1.      Introduction

1.       This Resettlement Plan describes the involuntary resettlement planning process and
procedures that will be applied to the Vopur-Rupatola Sub-project of Decentralized Rural
Infrastructure and Livelihood Project (DRILP) which will trigger involuntary resettlement policy
safeguards.

2.       Bajhang is mainly hilly and one of the most remote districts within far western region. Most of
the area of this district is agriculturally unproductive, resulting in food deficiency during critical
periods. The district is very rich in biodiversity and non timber forest products. The district
headquarter is yet to be linked with motorable access. The air transport is serving the people of the
district as main transport facility which is also uncertain and not reliable. Within the district, people of
the northern area have to walk up to four days to get access to essential goods and other
governmental services. Due to limited opportunities in the district, seasonal migration to India for
employment is very high. The Himalayan herbs and forest product could supplement the increment
of income level of the district in case of motorable access to the areas.

3.       The District Road Coordination Committee (DRCC) selected the Vopur-Rupatola section of
Chaipur-Kanda Road as a subproject of the project. The sub-project is an extension of Jai Prithivi
Bahadur Singh Marga presently under construction by the Department of Roads (DoR) for the
further funding under DRILP. The road starts from Vopur bazaar of Chainpur VDC (1 km east from
Chainpur, district headquarters) and passes through Sunikot VDC and ends at Rupatola of
Dhamena VDC. The subproject, a west-northeast rural road having hill and ridge alignment along
with Seti River provides access from district headquarters at Chainpur to the 3 VDC inaccessible
and backward north-east part of the district in terms of basic services. This road will help the people
of Rupatola and surrounding areas to access the public market, health facilities and government
services. The subproject is believed to be useful to pilgrims visiting Mansarovar and Kailash Parbat
in Tibet.

4.       The length of the subproject is about 17.903 km. This length is combination of 1 km existing
road and 17 km new construction. The subproject will be constructed into earthen standard (fair
weather) with 5 m formation width. The subproject road will be of Rural Road Class ‘A’ District Road
(RR-A) category according to DoLIDAR design standard. The road characteristics for this design
standard include regular and case specific road dimensions. Normally, a road formation width is
fixed at 5m which includes 3m of carriageway and 1m of shoulder on either side of the carriageway.
Lay-byes are provided at the rate of 3 per kilometre of road length. These are normally 3m wide and
15-20m long, requiring additional 2m wide and 15-20m long strip of land for this purpose. Similarly,
switchbacks and hairpin bends require land in addition to regularly acquired, but the quantity is
dependent on terrain characteristics and design parameters. Cut and fill sections are also case
specific and closely depend on terrain characteristics such as slope profile and geological properties.
Consequently, it is generally not possible to predict land requirements for cut and fill work and earth
retaining structures.

5.      For this project, the DDC has decided to acquire 10m width (either side 5 m. from the
centerline) for the rehabilitation of existing road and new construction. During the previous
construction the proponent had not given due consideration on formal land acquisition process and
used the individuals' land with their oral consent only. The resettlement assessment survey

conducted by the project in 2007 has considered the land used by the existing road as new land. In
this subproject the resettlement activities has been undertaken for total length of the road. The
additional land needed for the curves, lay-byes, widening and mass balance beyond the formation
width has been adjusted within this width. The construction of the subproject will require 10m wide
land for the road and associated structures resulting in acquisition of 179030sqm of land.

6.        Information on the socio-economic characteristics of the communities that will be affected by
the subproject has been collected using household surveys and focus group interviews, conducted
during the detail design. A separate survey of affected households was undertaken to ascertain
resettlement impacts of the subproject. A ‘household listing survey’ at the detail design stage of the
subproject enumerated likely resettlement impacts, and determined their landholding status and
eligibility for compensation. The census and socioeconomic survey has listed all project-affected
persons (PAPs) and determined the extent of the impact of the subproject on PAPs’ properties and
assets located adjacent to the road alignments.

7.     Resettlement impacts arising from the construction of the subproject are expected to be
experienced by about 987 persons due loss of land, trees, structures. Two households will lose
more than 10% of their total land holding and 3 households will be displaced from housing.
Altogether forty one persons in 5 households will experience major resettlement impacts. Since
the AP losing more than 10% of land is less than 200 person threshold, the project comes under
category B of IR policy of ADB. Therefore, a Short Resettlement Plan is prepared to mitigate the
losses due to the implementation of the subproject. In preparing a Resettlement Plan (RP), the
approved Resettlement Framework (RF) of the Project has been closely followed.

1.1    Alternative Options
8.       The community meetings and interviews were conducted with land owners who lost land to
the existing alignment and the owners of the additional land needed for widening the alignment.
Details of land additional requirements and associated land donation and compensation procedures
were discussed with affected persons and families. The beneficiaries were asked to suggest best
alignment which will require minimum area of individual land and serves greater number of
population. The detail survey and design team has selected the alignment considering the technical
feasibility of the alignment and offer of the community.

9.       To improve the access from the main district road up to settlement along the alignment and
link local area market, acquisition of a considerable quantity of arable and productive land would be
required. Most of the affected households are anxious to see the road to their houses and hoping to
be able to link with the market to import and export the goods needed and produced. According to
the local people, they could save travelling time to and/or from district headquarter, enhance income
generation potential through employment generated by the road and other business opportunities.
Compared to potential benefit from the project the loss will be nominal to the majority of the affected
people. To reflect the enthusiasm of the beneficiaries the survey team has selected the proposed
alignment. While there are very limited options with survey team to avoid or minimize the land
requirement for the construction, the survey team has explored several alternatives to avoid and
minimise further land requirement by using the existing pedestrian track. The survey team has
selected the least valuable, least agriculturally productive land for the lay-bys, curves and cut/fill
areas and took care to avoid the demolition of houses. These changes have been designed and
incorporated into the sub-project detail design.

1.2     Likely impacts from subproject construction
10.     The Household Listing and Census Survey shows that the proposed alignment is affecting
987 people of 132 households in terms of use and need of land and other assets. In total 11
structures are to be relocated. They are five residential houses, two kitchen, one cattle shed, two
temple, one shop and one community chautari. A total of 4.10 hectares of private land will be
required for the road construction. This represents an average loss of 0.03 ha per household and is
equivalent to 4.21% of holdings on average. Out of the total 132 HHs, 115 HHs are being
interviewed and remaining 17 households live outside the project area. The key effects of the
projects are summarized in the following table 1.

2.           Socio-Economic Information of the Affected Households

11.     The census was followed by a detailed socio-economic survey of 115 APs households, in order
to collect further information regarding APs income, food sufficiency, poverty and ethnic background.
Table 2 below summarizes the APs socio-economic information from the survey.

12.      The survey revealed that average annual income of the affected HHs is about 89106
rupees. 2 Out of the115 HHs, 96.52% have annual income above 50,000 rupees. It is notable
that out of the total annual income about 78 percent income comes from other sources and only
22 percent comes from land. HHs has numbers of strategies to deal with food sufficiency from
their own agriculture products; these households are managing the food deficit from different
sources. 26.54 percent of the HHs is involved in off farm wage e, 22. 06 percent of the HHs earns
from the formal employment, 13.45 percent of the HHs earns through selling of the livestock’s, 11.49
percent HHs earn through agricultural wages, 11.95 percent of the HHs earn through selling of the
cash crops. 10.11 percent HHs earn through the remittance, and 4.40 percent of the HHs earn from
selling vegetables. The trend shows that dependency on agriculture is slowly changing to off-farm
activities for subsistence, while no changes are expected on non-agricultural income in proportion to
loss of land. On average, households are expected to experience reduction of annual agricultural
income and food sufficiency of less than 592 rupees and 1.35 month respectively. In respect to food
security all household have more than 9 months food sufficiency from their sources of income both
from agriculture and non agriculture.

13.     The donation criteria of the project state that the economic future of the APs must be same
as they are before the project. The project RF criteria measure the poverty level in terms of food
security i.e. the donation accepted from those households whose annual food security is > 9 months.
During the socio-economic survey poverty level of the individual household has also been assessed
and found that two households fall below district poverty line. The socio economic survey revealed
that the major income of the households is from non-agriculture income sources and had year round
food security from their annual income. The survey findings show that there will be more or less
same earning level and food security before and after the project. It is expected that the loss
incurred due to the project will also be off-set by benefits of the road as well as assistance and skill
training provided under the project. The result of socio-economic analysis shows that all APs meet
RF donation criteria and allow land donation from all.

14.     Ninety percent of the affected households are from the Brahmin/Chhetri/Thakuri and only 9.8
percent of the households are from dalit community. The data indicates that along the road
alignment Brahmin/Chettri is found to be the dominant caste group and raring mainly cow/oxen,
buffalo, and sheep/goats. Out of the total HHs 54 HHs have Radio, 3 HHs have own a radio, 2 HHs
have own Rice Mill, 4 HHs have sewing looms, 10 HHs own camera, 10 households own a solar
panel and 12 HHs Gobargas plant.

15.       The members of affected households already have useful skills for road construction. Useful
skills are already held by the households along the Vopur-Rupatola 38.5% HHs already have
previous knowledge and awareness on infrastructure projects for example, road, bridge, rails, tree
planting, and water supply. Regarding skill experiences of craftsperson like Bamboo works,
carpentry, food processing, house construction. Male have more skills on the mentioned training
experience than female. Various types of income generation and awareness trainings like adult
literacy, empowerment, girl trafficking, health and sanitation, agriculture extension, livestock raising,
saving and credit have been taken by the affected peoples, through different agencies. The data

indicates that affected people on the road alignment have knowledge on income generation
activities.

16.     The average time taken to reach the District Headquarters is 111 minutes on foot, walking
time to primary schools is around 25 minutes, to college 107 minutes, secondary school 104
minuets. Local traditional healers are located in all communities at about 34 minutes walk, sub-
health posts at about 34 minutes and a health post at about 118 minutes. Hospital is found in 125
minutes walk and local markets on 32 minutes. Veterinary and agro-centre are found in average 125
minutes walk and telephone service is available only after 127 minutes walk.

3.     Objectives, Policy Framework and Entitlements

17.    This section reviews the policy framework that applies to the project. Resettlement Plan (RP)
is guided by Land Acquisition Act (LLA) 1977, ADB Involuntary Resettlement Policy, and the
approved Resettlement Framework of the project. According to The Land Acquisition Act 2034, if the
Government of Nepal (GoN) or any party acquire portion of land of the public it should pay
compensation or on the negotiation for public purposes and works.

18.      There is some space for voluntary land donation under the Land Acquisition Act (1977).
While building rural roads and small-scale community projects in Nepal, the communities and
individuals often voluntarily contribute land. The Act States in Clause 27, "Not withstanding anything
contained elsewhere in this act, GoN may acquire any land for any purpose through negotiations
with the concerned land owner. It shall not be necessary to comply with the procedure laid down in
this act when acquiring land through negotiations".

19.       The main objective and principle of the ADB's Policy on Involuntary Resettlement is to avoid
involuntary resettlement where feasible. Where population displacement is unavoidable, it should be
minimised by exploring all viable options. The policy addresses loss of land, resources, and means
of livelihood or social support systems, which people suffer as a result of an ADB financed project.
The policy requires that people unavoidably displaced should be compensated and assisted, so that
their economic and social future would be generally as favourable as it would have been in the
absence of the project. People affected should be informed fully and consulted on resettlement and
compensation options. As far as possible, involuntary resettlement should be conceived and
executed as part of the project. The full costs of resettlement and compensation should be included
in the presentation of project costs and benefits.

20.     ADB’s Operational Manual Section F2/OP states that where projects provide direct
benefits to communities, and are amenable to a local decision-making process, arrangements
to deal with losses on a transparent, voluntary basis may be included in resettlement plans, with
appropriate safeguards. Such safeguards include (i) full consultation with landowners and any
non-titled affected people on site selection; (ii) ensuring that voluntary donations do not severely
affect the living standards of affected people, and are linked directly to benefits for the affected
people, with community sanctioned measures to replace any losses that are agreed to through
verbal and written record by affected people; iii) any voluntary “donation” will be confirmed
through verbal and written record and verified by an independent third party such as a
designated non-government organization or legal authority; and (iv) having adequate grievance
redress mechanisms in place.

21.       The Resettlement Framework of DRILP states the following principles:

      •   Steps will be taken to minimize the impact of project works on APs and their land and
          structures and to mitigate any adverse effects;
      •   Resettlement assistance will be provided, including entitlements to replacement of land and
          other assets and/or compensation in case of involuntary resettlement.
      •   APs and their representatives will participate fully in project design and works and in the
          resettlement planning and implementation;
      •   Specific provision will be made to safeguard or improve the welfare of affected vulnerable
          groups;
      •   The economic and social future of people shall not be unfavorably affected, and they will not
          face a material reduction in income, living standards or unnecessary social and cultural
          dislocation as a result of the project;
      •   Compensation at replacement cost for houses and other affected structures without
          deduction for depreciation or salvageable materials
      •   Movement allowances, transfer allowance and rental stipend when appropriate.
      •   The RP will provide for the monitoring and evaluation of resettlement by Internal and an
          External Monitor;
      •   No distinction will be made between APs with land title and those without title and whose
          land rights are based on land use and occupancy.

22.     The project resettlement framework has accepted the policy of land donations for very small
parcels of land. The framework allows land donations in cases where the donation is made freely in
public and without coercion, does not affect household food security and where adequate income
restoration support exists for the household. The voluntary contribution will be accepted if the
following criteria are met:
      •   The donation is unforced and not the result of community pressure
      •   Donated land shall be < 10% of total land holdings
      •   Food security above 9 months
      •   HH above poverty level calculated for the food consumption
      •   Full income restoration measures are in place
23.      Any new land outside the donation criteria will be acquired by paying compensation in the
following way: (i) if households lose 15% only 5% will be compensated (ii) If the households falls
below poverty line entire land will be compensated, (iii) If the households have annual food security
less than 9 months entire land will be compensated, (iv) If the AP disagree to donate the land entire
land will be compensated. The structures will be compensated at replacement cost and the lost of
trees will be compensated at the cost of harvesting, felling, sectioning and transportation from the
site to home. The quantity of crops loss will be calculated based on the local area productivity and
compensated at market value. The detail of entitlement policy matrix for this sub-project is included
as Attachment 1.

4.        Compensation and Income Restoration

4.1 Arrangements for Valuing and Disbursing Compensation.


24.     The survey and valuation of affected land and households was undertaken by an enhanced
survey team at District level in the DTO (District Technical Office) assisted by the DISC. The team
has assessed the various categories of loss envisaged in the entitlement matrix and fixed
prices/costs for compensation. Cadastral mapping has been completed with the help of District
Survey Office to verify the plot boundaries or for comparison with lal purja documents held by the
owners. Cadastral maps marked with the proposed alignment have been produced to make the
deed transfer process easy.

25.      The Compensation Determination Committee (CDC) will be formed under the chairmanship
of CDO. The Chief of the Land Revenue Office, a representative of DDC and the Project Manager
will be the members of the CDC and other related officials will be invited if needed. The CDC will
then agree rates of compensation with the affected person. Safeguards for poor and socially
disadvantaged groups will be facilitated by the presence of the social mobilisation coordinator.

26.    Land donation agreement papers have been produced for the loss of land above within
donation criteria. However, compensation for trees and crops are calculated based on the
replacement cost principle. Compensation for trees and crop will be disbursed by cheque/cash.

4.2       Voluntary Land Donation Process

27.     The identified APs were called for community meeting to disclose the draft RP and donation
agreement for land tree and structure loss. In the meeting, they discussed on the benefits and
opportunities of the road construction. Further, the concerned households whose land will be
acquired for the project were informed about the land donation process and entitlements. Out of 115
land losing HHs, 92 have signed (MoU) 3 and other are out of district. The agreement is being
witnessed by third party, NGO federation, Bajhang and also verified by VDC level Grievance
Redress Sub-committee formed by VWRCC to ensure that the donation was unforced. Therefore,
the HHs away from district during the time of agreement will be regularly follow-up and when they
will be available they will be given further consultation on entitlement, compensation and land
donation procedures. Finally, the Memorandum of Understanding (MoU) will be prepared for those
HHs offering the land and the HHs who refused to donate the land will be compensated for. The fund
needed for the compensation of such land will be paid from reserved fund allocated for absentee
owner (see table 7).

4.3       Income Restoration Measures

28.      The project has been planning to restore the income level from two ways. The measures are
direct employment in the project construction work as unskilled labour and income generation
training for the members of affected families. Affected people will be given priority for employment as
labourers on the sub-projects and this will be the main income restitution measure envisaged for this
project. The project will provide job opportunities at least one adult from affected families for at least
90 days unskilled labour, in order to enable families to earn sufficient to restore their income. The
project will ensure that there is no employment of children on the project (Under 16 years

recommended by the ILO). The social mobilisation coordinator will monitor incidence of child labour.
AP workers will be given priority after construction for work as maintenance workers.

29.     The improvement in earning capability and project benefits will be maximised through the
addition of a savings component and life skill training for labourers, run by the project. This scheme
will encourage labourers to save 20% of wages in a savings scheme while payments are made. The
labourer joins a savings group and develops the ability to manage savings, saves a small capital
sum, learns more life skills and, as a result, can participate in other development initiatives,
encouraged by the project component. Achieving regular savings will help the poorest learn to save,
to manage these savings. Reduce indebtedness, create a small lump sum that could be used to
improve their living conditions and gain experience in managing loans. Having some savings will
enable these households to respond to and participate in other development activities and increase
the poverty alleviation impact of the project.

30.     The unskilled labour selected for the construction work will be converted to skilled workers
through employment. Training in masonry skills for drainage and retaining wall structures, gabion
building and culverts etc are learned informally on site as needed. The project hopes that this
knowledge will be useful for the income generation after the project.


4.4      Livelihood Restoration Programme for APs


31.    This section covers support to affected persons with the reestablishment of their livelihoods,
the development of new income-generating opportunities and training in life skills. During the
construction the project affected families will have priority for employment as labourers in Building
Groups and contractors labour groups. Employment as labour might be insufficient to restore lost
assets and further income restoration measures i.e. life skills training and access to other
development initiatives will be provided by the project.

32.     Household Listing, Census and Socio-economic Survey of the affected family shows that
there are 15 households (losing more than 10% of land holding and economically poor, women
headed households and displaced from the housing) which falls under the vulnerable group. Out of
15, 9 are woman headed households, 2 are poor and losing more than 10% of total holding and 3
are displaced from the housing. The following strategy will be adopted to mitigate the adverse impact
of the project in long run to the members of the household.

1.    All the interested member of the vulnerable group will have special right to join the labour group
      both in VWRCC works and contractors work while there is a provision of one member of the
      affected family will get employment as unskilled labour in normal condition. A special condition
      of contract will be added in contractor's contract to include the affected family member to join
      the labour group.

2. A special consideration will be given to reduce further damage of the remaining land during the
    construction.

3.    Special livelihood restoration program has been designed and budgeted (Table 3 and 4).

4.     Social team of DISC will further assess the need and demand of the income generation and
       livelihood restoration activities to help the family. From the assessment a recommendation will
       be made with specific action plan. The total cost allocated for this program is 1,148, 494 and will
       be borne by community development and training cost of the project.

5.        Consultation, Participation and Grievance Redress

5.1       Community consultation and participation

33.    Public meetings and several consultations in each affected ward of each VDC where the
proposed alignment and project modalities were discussed. ADB Policy on resettlement
compensation and entitlement were discussed in the context of the impact of the sub-project on
DDC programmes and budgets and the importance of the proposed access infrastructure to local

people. People were requested to participate in walkover, feasibility and detail design survey.
Beneficiaries were actively participated in identifying the alignment and recommended the possible
alternatives to minimize the land property loss due to construction.

34.      Total 17 consultation meetings were held with the land owners in each ward of the affected
VDC. During the meeting people were informed about the income restoration programme of the
project. People discussed on the project's benefit to them, possible impacts on their livelihood and
mitigation measures to be adopted to safeguard the economic future of the APs. The APs have
identified some skill and income generation training as indirect compensation of the project impact.

35.     The social team of DISC assisted by VWRCC and supported by DTO/DDC has carried out
an information campaign before conducting the registration of APs, and distributed a project
introductory leaflet in Nepali and the process will be continued. The information leaflet contains
information on the Project introduction, objective, working modality and compensation policy. During
the Affected Household Census Survey, each household was also personally informed about the
project, entitlements and procedures. This Resettlement Plan has been disclosed to the affected
people and they are informed about their entitlements through disclosure meeting organized in their
community. The RP has been endorsed by DDC/ DoLIDAR and posted on DRILP website
www.drilpnepal.org. The disclosure and consultation process was aimed to:

•     Explain the relevant details of the Project scope and schedule,

•     Explain the RP and the various degrees of project impact,

•     Provide details of the entitlements under the RP and what is required of APs in order to claim
      their entitlement,

•     Explain the Implementation Schedule with a timetable for the delivery of entitlements,

•     Explain the compensation process and set out compensation rates,

•     Provide a detailed explanation of the grievance process and other support in arbitration,

•     Enlist the help of VWRCC and other influential community officials in encouraging the
      participation of the APs in RP implementation, and

•     Ensure that all vulnerable groups understand the process and that their needs are specifically
      taken into consideration and are met by assistance by the Project.

36.      A   continued    information   and   consultation   programme    will   be   conducted   during
implementation of RP and designed income restoration programme. The social mobilisation
coordinator of DISC will act as the information conduit, informing communities about the
progress of the sub-project and supporting and facilitating the VWRCC in its community
organisation role. The social mobilisation coordinator will also support the DPO in land donation
acquisition and resettlement compensation, and actively encourage and enable the affected
people and women-headed households to participate in the process. This support will enable
communities to prepare for participation more readily and help the less socially advantaged to
negotiate employment, understand their compensation requirements, gain fairer compensation
or acceptable alternatives and conclude land deed transfer to the Government.

37.    The land donation agreement has been made freely without social pressure or coercion in
the presence of local NGO as third party. The social mobilisation coordinator will help the affected
persons in payments and also increase awareness and reduce the potential for loss of
compensation. Payment will be made at the family home or at public meetings in the local area for
small amount and by cheque for land payments or amounts more than Rs 1000.

5.2    Grievance Redress Mechanism

38.     The project affected persons have formal recourse to the CDO and Ministry of Home Affairs
in case of grievance under regulations specified under the Land Acquisition Act 2034 (1997).
Further, the project has set up a Grievance Redress Committee in the district and a Grievance
Redress Sub-Committee at VDC level to hear complaints. Owners feeling unfairly pressurised into
land donations can complain to the official Grievance Redress Committee. A grievance process has
been established in which APs who are not satisfied that compensation, replacement of lost assets
and livelihoods and allowances due to them have been fairly provided are able to seek redress and
to make a formal complaint. For this purpose a Grievance Redress Committee has been
established.

39.    A Grievance Redress Committee at District Level Comprise:

                    i.Head of DDC as Chairperson,
                   ii.Representative of the VDC;
                  iii.Representatives of the affected families (including VG member)
                  iv. Village elders or local level representatives of mass organizations or other
                      relevant agencies;
                  v. Project Manger;
                  vi. Social mobilization coordinator; and

40.     VWRCCs will also help arbitrate local problems. A villager can approach the VWRCC with
their problem which is then discussed locally with the aim of brokering a settlement. Each VWRCC
has formed a sub-committee in each VDC compromising 5 member including affected person to
hear complaints and grievances in VDC level. The VDC level sub-committee will comprise of:

                  i) Three members from VWRCC
                  ii) Two representatives of APs

41.     The presence of social mobilisation coordinators acting as intermediaries for the more
disadvantaged will assist many smaller problems being sorted out locally, preventing the need to
approach the DDC or District Administration. Such intervention supports existing cultural practices,
though not challenging or duplicating local systems and processes, but enabling them to work more
effectively and more equitably.

42.       The grievance Redressed Steps:

                                      Steps for Grievance Resolution

      Steps 1: APs file the complaints in Grievance Redress Sub-Committee (GRCS) formed at VDC
      level. Complaints of APs on any aspect of donation, compensation, relocation or unaddressed
      losses shall in first instance be settled verbally or in written form with GRCS. The complaint can
      be discussed in an informal meeting with the AP by the concerned personnel to settle the issue
      at VDC level. The Project Manager, Social Mobilization Coordinator of DISC, Community leader
      and NGO working in the VDC will also be involved in the consultation process in this regard.

      Steps 2: If no understanding or amicable solution reached from the GRCS at Village level, APs
      can appeal to District level GRC.

      Steps 3: If APs are not satisfied from the response of District level GRC member, the APs can
      appeal to the CDC. While lodging the complaint, the AP must produce documents to support
      his/her claim. The CDC will provide the decision within 15 days of registering the appeal.

      Steps 4: If APs are not contended with the decision of CDC or in the absence of any response of
      its representatives, within 35 days of the complaint, the AP, in his/her last resort, may submit its
      case to the District Court.


5.2.1     Grievances received and mitigations
43.      During RP preparation, the affected persons were informed about the grievance redress
mechanism of the project and existence of grievance redress committees in VDC and District level.
In the course of time, there were no written complaints filed with GRC. But total 5 land owners
requested in the RP disclosure meeting to reduce land requirement from the adjustment of the
design. The VWRCC and GRC members with DISC discussed on the request of the APs and found
that there is possibility of modification in design. The project proponent has modified the design by
shifting the lay-byes and cut-fill areas proposed in their land to nearest public land. The following
table provides the actions taken to settle the grievances received during RP finalization.

6.        Institutional Framework
44.     The District Technical Office (DTO) is responsible for planning and managing the
resettlement of project affected persons. The main tasks and responsibilities in planning and
managing resettlement in this sub-project are as follows.

6.1 Central-level Arrangements
45.     As the project executing agency, DoLIDAR, with support from sectoral Ministries and
Departments, has overall coordination role on compensation and rehabilitation measures. The office
of the Central Implementation Support Consultant within the DoLIDAR will support effective
implementation of the resettlement, compensation and rehabilitation measures outlined in this
resettlement plan.

6.2     District Level Arrangements
46.     Project Manager (PM) of the district will lead the implementation of the plan in sub-project
level. For the smooth implementation of the land acquisition and compensation and mitigation
measures, PM will establish integration and coordination with the Office of the Chief District Officer,
Land Revenue and Survey Office, District Agriculture Development Office, District Forest Office
within sub-project. The DRCC and VWRCC will provide necessary support to the project manager.

47.     DISC will support project manager for effective implementation of resettlement plan and also
help the affected person with information campaigns to promote clarity and transparency, and help
with community level consultations about entitlements and of what to do with compensation
payments and income generation opportunities. DISC will also act as advocates for APs to access
government programmes for income generation and local development

6.3       Compensation Determination Committee (CDC)
48.    The Land Acquisition Act 2034 provides for the establishment of Compensation
Determination Committee to decide compensation levels at District level. This is composed of the
CDO, the LRO, a representative of the DDC and the project manager, in this case the DTO
engineer. To make the decision taking process transparent and representative of the affected
persons, someone from the VWRCC and DISC member will be invited as observers.

7.        Resettlement Budget and Financing
49.     The financial resources necessary for relocation and compensation are budgeted into the
project costs and will be administered according to the Land Acquisition Act. These include:

      •   Direct compensation costs for acquisition of assets;
      •   Costs associated with rehabilitation measures for affected households and persons; and
      •   Costs associated with the implementation and management of resettlement activities

53.      The direct costs of compensation for trees, land and structures are the responsibility of
District Project Office. The compensation cost incurred due to the loss of trees, land and structures
will be covered by project cost and the fund is already available in the project account.

7.1       Costs of Compensation for Assets
54.     Two (Khet, and Pakho/Barren) types of land is affected due to the construction of the
subproject. Official land prices for the registration purpose are calculated annually at district level for
each of the different land types and classes. The Land Revenue Office (LRO) responsible for land
administration and revenue collection has four qualities and two types of land for the valuation. The
resettlement survey team has assessed the market rate of the land during the loss assessment

survey. In the market the quality and types of land for the determination of transaction rate is similar
to the government. But there is difference in the land rate between government and market rate. The
following table will provide the current and comparative land rate in the district.

The quantity of tree production and valuation is carried out on basis of Ministry of Forest and Soil
Conservation (MoFSC) Norms 2050. The norms has following provision for felling of trees having
girth of more than 12 cm when measured at 1.3m above the ground including the sectioning of trunk,
branches, and stumps up to a distance of 15m along the road with the indicated size would need the

55.      Total 179030 sqm of land will be needed for the construction of the subproject. In which
41089sqm is private land equivalent to 1.76 million rupees value as per market rate, need to be
acquired by the project. Out of private land, 92 HHs with 37459 sqm land equivalent to 1.65 million
rupees has already donated to the DDC while 23 absentee HHs with 2085 sqm of land equivalent to
0.06 million rupees yet to decide land donation. If all absentee land owners met the criteria and
would decide to donate land then the Value of total donated land would be equivalent to NRs 1.71
million. The combined value of donated land and acquired land is equivalent to NRs 1.75 million.
The total cost for compensated land for the households outside the donation criteria is NRs. 0.04
million and the value of donated land is NRs. 1.71 million. The total cost of resettlement including
compensation for the loss of trees, structure, land, livelihood restoration programme and deed
transfer is NRs. 3.1 million. The Entitlement matrix to compensation with detail break down of direct
cost is attached as attachment 2.

7.2     Allowances

56.     The time spent in the district headquarters or villages for negotiating the
compensation/donation and cost of travel and time to prove compensation is an added loss to the
landowner. Travel allowances will be paid for travelling and time spent in re-registering land and
negotiation will be paid on the basis of district agriculture wage rate. The estimated cost needed for

the production of the document for the deed transfer is NRs. 115,000 and the fund is already
available in the project account.

7.3    Community Support Costs

57.   This cost item covers the organisational arrangements required for the implementation and
management of resettlement-related activities. It includes awareness and information dissemination
campaigns and costs for meetings. The community support cost is included in the project
management and capacity building component.

8.2    Deed Transfer and Addressing the Pending Issues
The ownership transfer of donated land has already been initiated by DDC. Out of total owner only
92 households are available in the district and could be possible to complete deed transfer before
the contract awards. For the remaining of newly acquired land will be completed within 6 months of
contract signing of civil works. The DDC will request Land Revenue Office (LRO) to convene the
activities of deed transfer committee and makes necessary arrangements required for the
completion of such activities within estimated timeframe. The detail action plan purposed for the
formalization of land donation and ownership transfer is given in table 9.

9.     Monitoring and Evaluation


59.      The project has an internal monitoring and evaluation mechanism to monitor the
resettlement and compensation process in order to ascertain that the procedures prescribed have
been followed and that affected persons are at least no worse off than they were without the project.
The verification of resettlement activities will be done before the ADB will permit DoLIDAR and DDC
to sign contracts with the building groups and contractors and to commence work. This checks that
assess that the procedures were followed, that compensation was assessed and disbursed
according to the entitlement matrix. This is the responsibility of CISC resettlement specialist. This
requires additional surveys of around 10% of all affected persons to check compliance and a
verification report issued to the DDC/ DoLIDAR and then to the ADB.

60.      The impact of resettlement and compensation payments and associated issues will be
monitored. The DISC will be responsible for the monitoring of these components of the project,
supervised by the Resettlement Specialist. The social mobilisation coordinator will support the
collection of the data required for monitoring and facilitate the evaluation process at the end of the
project.

61.     Ongoing monitoring of land acquisition, compensation and resettlement will occur as a
standard activity of the sub-project DTO Engineers. During project implementation, DTO will
establish a monthly monitoring system involving DPO, DISC and implementing staff, and will prepare
progress reports on all aspects of land acquisition, compensation and resettlement activities and
operations. The monthly reports will reflect the progress in resettlement plan implementation with
particular attention to compensation payments, consultation, participation of PAPs in resettlement
plan implementation, and grievance resolution. They will submit quarterly progress reports to the

62.     DTO Engineer will attend VWRCC/ Building Group meetings as and when required. S/he will
record and monitor local reactions, concerns and grievances for discussion with the DPO Engineer
in charge. The VWRCC and social mobilisation coordinators will play an important monitoring role by
providing feedback on community concerns, grievances and requests.

63.     DTO will submit a trimester report to ADB on progress of Resettlement Plan implementation.
The implementation support consultants (CISC/DISC) will monitor the implementation progress and
advise DTO on the timely implementation of the Resettlement Plan and submission of a trimester
report to ADB through PCU.

9.1 Monitoring and Evaluation Indicators
64.     Indicators required measuring the process, project outputs and their impact on the
DRILP/ADB project objectives are summarised in below given table. Targets should be set for each
indicator at the start of sub-project design and then progress towards these targets assessed.

9.2 External Monitoring


65.      External monitoring will be conducted to assess the resettlement plan implementation and its
impacts, verify internal monitoring and suggest adjustment of delivery mechanisms and procedures.
Additional monitoring surveys of a sample of affected households will be undertaken as a part of this
activity. The socio-economic baseline surveys conducted during resettlement planning will be a part
of this monitoring activity. This activity will be undertaken by an external independent agency trained
in monitoring and evaluation and familiar with resettlement aspect of the infrastructure development,
which will provide feedback on RP implementation to both EA/IA and ADB. The external monitoring
agency will be hired by PCU with ADB concurrence. The hiring process is now initiated by PCU and
it is expected that the hiring process will be completed within 6 months of initiation. The cost needed
for such procurement will be borne by project cost.
