We practice regularly in the Mid-Hudson Valley with a particular emphasis on Dutchess, Westchester, Rockland, Putnam, Orange, Columbia, Greene, Ulster and Sullivan counties and to a lesser extent, New York City and the Albany area. We also appear with regularity in the Federal Courts of the Southern District and the Northern District of New York. We routinely handle direct defense assignments from Amica Mutual Insurance Company, Eastern Mutual Insurance Company, Tower Risk Management, New York Central Mutual Fire Insurance Company, Sterling Insurance Company, Trident Insurance Services (Argonaut Insurance), Community Mutual Insurance Company, New York Municipal Insurance Reciprocal (NYMIR) and USAA. In addition, we defend liability claims filed against Central Hudson Gas & Electric Corporation (our area’s major utility). We also represent the City of Poughkeepsie, Dutchess County and the City of Newburgh in the defense of general municipal claims as well as their police and public officials including employment and civil rights claims. We also have and are handling matters for Hertz Claim Management involving accidents with rental cars. In addition to these direct dealings with insurance carriers we work closely with many third-party administrators such as Gallagher Bassett, Crawford & Company, Vericlaims, Inc. and accept defense assignments on behalf of their varied clients. David L. Posner, born July 21, 1949. Graduated New York University School of Law, Cum Laude, 1975; admitted State and Federal Courts, Court of Appeals, Second and Third Circuit, and United States Supreme Court; member of American Bar Association, New York State Bar Association, New York State Trial Lawyers Association and American Board of Trial Advocates. David has been designated as a Super Lawyer by Super Lawyers Magazine since 2007. Page 2 He joined McCabe & Mack in 1980 and became a partner in its litigation department in 1985. He handles defense of personal injury and civil rights litigation as well as appeals in state and in federal court. He has conducted trials in all the courts in which the office regularly appears including automobile negligence, products liability, Labor Law, civil rights and police liability. He handles the complete scope of all insurance defense files and also works extensively defending municipalities on general negligence and civil rights claims in state and federal courts. Scott D. Bergin, born April 13, 1960. Graduated Albany Law School of Union University 1985. He was admitted to the Connecticut Bar in December 1985, New York State Bar in January 1986, U.S. District Court, Southern, Eastern and Northern Districts, 1986. He is a member of the Connecticut Bar Association, New York State Bar Association, Dutchess County Bar Association, New York State Trial Lawyers Association and The Association of Defense Trial Attorneys. He joined McCabe & Mack in August of 1985 and became a partner in July 1991 in its litigation department. He has taken numerous verdicts in a variety of State Supreme Courts. He has also handled appeals in both State and Federal Courts. Matthew V. Mirabile, born May 1, 1967. While attending law school, Mr. Mirabile interned with the office of the District Attorney of Orange County as an appeals clerk writing appellate briefs. Prior to joining McCabe & Mack in July of 1996, Mr. Mirabile worked as an associate with the law firm of Larkin & Axelrod, P.C. in Newburgh, New York. Since joining McCabe & Mack, Mr. Mirabile has taken numerous verdicts in State Supreme Court in the defense of municipal liability and bodily injury claims in automobile and premises liability actions. Matt routinely defends arbitrations administered by the American Arbitration Association and prosecutes subrogation actions on behalf of our carriers. He became a partner in January, 2004. Kimberly Hunt Lee, born August 10, 1975. Ian C. Lindars, born July 15, 1977. Graduated Boston University 1999; graduated Albany Law School of Union University 2004.
