                                          July 13, 2010

Minutes of a Meeting of the Town Board of the Town of Eastchester held on July 13, 2010 at 8:00 p.m., at
the Town Hall, Eastchester, New York.

   I.            CALL TO ORDER

Supervisor Colavita recognized newly elected County Legislator Sheila Marcotte and thanked her for her
years of service as a “dutiful and exceptional Town Board Member.”

Mrs. Marcotte congratulated the Town Board on the appointment of Luigi Marcoccia to fill the Town Board
vacancy. Mrs. Marcotte called Mr. Marcoccia a “fine asset to the community,‟ having worked with him in
the Village of Tuckahoe.

Mrs. Marcotte thanked the Town staff and the Town Board for working so well together for the past 7
years. In closing, Mrs. Marcotte thanked the voters for their support and promised to work hard in
representing the Town on the Westchester County Board of Legislature.

    IV.       APPOINTMENTS

              A) APPOINTMENT – TOWN COUNCIL

Supervisor Colavita offered a motion that was seconded unanimously by Councilwoman Ford,
Councilman Cahalin and Councilman Salanitro to appoint Luigi Marcoccia to the position of Town
Councilman effective July 13, 2010 – December 31, 2010.

Supervisor Colavita stated Mr. Marcoccia has a solid record of service to the Tuckahoe community having
served on the Zoning Board of Appeals and the Tuckahoe Village Board.

On the roll call, all voted "AYE." Motion carried.

Judge Porco administered the Oath of Office to Councilman Marcoccia.

Councilman Marcoccia thanked Supervisor Colavita and the Town Board for their confidence and stated
he looked forward to working together. He pledged to bring over 2 years of Zoning Board and nearly 8
years of Village Board experience to his new position on the Town Board. Mr. Marcoccia thanked his
family and friends for their attendance at the meeting and their support.

In closing, Councilman Marcoccia congratulated Sheila Marcotte and stated he looked forward to
continuing to work together.

             B) APPOINTMENT – POLICE SERGEANT

Supervisor Colavita reviewed a memo in which Police Chief Tim Bonci requests the probationary
appointment of Police Officer Luke Yankowski of Eastchester, New York to the position of Police
Sergeant. Officer Yankowski has been on the force since August 16, 1999.

He will be assigned to the Patrol Division. This assignment will be effective starting July 23, 2010.

Police Officer Yankowski‟s name appears on the eligible list #75-819 established August 6, 2009. As
provided in the Westchester County Civil Service Rules, it is necessary for him to serve a probationary
period of a minimum of twelve weeks to a maximum of fifty-two weeks.

Councilman Cahalin offered a motion that was seconded by Councilwoman Ford to approve a Resolution
to appoint P.O. Luke Yankowski to the position of Police Sergeant effective July 23, 2010 at the annual
salary of $98,707.

On the roll call, all voted "AYE." Motion carried.

Sgt. Yankowski thanked Chief Bonci and the Town Board for their support and stated he „would not let
anyone down.‟ Further, he thanked family members, friends and fellow Police Officers in attendance for
their encouragement and support.

    V.       SPECIAL PRESENTATION

Miriam “Bunny” Rappaport, Director of the Eastchester Youth Council Summer Theater introduced the

cast and crew of the 2010 production, “The Music Man.” The program is entering its 26 year of providing
a summer theater program to the youth, ages 13-22 who reside in Eastchester, Tuckahoe and Bronxville.

The „dinner-theatre‟ performances will be held at Lake Isle on August 6 , 7 and 8 .

    VI.      PUBLIC HEARING

             A) PUBLIC HEARING TO CONSIDER THE ADOPTION OF LOCAL LAW 2-2010
             ELECTING A RETIREMENT INCENTIVE PROGRAM AS AUTHORIZED BY CHAPTER 105
             LAWS OF 2010 FOR THE ELIGIBLE EMPLOYEES WHO HAVE THE TITLE OF
             ASSESSOR

Councilman Cahalin offered a motion that was seconded by Councilwoman Ford to open the Public
Hearing. The Affidavit of Publication had been received.

On the roll call, all voted "AYE." Motion carried.

Fred Moses stated he was sad to see Rich O‟Donnell leave the Town as he is “an incredible public
servant.”

Peter DeFelice clarified the only position effected by the Local Law is the Assessor. He wished Mr.
O‟Donnell well.

There being no further public comment, Supervisor Colavita offered a motion that was seconded by
Councilman Cahalin to close the Public Hearing.

On the roll call, all voted "AYE." Motion carried.

Councilwoman Ford offered a motion that was seconded by Councilman Cahalin to Adopt Local Law 2-
2010.

On the roll call, all voted "AYE." Motion carried.

    VII.    OPPORTUNITY TO ADDRESS THE BOARD ON AGENDA ITEMS

Steve Ecklond, Tuckahoe Village Trustee, called Luigi Marcoccia‟s appointment the “absolute best
choice” for the Town Board vacancy. Mr. Ecklond cited Councilman Marcoccia past experience on the
Village Board and his professional experience in Finance as reasons why he will be an asset to the Town
Board.

Fred Moses wished Councilman Marcoccia best wishes in serving all the residents of Eastchester,
Tuckahoe and Bronxville.

Peter DeFelice inquired about the July 8 Special Town Board Meeting. Supervisor Colavita responded
the Meeting had been properly noticed and had been held in order to interview potential Police Officer
and Police Sergeant Candidates.

    VIII.   APPROVAL OF MINUTES

            A) APPROVAL OF MINUTES OF THE JUNE 1, 2010 TOWN BOARD MEETING, THE JUNE
            15, 2010 TOWN BOARD MEETING AND THE JULY 8, 2010 SPECIAL TOWN BOARD
            MEETING

Supervisor Colavita offered a motion that was seconded by Councilman Salanitro to approve the Minutes
of the June 1, 2010 Town Board Meeting, the June 15, 2010 Town Board Meeting and the July 8, 2010
Special Town Board Meeting as prepared by Town Clerk Linda Doherty.

On the roll call, all voted "AYE,” except Councilman Marcoccia who “ABSTAINED” from voting on
the Minutes and Councilwoman Ford who “ABSTAINED" from voting on the approval of the July

8 Special Meeting. Motion carried.

    IX.     REPORTS OF DEPARTMENTS, BOARDS AND COMMISSIONS

            A) POLICE DEPARTMENT REPORT

The Board reviewed and approved for filing reports for June 2010: Parking Summonses, Citation Activity
Report, Patrol Activity Report and the Traffic Accident Report.

Police Chief Bonci wished Sheila Marcotte best wishes as she serves as County Legislator. In addition,
Chief Bonci welcomed Councilman Marcoccia and stated his door is always open.

            2. RESOLUTION AUTHORIZING THE SETTLEMENT OF A CLAIM BY MARGARET
               TELESCO

Supervisor Colavita offered a motion that was seconded by Councilman Cahalin to approve a
RESOLUTION authorizing the settlement of a claim by Margaret Telesco against the Town of Eastchester
in the sum of $509.34 for damages sustained to Mrs. Telesco‟s vehicle when a Town of Eastchester
Highway Department employee accidentally struck it with a refuse container on January 11, 2010.

On the roll call, all voted "AYE." Motion carried.

            3. RESOLUTION AUTHORIZING THE SETTLEMENT OF A CLAIM BY DENNIS P. WOOL

Supervisor Colavita offered a motion that was seconded by Councilman Cahalin to approve a
RESOLUTION authorizing the settlement of a claim by Dennis P. Wool against the Town of Eastchester
in the sum of $1,652.19 for damages sustained to Mr. Wool‟s vehicles when a Town of Eastchester
Highway Department employee accidentally struck them with a refuse container on April 22, 2010.

On the roll call, all voted "AYE." Motion carried.

            4. RESOLUTION AUTHORIZING THE SETTLEMENT OF A CLAIM BY HENRIQUETA
               CIPRIANO

Supervisor Colavita offered a motion that was seconded by Councilman Cahalin to approve a
RESOLUTION authorizing the settlement of a claim by Henriqueta Cipriano against the Town of
Eastchester in the sum of $3,155.75 for damages sustained to Mrs. Cipriano‟s vehicle when a Town of
Eastchester Highway Department vehicle accidentally struck it on June 16, 2010.

On the roll call, all voted "AYE." Motion carried.

            5. RESOLUTION AUTHORIZING THE SETTLEMENT OF A CLAIM BY MARY SWIKATA

Supervisor Colavita offered a motion that was seconded by Councilman Cahalin to approve a
RESOLUTION authorizing the settlement of a claim by Mary Swikata against the Town of Eastchester in
the sum of $3,472.39 for damages sustained to Mrs. Swikata‟s vehicle when a Town of Eastchester
Highway Department vehicle accidentally struck it on June 25, 2010.

On the roll call, all voted "AYE." Motion carried.

              6. RESOLUTION AUTHORIZING THE SETTLEMENT OF A CERTIORARI PROCEEDING
                 BY SPEAR CIRCLE PROPERTIES, INC.

Councilman Cahalin offered a motion that was seconded by Councilman Salanitro to approve a
RESOLUTION authorizing the settlement of a certiorari proceeding instituted by Spear Circle Properties,
Inc. affecting premises known as Section 28, Block 5, Lot 63 – 40 Terrace Avenue, Tuckahoe as follows:

              C) HIGHWAY DEPARTMENT REPORT

Superintendent of Highway DiLeo reported the work under the 2010 Sidewalk and Curb Project and the
2010 Street Resurfacing Project commenced during June.

Crews raised & repaired curbs as necessary at various locations to eliminate erosion and water runoff
onto the Town roadway.

With this extremely dry weather flowers planted in baskets and parklets are watered daily. Manpower
was assigned to weed parklet areas, entry sign gardens and to clean parking lots.

Crews also continued to fill potholes on an as needed basis and continued to rebuild eroded catch basins.

Councilwoman Ford suggested Highway Department drivers participate in Defensive Driver Training to
help prevent further accidents. Mr. DiLeo admitted training conducted in the past had proven helpful.

              D) BUILDING DEPARTMENT REPORT for June 2010 was received and filed.

              E) RECEIVER OF TAXES REPORT for June 2010 was received and filed.

              F) TOWN CLERK’S REPORT for May 2010 was received and filed.

            C) MEMORANDUM FROM COMPTROLLER RE: NYS RETIREMENT SYSTEM
            REQUIREMENT

Supervisor Colavita reviewed a memo prepared by Comptroller Jones regarding a regulation recently
adopted by the NYS Retirement System which more clearly defines the process for reporting time worked
by elected and appointed officials. The new regulation adds additional requirements for both employers
and elected and appointed officials including an expanded record of work-related activities and a more
detailed standard work day resolution.

The new regulation applies to all elected and appointed officials who are members of the Retirement
System and do not participate in an employer's time keeping system that shows hours worked. (This
includes systems that keep track of accruals used and attest that, other than time charged to accruals, full
hours were worked.)

The new regulation applies to new terms of office or appointments beginning on or after August 12, 2009.
The first time these new requirements will affect currently serving elected or appointed officials is the start
of the term after their next election or appointment to office.

                            Standard Work Day and Reporting Resolution

Supervisor Colavita offered a motion that was seconded by Councilwoman Ford to approve the following
RESOLUTION:
BE IT RESOLVED, that the Town of Eastchester hereby establishes the following as standard work days
for elected and appointed officials and will report the following days worked to the New York State and
Local Employees’ Retirement System based on the record of activities maintained and submitted by these
officials to the clerk of this body:

   Supervisor Colavita explained due to the severity of the 2009/2010 winter season the estimated
   expenditure for snow and ice agreement between the Town and NYS Department of Transportation is
   being amended to reflect additional plowing of state roadways.

   Councilman Salanitro offered a motion that was seconded by Councilman Cahalin to approve a
   RESOLUTION to approve and execute Amendment B, to revise the Estimated Expenditure of Municipal
   Snow and Ice Agreement for the 2009/2010 snow season.

            E) MEMORANDUM FROM SUPERINTENDENT OF HIGHWAYS RE: PERMISSION TO
            BID – DRAINAGE IMPROVEMENT PROJECT-HIGHWAY DEPARTMENT YARD

Councilman Salanitro offered a motion that was seconded by Councilman Cahalin to approve a
RESOLUTION to authorize the Highway Department to go out to bid for the Drainage Improvements at
the Highway Yard.

Funding in the amount of $194,550 has been allotted for the project in which $169,550 will be reimbursed
to the Town through a National Fish and Wildlife Grant.

            FRONT WHEEL LOADER

On Tuesday, June 8, 2010, at 11:15 a.m. three bids were received and read aloud in the Office of the
Town Clerk for a 2010 model, Front Wheel Loader with Trade in options. The breakdown is as follows:

Therefore, at this time I am recommending that the contract for the delivery of one 2010 Front Wheel
Loader as per the contract specifications, be awarded to Edward Ehrbar, Incorporated for the total bid
amount of $95,700, with trade in options.

            G) MEMORANDUM FROM LIBRARY DIRECTOR RE: PERMISSION TO BID – HVAC
            REPLACEMENT BID

Per a request from Tracy Wright, Library Director, Councilwoman Ford offered a motion that was
seconded by Councilman Salanitro to approve a RESOLUTION to authorize the Library to go to bid for
the replacement of the HVAC System.

            H) MEMORANDUM FROM DIRECTOR OF SENIOR PROGRAMS AND SERVICES RE:
            APPROVAL OF CONTRACTS BETWEEN TOWN OF EASTCHESTER AND
            WESTCHESTER COUNTY DEPARTMENT OF SENIOR PROGRAMS AND SERVICES -
            APRIL 1, 2010 – MARCH 31, 2011

Supervisor Colavita offered a motion that was seconded by Councilman Marcoccia to approve the
Contracts between the Town and the Westchester County Department of Senior Programs and Services
for CSE Program Year April 1, 2010 through March 31, 2011 in the amount of $29,860.

LATE FLYING ITEM

Supervisor Colavita asked that the Town Board adjourn into Executive Session for the purposes of
discussing a personnel matter. The Supervisor stated no action would be taken during the Executive
Session and announced the Town Board would be returning to complete the rest of the Meeting.

Councilwoman Ford offered a motion that was seconded by Councilman Cahalin to adjourn into
Executive Session for purposes of discussing a personnel matter.

On the roll call, all voted "AYE." Motion carried.

The Town Board was joined by Police Chief Bonci, Town Attorney Reda and Comptroller Jones to
discuss a personnel matter in Executive Session.

Councilman Cahalin offered a motion that was seconded by Councilwoman Ford to move out of
Executive Session and return to the Regular Town Board Meeting.

On the roll call, all voted "AYE." Motion carried.

Councilman Cahalin offered a motion that was seconded by Councilwoman Ford to approve a
RESOLUTION: Whereas the Town Board has reviewed and considered a memorandum dated July 13,
2010 presented by Chief Timothy Bonci and the information contained within. Now therefore be it
resolved that Police Officer Ramon Rosado shall be placed immediately on a suspension without pay
status in accordance with the memorandum.

    XI.     MISCELLANEOUS BUSINESS - none

    XII.    COUNCIL MEMBER REPORTS

Councilwoman Ford reminded the public the Library is offering a film series on Tuesday and Friday
afternoons at 1pm during the summer months. In addition, the Friends of the Library Book Sale is held
on Tuesday, Thursday and Fridays from 11-3.

Councilman Cahalin reported the heat of the summer has increased usage of the pool at Lake Isle. Mr.

Cahalin reported the 30 Anniversary Celebration at Lake Isle had been a great success.

Councilman Salanitro congratulated former Councilwoman Sheila Marcotte on her election to the
Westchester County Board of Legislators. Mr. Salanitro stated Mrs. Marcotte will be a „great asset‟ to the
entire county. Further, Councilman Salanitro welcomed Councilman Marcoccia to the Town Board.

Councilman Marcoccia reported the negotiations are continuing between the local municipalities and
United Water regarding the proposed rate increase. A Public Hearing will be scheduled in early August in
New Rochelle to provide residents with the opportunity to voice their concerns regarding the rate
increases. Mr. Marcoccia encouraged residents to get involved and to voice their opposition to the
proposed increase.

In closing, Councilman Marcoccia asked residents to contact him via Town Hall with any concerns or
questions.

Supervisor Colavita explained the temporary installation of generators on White Plains Road at Stewart
Place and north of Brook Street. Con Edison has placed temporary generators along White Plains from
Eastchester to White Plains to provide power as system repairs are completed. A large fire in the White
Plains business district caused significant damage. Repairs are to be completed within the next weeks.

Supervisor Colavita reported new playground equipment is being installed at the Garth Road Playground
over the next week. In addition, netting will be installed between the baseball field and the playground to
prevent balls from entering the playground area from the field.

Supervisor Colavita emphasized the fact that „bike lanes‟ have not been installed on California Road. The
painted bike stencils are meant to direct bikers, not provide a lane.

As a follow-up to action taken by the Town Board at the June 1 Town Board Meeting, the refinancing of
$2.6 million has been completed. The new rate obtained by the Town is .98% further contributes to the
sound financial health of the Town.

The installation of a security system in the Court will be completed over the coming weeks and will include
a metal detection device.

    XIII.   SECOND OPPOPRTUNITY TO ADDRESS THE BOARD

Andy Benejam spoke on behalf of the residents of Oakridge Place regarding the increase in B-Line Bus
traffic and idling in their neighborhood. Supervisor Colavita responded that he had contacted officials at
bus line and was told the idling would stop. The Supervisor indicated that the Town would continue to
work with residents to resolve their concerns.

Fred Moses stated the Summer Theatre program is a „demonstration of how wonderful it is to live in
Eastchester.‟ Further, Mr. Moses expressed concern at the level of property taxes imposed on residents
by the County, School District, Fire District and Town.

Tom Andruss suggested the microphones and/or sound equipment be serviced as the replay of the Town
Board Meetings on cable is difficult to hear.

Further, Mr. Andruss inquired about the proposed traffic signal at Swift Avenue and White Plains Road.
Supervisor Colavita responded the Town has received the necessary approval from the NYS DOT to
install the light. Before starting the project, a review is being made by the manager of the Lord & Taylor
property. They are considering the steps necessary and the approvals required to realign the parking lot
entrance/exit.

Mike Coolidge inquired where residents should report damage caused by sanitation trucks. Supervisor
Colavita responded the Law Department reviews all claims.
