      That the manager looks at placing a line in the centre of the road facing 44
      and 45 Kilshane Drive as it is proving very difficult for residents to judge which
      side of the road they are on

      That the manager looks at a programme of repairing and replacing paths and
      tarmac margins along Abbotstown Road, in particular numbers 1-19.

      The North West Area Committee call on Dublin City Council to put in place a
      standard „maintenance pack‟ for residents associations to assist them in
      maintaining street signs in their area.

      That in view of the chaotic traffic/parking conditions on Fitzmaurice Road and
      the fact that recent works while welcome from a safety point of view have
      restricted parking, that the Manager arrange for a parking plan to be drawn up
      for the area in consultation with local traders to enable this area to operate
      efficiently and safely

      That the manager looks at the upgrade of lights as well as extra lights
      between 108-120 Tolka Estate



16.   Motion in the name of Councillor Mary Fitzpatrick



      Can the Manager seek to improve the public lighting scheme in the cul-de-sac
      at Clancy Avenue and examine if the trees are blocking light and require
      removal or pruning.



17.   Motion in the name of Councillor Paul McAuliffe

      The North West area committee commend the work of the Dublin City Fire
      Brigade and all Council workers for their efforts over the Halloween period.
      The Committee express their revulsion at the recent assault of a member of
      the Brigade in the area and ask the Council to outline the supports which are
      available to injured members and ensure that these supports are adequate.

18.   Motion in the name of Councillor Paul McAuliffe



      Given the challenge facing the city budget, the North West Area Committee
      call on Dublin City Council to put in place all measures possible to ensure the
      remaining €8.6 million of Government allocated Sports Capital Grants are
      drawn down and used by Dublin City Council.



19.   Motion in the name of Councillor Julia Carmichael



      The NWA Committee call on the Manager to address the illegal dumping
      which is taking place behind the shops at the west end of Clune Road. This
      dumping is visible from the public road, detracts from the area and poses a
      health risk to adjoining homes.

      That the manager looks at once again the possibility of placing railings around
      the green area facing 44 Plunkett Green, as it's badly needed to protect this
      area.

      That this Area Committee calls for a report into the amount of people using
      Tolka Valley Pitch and Putt course and how much revenue it brings in to
      Dublin City Council.

      That the Manager investigate and report on why the Poppintree Park entrance
      at Cedarwood Green was closed thirty five minutes earlier than the official
      closing time on Sunday 8th of November, which resulted in a number of local
      residents being left stranded inside the park grounds. Furthermore, that the
      Manager ensure that the official opening and closing times of the park are
      strictly adhered to in future.

      That the Manager outline the precise vetting procedures which are followed

The Chairman on his behalf and on behalf of the members of the Committee extended his
condolences to Councillor Bill Tormey following the recent death of his father Dr. Philip F.
Tormey. The Area Manager on behalf of the staff of the North West Area office asked to be
associated with the Chairman’s sentiments.

NW/374/09      Finglas Area Office update.

               ORDER: Noted.

1.    The Committee requested that Donal Keating of Dublin Bus be invited to
      November meeting.

2.    The Committee congratulated the Sports Development Officer Bruce
      McDevitt, the Public Domain Officer Jackie O‟Reilly and the
      Environmental Liaison Officer Bob Ward on the success of recent
      projects and in particular the historical walk of Finglas. Margaret
      Geraghty informed the members that the Area Office hopes to expand
      the „walk‟ programme and are working with local schools.

3.    The Committee raised concerns at the level of rent arrears and
      requested that the Manager continue to deploy resources locally in the
      areas of rent assessment and rent arrears.

4.    The Committee acknowledged the change of venue for the Finglas
      Halloween Festival and agreed to give full support to the event.

            Area.

            ORDER: Noted. The members requested a report on the
            different housing options now being considered for affordable

            That BRL provide full details of the proceeds of the sale of part of
            Poppintree for the Parkview development; that they outline the precise

            That BRL and Dublin City Council outline the steps that they will take
            to deal with the intolerable living conditions of residents in the Coultry

              2011-2017 on Friday 30th October and were asked to be in
              attendance at 9am to meet the Draft Development Plan Team first.

              „driveway extension‟ programme in the 2010 Budget.

                          MINUTES OF SPECIAL MEETING

                              TUESDAY 22nd OCTOBER 2009




NW/391/09      Poppintree Park.

ORDER: It was agreed that a letter would be sent to Residents Groups signed by all
the Councillors stating the following:

1.     Phase 1 of the Park will be officially opened early May 2010.

2.     CCTV tender advertised. Expected to be operational by Feb 2010.

3.     Increased awareness of Community Gardai and what they are responsible for.

4.     Sloped coving will be placed on top of flat wall to prevent congregation of youths.

5.     The hedge to be examined by Parks and Landscape Services and may have to be
       trimmed for horticultural reasons to strengthen and thicken the lower end. This
       will be done in consultation with local Residents.

6.     Garda cross radio communication between the Finglas and Ballymun Stations to
       assist in the response to call-outs to the park and the surrounding area.

NWA   Can the Manager provide an update on the acquisition by Dublin City Council of the paved
      area in front of (details supplied), in particular can he provide a map of the area to be
      acquired and detail a programme of works to improve the pavement, which is in a serious
      state of disrepair.



                     CITY MANAGER‟S REPLY:

                     The attached map illustrates the area of footpaths that the City Council
                     has taken in charge recently at Fitzmaurice Road. The Road
                     Maintenance Section expects to complete an upgrade of the footpaths
                     at this location within the next month. The upgrade comprises the

              repair of damaged areas of concrete and the provision of bollards to
              prevent vehicles parking on the renewed path.

I refer to the attached report dated 16th April 2009 to the North West Area Committee
regarding the matter. It was stated in that report that the matter of charging for the
use of the tennis courts at Albert College would be considered again in September
2009.



I now wish to recommend the following schedule of charges for 2010.

1.Projects



Ballymun East Temporary Youth Facility

This project currently on site is funded under the Young Peoples Facilities and Services Fund.
A budget of 220,000 was originally allocated to install a large portacabin on Shangan Road,
which was to accommodate a combination of existing and new youth groups in the area.
Subsequently an alternative, more sustainable plan emerged involving the refurbishment of
four classrooms in the Virgin Mary School. Three key local organisations will be
accommodated here, the Plough Youth Club, the Aisling Project and Young Ballymun.
Agreement has been reached with the proposed anchor tenants, which will allow us to
maximise the use of the space. Work is almost complete on the refurbishment and the
groups are already in the process of moving in.



Poppintree Community and Sports Centre

The Centre has recently been handed over to the Culture and Recreation Department,
Dublin City Council. The new manager is in place with additional sports staff due on site in

the next couple of weeks. Eleven community groups are to be housed in the complex. These
include four pre schools, two youth groups, two boxing clubs, a community employment
scheme and two community forums. The local estate office will also be based here in the
neighbourhood centre.



Silloge Neighbourhood Centre

A management group has been established to oversee the day-to-day operations of
this newly built neighbourhood centre. The building is complete and we are now
awaiting official handover from BRL. The local forum for the area and our silloge
estate office will be housed here.



Cuilin House

The work on Cuilin House/Albert Cottages is temporarily suspended as the Mountjoy
Community Works Party has withdrawn their service due to a shortage of Prison Staff
and suitable prisoners. Discussions are ongoing with The Irish Prisons Service to re
engage the works party in the near future. There are also contractual and insurance
issues to be dealt with. DCU have expressed an interest in the future use of Cuilin
House and estimates for the completion of works at Albert Cottages by a contractor
will be available in November.



Relocation of Community Groups

The process of identifying and responding to the accommodation needs of
community groups operating from flats and basements that are now required for
demolition is continuing. Area staff in conjunction with Ballymun Regeneration Ltd
have identified alternative accommodation and refurbished units for more than fifty
community-based organisations. These groups have been facilitated with a move into
interim accommodation, however the long-term sustainability of these community
groups is a concern as there are a number who currently have no viable long-term
accommodation plan.

2. Community Activities And Events



Ballymun Otherworld Festival



The otherworld festival took place during the month of October and offered a wide range of
activities for the community of Ballymun including a major public event on Halloween night.
The project was organised by the Ballymun Festival Steering Committee, an inter-agency
group chaired by the Senior Community Officer from DCC.



During October the following activities took place and involved over one thousand
children and teenagers.



1.     A four-week street art program at four separate locations

2.     A Schools art program that produced over six hundred Mollidolls

3.     A two week long circus school programs for sixty children and teenagers

4.     A four-week arts program for Poppintree Youth Project, BRYR and the Plough
       Youth Club.

5.     Film making project at BRYR

6.     Music rehearsals at BRYR



On the 31st of October Ballymun hosted the biggest “Otherworld Festival” to date. It
had the full support of An Garda Siochána and had about 3,000 visitors.



The event included a number of attractions including:

1.     A parade

2.     The BRYR rock music venue in which fourteen bands performed

3.     Setanta “Teach Ceol” with Irish Music and dance

4.     A youth activity centre

5.     A children‟s play centre

6.     Circus Gerbola performed to several hundred people and hosted six different
       dance groups from Ballymun

7.     “Mun TV” produced two hours of television screened on the front of the axis
       centre and included live music, a film produced by young people and
       interviews with participants and guests including the Lord Mayor.



The finale for the event comprised of a specially commissioned audiovisual piece by
Melimage featuring the Artane Band. The band also played live accompanied by two
groups of dancers from Ballymun. The event concluded with a fireworks display.




Sports Development

Sports Development Ballymun are continuing to organise & deliver fully accredited
FETAC Sporting modules. Summer time saw the completion of two accredited
modules in Health Related Fitness. Sixteen young people participated in and
successfully completed these modules. Additional modules including outdoor
pursuits, stable-yard and health related fitness are scheduled to take place between
September and December 2009.

3. Environment



Litter Fines

From 1st January 2008 to date 346 Litter Fines were issued in the North West Area.



Litter Wardens visited all commercial premises & industrial estates in the area prior to
Halloween issuing them with a Waste Enforcement warning letter & advised of the
responsibilities under the Litter Pollution Act & the Waste Management Act a warning
letter was also issued too.



Graffiti Removal

From 1st January 2009 to 31st October a substantial amount of Graffiti was removed
from the North West Area. Graffiti was removed from 99 locations in Ballymun &
Santry. A total of 1935 sqm was removed. We are currently only removing graffiti
from public property and offensive/abusive graffiti in the Public Domain due to budget
restrictions. Any incidents of illegal dumping or graffiti can be reported to our Free
Phone Litter Hotline 1800 251 500 or direct to the Finglas Area Office on 222 5412 /
222 5400.



Litter Picking & Cleansing

In conjunction with the standard cleansing services supplied by Waste Management
Services & Parks all open green spaces are litter picked at least twice a week in
Ballymun & Santry. The public domain crew also clean additional 18-priority routes
in the area at least 5 times a week. Additional clean ups are also carried out on
request. We also assist a number of residents groups with cleanups.



Halloween Report

The North West Area once again increased their efforts to remove bonfire materials
in the run up to Halloween. We began removing materials on the 14th September.
We contacted all our local residents groups and asked them to forward any details
they might have in relation to youth‟s stock piling bonfire materials. We did receive a
number of tip offs and were able to gather large amounts of materials. Over 1, 200
warning letters were issued to residents in relation to the storing & transporting of
bonfire materials/waste in their gardens in the run up to Halloween. We worked
closely with residents to ensure that most skips in the area were removed on or
before 31st October in order to minimise materials available for the bonfires. We
carried a large number of early morning raids on properties were we knew there were
large amounts of bonfire materials stored. In cases where these were DCC tenants

they will be interviewed and advised that they have incurred a breach of their tenancy
Agreement.



From Saturday 24th October the Parks Department & Housing Maintenance had a number of
crews in the area to remove all bonfire materials. We provided them with a list of locations
having gathered the information. These crews were in addition to the normal Waste
Management crews, the Rapid Response crew.



On Halloween we continued to collect materials until 1.30pm in the Ballymun area. In
Finglas we continued to confiscate materials until 5.30pm. The Gardai were fully
supportive of this and supplied us with assistance all day in the Finglas area
otherwise this could not of happened. We targeted bonfires that we believed were an
issue under Health & Safety & had large amount of tyres or toxic materials. The
Public Domain Officer identified these bonfires and the Gardai blocked off the area
while the parks department obtained the materials. This proved to be hugely effective
as the bonfires were much smaller than previous years and many were almost
extinguished as early as 10.00pm. The Gardai have also confirmed this. We
managed to reduce the bonfires in the Finglas area by four locations & three
locations in Ballymun .



210 tonnes of materials were removed by parks on the Northside of the city from 24th
to 31st October. It is estimated that over 60% of this was from the NWA.    The
clean up was complete in the NWA by Thursday 6th November. The size of the
locations burned was much smaller than previous years & less domestic waste was
burned this year in comparison to 2008. This was due to the number of investigations
into domestic waste accounts in the area & the processing of domestic waste waivers
in the North West Area.




4. Social Sustainability



Safer Ballymun

The Safer Ballymun initiative is continuing, with regular public meetings at which
residents, Dublin City Council, Ballymun Regeneration and the Gardai come together
to address issues of community safety. The next public meeting is scheduled for 14th
December. Safer Ballymun Week took place from the 19th to the 23rd October,
during which a wide range of activities were held, including coffee mornings in the

Neighbourhood Centres, a poster competition in schools and presentations by the
Lord Mayor of Safety Awards to various groups and individuals. One of the most
popular events was the open day in the new Garda Station.




Ballymun Neighbourhood Council

BNC is undergoing a strategic review at the moment to assess its current status and
the direction for the future. A morning long session is planned for 16 th November as
part of this process.

5. RAPID



Dormant Accounts

The groups that have received funding to date are detailed in the table below; all
other applicants are out standing at present. The McCarthy report recommended the
discontinuation of the Dormant Account funding, however no decisions have been
made to date. The funding allocated to Ballymun in 2009 was 320,000; to date the
successful groups have received a total of 177,700. The second round of the
Dormant Account funding is due to be announced October/November.

No new funding streams have been announced.



CCTV

Contractors have been selected for the transmission and the civil work for the Ballymun
CCTV project. POBAL have requested BRL to send them the top three contractors along with
the marking criteria used to assess the tenders submitted. Pobal need to formally approve
the contractors selected. POBAL have also requested BRL to complete a number of
templates and send additional documents, once this is done BRL can go to contract with
POBAL. We anticipate that work will commence in November and the system will be fully
operational by March 2010.

Anti Social Unit



63 complaints were received in the Ballymun Office and 12 first interviews and 9
follow up interviews were held between Sept 2009 and Oct 2009, 4 final letters were
issued for Anti Social Behaviour.

Coultry Road

This area has seen an increase in anti social behaviour and a meeting with the
Gardai was set up to seek a common approach to dealing with this problem. We
identified a number of youths who were involved in this behaviour and they have
been called in for interview some received final warnings and some cases are being
forwarded for legal action to begin. We also arranged to have the stairwells power
hosed and cleaned.



Silloge Road

Following on from final interviews with youths from the Silloge area a number still
continue to cause anti social behaviour problems in the Silloge area. These files will
be forwarded to the central unit for the consideration of legal action

C.C.T.V

We are in daily contact with the concierge in Balbutcher Lane which operates our C.C.T.V
and our door entry system. We continue to work with them in identifying areas where anti
social behaviour occurs and liaising with the Gardai and the local residents in resolving this
behaviour.




Poppintree Neighbourhood Centre



The Poppintree Estate office has nearly reached completion. The office is due to open in
early December, pending installation of computer systems.



Carton Estate



Letters were sent to all the residents in Carton who have made changes to their
regeneration houses. The people who painted their houses have been called in for
interview. A copy of the minutes of the interview has been put on their housing file. Letters
were sent with a break down of the procedure for requesting permission to make
alterations; a warning was given to any one who made minor alterations.



The Halloween festivities were very well managed in the Poppintree Area. There were 9
Bonfires in Poppintree. All bonfire debris was cleared up with in two working days.



The courts are swept once a fortnight. The Estate Manager regularly walks the area
with the Ballymun Environmental Group, to ensure the Courts are being cleaned on a
regular basis.



A clean up was held in Belclare Park with the children. The leaves were swept and a
general tidy up was done. The local Centra shop provided goodie bags for the
children who took part.

There is an ongoing issue of Horses on the green areas in the Poppintree area. The
local office has logged complaints with the Environmental Department requesting the
removal of these horses.



Balcurris Neighbourhood Centre



Ten lettings were made in the Balcurris area during the September/October period.
Two lettings were from the housing list. The remaining eight were transfers, seven of
which were regeneration moves to the newly opened Dolmen Way and Dolmen
Terrace. There are currently nine vacancies, two houses and seven flats. Seven of
these vacancies are under offer and are expected to be occupied in the near future.
As part of “Breaking New Ground‟s” Art Trail of public Art works for Ballymun,
Balcurris Park saw the installation in October of a piece by Kevin Atherton entitled
“Another Sphere”. It consists of a pair of stainless steel hemispheres sited at
opposite ends of the park, the reflected surfaces of which are continuously filmed by
two CCTV cameras and the images are transmitted to a central broadcasting point.



Silloge Neighbourhood Centre



As part of Safer Ballymun week an information / coffee morning was held in Marewood
Court Older Persons Complex on Thursday, 22nd October 2009. This event was supported by
Ballymun Community Gardai, Dublin City Council, Estate Management Section, Liaison
Service and Safer Ballymun Staff. This was a very well attended event with entertainment
provided by the local girls school. A beautiful buffet was provided by LINX. Information with
regard to personal safety and safety within the home was given by the Gardai.



Sandyhill Gardens - a number of residents are moving from upper floor accommodation to
ground floor vacant accommodation due to medical needs.



Shangan Neighbourhood Centre



The number of callers to the Shangan Area Office on Wednesday‟s mornings is
increasing each week. Most calls are with regards to housing issues & estate
management.

There are a number of tenants in breach of their tenancy agreements having painted the
outside of their houses/railing etc. in the Whiteacre/Shangan Regeneration Area. Letters
have been sent to these tenants requesting them to stop and the area office has received a
good response from tenants seeking permission asking to retain the paintwork. This matter
is currently with the Area Engineer pending outcome.



Dublin City Tenancy Sustainment is currently working together with estate
management on 2 cases within the Shangan Area; the aim is to give these families a
better support network within their everyday living needs.



Two case conferences have taken place with regard to residents of Hampstead
Court. Both were attended by representatives of Estate Management, Liaison
Service, Alone, De Paul Ireland, Home Help Service, G.P. Service and Welfare
Officers. Problems with regard to the two residents were discussed in great detail
with emphasis on their well being and capability to independent living being a main
priority. Responsibility with regard to medical tests, independent living sustainment
with supports were agreed and will be monitored on an ongoing basis.



Problems with the leaking roof in Domville Court have been addressed with the
builder with temporary accommodation being provided in a local hotel for a couple
resident in the complex. There are currently no vacancies in this complex.



Coultry Neighbourhood Centre



Local children from the Coultry area made costumes and facemasks, with the help of
the street arts projects and took part in the parade from Days Hotel to Civic Plaza.



Gardai have reported that there were no major incidents on Halloween night in the
Coultry area.



The 2nd block in Coultry is nearly empty and will be handed over for demolition in
2010.



Relocation

22 units in Poppintree 3 (Dolmen Way and Dane Road) have been handed over to
Dublin City Council. The families that moved in were from Coultry Road, Balbutcher
Lane, Silloge Road and Shangan Road.          Allocations and Rent Assessment are
complete for the remaining units, which are due for handover in late November 2009.



20 units in Silloge 6 (Marewood Crescent and Sandyhill Gardens,) were handed
over. The families that moved in were mainly from Silloge Road. Allocations and
Rent Assessment are complete for the remaining units, which are due for handover
in early December 2009.



Allocations are ongoing for Balcurris 5 and rent assessment has started. Handovers
are due to commence in March 2010



A refurbishment program has now been completed in Coultry Road no.65, 32 and
32A for two football clubs to facilitate the demolition of block 2 Coultry Road (94-186)

The two football clubs will take over these new facilities on Thursday 11/11/09.



Demolition is now nearing completion on 1-48 Silloge Ave; this is the last of the four
storey blocks remaining in Ballymun.



Clerk of Works/Quality Control




Sillogue 4 + 5

Sisk Builders have started their snagging and are hoping to be completed before the end of
the year. The detail on the entrance steps to a number of dwellings on this site are being
examined by BRL as they may be problematic from an estate management viewpoint.



Poppintree 12

The snagging on this site should commence next week.



Owensilla Terrace

Dublin City Council will be taking charge of this estate, with the exception of a couple
of addresses with outstanding issues.




Rent Assessment



In addition to the general day-to-day functions of Ballymun Rent Assessment Section, the
following work is being carried out.

As previously reported, the remaining AR1 (Household Incomes Details) forms have been
distributed by the central rents office. To date, approximately 900 of these forms have been
returned to this office, and of these approximately 470 have been processed.         A small
number of these forms have not been fully completed, i.e. information remains outstanding.
In these cases tenants have now been sent a final notice, having failed to respond to two
reminder letters. Should they fail to respond to this final notice, assumed incomes will be
applied for the period under review, a method which has proved successful in dealing with
previous AR1 returns.




           2. Over 18‟s list



This is a process whereby each person over 18 is added to the differential rent on the basis
of an assumed income until information is received.

Report un-sold affordable housing North West Area



In the North West Area, Dublin City Council has unsold affordable units in Prospect
Hill - Finglas Road, Parkview – Poppintree Park and Hampton Wood - St. Margaret‟s
Road.




The Affordable Unit propose to utilise these units as follows:

1.      Prospect Hill – 39 units unsold – selling affordably by way of Newspaper
        advertisement and Web (dublincity.ie/ahp.ie/Daft).
2.      Parkview, Poppintree Park– 15 units unsold – selling on the open market at
        market value by way of Newspaper advertisement and Web
        (dublincity.ie/ahp.ie/Daft).
3.      Hampton Wood - 47 units unsold - assigned to Social Leasing and De-
        tenanting as per Circular AHS 01 2009.
4.      NABCO Finglas Rd – 51 units development not completed -assigned to Social
        Leasing.

Local Authority House Purchase Loan scheme.

Dublin City Council operates the Local Authority House Purchase loan Scheme for
the provision of annuity and shared ownership loans to purchase new and existing
properties in its‟ administrative area.

To be eligible to apply for the House Purchase Loan applicants must be:

1.      First Time Buyers.

2.      Be in permanent employment for at least two years.

3.      Have income not exceeding €50,000 for a single applicant or €75,000 for a
        joint application.

4.     Have a minimum deposit of 3% of the purchase price of the property.

Fully completed application forms are accepted by the Loans Section of Dublin City
Council and forwarded directly to a central bureau for underwriting. As part of the
underwriting process a credit and judgement check is carried out on each application.

The Department of Environment, Heritage & Local Government introduced a credit
policy and guidelines for the assessment of all applications for Local Authority
Housing Loans. The new loan assessment criteria are in place with effect from 27th
April, 2009.

A Letter of Recommendation to decline or approve a loan is issued by the Central
Bureau to Dublin City Council. Upon receipt of the Letter of Recommendation the
application is presented to the Credit Committee of Dublin City Council for final
recommendation.




Since the introduction of this new assessment criteria Dublin City Council has
received 30 applications for the House Purchase Loan.

With reference to the acquisition of 62 Coultry Gardens, in exchange for 74
Forrestwood Avenue, Ballymun, Dublin 9.




During the consultation process with residents adjoining the Coultry 6 housing
scheme, Ballymun Regeneration Limited, agreed to acquire 62 Coultry Gardens.
Following negotiations agreement has been reached with the owner to acquire this
property by way of exchange for 74 Forrestwood Avenue.



It is therefore proposed to dispose of 74 Forrestwood Avenue, to the executors of the
estate of the late Mr. Joseph Doyle deceased, in exchange for 62 Coultry Gardens,
on the following terms and conditions.



1.     BRL will dispose of the fee simple interest in 74 Forrestwood Avenue, to the
       respondents of Joseph Doyle deceased. The property to be disposed of is
       outlined in red in drawing no. AG 039_001 attached.



2.     BRL will acquire Mr. Doyle’s interest in 62 Coultry Gardens free from all
       encumbrances.



3.     Each party will be responsible for their own legal costs.

4.      BRL will pay a contribution of 20,000. (twenty thousand Euro) towards your
        necessary legal and other costs associated with the transaction.



The exchange of lands shall be subject to conditions as to title, as the Law Agent in his
discretion shall stipulate.



No agreement enforceable at law is created or intended to be created until an exchange of
contracts has taken place.
