Date and description of alleged misconduct:                On 8/25/05 Frank was found on campus to be under the influence of a
   controlled substance Marijuana. This is his third drug/alcohol related offense (first one occurred 5/7/04 and involved possession
   of drug paraphernalia; second offense occurred 2/11/05 and involved possession of alcohol at the school’s basketball game).




Description of interim disciplinary action pending outcome of Manifestation Determination:
     Suspended from school for:     5 days (not to exceed 5 consecutive schooldays or 20 cumulative schooldays.)
     Placed on in-school suspension for:        days (not to exceed 5 consecutive schooldays or 20 cumulative schooldays.)
     Continues current placement         with modifications:
     Superintendent/designee extended suspension (not to exceed 10 consecutive days) while expulsion is being pursued.
     Ordered to 45 schoolday interim placement:
     Court order preventing student from being on school campus.

Description of student’s disability:                Specific learning disability involving visual processing deficits (difficulty with

  Explain:      Neither Frank nor his parents were able to present any information that would directly connect his specific learning
  disability to the alleged misconduct.

2. Was the conduct in question the direct result of the school district’s failure to implement the IEP?
     YES     NO      Explain: Frank was receiving the special education and related services documented on the 1/12/05
  IEP and 2/15/05 IEP Team Meeting Notes. The 2/15/05 Behavior Support Plan was also being followed at the time of the alleged
  misconduct.




                                        IEP TEAM FINDS STUDENT’S BEHAVIOR:
      WAS a manifestation of the disability (“Yes” was the response to question 1 and/or question 2).
      WAS NOT a manifestation of the disability (“No” was the response to questions 1 and 2).
