Homestead Declaration

More Info
A homestead declaration is a written statement, made under the penalty of perjury that
claims a particular ?dwelling? (for example, a house, condominium, boat, or similar
property) as the owner's principal place of residence. For simplicity, this guide uses the
word ?home? to describe any principal dwelling. When a homestead declaration is (1)
signed by a homeowner, (2) acknowledged (i.e., ?notarized?) by a notary, and (3)
?recorded,? it helps protect the home against loss to creditors. By law, a portion of the
value of a home can be protected from legal actions including bankruptcy, collections
and property taxes. Use this form when wanting to protect a home (or part of) from
creditors (most of them).
