ROOM RENTAL AGREEMENT This is a legally binding agreement. It is intended to promote household harmony by clarifying the expectations and responsibilities of homeowner (landlord) and renter (tenant) when they share the same home/duplex. All parties shall receive a copy of this document. RENTAL UNIT LOCATED AT: (Room Rental Location) PARTIES Landlords Parent or Gardian Name Parent or Gardian Name Renter Childs Name (over 18) TERMS Length of Agreement Month to Month. Either party may cancel this agreement or change its terms upon thirty (30) days written notice. The written notice period may be lengthened or shortened by written agreement. Minimum notice period is seven (7) days. Rent and Late Service Fee Rent per month Tenant shall pay the rent for the entire term of this Agreement in equal monthly installments on the first day of each month as set forth in this Agreement, in advance. The first month's rent shall be apportioned so as to fall on the first day of each month, and henceforth the rent shall be due on that date. In addition to said rent, Tenant shall pay a Service Fee as follows: (a) If the rent is paid after the fifth day of the month, a fee of 5% ($___.00) shall be due. If the rent is paid after the tenth day of the month, an additional fee of 5% ($15.00) will be added for a total fee of 10% ($___.00) shall be due. And if the rent is paid after the fifteenth day of the month, an additional fee of 5% ($___.00) will be added for a total fee of 15% ($___.00) shall be due. These fees must be paid with the rent. (b) A Service Fee of Twenty Dollars ($20.00) is imposed any time the Tenant's bank refuses to honor a check drawn by the Tenant. Rent does include utilities as follows: Gas/Electricity, Water/Garbage, Internet (Wireless). 1 Rent will be paid to Person to receive rent payments at address Payment Location, home address or payee by check or cash. To avoid any service fees mailed rent checks must be postmarked before the fifth day of the month. USE OF PREMISES The premises shall be used as a private residence for Tenant, and for no other purpose, without the written consent of the Landlord. Occupancy by guests staying overnight 3 days will be considered in violation of this provision, unless consented by the Landlord. Pets shall not be brought on the premises, either inside or outside, without prior written consent of the Landlord. Tenant agrees to abide any and all house rules, whether promulgated before or after execution hereof, including but not limited to, rules with respect to noise, odors, disposal of refuse, pets, parking, and use of common areas. Tenant shall comply with all statutes, ordinances and requirements of all municipal, state and federal authorities now in force, or which may hereafter be in force, pertaining to the use of the premises. No nuisance will be permitted on or about the Premises; nothing shall be done upon or about the Premises which shall be unlawful, improper, noisy or offensive, or contrary to any law, ordinance, regulation or requirement of any public authority or insurance inspection or rating bureau or similar organization having jurisdiction or which may be injurious to or adversely affect the quality, operation or tone of the Premises; the Premises will not be overloaded, damaged or defaced; Tenant will not drill or make any holes in the stone or brick work; Tenant will not permit the emission of any objectionable noise or odor from the Premises; and all waste and refuse will be containerized and removed from the premises in accordance with rules and regulations therefore as shall be prescribed by Landlord from time to time. Tenant will not do, or suffer to be done, or keep, or suffer to be kept, or omit to do anything in, upon or about the Premises which may prevent the obtaining of any insurance on the Premises or on any property therein including, but without limitation, fire, extended coverage and public liability insurance, or which may make void or voidable any such insurance, or which may create any extra premiums for or increase the rate of, any such insurance. If anything shall be done or kept or omitted to be done in, upon or about the Premises which shall create any extra premiums for, or increase the rate of, any such insurance, Tenant will pay the increased cost of the same to Landlord upon demand. DRUG TRAFFICKING IS A VIOLATION OF THE LAW AND OF THIS RENTAL AGREEMENT AND WILL NOT BE TOLERATED. ANY ILLEGAL DRUG TRAFFICKING IS A BREACH OF THIS AGREEMENT AND SUBJECTS TENANT TO IMMEDIATE TERMINATION OF THIS AGREEMENT. TENANT TO INITIAL __________ ATTORNEY’S FEES 2 In the event any legal action is brought by either party to enforce the terms herein or elating to the demised premises, the Landlord shall be entitled to all costs in connection with such action, unless otherwise ruled by the court. WAIVER No failure of the Landlord to enforce any item hereof shall be deemed a waiver, nor shall acceptance of a partial payment of rent be deemed a waiver of the Landlord’s right to the full amount thereof. NOTICES Any notice which either party may or is required to give, may be given by mailing the same, to Tenant at the premises or to the Landlord at the address as listed in this agreement or at any other place as may be designated by the parties. NO LIABILITY FOR LOSS OR DAMAGE TO TENANT'S PERSON OR PROPERTY; INDEMNITY TO LANDLORD. Tenant agrees to be solely responsible for all loss or damage to Tenant's person or property or to any other person which may be situated in the Rental Unit during the term of this Agreement or any renewal or extension thereof, including any loss by water, fire, or theft in and about the Rental Unit and storage area; gross negligence of Landlord, its servants, agents or employees excepted; and Tenant agrees to procure adequate content and liability insurance to afford protection to himself against the risks herein assumed. In addition, Tenant agrees to indemnify and save Landlord harmless from any and all loss occasioned by Tenant breach of any of the covenants, terms and conditions of this Agreement, or caused by his family, guests, visitors, agents or employees. ADDITIONAL TERMS AND CONDITIONS The Landlord shall be released from liability arising from loss, damage, or injury caused by fire or other casualty for which insurance is carried by Tenant, under a policy which permits waivers of liability and waives the injurer's rights of subrogation to the extent of any recovery by the insured party under the policy. NOTICE OF EXTENDED ABSENCE Tenant shall, no later than the first day of such absence, notify the Landlord in writing of any anticipated absence from the Rental Unit for more than seven (7) days. DEFAULT BY TENANT 3 If the Tenant shall default at any time in the payment of rent as herein stipulated or shall breach any one or more of the other covenants of this Agreement, the Landlord may, at its option, demand payment thereof and notify the Tenant, in writing, that unless payment is made within five (5) days after notice is given or sent, the Agreement will be terminated. If the Tenant remains in default, the Landlord may thereafter bring an action for summary possession or any other proper proceeding, action or suit. PRIVACY As required by law, the homeowner may enter the tenant's room only for the following reasons: (a) in case of emergency; (b) to make necessary or agreed-upon repairs, decorations, or improvements, supply necessary or agreed-upon services, or exhibit the dwelling unit to prospective or actual purchasers, mortgagees, tenants, workers, or contractors; (c) when the tenant has abandoned or surrendered the premises; or (d) pursuant to court order. The homeowner must give the tenant twenty-four (24) hours notice of intent to enter and may enter only during normal business hours, excepting, by necessity, cases (a) and (c) above. ( ) Last month's rent ( ) Security Deposit Paid on N/A , Amount $0.00 Paid on N/A , Amount $0.00 OTHER AGGREEMENTS As attaining a higher education is important and valued in this family for the betterment of each member and the family as a whole certain discounts will be available to family members renting rooms based on the amount of school work load and grade average. This discount will not extend to an indefinite period of time but will be limited to a reasonable amount of time it takes to receive an undergraduate degree or equivalent work related certification. If the grade average falls below the minimum grade average then the rent discount will be removed until the grade is brought back above the Minimum Grade Average at the next grade reporting or a note from the professors/instructors. THIS RENTAL AGREEMENT SUPERSEDES AND REPLACES ANY OTHER WRITTEN OR ORAL AGREEMENTS. 4 THE UNDERSIGNED TENANT HEREBY ACKNOWLEDGED RECEIPT OF A COPY HEREOF.
