substantiated or cannot be proven, the petition will be dismissed. In those situations where the allegations are substantiated, the judge will proceed immediately or will set a later hearing to determine the appropriate outcome or disposition for the case. The purpose of the dispositional phase is to determine an appropriate course of action regarding the child and his/her circumstances. Disposition, insofar as possible, typically attempts to meet the treatment, social, and rehabilitation needs of the child. Data Collection Methods The revised Juvenile Court Data Form was designed to collect information about juvenile court activities, and the children and youth served, for the Tennessee Juvenile Court Information System. As required by Tennessee law, all of Tennessee’s 98 juvenile courts participated in data collection. The majority of courts (over 95%) used a data entry software program provided by TJCIS staff or other software and sent data to TJCIS electronically. The remaining non-automated courts sent information on data collection forms. The basic categories of data captured by the revised Juvenile Court Data Form were referral/intake information, judicial action and informal adjustment information, outcome/dispositional information, detention information, and basic demographic information. This form did not capture specific pre-dispositional functions such as ACCT/ICAM pre-dispositional evaluations, JCCO evaluations, sex abuse physical evaluations, etc. Additionally, it did not capture internal, periodic case, CART-Team, or judicial reviews. In 1998 there was a change in the TJCIS reporting format. More detailed referral reasons regarding serious offenses were added to the referral reason codes. Collection of information on up to six referral reasons was reduced to collection of information on up 2 to five referral reasons. There were several other smaller changes. These changes in the format led to a decrease in the reporting of some referrals and referral categories. Archived Data Files The data in the Archived files are stored as numeric characters (which are whole numbers) unless otherwise noted. The records for each case are 206 characters in length and contain 91 variables. The data are stored in single year files. The Archive will contact Tennessee’s Council of Juvenile and Family Court Judges regarding their release. Upon the Office's authorization to release and disseminate the data, the data files will be supplied to the requestor by the Archive with any necessary cautions or restrictions. The Archive provides the data on magnetic tapes AS IS and shall not be held responsible for any liability incurred as a result of any error or omission in the data as it appears on the magnetic tapes. However, should any inconsistencies be found, the Archive asks to be notified so that corrections can be made to the data. Box 1248, Ann Arbor, Michigan. 48106. 3 USING THE CODEBOOK The information that follows is based on a study of available documentation from the data supplier (e.g., Administrative Office of the Courts Coding Manual and Procedures Manual), interviews with the data supplier and court personnel, and diagnostic analyses performed by the Archive staff. The example below is a reproduction of information appearing in the codebook for a typical variable. The numbers in brackets do not appear in the codebook, but are references to the descriptions, which follow this example. If the variable is a year, the symbol ## represents the most current year for which data are available. The textual definitions of the codes. The first 20 characters form a short value label which some systems use to document the output of analysis programs. A longer description follows the short label when necessary. The designation of missing data. The Archive staff has replaced any out-ofbounds codes with missing data codes. Many analysis packages require that certain types of data which are usually excluded from analysis be designated as [7] 4 "missing data". Fields with no entry were left blank and "( ) No entry" is listed as a code value. Some variables also have response options representing "unknown" which are also listed as code values. Complaint substantiated - Status offender-There is a judicial determination that the child committed the status offense(s) alleged in the complaint. Informal adjustment-A non-judicial procedure whereby the juvenile court staff, subject to court approval, make the decision to attempt to remedy the situation alleged in the referral by giving counsel and advice to the parent(s) and child. Pretrial diversion-A procedure similar in nature to an informal adjustment, with no official finding as to guilt, except a judge must approve any agreement.
