                                      COUNCIL PROCEEDINGS

Of the Common Council of the City of Phillips at a regular meeting held in the council room on
November 6, 2001.
Mayor Corcilius called the meeting to order at 7:00 PM. Council members present as listed below.

Visitors present: Michelle Rapacz, Joe Karpinski, Terry Staroba, Jim Brunette, Grace Kielsmeier, Marvel
Cole, Trisha Kempkes, Police Chief Moore, Ed Miller, Officer Holm and John Hendricks.
         Motion by Mr. McBain, seconded by Mr. Namtzu to convene into closed session. Alderpersons
voting aye: Mr. McBain, Mr. Presley, Mr. Boho, Mr. Namtzu, Mr. Këmpkes and Mr. Perkins.
Alderpersons voting nay: None.
Authority: Wisconsin State Statute 19.85(l)(e), Consideration of negotiating the purchase of privately
owned property with public funds. Clerk/Treasurer Lamoreaux and D.P.W. Staroba invited into the closed
session. Convened into closed session at 7:00 PM.
         Motion by Mr. McBain, seconded by Mr. Boho to reconvene into open session. Alderpersons
voting aye: Mr. McBain, Mr. Boho, Mr. Namtzu, Mr. Kernpkes and Mr. Perkins. Alderperson voting nay:
Mr. Presley. Authority: Wisconsin State Statute 19.85(2). Reconvened into open session at 7:23 PM.
         Motion by Mr. Kempkes, seconded by Mr. McBain authorizing City Attorney Bilz to enter into
negotiations with a property owner owning property within the city limits to consider property sale price
and range of payment options. Alderpersons voting aye: Mr. McBain, Mr. Boho, Mr. Namtzu, Mr.
Kempkes and Mr. Perkins. Alderperson voting nay: Mr. Presley. Carried.
         The following are comments stated during the Public Comments item on the meeting agenda:
Mr. Namtzu: The Express Mart is setting milk crates on the parking space directly in front of the
building. I have received complaints from people attempting to park in this parking space.
Mr. Ed Miller: I have a wreath making business on my property which is zoned residential. Am I in
compliance with city ordinances? Clerk/Treasurer Lamoreaux advised Mr. Miller of the need to apply for
a conditional use permit.
         Motion by Mr. McBain, seconded by Mr. Presley to accept the minutes of the meeting held on
October 2, 2001. Carried.
         Motion by Mr. McBain, seconded by Mr. Perkins to place $30,000 of Municipal Savings Account
money that was budgeted for improvements to city parks into the Recreation Fund Savings Account.
Carried.
         Motion by Mr. Perkins, seconded by Mr. McBain to reserve the following savings account
balances for specified uses.Carried.

         Motion by Mr. Presley, seconded by Mr. McBain to reserve $70,000 of Municipal Savings
Account money for completion of the Victoria Street Project. Carried.
         Motion by Mr. Boho, seconded by Mr. McBain to reserve $10,000 of Municipal Savings Account
money for future fire hall building expansion. Carried.
         Motion by Mr. Perkins, seconded by Mr. McBain authorizing Water-Sewer Plant Supervisor John
Martwick to sign Notices of Partial Completion , WWTP Improvements Project. Carried.
         Motion by Mr. Perkins, seconded by Mr. McBain tabling the hiring of Officer Neil Holm for a
full time patrolman job position until union contract negotiations are finalized, noting 10 minute response
time in current union contract. Carried.
         Motion by Mr. Presley, seconded by Mr. McBain instructing Police Chief Moore to compile a list
of residential property owners operating a business out of their homes and turn the list over to City
Attorney Bilz for review and action recommendation. Clerk/Treasurer Lamoreaux was instructed to set up
a public hearing for the Common Council to receive comments and discussion on the legality of these
cottage industry type of operations, in January, 2002. Carried.
         Motion by Mr. Namtzu, seconded by Mr. Presley to place a notice for bids on the cleaning of the
Municipal Center building and the City Garage office and restrooms. Carried.
         Council members set the date of December 11, 2001 at 6:30 PM to conduct a public hearing on
the proposed 2002 City of Phillips Budget.
         Motion by Mr. McBain, seconded by Mr. Namtzu to execute a notice of contamination to
property, Elk Lake Park specified property, and authorize Mayor Keith A. Corcilius and Clerk/Treasurer
Lee V. Lamoreaux to sign said document. Carried.
         Motion by Mr. Perkins, seconded by Mr. Namtzu to pay invoices in the total amount of
$37,228.92, check numbers 44878 through 44947. Carried.
         Motion by Mr. Boho, seconded by Mr. Presley to adjourn. Carried.
Meeting adjourned at 9:02 PM.
