Baroda Chapter is being established and currently Mr.Bhavesh Patel owner of Beats Cafe who has joined
the association recently is meeting Cyber Cafe Owner in Baroda. Members can contact him on

member who are joining. One Baroda has 20 members a proper election of the committee shall be
carried out and the elected President of Baroda shall be member of the Central Committee. The member
Registration fee shall be collected at the time of election in Baroda. All the Café Owner Friends in Baroda

Foundation


Sine 2006 when Gujarat Cyber Act was introduced a need of such an association was felt by cyber café
operators in Rajkot and elsewhere. In 2009 when an email sent by Indian mujahidin was detected to have
been sent from Rajkot; the cyber café operator was arrested by the Police department but the person
who had sent the email was not traced due to insufficient information, this is when the base for this
association was laid.

Gujarat Police Rajkot SOG Division Police Inspector Mr. Pandya had the responsibility to trace and
prevent cyber crime which was given very high priority by the Police department. Regular checking was
carried out in all the cafes in Rajkot by SOG where records of the users were checked regularly and it was
ensured that proper procedures are followed by each café operator.

After the attack on Hotel Taj and use of VOIP device; Mr.Vikram Tanna of Kaizen Mindworks Pvt. Ltd. was
contacted by SOG to get VOIP call logs made from different Cyber Cafes as he was the Master Franchisee
for Sify Telecenter. Mr.Vikram Tanna who also owns a Cyber Café in Rajkot offered all the support in
providing the required logs and also imparted some basic training to SOG on VOIP and Internet. During
his frequent meetings with PI Pandya they felt need of an association so that proper information could be
gathered which can prove helpful to the police department in tracing cyber crime. Mr. Vikram suggested
a centralized system where all the details required by the Police Department as per Cyber Act can be
stored and accessed online. At this point Mr.Vikram was inspired by the SOG to try and bring people
together so that such a system can be put in place. SOG also suggested taking help of Mr. Ashutosh
Mandlik who owns one of the oldest Cyber Café ‘Sign up Cyber Cafe’ in Rajkot. During regular checking
and visits by the SOG PI Pandya he had found ‘Sign up’ to be one of the first Cyber Café in Rajkot who had
Cyber Café License and was maintaining proper records.

On 7th April 2009 Mr.Vikram and Mr. Ashutosh had a meeting at Kaizen Mindworks office at kishanpara,
Rajkot and jointly decided to go ahead and make an effort to form an association of Cyber Café, Gaming
Zones and VOIP Calling Booths. A paper Advertise was placed in Akila News Paper for the formation of
Association which had a very good response and today and idea has turned into reality with the
participation & support of all the Cyber Café Owners. The success of the association is the result of joint
efforts of all our members and the co-operation and inspiration that we have received for Police
Department, RMC and Press.

The Association started operations from July 09 and collection of regular membership fee started from
July onwards.

Members Obligations
     Abide by all Union, State, Municipal Corporation Acts/Laws

     Abide by the Memorandum of the Association

     Abide by all the resolutions passed by the association

     Maintain rates as per the “Minimum Rate List” and “VOIP Rate List” in their respective city

     Follow “Compulsory Holidays List” and “Outlet Operating Time” of their respective city

     Shall not enter into unhealthy competition with any outlets registered with the association

     Display the association sign board on the front side of their outlet

     Make sure that no person who is on the “Active Defaulters Internet Users List” published
      by the association be entertained in their outlet in any way

     Carry out their business in a manner in which dignity of our profession is maintained.
      Members shall not operate with closed cabins or private areas for internet users as
      required by the Law. Outlet should not be operated as meeting points for couples etc by
      providing enclosed area of any kind.

     Agree and abide to the decisions taken by the Central/Local Body

     Pay in advance the prescribed “Central Annual Membership fees” and “City Annual
      Membership fees”

     Collect Internet Users Information on “Internet Users Membership Forms” published by
      the Association and submit it to the appointed contractor or to the Association for
      publication on the “Internet Users National Database”

     Verify and take responsibility of the information collected through “Internet Users
      Membership Forms”

     Maintain internet usage sessions as prescribed by the Association in accordance to the
      Law

     Entertain “Internet Usage Members” of the Association listed on the “Internet Users
      National Database”

     Use Association Trademark as per “Association Trademark Usage Policy”

     Resolve disputes with any other outlet who is member of this association internally
      through the City Body.

     Deal with contractor in the “Active Contracts File” appointed by the association in
      accordance with the Contract Terms and conditions.

     Deal directly with any/all Third Party Services Providers / Registered Suppliers with which
      the association has signed a MOU or has entered a Tie-up. Quality of any such services /
      products have to be verified by members directly and association shall not be responsible
      in any case towards the same. Members shall make payments to all such parties whose
      service / products have been used and in case of any disputes in this regards the
      Association may intervene.

     Shall participate in elections of city body and shall also remain present in important
      meetings of the association for passing important resolutions and vote for the same.

     Report violation of the charter of the association by any other member outlet of the
      association to the City Body.

     Introduce service providers to the association and be instrumental in forming new Tie-
      ups.

     Collect advertisements for the association website/Login Screen/print materials etc.

     Stand united for any member of the association in hour of need. To respond to any call
      for strike or Bandh by the Association to register our protest.

     Help the Government agencies in Preventing Cyber Crime.

     Conserve Electricity by switching off all the power consuming instruments like computers
      when they are not in use. To switch on Air conditioners only when there are 3 or more
      customers in the outlet. Avoid the use of Glow sign (Back Light) boards of any kind.

     Report any person on the “Defaulter Employees” List to the Association and not to
      employee any such person in their outlets.

     Support of the association while facing any problem with any external entity. United front
      to fight Cyber Crime

     Legal Guidelines as and when required. Representation by Association Lawyers for
      legal/police cases free of cost in accordance with the charter of the association.

     Prevention of unhealthy competition. Standardization of Rates, Holidays and Operating
      timings City wise. Centralized Internet Users Information collection and verification
      system

     Use Associations Internet Users Database to verify the identity of Internet users

     Issue and Verify Internet User Membership of the association

     Suspend any Internet User Member of the association from using any services in
      associate outlets for justifiable reasons.

     Access to Cyber Café Management Software of the Association

     Listing on the Association Website along with login access to members area

     Generation of extra revenue through the tie-ups of the association with various
      companies

     Special Rate for Services and product required by us through Rate contracts with
      Suppliers

     Generate extra income through advertisement contracts of the association from time to
      time. Earn commissions through advertisement collected for the association

     Report complaint against any association member violating the charter of association

     Voting rights for the city body of the association. Voting rights for various resolutions
      passed in all member general meetings.

     Access to all the documents of the Central / City Body of the committee. View accounts of
      the association and report any errors or mismanagement

     Install Association Sign board for the registered outlet as per specifications. Use
      association logo on visiting and rate cards as per specifications. Display Association
      Membership certificate inside the registered outlet

     Facility to report employees on “Defaulter Employee List” who are involved in theft of any
      kind from your outlet and get assistance from the association to trace the person with
      assurance that the person shall not be employed with any associate outlet.

      Get pre printed basic café management stationary from the association at subsidized rate
       or totally free of cost made available through sponsorers of the association.


The Central Body
Central Organization Chart – Published with the signature of the Founders/Observers

Every time there is a change in the Central committee a new “Central Organization Chart” signed
by the President/Founder shall be published and the old will be filed for references. The names in
this Cart shall have the authorities as defined by the association. This list should be published on
the association website. The central body will be the main body which shall manage the entire
association nationwide.

The Central Committee shall comprise of members as follows. The member should quality for the
post as defined below and his tenure shall be as mentioned below.

All the members of the Central body shall be given User ID and passwords with special privileges
to logon to the association website and carry out their routine work. Any activities carried out by
the Central Body member after logging into the association website shall be considered
authorized and his submission of password shall be taken as his personal signature.

Central Committee Members

President of every Local (City) Body of the Association shall by default be the member of the
central committee and shall be appointed as per standard procedure no 3. Local Body Elections
shall be held every two years or earlier. Any central committee member who has been assigned
a portfolio by the Chairman shall be looking after related matters of the association. Although the
committee member shall not be authorized to take independent decisions concerning his
portfolio.

The Local (City) Body - Chapter
City Organization Chart – Published with the signature of the Founders/Observers

Every time there is a change in any City Committee a new “<City Name> Organization Chart”
signed by the Central President/Founder shall be published and the old will be filed for
references. The names in this Cart shall have the authorities as defined by the association. This
list should be published on the association website. The City Body will be the main body which
shall manage the association activities as per set guidelines in that particular City.

The City Committee shall comprise of members as follows. The member should quality for the
post as defined below and his tenure shall be as mentioned below.

In case where a city body is not feasible or not required than such cities or locations shall be
directly under the central body and the central body shall carry out the activities of the city body
directly.

All the members of the City body shall be given User ID and passwords with special privileges to
logon to the association website and carry out their routine work of their respective cities. Any
activities carried out by the City Body member after logging into the association website shall be
considered authorized and his submission of password shall be taken as his personal signature.

Association Member
Any company, partnership firm or a proprietor can become member of the association who is
operating any of the below mentioned profession

Types of Professionals and business to be taken as members

   1.   Cyber Café
   2.   Gaming Zones (PC Based)
   3.   VOIP Calling Zones
   4.   Internet Service Providers
   5.   Internet Telephony Service Providers
   6.   Broadband Cable Network Operators

An “Association Membership Form” will be required to be filled in by the Person representing
the concerned entity. All required documents will have to be submitted. Membership shall be
granted as per standard procedure no 6.

The Member shall comply with the “Member Obligations” as mentioned in the memorandum of
the associates. The Central Body shall have the authority to suspend / terminate membership of
any associate through a resolution. In cases where any outlet or associate has stopped
operations in our sector or has discontinued business or is not contactable than the city body
shall pass a resolution mentioning the same and taking signature of five near by associate
outlets and terminate any such Associate member.

All the members of the association shall be given User ID and passwords with member privileges
to logon to the association website and carry out their routine work. Any activities carried out by
any member after logging into the association website shall be considered authorized and his
submission of password shall be taken has his personal signature.

Organizations having more than one outlet (outlets with different addresses to be considered
different entity) shall require taking separate membership for all such outlets. Membership
Registration and Annual Membership fees for all such outlets shall be payable separately.
Although membership fee shall be same regardless of the number of computer systems in any
outlet.

At any point the fees paid by any associate to the association shall not be refundable for any
reason what so ever. The membership fees shall not be transferable.
