1. Subject of the Agreement
1.1 Palmary LTD shall provide the group of the tourists listed in Paragraph 2 with the touristic services (“services”)
according to the terms and conditions of Paragraph 5 of the present Agreement.

3.2 Visa:
To enter the territory of the European Union countries, the tourists might need Shengen visa. The Shengen visa
should be multiple and be valid within the whole period of the cruise. If you plan to arrive in Barcelona beforehand, till
the 3rd of June, the Shengen visa should be issued in the Embassy of Spain in your city/region. Otherwise the
Shengen visa should be issued in the Embassy of Italy in your city/region (due to the largest number of arrivals in
Italian ports during the cruise).
The multiple Shengen visa shall be opened by the tourist by himself. Palmary LTD shall provide the touristic
voucher and official invitation letter proving the booked services. All other documents necessary to apply for
the visa in the embassy shall be provided by the tourist himself.
Please make sure before the booking of the cruise that you have a possibility to open a multiple Shengen visa for the
cruise.
Hereby I confirm that I will open a multiple Shengen visa in the embassy independently by myself and I bear full
responsibility for meeting all the requirements regarding my documents:

3.3 Insurance:
The medical insurance which is necessary for entering the territory of the European Union shall be bought by the
tourist himself. The tourist can include to the insured accident those risks of his own choice which he considers
obligatory such as: insurance against non-leave, change of the period of stay abroad, baggage loss, accidents, etc. If
the insured accident happens to the tourist during the cruise, he should act according to his insurance policy.
Hereby I, ________________________________ (full name) confirm my refusal from insuring the costs caused by
cancellation of the trip abroad or change of the period of stay abroad. Thereby I fully undertake all the financial risks
which can be caused by the cancellation of my trip abroad or change of the period of stay abroad, including those
caused by non-receipt of the entrance visa to the country of arrival, by abrupt disorder, by property damage or
destruction or any other causes which do not depend on Palmary LTD.

3.4. Transfer:
Meeting in the airport of Barcelona, transfer from the airport to the liner and return are not included into the cost of
the cruise. This service can be booked separately through Palmary and paid as per the current rates.
3.5. Tours and Excursions:
The city tours and excursions in the ports of call are not included into the cost of the cruise. Palmary will prepare the
tour package 1-2 months prior to the cruise which will be paid additionally and optionally.
4. Payment for the cruise:
4.1 Full payment for the cruise:

Cancellation Policy in full payment:
- cancellation of the cruise till March 1, 2011 – 50% penalty
- cancellation of the cruise within the period 01.03.2011 – 01.05.2011 – 75% penalty
- cancellation of the cruise after 01.05.2011 – 100% penalty
- up to 01.04.2011 you can change the name of the traveler without penalty, within the period 01.04.2011 –
01.05.2011 the cost of the name change will be USD 70 provided that the change will be permitted by the cruise
company, otherwise the change of the name in the list of the passengers will be impossible.
Cancellation of the cruise and any other changes thereto shall be accepted from the tourist only in written form
(photocopy of the letter in free form, signed and dated). The date from which the cancellation policy starts, shall be
considered the date of the receipt of the application by the company: the date is fixed in the application, signed and
stamped, and sent to the tourist.

Cancellation Policy in payment by installments:
- in the absence of the second and the third payment within the periods mentioned in the above table, Palmary shall
have the right to cancel the cruise for the tourist, the amount on the cruise account shall not be reimbursed and shall
be considered as the cruise cancellation penalty.

4.3 Payment of the cruise with the certificate of Palmary LTD
Certificate of Palmary LTD is a personal document obtained by a tourist in Palmary marketing program after closing
the Board of Travelers. The certificate is valid within 6 months from the moment of the receipt, after this period it is
impossible to use the certificate.
The Gold Certificate compensates the cost of the cruise at the amount of USD 650. The Silver Certificate – at the
amount of USD 350.
If the tourist cancels the cruise and the term of validity of the certificate is over, the certificate shall not be restored,
reimbursed and/or transferred to another person.
If the tourist wishes to change his name in the cruise for the name of another person, and at this the term of validity
of the certificate is over, the new owner of the place in the cabin shall reimburse the cost of the certificate by cash.
5. Terms and Conditions:
5.1 The company shall execute the request of the client and provide all necessary documents of the cruise booking.
Palmary LTD shall do its best to fulfill its obligations in booking services.
5.2 The client shall provide all necessary documents for providing touristic services as well as true personal
information. The client shall be obliged to pay the cruise cost according to Paragraph 4 and chosen category of the
cabin and the conditions of the payment.
5.3 The client is informed that the cost of the cruise is indicated for 1 place in a double cabin. It means that the
company shall have the right to accommodate the client in one cabin with another client. Or the client shall be obliged
to include into his agreement the data of the second client who will be accommodated with him in one double cabin.
5.4 The cost of the cruise includes:
Accommodation in the cabin of the chosen category
Meals: Full Board including breakfast, lunch, dinner, afternoon snack, pizzas and snacks, dinner and supper.
Port fees
Government taxes
Use of the swimming pools, deck chairs and armchairs, fitness center, Jacuzzi, night club, sauna, beach
towels, library.

Participation in social events: games, quizzes, tournaments, karaoke, dance club, theme events.
Live music, show, cabaret theatre, parties according to the program.
Main restaurant and buffet with soft drinks.
Official invitation letter and touristic voucher for applying for multiple Shengen visa in the embassy
The cost of the cruise does not include:
Club Restaurants a la carte on board
City tours and excursions in the ports of call
Personal services (beauty salon, SPA services, purchases in shops, laundry services, telephone calls, Internet
etc.)
Alcohol drinks on board
Drinks in bars (alcohol and non-alcohol)
Tips at the amount of USD 90 per person (shall be withdrawn from the deposit on board)
Mini bar in the cabin
The cruise company has the right to impose Fuel Fee if the price for oil of light sweet brand exceeds 70$ per
barrel on the NYMEX New York Exchange.
To be paid additionally:
Air tickets to Barcelona
Transfer from the airport to the liner and return
Consular fees for issuing Shengen visa in the embassy
Insurance
The cruise company shall have the right to increase the price for the cruise due to objective reasons such as:
- abrupt change of the exchange rate, by more than 5%
- imposition of new or increase of the current taxes, fees and any other compulsory payments
5.5 The cost of the single occupancy in a cabin shall be considered as 200%, i.e. the double cost for 1 adult in a
double cabin.
The cost of the additional third and the fourth place in a cabin shall be USD 800 approximately. This cost can increase
or decrease insignificantly, depending on the category of the cabin. Three-places and four-places cabins are booked in
two ways:
1. At primary booking of the cabin the client specifies at once the number of the tourists to be accommodated in
one cabin, their names, and makes full payment for additional places in the cabin and prepayment (or full
payment, optionally) for two main places. Further change of the number of the tourists in the cabin shall be
the cancellation of the cruise (for all the passengers in the cabin!) and entails all the conditions of the cruise
cancellation. The final cost of the additional place is determined by the cruise company before booking of the
cabin.
2. The client first books a cabin for two people, and after the full payment for the 2 people in the cabin the client
can send an application to the company about addition of the third and the fourth places in his cabin. If the
cruise company has the possibility to provide a cabin with necessary number of places, the final cost will be
determined and paid by the client in full. Further change of the number of the tourists in the cabin shall be
the cancellation of the cruise (for all the passengers in the cabin!) and entails all the conditions of the cruise
cancellation.
5.6 The company shall guarantee the provision of the cabins according to the category but not according to the
concrete placement in the liner. The numbers of the cabins will be given by the cruise company on the date of
embarkation.
5.7 The company shall not be responsible to the client in case of impossibility of fulfillment of the taken obligations if
the client provided false personal information, failed to submit the application or documents for applying for the
entrance visa to EU country, in case of non-receipt of the entrance visa in the embassy, in case of refusal by frontier
and customs authorities to permit the client to cross the frontier, in case of breach of the laws of the country of stay.
5.8 The company shall not bear any responsibility if for security or reasonability purposes the captain of the liner
takes the decision to change the course, to miss a port of stop, to change the time of stop, to transport the tourist
and his baggage to another ship, to refuse to disembark and in other similar cases.
5.9. The company shall not be responsible to the client in case of the change of time of departure and/or arrival of
the flight, cancellation of the flight, regardless of the reasons. In this case it is the air company which shall be
responsible under the conditions of the air ticket purchase.
5.10. The company shall not be responsible to the client if he was late for the registration and check-in to the board

of the liner in the port of Barcelona, if he missed the time of the liner departure in the port of call and was left on
shore, regardless of the reasons. All the costs for returning to the board of the liner or returning the baggage to the
board of the liner shall be incurred by the client.
5.11. The client shall be obliged to purchase insurance policy by himself, and carry always with him his passport,
insurance policy, the route of the cruise, telephones and addresses of the embassies, at disembarkation in a port.
5.12. The company shall be exempted from liability for full or partial non-fulfillment of its obligations under the
present agreement if such non-fulfillment is caused by force-majeure circumstances, earthquakes, floods, fires,
typhoons, volcanic explosions, military actions, general strikes, decisions of state bodies, as well as restrictions in
transportations or trade prohibitions between countries as a result of application of international sanctions or other
force-majeure events.
5.13. Palmary LTD officially cooperates with authorized representative of Carnival Magic cruise company, Atlantis Line
Sea Cruises, on the basis of Agency Agreement №80159 on realization of sea cruises. A successful many-years
practice of Atlantis Line Sea Cruises allows our company, Palmary LTD, to efficiently solve any issues relating to the
cruise bookings for our clients who can be sure in the quality and availability of the provided services.
5.14. After the full payment of the cruise cost the client receives by e-mail the documents confirming the booking of
the cruise (photocopies): accommodation voucher and invitation letter from Atlantis Line Sea Cruises for further
submission to the embassy and before the embarkation.
5.15. The present agreement on 6 pages signed between the Company and the Client, being a photocopy of the
original agreement, shall have the same legal force as the original agreement. The true agreement shall be that one
placed on the official website of the company www.palmarytravel.com in the Carnival Magic Cruise section.
Unauthorized changes in the agreement which do not conform to the official wording, shall be considered invalid.
