A.   That Council issue a Notice of Decision to Grant a Planning Permit P352/08 for Buildings
     and Works (Extension to the Existing Building and Baghouse) at 40-68 Devon Road,
     Devon Meadows, Lots 1 & 2 LP:207442 subject to the following conditions:

     1.    Amended plans to the satisfaction of the Responsible Authority must be submitted
           to and approved by the Responsible Authority. When approved, the plans will be
           endorsed and will then form part of the permit. The plans must be drawn to scale
           with dimensions and three copies must be provided. The plans must be generally
           in accordance with plans prepared by Thomas Anderson, Job No. 08-0116 dated
           October 2008 (Sheets P01 and P02), Issue C but must be modified to show:-

           (a)     Fully dimensioned site plan and elevations, drawn to scale depicting accurate
                   dimensions of the ‘baghouse’ adjacent to the extension.

     2.    The roof structure of the extension (subject of this application) must be enclosed
           in accordance with the endorsed plans within 90 days of the issue of a permit, to
           the satisfaction of the Responsible Authority.

     Endorsed plans

     3.    The layout of the development on the endorsed plans must not be altered without
           the written consent of the Responsible Authority.

     4.    The external appearance of the extension hereby approved must match that of the
           parent building, to the satisfaction of the Responsible Authority.

     Amenity

     5.    Noise emissions from the “extension” area and associated external equipment
           (baghouse) must not exceed those required to be met under State Environmental
           Protection Policy (Control of Noise from Commerce, Industry and Trade), No. N-1.

     6.    The ‘extended’ building and associated external structures (baghouse) must be
           managed to the satisfaction of the Responsible Authority so that the amenity of
           the area is not detrimentally affected, through the:

           (a)   Transport of materials, goods or commodities to or from the extension.
           (b)   Appearance of any buildings, works or materials.
           (c)   Emission of noise, artificial light, vibration, smell, fumes, smoke, vapour,
                 steam, soot, ash, dust, waste water, waste products, grit or oil.
           (d)   Presence of vermin.

     Hours of Operation

     7.    The extended building and associated equipment, including the baghouse shall
           not operate at night time between 10.00pm and 7.00am unless otherwise approved
           in writing by the Responsible Authority.

     Landscaping

     8.    The existing landscaping (ie the “Treed area” around the boundaries of the site)
           shown on the endorsed plans must be maintained to the satisfaction of the
           Responsible Authority and used for no other purpose, including that any dead,
           diseased or damaged plants are to be replaced.

     Stormwater and Waste Management

     9.    Stormwater runoff from the extension hereby approved must not be discharged
           from the site other than by means of an underground pipe drainage discharged to
           an approved outlet, to the satisfaction of the Responsible Authority (Note: the legal
           point of discharge is a water course located near the site’s southwest corner).

     10.   Polluted drainage from the extension hereby approved must not be discharged
           beyond the boundaries of the land, or into a watercourse or easement drain, but
           must be treated and/or absorbed on that lot to the satisfaction of the Responsible
           Authority.

     11.   Appropriate sediment control measures must ensure that the site is adequately
           managed in such a way that no mud, dirt, sand, soil, clay or stones are washed
           into or allowed to enter the stormwater drainage system, to the satisfaction of the
           Responsible Authority.

     Carparking

     12.   No vehicles under the control of the operator of the use hereby permitted, or his
           staff, shall be parked in Devon Road and adequate provision of shall always be
           made for the parking of these vehicles on the land to the satisfaction of the
           Responsible Authority.

     13.     All loading and unloading shall take place within the cartilage of the site.

     Melbourne Water Condition

     14.     No polluted and/or sediment laden runoff is to be discharged directly or indirectly
             into Melbourne Water’s drains or watercourses.

     Permit Expiry

     15.     This permit will expire if one of the following circumstances applies:

             •    The development is not started within two years of the date of this permit.
             •    The development is not completed within four years from the date of this
                  permit.

             The Responsible Authority may extend the periods referred to if a request is made
             in writing before the permit expires, or within three months afterwards.

     NOTES:

     (i)     On completion of works, to enclose the sides of the structure Council’s Planning
             Investigations Officer is to be contacted in order to arrange an inspection of the
             site.

     (ii)    The applicable flood level for the property is 38.75 metres to Australian height
             Datum (AHD)

COUNCILLORS BRADFORD/BALMES:

A.    That Council not support application P419/08 at the Victorian Civil and Administrative
      Tribunal for the Use & Development of a 24 Hour Service Station, 24 Hour Car Wash, 24
      Hour Emergency Service Facility (Ambulance Depot), Convenience Restaurant And Alter
      Access To A Road In A Road Zone Category 1 at 945 South Gippsland Highway
      Cranbourne North, Lots 2 & 3 LP28675 & 4 Huon Park Road, Cranbourne North, Lot 4
      LP28675 on the following grounds:

      1.     The proposed development will adversely impact on the amenity levels of
             surrounding residential properties by increasing noise levels, traffic and light
             spillage.

      2.     The proposed convenience restaurant use is inappropriately located outside of a
             designated activity centre contrary to Clause 12.01-2 of the Casey Planning
             Scheme.

      3.     The proposed development does not comply with Clause 22.09 (Non-Residential
             Uses in Residential Areas Policy) as the intensity of the use will not be in harmony
             with the surrounding residential context.

     4.    Given the site’s frontage prominence, its residential context and the amount of
           proposed hard surface area the layout provides inadequate landscaping
           opportunity for canopy trees and buffer vegetation.

     5.    The proposal does not address the pedestrian safety concerns that it generates at
           the Elizabeth Street and South Gippsland Highway intersection.

B.   That the objectors be notified of Council’s decision.

C.   That VCAT be advised that Amendment C99 to the Casey Planning Scheme was
     gazetted on 5 February 2009 which removed the Development Plan Overlay from the
     subject site and therefore the application should be subject to formal public notice and
     third party appeal rights.

D.   That Council advise the parties that it is supportive in principle of an ambulance depot
     at this location, given the broader community benefit derived, however that the balance
     of the site would need to be developed with uses that are more complementary and
     sympathetic to the residential context.

                   be retained or removed, including planting schedule of all proposed trees,
                   shrubs and ground covers, including botanical names, common names, pot
                   sizes, sizes at maturity, and quantities of each plant.

           (c)   Landscaping and planting within all open areas of the site.

           (d)   Two garden beds established within the front setback and planted to the
                 satisfaction of the Responsible Authority.

           (e)   Planting of a minimum of two medium indigenous canopy tree (minimum two
                 metres at planting) in the front setbacks of Paperback Street, and one small
                 indigenous native canopy tree within the private open space of each
                 dwelling.

           (f)   A minimum of three small canopy trees (minimum two metres at planting)
                 along the driveway.

           (g)   All species selected must be to the satisfaction of the Responsible Authority.
                 All plants must be low maintenance, hardy and drought tolerant, proven to
                 perform in a development of this type.

           (h)   No canopy tree planting is to be undertaken within any easement.

           All species selected must be to the satisfaction of the Responsible Authority.

     3.    The development as shown on the endorsed plans must not be altered without the
           written consent of the Responsible Authority.

     Actions Before Use Commences

     4.    The buildings must not be occupied until the following works have been
           completed to the satisfaction of the Responsible Authority:

           (a)   The premises are connected to reticulated water supply, sewerage, drainage
                 and underground electricity to the requirements of the relevant servicing
                 authority.

           (b)   The car parking and driveway areas have been constructed with coloured
                 (dusted) concrete or asphalt in accordance with the endorsed plan.

           (c)   The development including all landscaping works has been completed
                 generally in accordance with the endorsed plan.

           (d)   Letter boxes and street numbers have been provided to the satisfaction of
                 the Responsible Authority.

           (e)   Internal access lighting provided in accordance with Australian Standards.

           (f)   Front fencing painted in muted colours to match the colours of the dwelling.

     5.    Clotheslines must be provided for each dwelling and must be located to the
           satisfaction of the Responsible Authority so as not to be detrimental to the visual
           amenity of the neighbourhood.

     6.    All pipes, fixtures, fittings and vents servicing any building on the site must be
           concealed in service ducts or otherwise hidden from view to the satisfaction of the
           Responsible Authority.

     Landscaping

     7.    The landscaping shown on the endorsed plans must be maintained to the
           satisfaction of the Responsible Authority and used for no other purpose, including
           that any dead, diseased or damaged plants are to be replaced.

     Waste Management

     8.    Storm water must not be discharged from the site other than by means of an
           underground pipe drain discharged to an approved outlet to the satisfaction of the
           Responsible Authority.

     9.    Polluted drainage must not be discharged beyond the boundaries of the lot from
           which it emanates, or into a watercourse or easement drain, but must be treated
           and/or absorbed on that lot to the satisfaction of the Responsible Authority.

     10.   Appropriate sediment control measures must be undertaken during construction
           to ensure that the development site is adequately managed in such a way that no
           mud, dirt, sand, soil, clay or stones are washed into or allowed to enter the
           stormwater drainage system.

     Vehicle Crossings and Access

     11.   Vehicular crossings must be constructed to the road to suit the proposed driveway
           to the satisfaction of the Responsible Authority and the existing crossing must be
           removed and replaced with footpath, nature strip, and kerb and channel to the
           satisfaction of the Responsible Authority.

     Permit Expiry

     12.   This permit will expire if one of the following circumstances applies:

           •     The development is not started within two years of the date of this permit.
           •     The development is not completed within four years from the date of this
                 permit.

            The Responsible Authority may extend the periods referred to if a request is made
            in writing before the permit expires, or within three months afterwards.

     NOTES:

     (i)    On completion of works, Council’s Investigations Officer is to be contacted in
            order to arrange an inspection of the site.

     (ii)   A permit must be obtained through Council’s Works and Operations Department
            prior to works commencing for the construction of a crossover. Contact 9705 5345
            or 9705 5306.

B.   That the objector be notified of Council’s decision.
