RENTAL PARTNERSHIP PROGRAM (RPP) AGREEMENT BETWEEN COMMANDER, U.S. NAVAL FORCES JAPAN AND ______________________, CO., LTD.
在日米海軍司令官と_______________間に締結された賃貸住宅プログラム同意書
This Agreement is entered into this ____ day of ________ 2006 by and between _____________ (hereinafter the “Landlord”) and the Commander, U.S. Naval Forces Japan (hereinafter the “ Installation”).
本同意書は、この（日付上記英文参照）において、__________株式会社（以下家主）と在日米海 軍司令官（以下在日米海軍）との間に締結された。
WITNESSETH:

WHEREAS, the Landlord owns, or has agency over, certain residential housing in the Yokosuka, Japan area, which are held for the purpose of rental to the general public, and further described in Exhibit “A” attached hereto and made a part hereof.
家主は、又は, 不動産業者を介し、一般に賃貸住宅を目的として所有され、更にここに添付、又 は、一部添えられた書面 “Ａ”に記述された、日本の横須賀地域の住居用物件を有するものである。
WHEREAS, the Installation has a requirement for additional off-base residential housing for Department of Defense (DoD) employees assigned to or attached for duty in the Yokosuka area.
在日米海軍は、横須賀地域において勤務し、又は、所属する軍関係勤務者たちに対し、追加賃貸 住宅の必要性を有している。
WHEREAS, it is to the mutual benefit of the Landlord and the Installation that the Landlord’s aforementioned off-base residential housing units be offered to DoD employees at the agreed rental rate as outlined in Appendix (A) to be paid by those DoD employees who volunteer to participate in the Rental Partnership Program (hereinafter the “RPP”).
付記（Ａ）に予め定められた家賃を、在日米海軍の賃貸住宅プログラム（以下プログラム）に参 加希望している軍関係勤務者たちによって支払われ、家主の前述の民間住宅が提供されるのは、家主、 又は、在日米海軍の相互利潤である。
NOW THEREFORE, in consideration of the mutual benefits accruing to both parties hereto, the Landlord and the Installation agree as follows:
従って、両当事者におよぶ相互利潤をかんがみ、家主と在日米海軍は、以下のとおり同意する。

AGREEMENT
同意書
1. This Agreement shall be effective as of the date first written above, and shall continue until either the Landlord or the Installation terminate it by giving the other party at least thirty (30) days advance written notification.
１．本同意書は、上記期日をもって効力を発し、家主、又は、在日米海軍のいずれかにより、少 なくとも３０日の事前書面通知によって解除されるまで有効とする。
2. The term “DoD employees” as used herein is understood to include: all SoFAsponsored government employees – both military and civilian – and their family members, assigned to or attached for duty in the Yokosuka area.
２．“軍関係勤務者”というこの同意書で使われている用語は、次のものたちを含むものと理解 される： 横須賀地域に勤務を命じられたり、勤務している総ての日米地位協定上の従業員 －軍人、軍 属、それらすべての家族。
3. The Landlord is responsible for any and all costs incurred by the Landlord to offer offbase residential housing for lease under the RPP.
３．家主は、本プログラムのもとで提供される費用は、すべて家主の責任であるものとする。
4. The Landlord agrees to incorporate by reference the terms of this Agreement into every subsequent lease executed under the RPP and, in the event of a conflict between the terms of this Agreement and a subsequent lease, the terms of this Agreement shall take precedence. Further, none of the terms of this Agreement are intended to affect leases executed by the Landlord and DoD employees prior to the date of this Agreement.
４．家主は、本同意書のもとで行使されるいかなる契約にも本同意書に含まれる条項をとり入れ ることに同意する。 それら条項は、契約書内の矛盾するいかなる条項をも優先するものとする。 さらに、 この同意書のいかなる条項をも、この同意書の日付以前に軍関係勤務者との間に締結された契約書に影 響を与えるものではない。
5. Any lease entered into under the RPP after the date of this Agreement shall remain in full force and effect for the full term of the lease even if this Agreement is terminated by either party.
５．本同意書の日付以降に締結されたいかなる契約書も、当事者いずれかよりの本同意書の解除 があった場合にかかわらず、契約期間満了まで有効存続する。
6. During the term of this Agreement, the Landlord agrees to offer available off-base residential housing for lease to DoD employees under the RPP, with rent to be paid by the lessee in accordance with the terms of his/her lease. Only DoD employees with at least one year left on their tour will be eligible to participate in the RPP.

６．本同意書の期間中、家主は、契約書に沿って借家人より支払われる家賃で、当軍関係勤務者 へ空き民間住宅を賃貸用に提供することに同意する。赴任期間が最低でも１年を有する軍関係勤務者の み、本プログラムに参加資格あるものとする。
7. The Landlord agrees that the monthly rental rates for DoD employees shall include all amenities and services normally provided at no extra charge to residents of the same complex who are not DoD employees. The Landlord also agrees that the monthly rental rates for DoD employees shall include, at a minimum, the following appliances/furnishings which must meet or exceed the specifications indicated. The appliances/furnishings include, but are not limited to, refrigerator, microwave oven, stove, washer, dryer, dishwasher, garbage disposal, toaster, coffee maker, TV, air conditioners, heaters, smoke detectors, carbon monoxide detectors, safe, iron, ironing board, tableware, utensils, bed, living room and dining room sets, and a desk and chair. The specific requirements are provided as below:
７．家主は、軍関係勤務者に請求される家賃の額には、総ての電化製品、設備 やサービスなど の家主より同じ建物内に通常供給されるものを含むものとする。家主は、さらに、軍関係勤務者に対す る家賃には、少なくとも、明示された仕様同等またはそれ以上の以下の電化製品・家具類を含むものと する。 電化製品及び家具類は以下を含むがそれらにとどまらない: 冷蔵庫、電子レンジ、オーブン、洗濯 機、乾燥機、食器洗い機、ディスポーザー、トースター、コーヒーメーカー、テレビ、エアコン、ヒー ター、煙感知器、１酸化炭素感知器、セーフティーボックス、アイロン、アイロン台、食器類、銀食器 類（ナイフ、フォークなど）、ベッド、リビング及びダイニング家具、デスク、椅子。具体的な必要条 件は以下のとおり： (注：蛍光部分は必ずしも RPP 住宅の必要備品ではありません)
a. Refrigerator – Minimum 2 doors, and capacity exceeding 250 liters.
冷蔵庫 － 少なくとも２ドアで容量が２５０リッター以上。
b. Stove – Built-in, gas or electric, with more than 2 stove top burners. Alternatively, the stove may be stand-alone if it does not impede sufficient walkway space in the kitchen.
オーブン － 備え付けで、ガスまたは電気仕様のオーブン付き２バーナータイプ。台所内 の十分な通路スペースを妨げない場合、独立タイプも可。
c. Washer – Capacity exceeding 6.0kg.
洗濯機 － 容量が６.０Kg. 以上。
d. Dryer – Capacity exceeding 5.0kg.
乾燥機 － 容量が５.０Kg. 以上。
e. Air Conditioning and Heating – Central heating and air conditioning provided to sufficiently heat and cool each room as indicated. Alternatively, individual wall-mounted units may be provided to sufficiently heat and cool each room. The rooms to be heated and cooled are the living room, dining room, and bedrooms, excluding bathrooms and kitchen.

エアコン・ヒーター － セントラル冷暖房で各明示された部屋を十分に冷暖房する。又は、 個別の壁据付タイプで各部屋を十分に冷暖房する。冷暖房される部屋は、浴室や台所を 除く居間、食堂、そして寝室。
f. Smoke detector – One device per room.
煙感知器 － 各部屋に１つ設置。
g. Carbon monoxide detectors – One device per floor of the rental unit. However, these devices are required only if the heating unit and/or stove is powered by fossil fuel.
１酸化炭素感知器 － 各階に１つ設置。これらの感知器は, 暖房機や調理器が化石燃料 を使用の場合のみ必要。
8. The Landlord agrees to have its residential housing inspected by representatives of the Installation prior to the execution of this Agreement, and thereafter upon request of the Installation for the full term of this Agreement.
８． 家主は、この同意書の履行まえに、在日米海軍の代理人によって住宅物件を検査させ、そ の後も在日米海軍の要望により、本同意書の期間内において、検査させることに同意する。
9. The Landlord agrees to waive the customary security deposit, agent’s fee, and the Landlord’s appreciation fee for all DoD employees renting residential housing pursuant to this Agreement.
９．家主は、通例の敷金、不動産手数料や礼金を、この同意書のもと賃貸住宅を賃貸しようとい う軍関係勤務者にたいして免除することに同意する。
10. The Installation agrees to offer DoD employees in search of off-base housing a list of the Landlord’s available residential housing units. The Installation also agrees that, if any DoD employee subsequently decides to enter into a lease with the Landlord under the RPP, it will counsel said employee on the importance of abiding by the terms of his/her lease and, specifically, the responsibility to properly care for said unit. However, the Landlord and the Installation both acknowledge and understand that the Installation will not direct any DoD employee to enter into a lease with the Landlord. To the contrary, the Landlord and the Installation understand that a decision by any DoD employee to lease residential housing from the Landlord is a voluntary decision to be made by said employee.
10. 在日米海軍は、家主の空き住宅物件リストを、民間住宅を探している軍関係勤務者たちに提 供することに同意する。在日米海軍は、さらに、本プログラムにおいて軍関係勤務者が家主と契約締結 を希望する場合、それらの契約条項を遵守することの重要性、または、特に、当該物件の維持管理の責 任について指導することに同意する。しかしながら、家主及び在日米海軍ともに、在日米海軍は軍関係 勤務者に対して、家主との契約を締結するように命令することはないことを認識し理解するものとする。 しかし、家主及び在日米海軍は、家主より住宅物件を賃貸するという軍関係勤務者の意思決定は、当人 による自発的な決定であることを理解する。

11. The Landlord agrees that the Installation shall not be liable for damage to the Landlord’s residential housing, or to the appurtenances or property comprising the residential housing with respect to rents, fees, claims, obligations, or causes of action of any kind that are incurred by, attributed to, or in consequence of a DoD employee’s participation in the RPP. Additionally, this Agreement shall not be construed in any manner to obligate the United States Government or any of its agencies, instrumentalities, agents, servants, other employees, assigns, or successors for payment of same. The Landlord understands that the Installation is not acting as a guarantor for any rent charges or other payments of any kind. Further, the Installation does not assume any obligation, nor will it have any liability for the actions or failures to act by participating DoD employees or of any other person, including but not limited to visitors, guests, contractors, and the Landlord’s agents or servants, in consequence of any claim arising under or relating to either to this Agreement or a DoD employee’s participation in the RPP. The Installation will neither ensure nor indemnify the Landlord in any way under this Agreement; however, the Installation does agree to assist the Landlord in resolving liability attributed to a DoD employee’s participation in the RPP to the full extent permitted by applicable laws and regulations.
11. 家主は､本同意書において、軍関係勤務者のプログラム参加の結果､ 又は､軍関係勤務者に起 因する家賃､ 諸費用、損害賠償、義務、行為の結果について、住宅物件、その従物、又は､所有物に対す る損傷に対し、在日米海軍に責任はないことに同意する｡ 更に、本同意書は、米国政府やその如何なる 官庁、諸機関、代理人､ 公務員、その他の従業員､ 権利継承者、相続人に対して､ 同様の費用の支払いを 義務づけるものでは一切ないものと解釈される。 家主は､ 在日米海軍が本同意書のもと、如何なる家賃 やその他の支払いに対して保証人とはならない事を理解するものとする｡ 更に、在日米海軍は、如何な る責任も負わず、プログラムに参加する軍関係勤務者やその他の者、 又は､ 訪問者、滞在者､ 業者、家 主の代理人や使用人を含むがそれに限らず、その行為や不行為に対して、本同意書、又は､参加軍関係勤 務者に起因した如何なる損害賠償に対して責任を負わないものとする。 在日米海軍は、本同意書におい て、保険をつけたり、家主の損害を補償することは一切ないが、法律や規定の許される範囲において、 出来る限り負債を解決するように家主に助力することに同意する。
12. Within five days of entering into a lease as part of the RPP, the lessee is required to sign up for an automatic payroll allotment payable to the Landlord or his designee in the full amount of the monthly rent as stated in the lease. The lessee will maintain this allotment in effect throughout the course of his/her lease. If the lessee fails to initiate this allotment or, once initiated, fails to maintain it then the Landlord can terminate the lease, provided however, that the Landlord shall first give the lessee fifteen (15) days written notice of intent to terminate the lease and the lessee shall have fifteen (15) additional days to pay all back rents due (if any) and to initiate/reinitiate the allotment in the full amount of the monthly rent. If the lessee fails to comply with this provision, the Landlord may then terminate the lease.
12. 本プログラムの一環として契約締結をした５日以内に、借家人は、毎月家賃の全額を家主又 はその選定者に支払うよう自動給与分配に加入しなければならない。借家人は、契約期間中、この分配 を維持するものとする。借家人がこの分配を開始しなかったり、また一旦開始してもその維持を怠った りした場合は、家主は契約を解除できるが、家主はまず初めに借家人に対し、契約解除の意向を１５日 の事前書面通知を与えるものとし、 借家人は、その後１５日以内に全ての滞納家賃（もしあるならば） の支払いをし、毎月家賃の分配を開始又は再開する。借家人がこの条項に応じない場合は、家主は契約 を解除できるものとする。

13. The Installation agrees to provide an inspection by a housing field representative whenever a DoD employee vacates a residential rental unit, as well as at any other time when requested by the DoD employee or the Landlord. Such inspections will be coordinated with the DoD employee, the Landlord, and the housing field representative so that any party’s schedule, workload, and convenience are considered when dates and times for the inspections are set.
13．在日米海軍は、軍関係勤務者、又は、家主よりの要望があった場合同様、軍関係勤務者の退 去時には、住宅部担当者による検査を行わせることに同意する。 それらの検査は、軍関係勤務者、家主、 又は、住宅部担当者と調整され、検査の日時はそれぞれの当事者の予定、仕事量、又は、都合を考慮さ れ設定されるものとする。
14. In the event that a DoD employee leasing property under the RPP receives permanent change of station (PCS) orders outside the Yokosuka area, or if said employee leaves military service/federal employment for any reason, the DoD employee may terminate his/her lease by providing the Landlord with 30-days advance written notice of the intent to vacate and a copy of the relevant orders. A lease terminated under these circumstances will be treated as if the entire lease period had been fulfilled. Additionally, if the DoD employee receives an offer of on-base housing and opts to accept said offer, then he/she may terminate his/her lease provided that the DoD employee (1) has fulfilled the full-term of his/her initial lease; (2) provides the Landlord with 30-days advance written notice of his/her intent to vacate; and, (3) provides the Landlord with written notice from the Housing Office of the offer of on-base housing.
14．本プログラムのもと物件を賃貸している軍関係勤務者が横須賀地域以外への転勤命令書を受 領した場合、又は、当人が如何なる理由によって退役・退職をする場合でも、軍関係勤務者は、関係命 令書の写しと３０日の事前退去意思通知書を家主に提出し、契約を解除できるものとする。この状況の もと解約された契約は、全契約期間を満たしたものとみなされる。さらに、軍関係勤務者が軍官舎の提 供を受け、受け入れを選択した場合、軍関係勤務者が（１）当初の契約期間を満たし、（２）家主へ３ ０日の事前退去意思通知を提出し、（３）家主へ軍官舎受け入れの住宅部よりの書面通知を提出した場 合、契約を解除できるものとする。
15. At the termination of any lease executed under the RPP, the Landlord agrees to provide the lessee with a written statement of the condition of the rental housing unit that he/she occupied based on an inspection that occurs at a date agreed upon by the Landlord and the DoD employee.
15．本プログラムのもと実行された如何なる契約の解除時には、家主は、当人と軍関係勤務者と の間に同意された日に行われる検査をもとに、居住された賃貸住宅の状態の書面を借家人に提供するこ とに同意する。
16. If a conflict arises between the English and Japanese versions of this Agreement, the English version takes precedence.
16．本同意書の英文と日本文に矛盾が生じた場合は、英文を優先する。

IN WITNESS WHEREOF, the Installation and the Landlord have executed this Agreement as of the day and year first above written.
