Compliance Criteria are established by FLO-CERT to translate Fairtrade standard requirements and certification policies into verifiable control points that are evaluated in
the certification process to determine compliance with the Fairtrade Standard . Nonconformity with a Compliance Criteria is a non-conformity with the respective standard
requirement. Each Compliance Criteria is linked to a specific timeline indicating when it needs to be fulfilled. A Compliance Criteria identified as major is linked to a major
Fairtrade Principle and needs to be complied with at any time.

The FLO-CERT Public Compliance Criteria List - Fresh Vegetables from Africa - is based on the Fresh Vegetables Standards for Hired Labour (dated on September, 28th 2009)
and is a supplement to the Public Criteria List - Hired Labor -. Both compliance criteria lists apply and are controlled during a Fairtrade audit at a Hired Labour company
 producing Fresh Vegetables in Africa.

This version of the Compliance Criteria supersedes all previous versions. The Compliance Criteria may be published in several languages. In the case of an interpretation
dispute in any of the published languages, the English version of the Compliance Criteria prevails.

 4. Standards for Labour Conditions
Standard sections 4.1 to 4.2 on Freedom from Discrimination and Freedom of Labour are applicable to all workers employed by the outgrowers' organisation(s) or by
 members.
The term “workers” refers to all workers, including migrant, temporary, seasonal, sub-contracted and permanent workers. Where family labour of members of the
outgrowers' organisation is employed directly by the organisation, the term “workers” also includes them.
The term “workers” is not limited to field workers but includes all other hired personnel, e.g. employees working in the organisation’s administration. However, the term is
limited to personnel that can be unionised.

Standard section 4.3 on Conditions of Employment is only applicable where a significant number of workers are employed by the organization or a member of the
organization and where these workers are involved in producing a Fairtrade product (e.g. in a processing facility, administration, etc). These standards are only applicable
where the organization, an individual member or a group of members own at least 75% of the facility.
Where a significant number of workers are employed by the organization or individual members the requirements of section 4.3 must be met and are applicable to all types
of workers. The certifier interprets “significant” number of workers as 20 permanent workers or more.
