    1.      DEVELOP PROCEDURES, GUIDELINES AND
            PROCESSES                                                    25
    1.1     Analyse the Land Purchase Agreement to determine
            parameters of Land Usage
    1.2     Determine the Land Agreement procedure by formulating a
            work agreement which will stipulate the working relationship
            between the affected parties
    1.3     Facilitate discussions with the Legal Department to
            determine the rules and regulations pertaining to Lessor
            /Lessee and Purchaser / Purchasee Rights to design
            acceptable non-compliance guidelines and processes
    1.4     Develop contractors’ Code of Conduct and ensure the
            implementation of the code and continuously monitor
            adherence to the Code
    1.5     Monitor on a continuous basis adherence to the Land
            Agreement Procedure and Contractor’s Code of Conduct to
            establish contraventions and determine effective steps to
            deal with non-compliance

    2.      PROJECT LIAISON AND INTERFACING                                20
    2.1     Establish forums between Project Manager, Contractors
            and Land owners on an ongoing basis to create a working
            relationship to ensure the smooth running of the project.
    2.2     Approve, after negotiating with Contractors, Project
            Managers and Land owners access to land to incorporate
            access into project plan. Monitor implementation of plan
            and arrange access by continuous communication with
            Contractor and Land owners.
    2.3     Agree between all affected parties no go areas and have
            same monitored by creating an open line communication
            channel with post incumbent.
    2.4     Negotiate between Contractors and Farmland owners
            continuously the relocation of services and infrastructure
            ahead of construction, which would involve the Dept of
            Labour, Eskom Distribution and Provincial Road
            Departments.

    3.      IMPLEMENTING AND MONITORING AN ASSURANCE
            PROGRAMME
    3.1     Appointed as the Emergency Preparedness Programme
            head on the Rail Link projects by putting an EP plan
            together managing the plan and effectively test and
            monitoring the plan.
    3.2     Ensure that all Eskom assets are secured by entering a
            contract and managing a security contract in terms of
            Contract Management Principles.
    3.3     Manage the land purchased by Eskom in terms of sound
            land and environmental principles by ensuring the fauna
            and flora and that fences and gates kept in place to assure
            no stock theft and illegal occupancy to the Eskom land.
    3.4     Assure that no fires emanate from the Eskom servitude by
            ensuring that fire breaks are made and that Contractors
            and their employees are trained in fire prevention
            principles.
    3.5     Investigate and employ assessors to investigate fires when
            Land owners initiate claims. Register claims and conclude
            claims and give feedback to claimant.
    3.6     Keep photographic album of all infrastructures on project so
            as to be able to avert and or accept claims emanating from
            the works

    4.      PROVISION OF A PROJECT LOGISTICAL SERVICE                      15
    4.1     Approve Contractors Accommodation and yards by
            applying sound Safety and Health standards and
            considering the impact on local communities and farm land
            owners to minimize destruction of habitat and to keep good
            relations in tact.
    4.2     Liaise ahead of time with Provincial Traffic departments for
            the smooth transportation of rail tracks from Durban
            Harbour via Kimberley to Majuba Site by planning ahead of
            time, contracts with transportation coordinators with the

            understanding the all commercial processes have to be
            adhered to.
    4.3     Assist Project Managers to acquire water, electricity and
            office accommodation en route on the Rail Siding to
            enhance their working environment.

    5.      COMMUNITY/SOCIAL DEVELOPMENT AND LIAISON                     10
    5.1     Create forums and avenues to keep affected parties
            informed of project progress and planned activities by
            arranging and chairing meetings, information sharing
            forums and ad-hoc gatherings and documenting same.
    5.2     Represent Eskom at a Land owner’s Safety and Security
            forum and take stance on behalf of Eskom. Represent
            Eskom as a member of the fire protection association
            responsible for the Rail Siding servitude in terms of the
            Associations responsibilities.
    5.3     Interface and liaise on behalf of the Project with Eskom,
            Contractors, Land owners, Spoornet Local Authorities and
            Community Leaders.
    5.4     Establish an Aids awareness programme and include in all
            Contractors Induction programme. Assist local farmers and
            communities in employing volunteers to do road shows.
    5.5     Involve the Dept of Labour to recruit from local communities
            semi-skilled and non-skilled labours and set targets for
            Contractors prior to contract negotiations.
    5.6     Ensure that BWO targets are embedded in Contractors
            contracts and assist with the creation of BWO
            Entrepreneurs from partnership formation to the tendering
            process.

    6.      CLAIMS SETTLEMENT MANAGEMENT                                     10
    6.1     Attend to all stock theft and other related reported incidents
            by co-ordinating the reporting and eventual feedback on
            loss to adjacent farm land owners.
    6.2     Liaise with SAPD, Eskom Insurers and Eskom Legal Dept.
            on claims and agree on settlements in terms of the Eskom
            Claims Procedure.
    6.3     Resolve and advice on complaints from affected parties
            due to actions of Contractors or any Eskom Representative
            that may occur.

    7.      TENDER COMMITTEE MEMBER
    7.1     Incumbent to form part of the Project Team Tender
            Committee.
    7.2     Evaluate Tender.
    7.3     Ascertain if commercial process have been adhered to.
    7.4     Vote on Tender award.
