Facts: (D) bought the domain name vw.net in 1996 knowing that is represented their companies initials partly but better yet it represented VW cars even more. Latter on several dealerships offered to buy the domain name from them at which time they contacted VM and told them they had 24 hours to make an offer or the domain name would go to the highest bidder. Rules: Under ACPA a person can be cyber squatting if he has bad faith intent to profit form that mark (ii) and registers, traffics in or uses a domain name that has a distinctive mark or brand associated with. - You cannot but a domain name with eth intent to profit off of it by selling it to another vendor because of the popularity that could be associated with the lettering. Issues: Is it wrong for person to bu a piece of property for personal gain at the expense of another?
