Article: Spread of Fire – Liability to Landowner
During the past two months there has been considerable reporting of damage caused by runaway veld fires in the Cape
Peninsula particularly and in the Western Cape generally.
In the dry and hot weather conditions that have prevailed, these fires, fanned by strong winds, have caused substantial
damage not only to the environment but also to property both domestic and commercial.
In terms of the National Veld and Forest Fire Act 101 of 1998 (“the Act”) every landowner has a duty to:
1.     Prepare and maintain firebreaks;
2.     To acquire equipment and have available personnel to fight fires.
Failure to comply with these provisions is an offence in terms of the Act. The Act also provides for a number of other
offences relating to the lighting, use or maintenance of fires. The owner, occupier or person in control of land on
which a fire occurs and who fails to take reasonable steps to extinguish the fire or to confine it to that land or to
prevent it from causing damage to property on adjoining land is guilty of an offence.
The Act provides that landowners may form a Fire Protection Association (“FPA”), the objectives of which are to
predict, prevent, manage and extinguish veld fires.
It is important to note that in terms of Section 34 of the Act there is a presumption of negligence in civil proceedings
should a fire start or spread from land owned by the defendant. The defendant is presumed to have been negligent
until the contrary is proved, unless the defendant is a member of a FPA in the area where the fire occurred.
Whilst the cause of the fire originating on your land would have to be investigated, it is important to understand that a
Third Party merely has to show that the fire spread from your land onto his property and that he / she has suffered
damages as a result of the spread of fire.
As such, the onus is then placed squarely on the landowner to demonstrate that he / she was not negligent in causing
the said fire. In other words there is a rebuttable presumption of negligence on the part of the landowner.
Certain of the methods of discharging this onus of proof is to demonstrate that sufficient and necessary fire breaks
were made giving due consideration to the vegetation and the control of such vegetation in and around the fire breaks.
It is therefore recommended that consideration be given to the formation of an FPA as provided for in terms of the Act
given that the presumption of negligence would not operate against a member of an FPA.
Finally, it is economically wise to ensure that adequate liability cover is purchased particularly if surrounding property
is in a high density farming area for example in the vineyards or in plantations or close to crops which produce high
value yields. Obviously buildings, fencing and the like on neighbouring properties are also a material fact in
considering a landowner’s potential exposure in the event of spread of fire.
