AMENDED NOTICE OF HEARING (CHANGE OF DATES) YOU ARE HEREBY NOTIFIED that a hearing on the above-entitled case will be held before the undersigned Administrative Law Judge at the Charlotte-Mecklenburg Courthouse, 832 East 4th Street, Courtroom 6350 on the 6 th floor in the City of CHARLOTTE, NC on the 15th & 16th day of September 2009 beginning at 9:30 a.m. of each day.
NOTICE: CONTINUANCES WILL BE NOT GRANTED EXCEPT ON WRITTEN MOTION AND FOR COMPELLING AND UNFORESEEABLE GOOD CAUSE SHOWN. IF YOU BELIEVE THAT GOOD CAUSE FOR A CONTINUANCE EXISTS WHEN YOU RECEIVE THIS NOTICE OF HEARING, YOU MUST FILE YOUR MOTION FOR CONTINUANCE WITHIN FIVE (5) DAYS. IF YOU BELIEVE THAT CIRCUMSTANCES CONSTITUTING GOOD CAUSE FOR CONTINUANCE HAS OCCURRED AFTER ISSUANCE OF THE NOTICE OF HEARING, YOU MUST FILE YOUR MOTION FOR A CONTINUANCE IMMEDIATELY. THE FACT THAT OPPOSING COUNSEL HAS NO OBJECTION TO A CONTINUANCE REQUEST WILL NOT, IN THE ABSENCE OF A GOOD CAUSE, PROVIDE A BASIS FOR CONTINUANCE. IN THE EVENT THAT A SETTLEMENT IS REACHED IN THIS CASE, PLEASE NOTIFY THIS OFFICE IMMEDIATELY.
The parties are expected to be present and to present testimony and witnesses, if any, in support of their positions. At the hearing, the parties shall provide a copy of each exhibit for the Judge’s
use at the bench and shall exchange copies of all exhibits they intend to offer into evidence at the hearing. The Board will not provide copies of exhibits to parties after the hearing.
