					                                             CHILD CARE CONTRACT
Jennifer R. Maresca, herein called “Provider”, agrees to provide child care ____________________________, born on
________________________, herein called “Child”, on behalf of ________________________________, herein called
“Parent”, on the following terms and conditions.

                                            A. FEE AND PAYMENT PROCEDURES
1. Parent agrees to compensate Provider for childcare services at the rate of $__________ per (hour/day/week/month) to be paid
in advance on Monday each week or monthly by the 5th of each month. It may also be paid in two payments, on the 5th and the
20th.
2. Provider shall be entitled to charge $5 per day, for all late payments and $25 for all checks returned unpaid to Provider.
3. Provider shall be entitled to the above fees even if Child is not present at the Child Care Facility.
4. Provider may raise the rates by 3% annually for cost of living expenses.
5. Provider shall be entitled to a $250 non-refundable registration fee due at time of contract signing.


                                        B. TERMINATION PRCEDURE BY PROVIDER
1. The first two weeks of the Child’s attendance at the Child Care Facility shall be classified as an adjustment period. If, in the
judgement of the Provider, the Child is not environmentally compatible with the Child Care Operation, Provider shall issue a
written termination notice. The termination date shall be two weeks after the Parent has received the termination notice. Parent
will be solely responsible for alternate child care after the expiration of said two weeks period. Parent is responsible for any
unpaid child care fees that have accrued up to the termination date.
2. At any time after the adjustment period, Provider may terminate this agreement without cause by issuing a written
termination notice. The termination date shall be two weeks after the Parent has received the notice of termination. Parent is
responsible for any unpaid child care fees that have accrued up to the termination date.
3. Provider may terminate this agreement at any time for cause by issuing a written termination notice. That termination date
shall be 24 hours after the Parent has received the termination notice under the following circumstances:
           a. Failure to pay child care fees despite warning.
           b. Failure of Child or Parent to refrain from violent behavior despite warning.
           c. Failure of Child to refrain from destroying personal property despite warning.
           d. Continued failure of Parent to drop off and pick up Child at scheduled hours despite warning.
           e. Failure of Parent to repair/replace damaged properties per this agreement.
           f. Failure of Parent to refrain from bringing an ill Child to the Child Care Facility despite warning.
           g. Failure of Parent after notification to pick up an ill Child from Child Care Facility despite warning.
           h. Continued failure of Parent to refrain from slanderous and demeaning comments about Provider to other Parents, no
           warning needed. Parent is responsible for any unpaid child care fees that have accrued up to the termination date.

                                        C. TERMAINTION PROCEDURE BY PARENT
1. Parent may terminate this agreement at any time by issuing a written termination notice. The termination date shall be 30
days after personal service of a written notice to Provider. Parent is responsible for any unpaid child care fees that have accrued
up to the termination date.
2. Alternately, Parent may terminate this agreement forthwith by immediately tendering an amount equal to the child care fees
paid to Provider by Parent for two weeks of child care services.

                                                  D. ATTENDANCE OF CHILD
1. The schedule of hours for child care is as follows; Monday thru Friday, 7:00am to 6:00pm.
2. Unless prior arrangements are made, Child shall be picked up by 6:00pm each day. Parent understands that if Child is not
picked up at said time, Parent will immediately tender payment of an additional $ 1.00 for every minute that the Child remains
at the Child Care Facility after the pickup time specified above. If call is made to Provider prior the pick up time and informed of
slight delay (5-10 minutes), there shall be no fee tendered. If longer than 10 minutes, fees apply.
3. Any additional hours shall be subject to further agreement between the Provider and Parent.

                                            E. ILLNESS / EMERGENCY PROCEDURE
1. If Provider is unable to care for Child due to Provider’s illness or Provider’s emergency, and upon reasonable notification,
Parent shall then be responsible for seeking alternate child care. It is suggested that Parent prearrange alternate child care.
2. If Child is ill, Child shall not be allowed to attend the Facility and Provider shall be notified immediately of Child’s illness.
3. Children with diarrhea, a fever or vomiting shall not attend daycare until 24 hours after symptoms are gone.
4. If Child becomes ill after his/her arrival at the Facility, Parent agrees upon notification to immediately pick up the Child.
5. A Child may return to the Child Care Facility after 24 hours following illness when the Child displays none of the major
symptoms of the illness and can participate in activities, at the discretion of the Provider.
6. Both Provider and Parent shall notify each other of the diagnosis/prognosis of any illness suffered by either Provider or Child.
7. For the sake of Child and other children at the Facility, all immunizations proper to the Child’s age must be given.
                                            F. HOLIDAY / VACATION PERIOD

1. Provider will not provide child care services on the following holidays; New Year’s Day, Martin Luther King, Jr. Day,
President’s Day, Memorial Day, Fourth of July, Labor Day, Veteran’s Day, Thanksgiving and the day following, the week of
Christmas, and 5 additional days during the year, and one week in the summer. Child care fees will not be pro-rated during the
holidays & vacation specified above.
2. Parent shall be responsible for arranging alternate child care during the holidays / vacation periods defined herein.

                                                          G. LIABILITY
1. Parent agrees to be responsible for any damages to the Provider’s or the Landlord’s real/ personal property or to the personal
property of another child at the Facility caused by his/her Child. Parent agrees to repair or replace said property promptly.
2. Parent agrees to indemnify and hold Provider harmless from any and all liability for any injury or death of any person,
including Provider and employees of Provider, arising from an act or omission by the Child of said Parent in or about the Child
Care Facility or while under the supervision/ care of Provider.

                                                  J. WAIVER OF BREACH
The waiver of Provider of any breach of the terms of this agreement shall not constitute a continuing waiver or a waiver of any
subsequent breach of the same or a different term of this agreement.

                                                     K. MODIFICATION
Any modification of this agreement shall be in writing.
