party that wishes to use that land for pasturing

PASTURE LEASE AGREEMENT
This Pasture Lease Agreement is made and entered into this __________ day of __________,
Landlord does hereby grant on lease to Tenant, the following described farm lands and premises,
to occupy and use for pasturing purposes:
consisting of approximately __________ [AMOUNT IN WORDS] (___ [AMOUNT IN
NUMERALS]) acres situated in the County of __________________, in the State of
_________________. (hereinafter the “Pasture”)

The term of this lease shall be for a period of __________ [AMOUNT IN WORDS] (___
[AMOUNT IN NUMERALS]) years, commencing on the __________ day of __________,
_____, and ending on the __________ day of __________, _____. Any holding over by Tenant
shall be considered a trespass.
Upon expiration of this initial term, this lease may be extended by mutual agreement between
Landlord and Tenant for a further period upon the same terms and conditions as contained
(a) During the term of this Agreement, Tenant shall pay to Landlord a monthly rent in the
amount of __________ [AMOUNT IN WORDS] dollars ($_________ [AMOUNT IN
NUMERALS]) per animal unit pastured on the Pasture. This rent will be due and payable on or
before the _____________ [ORDINAL] day of every month.
During the term of this Agreement, Tenant will pay Landlord a yearly rental of __________
[AMOUNT IN WORDS] dollars ($_________ [AMOUNT IN NUMERALS]) per acre for the
use of the said Pasture. This rent will be due and payable on or before the _____________
[ORDINAL] day of ______________ [MONTH], every year.
(b) If the rent is not paid when due, Tenant agrees to pay interest on the amount of unpaid rent at
the rate of __________ [AMOUNT IN WORDS] percent (__% [AMOUNT IN NUMERALS]
per annum from the due date until payment is made.
(a) Tenant agrees:
i. Not to pasture any livestock which is dangerous or apt to break fences or break out of the
Pasture. In the event if any animal is found outside the Pasture on three occasions, the Landlord
may request its removal.
ii. Not to assign his/her rights and duties under this lease without the written consent of
iii. To brand or tag all livestock in a manner sufficient to determine their ownership.

iv. To take prior approval from Landlord regarding number, health, sex, breed, and age of the

condition as in the beginning of the term, normal wear and tear excepted and to use the said
Pasture for the purposes of a grazing operation only.
(b) Landlord agrees:
i. To keep the fences in good and serviceable condition prior to the date livestock are brought to
the pasture and to maintain the fences for the term of this Agreement.
ii. To provide an adequate source of water throughout the term of this Agreement.
iii. To give at least __________ [AMOUNT IN WORDS] (___ [AMOUNT IN NUMERALS])
days prior written notice to Tenant of any plans for putting any male animal(s) into the pasture,
including a description and approximate dates of entry and withdrawal.
iv. Subject to the compliance of all conditions contained herein by Tenant, Landlord shall ensure
that Tenant peaceably possesses and enjoys the said Pasture, without any interruption or
disturbance from Landlord or any representative of Landlord.
v. To pay all taxes levied against the said Pasture.
In the event Landlord gives __________ [AMOUNT IN WORDS] (___ [AMOUNT IN
NUMERALS]) days notice before putting any male animals into the pasture, Tenant shall then
have the option of removing any of the female stock without liability for any rental charges on
the animals removed for the remainder of the term of this Agreement. Failure to remove any
female stock within the specified length of time shall be interpreted to mean that Tenant has not
objected to Landlord’s stated intention and this Agreement shall continue to be binding.
(a) Tenant shall use the Pasture for the sole purpose of pasturing of the livestock for which
Tenant is the absolute owner or to which Tenant has a right of possession and, for no other
purpose or purposes whatsoever.
(b) Tenant shall not, without the prior written consent of Landlord, authorize or permit any other
person to use the said Pasture for the pasturing of livestock owned by such other person.

(c) Tenant shall not cause or permit the said Pasture or any part of the Pasture to be grazed in a
manner as to impair the normal reproduction of the vegetation thereon. In the event that
Landlord considers that the Pasture is overgrazed, Landlord may, by giving written notice,
request Tenant to reduce the number of livestock be maintained.
(d) Tenant has no rights to sand, gravel, or clay in the Pastures, except for his/her own use, and
Tenant shall have no right whatsoever to any valuable stone or other such substances existing on
or under the surface of the said Pasture.
(e) Tenant shall not change the natural course of any waterways on the said Pasture or cut down
trees growing upon the Pasture nor will Tenant permit any other person to do so, without written
consent of Landlord.
(f). Landlord reserves the right personally or by agents, employees, or representatives, to enter
upon the Pasture at any reasonable time to inspect and to work or make repairs or improvements
on the Pasture. Landlord reserves the right of entry and exit over and upon the Pasture for the
purpose of using any land and buildings expressly excluded from this Agreement.
(g) Tenant shall not keep more than __________ [AMOUNT IN WORDS] (___ [AMOUNT IN
NUMERALS]) animals in the Pasture at any time. Any violation of this condition shall
constitute ground for termination of this Agreement.
(h) Tenant agrees not to erect or permit to be erected any structure or building on the Pasture or
to incur any expense to the Landlord for such purposes.
Unless otherwise agreed upon, the payment of all taxes of the Pasture indicated in this
Agreement shall be made by Landlord.
8. Improvements and Seeding
Tenant shall be responsible for normal repair and maintenance of the Pasture. Without the prior
written permission of Landlord, Tenant shall not make any major improvements to the Pasture.
Major improvements shall include, but are not limited to,: water development, erosion control,
fencing and building construction, clearing, breaking, and seeding to pasture and hayland.
(a) Landlord and Tenant may mutually agree to terminate this lease at any time.
(b) If either party fails to carry out substantially the terms of this lease in due and proper time,
the lease may be terminated by the other party by serving a written notice citing the instance(s)

of default and specifying a termination date of __________ [AMOUNT IN WORDS] (___
[AMOUNT IN NUMERALS]) days from the date of such notice.
All notices, demands, and requests which may be given or which are required to be given by
either party to the other, hereunder shall be in writing. Such notices shall be deemed delivered
when personally delivered to the address of the party to receive such notice set forth below or,
whether actually received or not, five (5) days after having been deposited in any post office or
mail receptacle regularly maintained by the United States Postal Service, certified mail, return
receipt requested, postage prepaid, properly addressed as follows:

Tenant shall not sublet or assign this lease or any part thereof, or any interest therein without
obtaining the prior written consent of the Landlord to the sublease or assignment.
Any amendments and alterations to this Agreement shall be made only in writing and shall be
signed by both Landlord and Tenant.
12. No partnership created
This Agreement shall not be deemed to give rise to a partnership relationship, and neither party
shall have authority to obligate the other without written consent, except as specifically provided
in this Agreement.
13. No Waiver

The failure on the part of Landlord to insist upon strict performance of any covenants or
conditions in this Agreement or to exercise the right or option hereunder shall not be construed
or operate as a waiver or relinquishment for the future of any such covenant, condition, or option
and no waiver shall be inferred from or implied by anything done or omitted by Landlord, save
only express waiver in writing.
14. Force Majeure
No Party shall be responsible for delays or failure of performance resulting from acts of God,
riots, acts of war, epidemics, power failures, earthquakes, or other disasters, providing such delay
or failure of performance could not have been prevented by reasonable precautions and cannot
reasonably be circumvented by such party through use of alternate sources, workaround plans or
