					Moneybookers Card Terms and Conditions
These terms and conditions apply to your Moneybookers Card in addition to the Account Terms of Use
governing your Moneybookers Account. You must read them carefully. In these terms and conditions
"you" means the named Moneybookers Cardholder. "We", "us" or "our" means Moneybookers Ltd,
Welken House, 10-11 Charterhouse Square, London, EC1M 6EH, United Kingdom. “Card Issuer” means
Newcastle Building Society, Portland House, New Bridge Street, Newcastle Upon Tyne, NE1 8AL,
United Kingdom.. “Website” means the website at www.moneybookers.com


1. Your Moneybookers MasterCard® Prepaid Card
You can use the Moneybookers MasterCard Prepaid Card (the “Moneybookers Card” or “Card”) at any
location that displays the MasterCard Acceptance Mark, including shops, restaurants, online, or on the
telephone. You can also use your Moneybookers Card overseas. Before using the Moneybookers Card
you need to make sure that it is activated and that there are enough funds available (see section 3). You
will not be able to use your Moneybookers Card after its expiry date.

Your Moneybookers Card is not a credit card or debit card. It is a prepaid debit card linked to your
Moneybookers Account balance. You will not earn any interest on funds associated with your Card.

Your Moneybookers Card is issued by the Card Issuer under a licence from MasterCard International.
The Card remains the property of the Card Issuer.



2. Applying for and activating your Moneybookers
Card
To apply for our Moneybookers Card you must be at least 18 years old and an EU resident. We will
require evidence of your identity and your address if we have not already collected this information in
relation to your Moneybookers Account. We may ask you to provide documentary evidence to prove your
identity and your address and we may carry out checks electronically by verifying your details with credit
reference agencies or other ID verification service providers. Checks with credit reference agencies will
be undertaken for verification purposes only, not for obtaining a credit scoring.

When ordering your Card, you will be asked to choose one of the aforementioned currencies for your
Card: EUR, USD, GBP or PLN. You do not need to order a Card in the same currency as your
Moneybookers account, however, in case of any discrepancy between the currency of your Card and the
currency of your Moneybookers Account, each transaction will incur currency conversion fees.

We will review your application as soon as possible. It remains in our sole discretion whether we issue a
Moneybookers Card to you. If your application for a Moneybookers Card is approved, we will endeavour
to send your Card to you within 15 business days, however, please be aware that in some instances it can
take longer for your Card to arrive. Cards will only be sent to the address you have registered in your
Moneybookers Account profile. You are responsible for keeping a valid postal address registered at all
times and to inform us immediately of any changes.

You must sign the signature strip on the back of the Moneybookers Card as soon as you receive it.
In order to activate the Moneybookers Card you need to visit the Moneybookers website, log into your
Moneybookers Account and follow the activation process.

By using the Moneybookers Card you are agreeing to these terms and conditions.


3. Funds available through your Moneybookers Card
Your Moneybookers Card is a way to access funds on your Moneybookers Account and does not hold a
separate balance. For ways to upload funds to your Moneybookers Account as well as upload fees, please
refer to the Moneybookers Account Terms of Use.

You may not spend or withdraw more funds than you currently hold on your Moneybookers Account or
allowed by the transaction limits of your Moneybookers Account or the transaction limits of your
Moneybookers Card, whichever is lower.

The transaction limits of your Moneybookers Account depend on a variety of factors such as the
verification methods you used. Please refer to your Moneybookers Account settings to view your account
transaction limits.

Subject to the foregoing, the transaction limits of your Moneybookers Card are as follows:
Cash withdrawal at ATM or bank counter:            250 EUR per day
Purchases (Point of Sale transactions): 1000 EUR per day

Limits are quoted in Euro but if your Moneybookers Card is denominated in a different currency the
amount of these limits will be converted applying our then current standard exchange rates which are
available online in the Fees section of the Website.

If for any reason a transaction you make with your Moneybookers Card causes the balance on your
Moneybookers Account to go into negative, you must immediately upload funds into your Moneybookers
Account to cover the negative balance. We reserve the right to take additional steps such as demanding
and enforcing payments from you in order to make good any negative balance you incurred.



4. Using your Moneybookers Card
Transactions using a merchant terminal must be authorised by you by entering your PIN or, if making
payments using the magnetic stripe, by signing the merchant receipt. You cannot withdraw your
authorisation after having entered your PIN or signed the merchant receipt.

A Card transaction will be regarded as authorised by you where you:

    •    authorise the transaction at the point of sale by following the instructions given by the retailer to
         authorise the transaction, which may include any of the following:

    a)   inserting your Card into a terminal, till, ATM or other card reader
    b)   entering your PIN or providing any other security code
    c)   signing a sales voucher or receipt
    d)   providing Card details to the retailer or its payments processor, including your name, Card
         number, security number, start date, expiry date or any other detail requested at point of sale
    e) make a request for a cash advance at a bank counter

Authorisation for a transaction cannot be withdrawn or revoked by you after the time it is received by us
or on our behalf by a third party, except where a transaction is agreed to take place on a date later than the
date it was authorised as long as you provided notice to us no later than the close of business on the
business day in the United Kingdom before the transaction was due to take place.

You must always make sure that your available funds cover both the value of your transaction and the
applicable fees.

Like other payment cards, there is no guarantee that a retailer will accept your Moneybookers Card.

We may refuse to process a transaction:

    •   if we are concerned about the security of your Moneybookers Account or your Moneybookers
        Card

    •   your Moneybookers Account does not hold a sufficient balance to cover the transaction amount
        and applicable fees

    •   if we reasonably believe that you are acting in breach of these terms and conditions or the
        Moneybookers Account Terms of Use or any other applicable agreement between you and us

    •   if we reasonably believe that a transaction is potentially fraudulent or otherwise illegal;

    •   because of errors, failures (whether technical or otherwise) or refusals by merchants, payment
        processors, payment schemes or providers or technical infrastructure.


After your transaction, the funds of your Moneybookers Account available for spending through your
Moneybookers Card will be reduced by the amount of the transaction plus any applicable fees. Please
note that the actual debit of the transaction to your Moneybookers Account balance may take longer to
process in accordance with the following paragraph. To check your available funds, please log into your
Moneybookers Account.

The time it takes to execute your payment and debit the corresponding amount to your Moneybookers
Account depends on the time at which the recipient of the payment (usually the merchant or, in case of an
ATM withdrawal, the ATM operator) submits the transaction to us for payment. Once we receive the
payment request from the the merchant, we will ensure that the funds are paid over to the merchant’s
bank by the third business day following receipt of the request.

If you make a payment in a currency that is different from your Card currency, a currency conversion fee
of 1.99% of the transaction amount applies.

If your Moneybookers Card is denominated in a different currency from your Moneybookers Account,
you will incur an additional currency conversion fee of 1.99% of the transaction amount.

You can view your transaction history by logging into your Moneybookers account. You will not receive
a separate account statement for your Moneybookers Card.
5. Cancellation and expiry of your Moneybookers
Card
You have a legal right to cancel your Moneybookers Card up to 14 days after you receive the Card. – This
14 day period is known as the “Cooling-Off Period”. We will refund the initial charge of the annual card
membership fee if you cancel within the Cooling-Off Period.

You also have the right to cancel your Moneybookers Card at any time after the 14 day Cooling-Off
Period.

To cancel your Card you should always call the customer helpline on +44 (0) 870 383 0232.

If you cancel your Card, this does not automatically cancel your Moneybookers Account unless you
expressly tell us that you also wish to close it.

You may also cancel the Card by sending us a message through the “Contact Us” facility in the Support
Centre on the Website, but cancellation in that way will not take immediate effect and we will not be
responsible for any delay of the cancellation as a result.

Once you have cancelled your Moneybookers Card, you are not allowed to use it and you must destroy it
by cutting through the card chip and the magnetic stripe. You must dispose of the card securely so that no
third party can get hold of the card number or the security number.

In case of a cancellation, you will not be entitled to a refund of money you have already spent on
transactions to which you consented or of any fees for use of the Moneybookers Card before it is
cancelled.

We may cancel your Moneybookers Card at any time if we suspect fraud or misuse of your
Moneybookers Card, if we have any other security concerns or we need to do so to comply with the law.
We will tell you as soon as we can or are permitted to do so after we have taken these steps.

We may also cancel your Moneybookers Card for any other reason by giving you two months’ notice.

Your Moneybookers Card will be valid for 36 months. You are prohibited from attempting to use the card
after it has expired. The expiry date is shown on the front of your card.

Shortly before your Moneybookers Card expires, we will notify you and will send you a replacement
card, provided that your Moneybookers Account balance holds enough funds to cover the Replacement
Card Fee (see section 10).


6. Keeping your Moneybookers Card secure
You should treat your Moneybookers Card like cash and keep it safe at all times. The Card is personal to
you and you must not let anyone else use it.

Once you have received your Moneybookers Card PIN, you should immediately memorise it and destroy
the notification. If you find your PIN hard to remember, you can change it at most ATM's, by simply
selecting the "PIN services" option.
You must keep your PIN secret at all times. Do not write it down or reveal it to anyone. If you think your
PIN has been or may have been revealed to another person or otherwise compromised, you must inform
us immediately by calling the 24 hour Lost and Stolen Helpline on +44 (0) 207 117 6017.

We recommend that you check the balance on your Moneybookers Account and your transaction history
regularly online at the Moneybookers Website. You must report to us any transaction which you have not
authorised or otherwise wish to dispute in accordance with the procedure set out in paragraph 8.

If you lose your Moneybookers Card or it is stolen, or you suspect that your Moneybookers Card has been
used by someone other than you, you must tell us immediately by calling us on our 24 hour Lost and
Stolen Helpline +44 (0) 207 117 6017 so we can cancel your Moneybookers Card. You can also report
your card lost or stolen in the “Manage Card” section on the Website.

We and the Card Issuer reserve the right to investigate any disputed transaction or misuse of your
Moneybookers Card. In order to do so we may need more information and assistance from you and you
are required to reasonably co-operate with any investigation by us, the Card Issuer or any law
enforcement agency or other competent authority.

We will refund the amount of any transactions which the investigations show are not authorised by you,
provided you have kept your Moneybookers Card and PIN secure, you have not acted fraudulently, or
acted without reasonable care. However, if the investigations show that any disputed transaction was
authorised by you, or you have not kept your Moneybookers Card or PIN secure, we will not refund the
transaction amount.


7. Our liability
Like other payment cards, we cannot guarantee a retailer will accept your Moneybookers Card, or that we
will authorise any particular transaction. This may be because of a systems problem, something outside
our reasonable control, or because we are concerned that your Moneybookers Card is being misused.
Accordingly, we shall not be liable in any event that a retailer refuses to accept your Moneybookers Card,
or if we do not authorise a transaction, or if we cancel or suspend use of your Moneybookers Card.

Unless otherwise required by law, we shall not be liable for any direct or indirect loss or damage you may
suffer as a result of your total or partial use or inability to use your Moneybookers Card, or the use of
your Moneybookers Card by any third party.

In the event that you do not use your Moneybookers Card in accordance with these Terms and Conditions
or we find that you are using the Moneybookers Card fraudulently, we reserve the right to charge you for
any reasonable costs that we incur in taking action to stop you using this Moneybookers Card and to
recover any monies owed as a result of your activities.

Clause 16 of the Account Terms of Use applies.


8. Disputed Transactions
Disputes with retailers for the provision of goods and services should be resolved with the retailer
directly, see paragraph 13.
If you wish to charge back a transaction which you have not authorised or otherwise wish to dispute a
transaction that has been made in error, please contact us by calling +44 (0) 870 383 0232.

If you have provided us with all necessary information, we will refund any unauthorized or incorrectly
executed transaction immediately unless we have any reason to believe that the incident has been caused
by a breach of these Terms and Conditions or the Account Terms of Use, by gross negligence or if we
have reasonable grounds to suspect fraudulent activity. However, if our investigations show that the
disputed transaction was authorised by you or you have acted fraudulently or with gross negligence (for
example by failing to keep your Card, Card details or security features such as the PIN secure at all
times). Clause 16 of the Account Terms of Use applies.

You may also be entitled to a refund of any pre-authorised transaction where the exact amount of the
transaction was not specified at the time of the pre-authorisation (for example hotel bookings or car hires)
and the amount charged by the retailer is more than you could have reasonably expected taking into
account normal spending patterns on the Card or the circumstances of the transaction and the goods or
services provided to you. You shall not be entitled to a refund where the amount of the transaction was
provided to you at least 4 weeks before the transaction date or you fail to request a refund within 8 weeks
from the date on which the funds were debited.

Refunds must be requested within 13 months of the date on which the transaction was debited.


9. Changes to these terms
The up-to-date version of the Moneybookers Card terms and conditions will always be available on the
Moneybookers Website. We may change these terms at any time. Any changes will be communicated to
you by email. Unless we expressly give you a different effective date, the changes shall take effect two
months after they have been communicated to you, unless you have notified us of your objection to the
proposed changes before they take effect. In this case we reserve the right to cancel your Moneybookers
Card by giving you two months’ notice. Your right to cancel your Card at any time remains unaffected.

Changes to the spending limits of your Moneybookers Card that are necessary in order for us to comply
with legal requirements are not considered to be changes of these Terms and Conditions therefore do not
require prior notice. You can always check your spending limits by logging into your Moneybookers
Account.

If you make a transaction requiring one or more currency conversion, we will apply the conversion rates
as described in section 10 below. Currency conversion rates change frequently and therefore are not
subject to the notice procedure described above.


10. The Fees
The following Card fees apply:

Fees will be deducted from your Moneybookers account balance. Fees are quoted in Euro but if your
Moneybookers Account is denominated in a different currency the amount of fees will be converted
applying our then current standard exchange rates which are available online in the Fees section of the
Website.

When you use your Moneybookers Card at an ATM, you may also be subject to applicable fees,
surcharge rules and regulations of the relevant ATM, or other financial institution or association.

If the currency of your Moneybookers Card is different from the currency of your Moneybookers
Account, each transaction will require a currency conversion based on Moneybookers’ foreign exchange
wholesale rates as shown on our Website which will incur a foreign exchange fee of 1.99% of the
transaction amount.

If the currency of the transaction is different from the currency of your Moneybookers Card, the
transaction will require a MasterCard currency conversion based on the exchange rate determined by
MasterCard at the time at which a transaction is executed through the MasterCard system. You can find
out the exchange rate applied by MasterCard at the time of the transaction via the MasterCard website
https://www.mastercard.com/us/personal/en/cardholderservices/currencyconversion/index.html.


11. Your details
You must let us know as soon as possible if you change name, address, phone number or e-mail address.
If we contact you in relation to your Moneybookers Card, for example, to notify you that we have
cancelled your Moneybookers Card or to send you a refund by cheque, we will use the most recent
contact details you have provided to us. Any e-mail to you will be treated as being received as soon as it
is sent by us unless within 24 hours we receive a failure notice indicating that the email has not been
transmitted. We will not be liable to you if your contact details have changed and you have not told us.


12. Data protection
In applying for the Moneybookers Card and using it, you agree that we can use your personal information
in accordance with our Privacy Policy. Our Privacy Policy is set out on the Moneybookers Website, and
includes details of the personal information that we collect, how it will be used, and who we share it with.

By using the Moneybookers Card at retailers or elsewhere to make a payment or withdraw cash, you
consent to the use of your personal information as required to execute the payment in accordance with
regulatory requirements and the MasterCard Rules. Depending on where you use your Moneybookers
Card, this may include a processing of your information outside the European Economic Area.


13. Disputes with retailers
If you have any disputes about purchases made using your Moneybookers Card, you should settle these
with the person you bought the goods or services from. We are not responsible for the quality, safety,
legality or any other aspect of any goods or services purchased with your Moneybookers Card.


14. Communication
If you have an enquiry relating to your Moneybookers Card, you can use the "Contact Us" facility in the
Support Centre on the Website. We will deal with your enquiry promptly. If you do not wish to enquire in
this way you can alternatively call our customer service telephone line on +44 (0) 870 383 0232. The
customer services telephone line is a chargeable service.

15. Complaints
The Moneybookers Card is managed by Moneybookers. If you are unhappy in any way with your
Moneybookers Card or the way it is managed, tell us by using the ”Contact Us” facility in the Support
Centre on the Website or call us on +44 (0) 870 383 0232 so we can investigate the circumstances for
you. Any complaints you have will be dealt with quickly and fairly. You may be able to take unresolved
complaints to the Financial Ombudsman Service at South Quay Plaza, 183 Marsh Wall, London E14

16. Compensation
The Moneybookers Card is an electronic money product and although it is a product regulated by the
Financial Services Authority, it is not covered by the Financial Services Compensation Scheme. No other
compensation scheme exists to cover losses claimed in connection with the Card. This means that in the
unlikely event that Newcastle Building Society or Moneybookers become insolvent your funds may
become valueless and unusable and as a result you may lose your money.


17. Assignment
We may assign the benefit and burden of these terms and conditions to another company at any time, on
giving you at least two months prior notice of this. If we do this, your rights will not be affected.


18. Governing law
All communications with you will be in English. These terms and conditions will be construed in
accordance with English law.


19. Statutory Information
Your Moneybookers Card is issued by Newcastle Building Society, Portland House, New Bridge Street,
Newcastle Upon Tyne, Tyne and Wear, NE1 8AL, which is authorised and regulated by the Financial
Services Authority (registered number 156058) as a building society. NBS subscribes to the Banking
Code, copies of the Code are available upon request. Your Moneybookers Card is the property of
Newcastle Building Society and is not transferable to anyone else.

Moneybookers Ltd is incorporated in England and Wales and its registered office is at Welken House, 10-
11 Charterhouse Square, London EC1M 6EH, United Kingdom. Moneybookers is contactable
electronically by using the “Contact Us” facility in the Support Centre on our Website. Moneybookers is
authorised and regulated by the Financial Services authority as an issuer of e-money (registration no.
214225).
