									This is a form that a company can use to obtain a waiver of liability from volunteers.
The volunteer acknowledges that he or she understand the risks and hazards
associated with the volunteer activity and that he or she will not hold the company liable
for any injuries that occur. This form can be used by small businesses or charitable
organizations that want to limit their potential liability by obtaining a waiver from
volunteers.
                       VOLUNTEER WAIVER OF LIABILITY

   This Volunteer Waiver of Liability (the “Agreement”), is between [Insert name of
organization to whom services are being volunteered] (the “Organization”) and [Insert name of
volunteer] (the “Volunteer”) regarding services to be rendered at no charge by Volunteer. The
Volunteer acknowledges and agrees to, on behalf of the Volunteer, and on behalf of the
Volunteer’s personal representatives, successors, heirs, assigns, executors, administrators and
next-of-kin, as applicable, as follows:

   1. The Volunteer agrees to perform [Describe services to be performed] on behalf of
Organization at [Insert location where services are to be performed] (the “Premises”].

   2. The Volunteer acknowledges being advised by the Organization that there may be
unforeseen and unknown hazards associated with the volunteer work to be performed by the
Volunteer at the Premises.

   3. The Volunteer also fully acknowledges having been advised by the Organization that all
necessary work professionals, including but not limited to, engineers, structural engineers, and
health and safety inspectors have inspected the Premises in respect to the safety of the Premises
and the structure of the Premises being sound to commence the volunteer work.

    4. The Volunteer hereby releases the Organization and its respective directors, officers,
shareholders, employees, agents, contractors and their personal representatives, successors, heirs,
executors, administrators, next-of-kin, and assigns (collectively, the “Releasees”) from and
against any and all liability for any loss, damage, injury, expense, demand or cause of action that
the Volunteer may suffer whether with respect to personal injury, death, damage to or destruction
of property, theft or otherwise (the “Damage”) which may arise as a result of the Volunteer
performing the volunteer services, save and except if such Damage is caused as a direct result of
the negligence of one or more of the Releasees.

    5. Further, the Volunteer will indemnify and save and hold harmless the Releasees,
collectively and individually, from any and all losses, liabilities, damages, demands, costs and
expenses (“Loss”) that the Volunteer may incur, for any reason whatsoever, which may arise as a
result of the volunteer work save and except if such Loss is caused as a direct result of the
negligence of one or more of the Releasees.

    6. This Agreement shall be subject to the laws of the State of ___________ and enure to the
 benefit of and be binding on the Releasees’ and Volunteer’s successors, personal
 representatives, executors, next-of-kin, heirs, administrators and assigns, as applicable.

The Volunteer hereby acknowledges having read this Volunteer Waiver of Liability, and
certifies that the Volunteer fully understand its terms and has signed it freely and
voluntarily without any inducement, assurance, guarantee or oral representation being
made.
