                                                   PART I
                                     GENERAL INFORMATION
1.1   Purpose. This Request for Bid (RFB) provides to those interested in submitting bids for the subject
      procurement (―Bidders‖) sufficient information to enable them to prepare and submit bids for the Prince
      George’s County Economic Development Corporation – Workforces Service Division’s
      consideration to satisfy a need for renovation and build-out of warehouse facility space
      (approximately 1000 square foot) (―Project‖). We are particularly interested in the architect-
      engineer (A-E) services through a conventional two phase method of (1) cost-control architect
      design and (2) construction of the project. The project requires; (1) construction drawings, and (2)
      construction services for the addition of one training room, and two stand only offices or three cubicle
      work station areas, inclusive of all ceiling and grid lighting, HVAC split system roof top unit, electrical
      outlets, phone/data box locations, painting, and carpeting throughout.
1.2   Issuing Office. The Prince George’s County Economic Development Corporation – Workforce
      Services Division (―Issuing Office‖) has issued this RFB. The sole point of contact for this RFB shall
      be Sonji A. Epps, 1100 Mercantile Lane, Suite 120, Largo, Maryland at sepps@pgcedc.com, the Issuing
      Officer for this RFB. Please refer all inquiries to the Issuing Officer via email. Questions will be
      accepted as specified in the Calendar of Events.
1.3   Scope. This RFB contains instructions governing the requested bids, including the requirements for the
      information and material to be included; a description of the service to be provided; requirements which
      Bidders must meet to be eligible for consideration; general evaluation criteria; and other requirements
      specific to this RFB.
1.4   Problem Statement. The intent of this RFB is to identify an Bidder to deliver architect-engineer (A-E)
      services for the renovation and build-out of warehouse facility space through a conventional two phase
      method of (1) construction drawings, and (2) construction services. Additional detail is provided in
      Part II of this RFB.
1.5   Type of Contract. It is proposed that if the Issuing Office enters into a contract as a result of this RFB,
      it will be a firm-fixed-price contract priced on a lump-sum, one-time payment basis. The Issuing Office,
      in its sole discretion, may undertake negotiations with Bidders whose bids, in the judgment of the
      Issuing Office, show them to be qualified, responsible and capable of performing the Project.
1.6   Rejection of Bids. The Issuing Office reserves the right to reject any, part of any, and all bids, in its
      sole and complete discretion, for any bid received in response to this RFB.
1.7   Incurring Costs. The Issuing Office is not liable for any costs the Bidder incurs in preparation and
      submission of its bid, in participating in the RFB process or in anticipation of award of the contract.
1.8   Site Visits. The Issuing Office will hold Site Visits as specified in the Calendar of Events. The Site
      visit located at the One-Stop, 1100 Mercantile Lane, Suite 100, Largo, Maryland, 20774 is required for
      all interested Bidders who plan to bid on this project. Interested Bidders will have the opportunity
      during the Site Visit to submit questions relative to the actual site, as part of the RFB, in accordance

       with Part I, Section 1.10. The Site Visit is the only opportunity for interested Bidders to view the site.
       Participation in the Site visit is a prerequisite for a bid submission.
1.9    Pre-Bid Conference. The Issuing Office will hold a Pre-Bid Conference as specified in the Calendar of
       Events. The purpose of this conference is to provide opportunity for clarification of information
       contained in this RFB. Bidders should forward all questions to the Issuing Office in accordance with
       Part I, Section 1.10 to ensure adequate time for analysis before the Issuing Office provides an answer.
       Bidders may also ask questions at the conference. In view of the limited facilities available for the
       conference, Bidders should limit their representation to two (2) individuals per Bidder. The Pre-Bid
       Conference is for information only. Any answers furnished during the conference will not be official
       until the Issuing Office has verified them, in writing. All questions and written answers will be posted
       on the PGCEDC-WSD’s website as an addendum to, and shall become part of, this RFB. Attendance at
       the Pre-Bid Conference is optional.
1.10   Questions & Answers. If a Bidder has any questions regarding this RFB, the Bidder must submit the
       questions by email (with the subject line “RFB #EDC-WSD 010-03/08 Question”) to the Issuing
       Officer named in Part I, Section 1.2 of this RFB. If the Bidder has questions, they must be submitted
       via email no later than the date indicated on the Calendar of Events. The Bidder shall not attempt to
       contact the Issuing Officer by any other means. The Issuing Officer shall post the answers to the
       questions on the PGCEDC-WSD’s website by the date stated on the Calendar of Events.
       All questions and responses as posted on the PGCEDC-WSD’s website are considered as an addendum
       to, and part of, this RFB in accordance with RFB Part I, Section 1.11. Each Bidder shall be responsible
       to monitor the PGCEDC-WSD’s website for new or revised RFB information. The Issuing Office shall
       not be bound by any verbal information nor shall it be bound by any written information that is not
       either contained within the RFB or formally issued as an addendum by the Issuing Office. The Issuing
       Office does not consider questions to be a protest of the specifications or of the solicitation.
1.11   Addenda to the RFB. If the Issuing Office deems it necessary to revise any part of this RFB before the
       bid response date, the Issuing Office will post an addendum to the PGCEDC-WSD’s website at
       www.pgworkforce.org. It is the Bidder’s responsibility to periodically check the website for any new
       information or addenda to the RFB. Answers to the questions asked during the Questions & Answers
       period also will be posted to the website as an addendum to the RFB.
1.12   Response Date. To be considered for selection, hard copies of bids must arrive at the Issuing Office on
       or before the time and date specified in the RFB Calendar of Events. The Issuing Office will not accept
       bids via email or facsimile transmission, nor any hand written bids. Bidders who send bids by mail or
       other delivery service should allow sufficient delivery time to ensure timely receipt of their bid. If, due
       to inclement weather, natural disaster, or any other cause, the office location to which bids are to be
       returned is closed on the bid response date, the deadline for submission will be automatically extended
       until the next business day on which the office is open, unless the Issuing Office otherwise notifies
       Bidders. The hour for submission of bids shall remain the same. The Issuing Office will reject and
       unopen any late bids.
1.13   Bids. To be considered, Bidders should submit a complete response to this RFB, using the format
       provided in Part III, shall be submitted in triplicate (original and two copies) to the Issuing Office.
       Bids shall be stapled in the upper left-hand corner; binders and bonded bids are not necessary.

           Bidders will not add any conditions, and/or escalator clauses of qualifying statements to the bid. The
           Bidder shall make no other distribution of its bid to any other Bidder. Each bid page should be
           numbered for ease of reference. An official authorized to bind the Bidder to its provisions must sign the
           bid. For this RFB, the bid must remain valid for sixty (60) days or until a contract is fully executed. If
           the Issuing Office selects the Bidder’s bid for award, the contents of the selected Bidder’s bid will
           become, except to the extent the contents are changed through Best and Final Offers or negotiations,
           contractual obligations. The information in the bid will become a public record upon contract execution.
           Each Bidder submitting a bid specifically waives any right to withdraw or modify it, except that the
           Bidder may withdraw its bid by written notice received at the Issuing Office’s address for bid delivery
           prior to the exact hour and date specified for bid receipt. A Bidder or its authorized representative may
           withdraw its bid in person prior to the exact hour and date set for bid receipt, provided the withdrawing
           person provides appropriate identification and signs a receipt for the bid. A Bidder may modify its
           submitted bid prior to the exact hour and date set for receipt only by submitting a new sealed bid or
           sealed modification that complies with the RFB requirements
1.14       Bid Bond. (Required on all projects). A bid bond in the amount of five percent (5%) of the base bid
           must accompany each bid. The purpose of the bid bond provides financial assurance or penal sum that
           the bid has been submitted in good faith, and that the Bidder intends to enter into the contract at the
           price bid and provide the required performance and payment bonds.
           The basis of the bid shall be a lump-sum price for the entire work to be completed, in accordance with
           the bid instructions. Bid bonds shall be made by certified check payable to Prince George’s County
           Economic Development Corporation. Bid bonds will be returned to the unsuccessful Bidder upon the
           award of the contract, and to the successful Bidder upon the execution of the contract, and the meeting
           of the bond requirements, as applicable, via U.S. Postal Mail certified return receipt. A combination of
           certified check and other fiduciary instruments is in not an acceptable response to the bid bond
           requirement.
           The successful Bidder’s failure to execute the contract or meet the bond requirements shall result in the
           bond deposit being forfeited to the PGCEDC as liquidated damages. Bidders are required to visit the
           project site and verify all existing conditions.
1.15       Payment Bond. (Required on all projects). In addition to the bid bond, a payment bond in the
           amount of twenty percent (20%) is required on all projects less than $100,000 or a payment bond in the
           amount of one hundred percent (100%) is required on all projects greater than $100,000 at the time of
           the award. Based on the Miller Act1, this is a guarantee that the Bidder will pay for subcontractors,
           laborers, and material suppliers. The payment bond shall be made by certified check payable to Prince
           George’s County Economic Development Corporation. A combination of certified check and other
           fiduciary instruments is in not an acceptable response to the payment bond requirement.
           The successful Bidder’s failure to furnish an acceptable payment bond with twenty (20) days after
           receipt of notice of award shall render the Bidder liable to PGCEDC.

1.16   Disadvantaged Business Information. The Issuing Office encourages participation by small
       disadvantaged businesses as prime contractors, joint ventures and subcontractors/suppliers and by
       socially disadvantaged businesses as prime contractors.
       Small Disadvantaged Businesses are small businesses that are owned or controlled by a majority of
       persons, not limited to members of minority groups, who have been deprived of the opportunity to
       develop and maintain a competitive position in the economy because of social disadvantages. The term
       includes:
       A.     Maryland Department of Transportation Office of Minority Enterprises (MDTOME)-certified
              minority business enterprises (MBEs) and women business enterprises (WBEs) that qualify as
              small businesses; and
       B.     United States Small Business Administration (SBA) -certified small disadvantaged businesses or
              8(a) small disadvantaged business concerns.
       Small businesses are businesses in the United States that are independently owned, are not dominant in
       their field of operation, employ no more than 100 persons and earn less than $20 million in gross annual
       revenues ($25 million in gross annual revenues for those businesses in the information technology sales
       or service business).
       Socially disadvantaged businesses are businesses in the United States that MDTOME determines are
       owned or controlled by a majority of persons, not limited to members of minority groups, who are
       subject to racial or ethnic prejudice or cultural bias, but which do not qualify as small businesses. In
       order for a business to qualify as ―socially disadvantaged,‖ the Bidder must include in its bid clear and
       convincing evidence to establish that the business has personally suffered racial or ethnic prejudice or
       cultural bias stemming from the business person’s color, ethnic origin or gender.
       This RFB does not contain SBA set-asides.
1.17   Economy of Preparation. Bidders should prepare bids simply and economically, providing a
       straightforward, concise description of the Bidder’s ability to meet the requirements of the RFB. The
       required bid documents, using the format provided in Part III, shall be submitted in triplicate (original
       and two copies) to the Issuing Office. Bids shall be stapled in the upper left-hand corner; binders and
       bonded bids are not necessary.
1.18   Alternate Bids. Bidders may not submit multiple bids. We will not entertain duplicate bids from the
       same Bidder, with different titles, or for the same products and/or services.
1.19   Discussions for Clarification. Bidders may be required to make an oral or written clarification of their
       bids to the Issuing Office to ensure thorough mutual understanding and Bidder responsiveness to the
       solicitation requirements. The Issuing Office will initiate requests for clarification.
1.20   Prime Contractor Responsibilities. The contract will require the selected Bidder to assume
       responsibility for all products and services offered in its bid. The Issuing Office will consider the
       selected Bidder to be the sole point of contact with regard to contractual matters.
1.21   Bid Contents. Bidders should not label bid submissions as confidential or proprietary. The Issuing
       Office will hold all bids in confidence and will not reveal or discuss any bid with competitors for the
       contract, unless disclosure is required:

       A.     Under the provisions of any State of Maryland or United States statute or regulation; or
       B.     By rule or order of any court of competent jurisdiction.
       After a contract is executed, however, the successful bid is considered a public record under the Right-to
       Know Law, 65 P.S. § 66.1—66.9, and therefore subject to disclosure. The financial capability
       information submitted under Part III, Section 3.5 shall not be disclosed in the final contract. All
       material submitted with the bid becomes the property of the PGCEDC-WSD and may be returned only
       at the Issuing Office’s option. The Issuing Office, in its sole discretion, may include any person other
       than competing Bidders on its bid evaluation committee. The Issuing Office has the right to use any or
       all ideas presented in any bid regardless of whether the bid becomes part of a contract.
1.22   Best and Final Offers. The Issuing Office reserves the right to conduct discussions with Bidders for
       the purpose of obtaining ―best and final offers.‖ To obtain best and final offers from Bidders, the
       Issuing Office may do one or more of the following:
       A.     Enter into pre-selection negotiations; or
       B.     Schedule oral presentations; or
       C.     Request revised bids.
       The Issuing Office will limit any discussions to responsible Bidders (those that have submitted
       responsive bids and possess the capability to fully perform the contract requirements in all respects and
       the integrity and reliability to assure good faith performance) whose bids the Issuing Office has
       determined to be reasonably susceptible of being selected for award. The Criteria for Selection found in
       Part IV, Section 4.1, shall also be used to evaluate the best and final offers.
1.23   Bid Opening. The Issuing Office will hold a Bid Opening as specified in the Calendar of Events. The
       purpose of the opening is to hold a formal opening of the bids that is open to the public. Bidders and the
       public are invited, but not required to attend. There is not activity on the part of the Bidder at the
       opening other than attendance and note taking, is permitted. Any attempt to qualify or change any bid by
       any bidder in attendance may result in the rejection of the bid. Prices will be read aloud to the public
       when practical. No decisions related to an award of a contract or purchase order will be made at the
       opening. Attendance at the Bid Opening is optional. .
1.24   Press Releases. Bidders shall not issue press releases, Internet postings, advertisements or any other
       public communications pertaining to this Project without prior written approval of the Issuing Office,
       and then only in coordination with the Issuing Office.
1.25    Restriction of Contact. From the issue date of this RFB until the Issuing Office selects a bid for
       award, the Issuing Officer is the sole point of contact concerning this RFB. Any violation of this
       condition may be cause for the Issuing Office to reject the offending Bidder’s bid. If the Issuing Office
       later discovers that the Bidder has engaged in any violations of this condition, the Issuing Office may
       reject the offending Bidder’s bid or rescind its contract award. Bidders must agree not to distribute any
       part of their bids beyond the Issuing Office. A Bidder who shares information contained in its bid with
       other and/or competing Bidder personnel may be disqualified.
1.26   Debriefing Conferences. Bidders whose bids are not selected will be notified of the name of the
       selected Bidder and given the opportunity to be debriefed. The Issuing Office will schedule the time and

       location of the debriefing. The debriefing will not compare the Bidder with other Bidders, other than the
       position of the Bidder’s bid in relation to all other Bidder bids. A Bidder’s exercise of the opportunity to
       be debriefed does not constitute the filing of a protest.
1.27   Protest. Any protest concerning the award of the contract shall be decided by the Contracts Officer.
       Protests shall be made in writing to the Department of Administration and Contracts, and shall be filed
       within ten days of award notification issuance. A protest is considered filed when received by the
       Department of Administration and contracts. The written protest shall include the name and address of
       the protestor, procurement title and number, a statement of specific reasons for the protest. The
       Contracts Officer will respond to the written protest within seven days. The Contract Officer’s decision,
       as it relates to the protest, shall be final.
1.28   Funding Availability. Any contract awarded as a result of this RFB is contingent upon the availability
       of funds, as determined by the Prince George’s County Workforce Investment Board (WIB).
1.29   Term of Contract. The term of the contract will commence on the Effective Date and will end after the
       required performances are completed, and Prince George’s County inspected and certified as completed;
       however, not to exceed thirty (30) days.
       The selected Bidder shall not start the performance of any work prior to the Effective Date of the
       contract and PGCEDC-WSD shall not be liable to pay the selected Bidder for any products or services
       performed or expenses incurred, including Bid preparation, before the Effective Date of the contract.
1.30   Bidder’s Representations and Authorizations. By submitting the bid, each Bidder understands,
       represents, and acknowledges that:
       A.     All of the Bidder’s information and representations in the bid are material and important, and the
              Issuing Office may rely upon the contents of the bid in awarding the contract(s).
       B.     The Bidder has arrived at the price(s) and amounts in its bid independently and without
              consultation, communication, or agreement with any other Bidder or potential Bidder.
       C.     The Bidder has not disclosed the price(s), the amount of the bid, nor the approximate price(s) or
              amount(s) of its bid to any other firm or person who is an Bidder or potential Bidder for this
              RFB, and the Bidder shall not disclose any of these items on or before the bid submission
              deadline specified in the Calendar of Events of this RFB.
       D.     The Bidder has not attempted, nor will it attempt, to induce any firm or person to refrain from
              submitting a bid on this contract, or to submit a bid higher than this bid, or to submit any
              intentionally high or noncompetitive bid or other form of complementary bid.
       E.     The Bidder makes its bid in good faith and not pursuant to any agreement or discussion with, or
              inducement from, any firm or person to submit a complementary or other noncompetitive bid.
       F.     To the best knowledge of the person signing the bid for the Bidder, the Bidder, its affiliates,
              subsidiaries, officers, directors, and employees are not currently under investigation by any
              governmental agency and have not been convicted or found liable for any act prohibited by State
              or Federal law in any jurisdiction, involving conspiracy or collusion with respect to bidding or
              proposing on any public contract, except as the Bidder has disclosed in its bid.

       G.     To the best knowledge of the person signing the bid for the Bidder and except as the Bidder has
              otherwise disclosed in its bid, the Bidder has no outstanding, delinquent obligations including,
              but not limited to, any state tax liability not being contested on appeal or other obligation of the
              Bidder that is owed.
       H.     The Bidder is not currently under suspension or debarment in the State of Maryland, any other
              state or the federal government, and if the Bidder cannot so certify, then it shall submit along
              with its bid a written explanation of why it cannot make such certification.
       I.     The Bidder has not made, under separate contract with the Issuing Office, any recommendations
              to the Issuing Office concerning the need for the products and services described in its bid or the
              specifications for the services described in the bid.
       J.     Each Bidder, by submitting its bid, authorizes PGCEDC-WSD to release to the State of
              Maryland information concerning the Bidder's Maryland taxes, unemployment compensation,
              workers’ compensation liabilities, and total compensations for individuals charged to the
              contract.
       K.     Until the selected Bidder receives a fully executed and approved written contract from the
              Issuing Office, there is no legal and valid contract, in law or in equity.
1.31   Notification of Selection. The Issuing Office will notify the selected Bidder in writing of its selection
       for negotiation after the Issuing Office has determined, taking into consideration all of the evaluation
       factors, the bid that is the most advantageous to the Issuing Office.
1.32   Use of Electronic Versions of This RFB. This RFB is being made available by electronic means. If a
       Bidder electronically accepts the RFB, the Bidder acknowledges and accepts full responsibility to insure
       that no changes are made to the RFB. In the event of a conflict between a version of the RFB in the
       Bidder’s possession and the Issuing Office’s version of the RFB, the Issuing Office’s version shall
       govern.

                                           SPECIFICATIONS
2.1   Organizational Background. The Prince George’s County Workforce Investment Board (WIB), a
      team of private and public sector partners, governs the local workforce policy and its oversight. WIB
      members share a common goal of advancing an integrated, highly responsive regional workforce
      investment system. A workforce development system that gives businesses and job seekers the tools
      they need to stay competitive in today's global marketplace. The WIB works in conjunction with Prince
      George’s County Economic Development Corporation - Workforce Services Division, the administrator
      of workforce development activities for Prince George’s County. The mission of PGCEDC-WSD is to
      contribute to the economic vitality of Prince George’s County by providing a skilled labor force to meet
      the demands of business, and providing training and opportunities for high wage jobs to meet the
      demands of the County’s residents. This entails:
      A.     Equipping businesses with skilled workers and up-to-the-minute labor market information.
      B.     Providing job seekers with the skills training, self-exploration tools, and job search resources
             that put rewarding, sustaining careers in high growth/high demand occupations well within their
             reach.
      C.     Enhancing the lives of youth by giving them opportunities for self-assessment, career
             exploration, and hands-on work experience.
      D.     Attracting new businesses, and retaining existing businesses, to our thriving region.
2.2   Workforce Investment Act (WIA). The purpose of Title I of the Workforce Investment Act of 1998
      (WIA) is to provide workforce investment activities that increase the employment, retention and
      earnings of participants, and increase occupational skill attainment by participants, which will improve
      the quality of the workforce, reduce welfare dependency, and enhance the productivity and
      competitiveness of the Nation's economy. These goals are achieved through the workforce investment
      system. (WIA sec. 106.)
      The Workforce Investment Act provides the framework for a unique national workforce preparation and
      employment system designed to meet the needs of the nation's businesses, the needs of job seekers and
      those who want to further their careers. In order to clearly understand the implication of these provisions
      on the design and operation of programs funded under the WIA, Bidders should familiarize themselves
      with both the Act (Public Law 105-220), as amended, and the Final Regulations (20 CFR Part 652, et
      al), as amended. This information is available for review at http://www.usworkforce.org/finalrule.pdf,
      any public library, or through Congressional offices.
      The WIA creates a "One-Stop" delivery system through the establishment of career centers where
      individuals can access employment services and also obtain occupational training, education, or
      occupational skills training. The One Stop Career Center works to meet the core performance measures
      under WIA.
2.3   Scope of Work. PGCEDC-WSD invites bids from qualified vendors to deliver architect-engineer (A-E)
      services for the renovation and build-out of warehouse facility space in the through a conventional two

      phase method of (1) construction drawings, and (2) construction services for the addition of one training
      room, and two stand only offices or three cubicle work station areas, inclusive of all ceiling and grid
      lighting, HVAC split system roof top unit, electrical outlets, phone/data box locations, painting, and
      carpeting throughout. The project site is located at the One Stop, 1100 Mercantile Lane, Suite 100,
      Largo, Maryland, 20774.
      Each vendor is encouraged to conduct a site visit to achieve a full understanding the project site
      requirements prior to preparation and submittal of the bid. Site visits are offered as specified in the
      Calendar of Events.
2.4   Service Scope. In addition to the scope of work, the intent is to acquire services from a reputable, well-
      established, commercially available vendor to offer services that includes all labor, materials,
      equipment, permits, tools, services, and operations required to complete the scope of work and related
      work.
      The Bidder shall recycle and/or dispose of waste materials in accordance with County, State, and
      Federal laws and regulations.
      Bidders shall be solely responsible for any damages caused by the Bidder and any of his/her
      subcontractors to private or public property.
      The Bidder shall maintain site specific plans for fire prevention and response, health and safety, and
      emergency response.
      Bidders shall obtain and comply with any permits that may be required during the renovation and built-
      out operations of the site.
2.5   Contractor’s Requirements. Bids will be accepted from preferable Bidders who:
      A.     Are licensed to do business in the State of Maryland;
      B.     Are able to provide qualified staff to perform the work proposed in response to this RFB; and
      C.     Possess demonstrable experience consistent with the services requested in this RFB.
      Agencies that do no meet these minimum qualifications shall be deem non-responsive and will not
      receive further consideration.
2.6   Pricing. Bidders must offer pricing in a complete listing of all products and services that the Bidder
      proposes to offer under this RFB. All prices submitted must be itemized by labor, supplies, materials,
      and other allowable costs as separate line items, unless the product/service being priced is a per unit
      cost, which includes labor, equipment and materials, inclusive of any pricing discounts. This is
      inclusive of labor hourly rates, pricing sheets, catalogs, and other pricing forms that clearly identify and
      describe the supplies or materials, its unit of measure offered, and its stated price. When providing
      equipment costs, indicate the hourly, daily, and/or weekly rate. Pricing Sheet is made available as
      Attachment VI.
2.7   Green Procurement/Construction. PGCEDC-WSD is implementing policies and procedures toward
      the purchasing and usage of environmentally sound and energy efficient products and services. Green
      procurement includes the acquisition of recycled content products, environmentally preferable products
      and services, bio-based products, energy- and water-efficient products, alternate fuel vehicles, and

      products using renewable energy. In addition, PGCEDC-WSD will comply with the Department of
      Labor’s intentions and specific goals mandated by statutes and executive orders, as well as, any other
      issuances that may be mandated to maximize cost-efficient energy management. (FAR 7.101)
2.8   Insurance Requirements. The Bidder shall indemnify, hold harmless and defend COUNTY, its
      boards, commissions, agencies, officers, employees and representatives from and against all claims,
      damages, losses and expenses including attorneys’ fees arising out of or resulting from the performance
      of the work, provided that any such claim, damage, loss or expense is attributable to bodily injury,
      sickness, disease or death, or to injury to or destruction of tangible property (other than the work itself)
      including the loss of use. PGCEDC-WSD shall not be liable to the Bidder for damages or delays
      resulting from work by third parties or by injunctions or other restraining orders obtained by third
      parties.
2.9   Insurance to Be Carried By the Bidder. The Bidder shall not commence work under the contract until
      obtaining all the insurances required and such insurance has been approved by PGCEDC-WSD Chief
      Financial Officer, nor shall the Bidder allow any subcontractor to commence work on the subcontract
      until the insurance required of the subcontractor has been obtained and approved. If a contract is
      awarded, the Bidder will be required to purchase and maintain during the life of the contract, including
      any subsequent renewal terms, (i.e. Comprehensive General Liability insurance, Comprehensive
      Automobile Liability insurance, and Worker’s Compensation insurance, etc.) The Bidder shall provide
      PGCEDC-WSD with the Certificates of Insurance within ten (10) days of bid award notification.

                                  PREPARATION REQUIREMENTS
Bidders must submit their bids in the format, including heading descriptions, outlined below. To be considered,
the bid must respond to all requirements in this part of the RFB.
The Issuing Office reserves the right to request additional information which, in the Issuing Office’s opinion, is
necessary to assure that the Bidder’s competence, number of qualified employees, business organization, and
financial resources are adequate to perform according to the RFB.
The Issuing Office may make investigations as deemed necessary to determine the ability of the Bidder to
perform the Project, and the Bidder shall furnish to the Issuing Office all requested information and data. The
Issuing Office reserves the right to reject any, part of any, and all bids received in response to this RFB, if the
evidence submitted by, or investigation of, such Bidder fails to satisfy the Issuing Office that such Bidder is
properly qualified to carry out the obligations of the RFB and to complete the Project as specified.
3.1    Bid Format. Bids should be printed on white paper, double-spaced, using a 12-point font (Times New
       Roman or similar) and one-inch margins on all sides; pages should be numbered. Bids should not be
       placed in binders or folders or bonded; one staple in the upper-left hand corner, securing all pages, is
       sufficient.
3.2    Cover Sheet. Bidders should complete Attachment I: Cover Sheet on company letterhead and
       include the following information:
       A.      Name of firm submitting bid;
       B.      Firm contact information (full address, including mailing address, telephone, fax, web address);
       C.      Contact person’s name, title, and contact information (telephone, fax, email);
       D.      When and where incorporated;
       E.      SBA number (if applicable); and
       F.      Signature of individual with legal and fiduciary responsibility.
3.3    Executive Summary. The executive summary is limited to two (2) pages, excluding the cover sheet,
       bid form, pricing sheet, and forms. It should include the following information in the following order:
       Please caption each section as outlined below and include the section headings.
       A.      Executive Summary. Bidders should provide a brief summary of their understanding of the
               objectives of this RFB and describe how they will address those objectives, should they be
               selected.
       B.      Understanding of Requirements. Bidders should discuss their familiarity with the PGCEDC-
               WSD objective to deliver architect-engineer (A-E) services for the renovation and build-out of
               warehouse facility space in the through a conventional two phase method of (1) construction
               drawings, and (2) construction services.
       C.      Green Procurement/Construction. Bidders are requested to provide appropriate building
               approaches that are environmentally progressive, but also practical and affordable to implement.

              Green procurement/construction approaches along with other relevant evaluation criteria will be
              used in selection.
3.4    Bid Form. The Bidders must submit a base bid form, separate and apart from the executive summary.
       The base bid form Attachment II: Bid Form must be used for base bid and alternate bid submissions.
3.5    Sub-Bid List. The Bidders must submit a sub-bid list, separate and apart from the executive summary.
       The sub-bid list form Attachment III: Sub-Bid List must be used for all proposed subcontractors.
3.6    Statement of Qualification. Bidders are requested to provide detailed information that clearly
       demonstrates the Bidders qualifications, experiences, and resources available to deliver exceptional
       results to the PGCEDC-WSD. The statement of qualification Attachment IV: Statement of
       Qualification must be used for qualifications, separate and apart from the executive summary.
3.7    Statement of Reference. Bidders should provide the name, location, client references and brief
       description of the proposed references indicating successfully architect-engineer (A-E) projects for
       renovation and build-out services with similar objectives of size and scopes (scope of work and service
       scope). The statement of reference Attachment V: Statement of Reference must be used for past
       experiences, separate and apart from the executive summary.
3.8    Pricing Sheet. The Bidders must submit a pricing sheet, separate and apart from the executive
       summary. The pricing sheet Attachment VI, Sections A-C in three (3) parts): Pricing Sheet must be
       used in summarizing the service costs per base bid and per alternate bid submissions.
       The cost bid will be (by cost category):
       A.     Design: Construction Drawings
       B.     Renovation: Construction Services
       C.     Alternate Bid 1: Suite 120 Interior Painting Services
3.9    Bid Bond. The Bidders must submit a bid bond in the amount of five percent (5%) of the base bid, in
       accordance with RFB Part I, Section 1.14. The bid bond Attachment VII: Bid Bond must used, if
       submitting a bid bond.
3.10   Payment Bond. The Bidders must submit a payment bond, if the bid is awarded and the project is less
       than $100,000, in the amount of twenty percent (20%) is required or if the project is greater than
       $100,000, in the amount of one hundred (100%) is required at the time of the award, in accordance with
       RFB Part I, Section 1.15. The payment bond Attachment VIII: Payment Bond must used, if the
       previous criterions are meet.
3.11   Financial Statements. Bidders must provide documentation of sound fiscal practices. This
       documentation MUST include the following (with clearly labeled cover insert section separators):
       A.     Bidders' most recent audit of financial statements and auditor's opinion and management letter
              addressing internal controls, and
       B.     Annual Reports from the previous two years (if available).
       The Financial Statements must be in a separately sealed envelope (to be submitted with the
       official bid package).

3.14   Submission of Information. Each Bidder responding to this RFB must supply all the documentation
       that is required. The documentation listed below must be submitted with the bid. A Bidder's failure to
       provide the documentation with the Bidder's response to this RFB will result in the disqualification of
       the Bidder's bid.
       Bidders must submit in triplicate one (1) original (with signature in blue ink), and two (2) copies of all
       bid documents, except Financial Statements, in accordance with RFB Part III, Section 3.9, due as
       specified in the Calendar of Events. Official post office postmark depicting priority mail prior to
       Monday, June 2, 2008 will be sufficient to satisfy the submission deadline date.
       Note: No e-mail or facsimile bids will be accepted.
       It is the Bidder's responsibility to clearly identify and describe the products and services being offered in
       response to this RFB. Bidders are cautioned that the organization of their response, as well as
       thoroughness, is critical to the evaluation process. The RFB forms must be legible and complete in their
       entirety, with all required supplemental information presented in an organized, comprehensive, and easy
       to follow manner.

                                       SELECTION CRITERIA
PGCEDC-WSD reserves the right to award the contract in the aggregate, by individual service, or any
combination, whichever is in the best interest of PGCEDC-WSD.
An Evaluation Team comprised of representatives designated by PGCEDC-WSD will evaluate the responses to
the RFB. Based on the preliminary evaluation results, the highest rated Bidder may be invited by PGCEDC-
WSD to make oral presentations for final evaluations to be made. PGCEDC-WSD shall negotiate a contract
with the highest rated Bidder, at this time, the Bidder and the PGCEDC-WSD may negotiate any changes
desired in the offer if deemed in the best interest of the PGCEDC-WSD. If a satisfactory contract cannot be
negotiated with the highest qualified Bidder, negotiations will be formally terminated. Negotiations shall then
be undertaken with the next highest rated Bidder, and so on.
4.1    Service Evaluation Criteria. The following factors will be considered in the award of this contract.

4.3   Reference Verification. PGCEDC-WSD reserves the right to make verify all provided references of
      the official bid submission to assess the Bidders capabilities and previous performance.
4.4   Qualifying Bids. Bidders are advised that, in the event of receipt of an adequate number of bids, which,
      in the opinion of PGCEDC-WSD require no clarifications and/or supplementary information, such bids
      may be evaluated without further discussion. Hence, bids should be submitted initially on the most
      complete and favorable terms from a pricing standpoint that Bidders are capable of submitting. Should
      bids submitted require additional clarification and/or supplementary information, Bidders should be
      prepared to submit such additional clarification and/or supplementary information, in a timely manner,
      when so requested.

I.   DRUG AND ALCOHOL FREE WORKPLACE

     (Applicable to all contracts unless the contract is for a law enforcement agency and the agency head or
     the agency head’s designee has determined that application of COMAR 21.11.08 and this certification
     would be inappropriate in connection with the law enforcement agency’s undercover operations.)

     I CERTIFY THAT:

     1.     Terms defined in COMAR 21.11.08 shall have the same meanings when used in this
            certification.

     2.     By submission of its bid or offer, the business, if other than an individual certifies and agrees
            that, with respect to its employees to be employed under a contract resulting from this
            solicitation, the business shall:

            a.      Maintain a workplace free of drug and alcohol abuse during the term of the contract;

            b.      Publish a statement notifying its employees that the unlawful manufacture, distribution,
                    dispensing, possession, or use of drugs, and the abuse of drugs or alcohol is prohibited in
                    the business’ workplace and specifying the actions that will be taken against employees
                    for violation of these prohibitions;

            c.      Prohibit its employees from working under the influence of drugs or alcohol;

            d.      Not hire or assign to work on the contract anyone whom the business knows, or in the
                    exercise of due diligence should know, currently abuses drugs or alcohol and is not
                    actively engages in a bona fide drug or alcohol abuse assistance or rehabilitation
                    program;

            e.      Promptly inform the appropriate law enforcement agency of every drug-related crime that
                    occurs in its workplace if the business has observed the violation or otherwise has reliable
                    information that a violation has occurred;

            f.      Establish drug and alcohol abuse awareness programs to inform its employees about:
                    i.       The dangers of drug and alcohol abuse in the workplace;

     g.     Provide all employees engaged in the performance of the contract with a copy of the
            statement required by §J(2)(b) above;

     h.     Notify its employees in the statement required by §J(2)(b) above, that as a condition of
            continued employment on the contract, the employee shall:

            i.      Abide by the terms of the statement; and
            ii.     Notify the employer of any criminal drug or alcohol abuse conviction for an
                    offense occurring in the workplace not later than five (5) days after a conviction;
     i.     Notify the procurement officer within ten (10) days after receiving notice under
            §J(2)(h)(ii) above, or otherwise receiving actual notice of a conviction;
     j.     Within thirty (30) days after receiving notice under §J(2)(h)(ii) above, or otherwise
            receiving actual notice of a conviction, impose either of the following sanctions or
            remedial measures on any employee who is convicted of a drug or alcohol abuse offense
            occurring in the workplace:

            i.      Take appropriate personnel action against an employee, up to and including
                    termination; or
            ii.     Require an employee to satisfactorily participate in a bona fide drug or alcohol
                    abuse assistance or rehabilitation program; and
     k.     Make a good faith effort to maintain a drug and alcohol free workplace through
            implementation of §J(2)(a)—(j) above.

       DRUG FREE WORKPLACE REQUIREMENTS CERTIFICATION
Alternate I.

Pursuant to the Drug-Free Workplace Act of 1988, and its implementing regulations codified at 29 CFR 98,
Subpart F, I, _________________________, the undersigned, in representation of the Prince George’s County
Economic Development Corporation – Workforce Service Division, the grantee, attest and certify that the
grantee will provide a drug-free workplace by:

1.     Publishing a statement notifying employees that the unlawful manufacture,
       distribution, dispensing, possession, or use of a controlled substance is
       prohibited in the grantee's workplace and specifying the actions that will be taken against employees for
       violation of such prohibition;

2.     Establishing an ongoing drug-free awareness program to inform employees about:

       (a)     The dangers of drug abuse in the workplace;

       (b)     The grantee's policy of maintaining a drug-free workplace;

       (c)     Any available drug counseling, rehabilitation, and employee assistance programs; and

       (d)     The penalties that may be imposed upon employees for drug abuse violations occurring in the
               workplace;

3.     Making it a requirement that each employee to be engaged in the performance of the grant be given a
       copy of the statement required by paragraph (1);

4.     Notifying the employee in the statement required by paragraph (1) that, as a condition of employment
       under the grant, the employee will:

       (a)     Abide by the terms of the statement; and

       (b)     Notify the employer in writing of his or her conviction for a violation of a criminal drug statute
               occurring in the workplace no later than five calendar days after such conviction;

5.     Notifying the agency in writing ten calendar days after receiving notice under subparagraph (4) (b) from
       an employee or otherwise receiving actual notice of such conviction. We will provide such notice of
       convicted employees, including position title, to every grant officer on whose grant activity the
       convicted employee was working. The notice shall include the identification number(s) of each affected
       grant.

               program approved for such purposes by a Federal, State, or local health, law enforcement, or
               other appropriate agency;

7.     Making a good faith effort to continue to maintain a drug-free workplace through implementation of
       paragraphs (1), (2), (3), (4), (5) and (6).

8.     Notwithstanding it is not required to provide the workplace addresses under the grant, as of today the
       specific sites are known and we have decided to provide the specific addresses with the understanding
       that if any of the identified places change during the performance of the grant, we will inform the
