I spoke to Peter Bretherton at BC Assessment and here is what he had to say:

1. The issue of short-term vacation rentals is a nightmare as there is insufficient legislation to cover them
properly. The government has intended to change the legislation but are having trouble determining how to write
it so it works.

2. The Assessment Regulations (BC Reg 438/81) set the classifications that BC Assessment use. Class 1 is
residential and allows bed and breakfast rentals rented for less than 7 days. But to maintain this classification, the
property would have to be the principal residence of the landowner (same as the home occupation
requirements) and used as a B+B for at less than 50 percent of the 12 month period ending Oct 31. Tourist
accommodation that does not meet this requirement is in Class 6 - commercial classification.

3. Generally, there isn't a suitable classification for short-term vacation rentals and BC Assessment would have to
deal with each one individually to assess wether it fits in Class 1 or not (if not, by default it is in Class 6).

4. Peter suggested we write the permits so the temporary use can easily be fitted into one of the classifications. I
think we could do that if this becomes an issue, but it is ultimately up to BC Assessment to make the
determination (under s.10 of the reg).

I've attached BC Reg 438/81 for you if you're interested. Look at Class 1 in particular. B+Bs are covered under 1
(a)(iv).
