MINUTES
REGULAR COMMISSION MEETING
Ed Burke Recreation Center – 11400 NE 9th Court
Tuesday, August 8, 2006 – 7:00 p.m.
1. CALL TO ORDER: Mayor Hornbuckle called the meeting to order at 7:15 p.m.
2. PLEDGE OF ALLEGIANCE: Commissioner Anderson led the Pledge of Allegiance.
3. ROLL CALL: In addition to the Mayor, the following Commissioners were present at
roll call: Commissioner Anderson, Commissioner Mallette and Vice Mayor Morris. The
following members of staff were also in attendance: Frank Spence, Village Manager;
Holly Hugdahl, Finance Consultant; Ann Harper, Village Clerk; Tony Sanchez, Police
Captain; Elisa Tankersley, Recreation Director and Joe Fisher-,Public Works Director.
Commissioner Walker was ill and did not attend the meeting.
Attorney John Hearn was not present. Attorney Carolyn Egan attended the meeting.
4. ADDITIONS, DELETIONS OR WITHDRAWALS
Village Clerk Ann Harper requested to add item 9B, authorization to hire custodian.
5. PRESENTATION
Captain Sanchez presented certificates of completion to members of CERT
(Citizens Emergency Response Team).
A. Certificate of Appreciation to residents who participated in CERT training.
Residents Lillian E. Harper, Ann-Marie Jonckheer, Judy Hamelberg and James Murphy
were presented with certificates of completion for their participation in the CERT training.
B. Certificate of Appreciation to Leroy Tillman.
Resident Leroy Tillman was presented with a certificate of appreciation for his
assistance in aiding another resident.
C. Certificate of Appreciation to Sergeant Albert.
Captain Sanchez presented Sergeant Albert a certificate of appreciation in recognition of
her planning and preparation for the National Night Out events.

D. National Night-Out Recognition to Chief Glansberg by Commissioner
Anderson. Commissioner Anderson presented Chief Glansberg with a framed
photo of officers who participated in Night Out.
E. Update on status of SFECC (South Florida East Coast Corridor) study N. Jasmine
Yacinthe, Ph.D. Director of Transportation Planning Gannett Fleming, Inc.
Mayor Hornbuckle stated that this project will impact the Village because of the FEC
border. He urged residents to attend meetings and keep everyone advised on the
progress of the planning.
F. Power point presentation by Captain Sanchez on Natural Disaster Emergency
Operations Plan for Police.
Captain Sanchez noted that since 9/11/01 Police business is not being conducted in the
same way. He added that there must be basic and standard communication. Captain
Sanchez mentioned that the Biscayne Park Emergency Plan is in compliance and he
described the Department’s mission to protect the community.
Mayor Hornbuckle thanked Commissioner Anderson, Police Chief Glansberg and
Captain Sanchez for bringing the Village into compliance.
6. ATTORNEY’S REPORT
Attorney Carolyn Egan represented Village Attorney John Hearn and presented the
Attorney’s report. Attorney Egan said two agreements are before the Commission
relating to the employment of Frank Spence “Letter of Agreement” allowing Mr. Spence
to work as a consultant and the second is the “Interim Village Manager” agreement.
She noted that Mayor Hornbuckle should be authorized to sign both on behalf of the
Village.
Ms. Egan also mentioned that Commissioner Anderson has reviewed both agreements
and found that the salary falls in the line of other managers in the area.
Mayor Hornbuckle reviewed other salaries in the area of El Portal, North Bay Village and
Golden Beach and stated that the salaries fell about the same. The Mayor commented
that as a Consultant Mr. Spence will be making $48.00 per hour as a contracted
employee with no benefits at this time. In September when he becomes Interim City
Manager his salary will be $83,000 annually and will include benefits and the use of a
pool car.
Commissioner Anderson made a motion to approve both agreements, which was
seconded by Commissioner Mallet. The motion carried by voice vote 4/0.
Mayor Hornbuckle said Mr. Spence would provide the professional leadership needed to
lead the Village forward as the first Village Manager. The Mayor then introduced Mr.
Spence.
Mr. Spence thanked the Commission for giving him this new position and said he was
pleased to be back in the Village of Biscayne Park where he was once a resident. He is

familiar with this area having been there for three years and is looking forward to serving
the Commission and the residents.
7. CONSENT AGENDA –
Motion by Vice Mayor Morris, seconded by Commissioner Anderson to approve the
Consent Agenda. The motion carried by voice vote, 4/0.
8. UNFINISHED BUSINESS
Request authorization for Dog Park Committee to seek funding (see backup) –
Vice-Mayor Morris.
Vice-Mayor Morris said he tried to figure the cost of using the waterfront property as a
dog park, an outlined the cost of necessary items which total $15,000. In addition to
these items, there is the additional cost of sod. He suggested that funding for the park
should come through grants and donations from people who want the land used for dog
park. He said there should be beginning and ending dates for the project. He turned the
discussion over to John Ise, Chairman of the Dog Park Committee.
Mr. Ise distributed a report which addressed the concerns raised by Commissioner
Walker in his letter in the agenda backup. Mr. Ise talked about ways of raising funds and
said he would like the site to be an asset to the community.
Commissioner Anderson raised the question of the cost of water for landscaping and
suggested that the Village bear this cost. Public Works Director Joe Fisher advised that
the irrigation is now done through the canal.
Vice Mayor Morris made a motion, seconded by Commissioner Anderson, to authorize
the Dog Park Committee to seek funding for twelve months to complete the project. The
motion carried by voice, 4/0.
B. Discussion and consideration of approving Street Closures – Vice-Mayor
Morris
(1) NE 115th Street and Griffing Boulevard is a county road and will not be discussed this
evening as per Mayor Hornbuckle.
(2) NE 5th Avenue and 121st Street
There were no comments from residents.
Vice Mayor Morris made a motion, seconded by Commissioner Mallette, to approve this
closure subject to concurrence of Public Works and Police and removal of the stop
signs. The motion carried by voice, 4/0.
(3) NE 9th Court one-way between 113th and 115th Streets
There were no comments from the residents.

Motion was made by Vice Mayor Morris, seconded by Commissioner Anderson, to
approve making NE 9th Court one way between 115th and NE 113th streets. The motion
carried by voice vote 4/0.
The following residents addressed the Commission regarding NE 115th Street and
Griffing Blvd.
Michelle Chao, 11400 Griffing Blvd., said this closure affects four houses and the
barricade should be removed.
Commissioner Mallette said she went to these houses and noted that it has not been
proven unsafe; she does not want to inconvenience these residents with the closure.
Motion was made by Commissioner Mallette, seconded by Commissioner Anderson, to
remove the barricades at this location. The motion carried by voice vote, 4/0.
9. NEW BUSINESS
Request approval of Collective Bargaining Agreement between Village of
Biscayne Park and International Union of Painters and Allied Trades District
Council 378 Local 1010 (Supervisory Unit) for one year.
Vice Mayor Morris asked for Commission approval for Public Works to hire a custodian
to replace the one that resigned.
Motion was made by Vice Mayor Morris, seconded by Commissioner Anderson, to
authorize hiring of a Custodian. The motion carried by voice vote 4/0.
Mr. Fisher said that Public Works Supervisors joined a union in March and this
agreement starts in October. Next year the agreement for the Supervisors and the other
workers will be completed and ready for renewal at the same time.
Motion was made by Vice Mayor Morris, seconded by Commissioner Mallette, to accept
the agreement. The motion carried voice vote 4/0.
10. REGULAR BUSINESS
A. COMMITTEE REPORTS
Dan Keys, Chairman of the median Review Committee, asked whether or not the
County had been contacted regarding replacement of trees on Griffing Boulevard. He
was advised that weekly calls are made regarding this issue.

B. COMMISSION REPORTS
1. Mayor
Mayor Hornbuckle apologized for the delay in the newsletter and mentioned that all
columns should be in by August 14.
The Mayor also advised of open positions in planning and zoning and the code board.
The Mayor once again welcomed Mr. Spence and sent his best wishes on a speedy
recovery to Commissioner Walker and Chief Glansberg.
2. Vice-Mayor/Public Works Commissioner
Vice Mayor Morris requested the purchase of a new garbage truck and noted that it is
becoming more expensive to keep repairing the current one. He noted that the
department has been pruning the trees for hurricane season. Vice Mayor Morris also
mentioned that when the final report is in from the Forestry people then we would be
able to purchase some trees. He noted that the special asphalt has been attained to
repair the damage to the road secondary to the hurricanes and shortly we will be
repairing them.
3. Finance Commissioner
Commissioner Mallet on finance thanked everyone for their cooperation on holding
expenses down and barring any unforeseen circumstances end of year reserves are
better than expected.
4. Police Commissioner
Commissioner Anderson commenced discussing the code department violations and
said the department has issued 32 courtesy notices for July. Many residents are
installing generators and all residents need to have a permit.
Commissioner Anderson mentioned that there have been a total of 12 arrests, 229 traffic
citations, 2 parking citations, 29 verbal warnings.
11. ANNOUNCEMENTS: All Public hearings are held at the Ed Burke Recreation
Center – 11400 NE 9th Court, Biscayne Park, FL
1. Commission Meetings in August and September:
Commission Budget Workshop – August 15 at 6 pm

1st Budget Public Hearing – September 12 at 6 pm

Labor Day – Monday September 4 – All Village Departments will be closed
Primary Election Day – Tuesday, September 5 – Precincts will vote in the
Recreation Center
Village Hall will be closed on August 25 and 26 to be tented for termites.
12. Good and Welfare
Hans Laurenceco 770 NE 113 Street
Is running for State Representative and introduced himself to the commission.
James Murphy 941 NE 115 Street
Welcomed Mr. Spence, thanked the Commission for CERT (Citizens Emergency
Response Team) program, and requested more resident participation to complete a full
team, which consists of about 25 people.
Peter Walsh 504 NE 101 Street
Democrat candidate for State Representative for this district and introduced himself to
the commission.
Tim Tierney 11719 NE 11 Street
Just purchased home and has been trying to get an answer from zoning. He wants to
put a pool in at his residence.
Dan Keys 1108 NE 118 Street
Requesting to reconsider the installation of a sidewalk on 9 th court because of the
parking issue and that some might use as a jogging path. Also the fence ordinance
should get some photos and further discuss the process.
Steve Bernard 860 NE 115 Street
FEC is looking at putting a station on 108th which will have a huge impact.
13. Adjournment
Mayor Hornbuckle adjourned the meeting at 9:25 p.m.
