Sir,
I am directed to refer to your letter No. 10F(Cons)-83/2000, 15014/F&E dated 18.09.2000 and
subsequent letter No. 10F(Cons)83/2000/8473 dated 22.05.2002, a copy of which was forwarded by
M/s OMC vide letter dated 20.01.2006, whereunder the above mentioned proposal was submitted
seeking prior approval of the Central Government in accordance with Section-2 of the Forest
(Conservation) Act, 1980 and to say that the above proposal was examined by the Forest Advisory
Committee (FAC) constituted under Section-3 of the Act.
2. After careful consideration of the proposal of the State Government and on the basis of the
recommendations of the above mentioned Advisory Committee, the Central Government granted
permission for diversion of 41.34 ha of already broken up forest land for renewal of mining lease for a
period of 10 years for the above mine vide letter of even no. dated 05.02.2001. The State Government
vide letter dated 22.05.2002 has submitted the modified proposal for diversion of 104.79 ha of forest
land for the above proposal and the proposal was examined by the Advisory Committee. After
consideration of the proposal of the State Government and on the basis of the recommendations of the
FAC, the Central Government hereby agrees in-principle for diversion of 104.79 ha (including 80.94
ha of broken up forest land and 23.85 ha of fresh forest land) of forest land for Chromite Mining in
Sukrangi Chromite Mines of Orissa Mining Corporation (OMC) Limited in District Jajpur, Orissa,
subject to fulfilment of following conditions: -
1. The Compensatory Afforestation shall be raised and maintained over non-forest land equal in
extent to the fresh forest land being diverted, at the cost of the user agency.
2. The non-forest land identified for Compensatory Afforestation shall be transferred and mutated in
the name of State Forest Department and shall be declared as Reserved Forest under Indian Forest
Act, 1927.
3. The State Government shall charge Net Present Value from the user agency for the entire diverted
forest land, as directed by Hon’ble Supreme Court and as per the guidelines issued vide Ministry

of Environment and Forests letters No. 5-1/98-FC (Pt-II) dated 18th September 2003 and 22nd
September 2003.
4. An undertaking from the user agency may also be obtained to the effect that in case the rates of
NPV are revised upwards, the additional/differential amount shall be paid by the user agency.
5. The State Government shall deposit all the above-mentioned funds with Compensatory
Afforestation Fund Management and Planning Authority (CAMPA), which has already been
constituted and notified by the Central Government on 23.04.2004. Till such time, the CAMPA
intimates the Head of Account for deposition of funds, the funds will be maintained in the form of
fixed deposits in the name of Nodal Officer or concerned Divisional Forest Officer of the State
Government. The funds realized towards the NPV shall not be utilized by the State Government.
6. The permission granted under FC Act shall be co-terminus with the mining lease granted under
MMRD Act or any other relevant Act or for 20 years, whichever is less.
7. The user agency shall construct 4 feet high RCC pillars with forward and backward bearings to
demarcate the area.
8. The approval issued vide this office letter of even no. dated 05.02.2001 stands cancelled.
9. Other standard conditions as applicable to proposals related to mining shall apply in the instant
case also.
After receipt of the compliance report from the State Government on fulfilment of the
conditions mentioned above, the proposal will be considered for final approval under Section-2 of the
Forest (Conservation) Act, 1980. Transfer of forest land shall not be effected till final approval is
granted by the Central Government in this regard.

Sub: Diversion of already broken up 70.57 ha (as against the originally diverted 117.84 ha) of
forest land for renewal of mining lease for iron-ore mining in favour of M/s Lal Trades
and Agencies Private Limited in Mayurbhanj, Orissa.
Sir,
The in-principle approval for diversion of 117.84 ha of forest land for the above project was
granted on 06.09.2004 subject to certain conditions. The user agency vide its letter No.
LTA/BBS/23/2005-06 dated 28.01.2006 has represented to this Ministry for modification of the in-
principle approval by reducing the forest land proposed for diversion from 117.84 ha to 70.57 ha on
the grounds that the 47.27 ha of forest land is devoid of minerals and also that it will reduce the
impact of NPV to be paid for the diverted forest land.
The request of the user agency was examined by the FAC constituted under Section-3 of the Forest
(Conservation) Act, 1980. On the basis of the recommendations of the FAC, the Central Government
hereby agrees in-principle for diversion of 70.57 ha of broken up forest land for renewal of mining
lease for iron-ore mining in favour of M/s Lal Trades and Agencies Private Limited in Mayurbhanj,
Orissa, subject to fulfilment of following conditions: -
1. The forest land already diverted stands modified and reduced to the extent of 70.57 ha of
already broken up forest land.
2. The conditions already stipulated in the letter dated 06.09.2004, communicating in-principle
approval for the above project shall be strictly complied with by the user agency and the State
Government.
3. The State Government shall charge Net Present Value from the user agency for the entire
diverted forest land, i.e., for the reduced area diverted for the proposal, as directed by Hon’ble

Supreme Court and as per the guidelines issued vide Ministry of Environment and Forests
letters No. 5-1/98-FC (Pt-II) dated 18th September 2003 and 22nd September 2003.
4. An undertaking from the user agency may also be obtained stating that in case the rates of
NPV are revised upwards, the additional/differential amount shall be paid by the user agency.
5. The State Government shall deposit all the above-mentioned funds with Compensatory
Afforestation Fund Management and Planning Authority (CAMPA), which has already been
constituted and notified by the Central Government on 23.04.2004. Till such time, the
CAMPA intimates the Head of Account for deposition of funds, the funds will be maintained
in the form of fixed deposits in the name of Nodal Officer or concerned Divisional Forest
Officer of the State Government. The funds realized towards the NPV shall not be utilized by
the State Government.
6. The surrendered area shall be reclaimed and rehabilitated at the project cost.
The State Government may take suitable action accordingly and forward the compliance report of
the user agency in respect of various conditions stipulated in the letter dated 06.09.2004,
communicating the in-principle approval.

Sir,
I am directed to refer to your letter No. 10F(Cons)65/2005/5533/F&E dated 02.09.2005
whereunder the above mentioned proposal was submitted seeking prior approval of the Central
Government in accordance with Section-2 of the Forest (Conservation) Act, 1980 and to say that the
above proposal was examined by the Forest Advisory Committee (FAC) constituted under Section-3
of the Act.
2. After careful consideration of the proposal of the State Government, and on the basis of
recommendations of the FAC, the Central Government hereby agrees in-principle for diversion of
232.438 ha of forest land, which includes 72.4695 ha of broken up forest land and 159.9685 ha of
fresh forest land, for Gandhamardan Block-B for renewal of mining lease for iron-ore mining in
favour of Orissa Mining Corporation (OMC) Limited in District Keonjhar, Orissa, subject to
fulfilment of following conditions: -
1. The Compensatory Afforestation shall be raised and maintained over non-forest land
equivalent in extent to the fresh forest area being diverted, i.e., over 159.9685 ha, at the cost
of the user agency.
2. The non-forest land identified for Compensatory Afforestation shall be transferred and
mutated in the name of State Forest Department and shall be declared as Reserved Forest
under Indian Forest Act, 1927.
3. The user agency shall create, fence and maintain a safety zone around the mining area. The
user agency shall deposit funds with the Forest Department for the protection and
regeneration of safety zone area and will also have to pay the cost of afforestation over one
and a half time of safety zone area in degraded forest elsewhere.
4. The reclamation of mines shall be carried out as per the reclamation plan and should be
regularly monitored by the State Forest Department.
5. The State Government shall charge Net Present Value from the user agency for the entire
diverted forest land, as directed by Hon’ble Supreme Court and as per the guidelines issued

vide Ministry of Environment and Forests letters No. 5-1/98-FC (Pt-II) dated 18th
September 2003 and 22nd September 2003.
6. An undertaking from the user agency may also be obtained stating that in case the rates of
NPV are revised upwards, the additional/differential amount shall be paid by the user
agency.
7. The State Government shall deposit all the above-mentioned funds with Compensatory

to demarcate the area.
11. The Wildlife Management Plan shall be implemented at the project cost.
12. Adequate soil conservation measures shall be undertaken under supervision of State Forest
Department to prevent soil erosion, at the project cost.
13. Other standard conditions as applicable to proposals related to mining shall apply in the
instant case also.
After receipt of the compliance report from the State Government on fulfilment of the conditions
mentioned above, the proposal will be considered for final approval under Section-2 of the Forest
(Conservation) Act, 1980. Transfer of forest land shall not be effected till final approval is granted by
the Central Government in this regard.

Environment Protection Group, Orissa, is an informal forum, where a
number of individuals with rich experience and expertise in different fields
have joined together with an aim to safeguard the state’s rich biological
diversity, its people, its economy and diverse culture of various ethnic
groups, especially tribals, from the clutches of existing ‘development
paradigm based on extractive mining and industrialization’.
During various informal discussions a felt need for and interactions with
many groups/forums/individuals it was felt need of proper, authenticate
information at right time. Keeping this, EPG, Orissa has decided to bring
an update on Mining at a regular interval. This is the first Step towards
strengthening of the voices of people/groups/forums
