COMPUTER LEASE PURCHASE AGREEMENT

This contract is an agreement between Iowa State University College of Design (College of Design) and
______________________, a student in the College of Design (Design Student).
1. The purpose of this Computer Lease Purchase Agreement is to provide a laptop computer to
College of Design students, and also to permit use of College of Design provided software on said
2. Term of Lease. This Computer Lease Purchase Agreement covers a time period beginning August
20, 2007, and ending May 7, 2010.
3. Design Student. To be eligible for leasing a computer under this program, a student shall be
enrolled in the College of Design and approved by the College of Design for participation. The
student must register for consecutive fall and spring semesters during the duration of the lease
purchase agreement. Enrollment at Iowa State University is not required during the summer
4. Payment Schedule. The Design Student agrees and promises to pay Iowa State University the sum
of $3870 in six (6) equal semester installments of $645 per semester. Each installment will
become due and payable on the Design Student’s University Bill in accordance with the Fee
Payment Policy of the Receivables Office, 0880 Beardshear Hall, Ames, IA 50011-2020.
5. Purchase. At the conclusion of the lease purchase agreement, the Design Student may purchase the
computer hardware for an amount of $5.00, upon the condition that all payments have been made
and the College of Design Computer Support staff has removed University-licensed software from
the computer and the University inventory number is verified and removed.
6. Computer Ownership. During the term of this lease purchase agreement, title to the computer
hardware will remain with Iowa State University and, therefore, Iowa State University shall be
considered the owner of the computer. After final payment is made to Iowa State University at the
conclusion of this agreement and the Design Student has permitted the College of Design to remove
any University-licensed software from the computer, ownership and title to the computer will
transfer to the Design Student.
7. Software Ownership. The Design Student does not obtain any ownership rights in the University-
licensed software used during the lease purchase agreement. At the conclusion of this agreement the
Design Student shall permit the College of Design to remove any University-licensed software from
the computer. If the Design Student does not follow the procedure for removal of the University
software and inventory transfer, the Design Student will have access to all University computer
accounts suspended and a charge for any University software not removed from the machine will be
assessed on the student's University bill as a receivable. All software that came with the original
machine will be returned to the student at the time the machine is cleared by Iowa State University.
This software will include the original operating system and any utilities that came with the
8. Insurance. An insurance policy insuring Iowa State University’s interest in owning the computer is
part of this lease purchase agreement. This policy covers theft, fire, accidental damage, loss due to
computer virus, and other physical loss, and carries a $500 deductible. The deductible is the
responsibility of the Design Student if the computer is lost or damaged during the lease purchase
agreement. Iowa State University is not responsible for any loss, misuse, theft, damage, or
unethical use of the computer. A description of the coverage is available by request.
9. Warranty. The computer will be purchased with a manufacturer's warranty during the lease
purchase agreement. There is no other warranty expressed or implied with the computer. The
Design Student is responsible for any misuse or damage to the computer that is not covered by the
manufacturer’s warranty. Abusive damage, and normal “wear and tear” of the machine may not be
covered by the manufacturer’s warranty, and is not covered by the College of Design.
10. Limitation of Liability. In no event will Iowa State University be liable to the student for any loss
or damage of any kind to the computer or software, including any loss of data or other special,
incidental or consequential damages arising out of the use or inability to use the computer or
software that is subject to this agreement.
11. Maintenance. Iowa State University will provide carry-in warranty service through the College of
Design Computer Support Center, 430 College of Design. This office will diagnose hardware
failures and facilitate repairs following vendor requirements and procedures.
12. Default. The Design Student will be in default under the terms of this lease purchase agreement if
a. Failure to make payments on the date required;
b. Misuse of the computer or software;
c. Withdrawal from the College of Design Program;
d. Cessation of enrollment as a student at Iowa State University for any reason, excepting that
Design Student is not required to attend summer sessions but must register for consecutive fall
and spring semesters in order to be in good standing under this agreement;
e. Transfer or attempted transfer of possession of the computer or software to another person.
13. Hardware. Whenever the computer that is subject to this agreement is mentioned in this agreement,
the parties mean the following hardware (to be completed upon delivery, at student request):

14. Software. The software on this computer is licensed to Iowa State University for use by the
University and is available for student use only because the Design Student is a student at Iowa
State University and is using this computer and software in furtherance of the Design Student's
education at the College of Design. The software available to students under this program may
change during the term of this agreement at the sole discretion of Iowa State University.
The following software is expected to be accessible from the computer:
If the Design Student has a PC (Intel/Windows-based) laptop computer:
Microsoft Windows operating system; Microsoft Office; AutoDesk Suite (AutoCAD
architectural desktop, etc.); Adobe Creative Suite 3: Adobe Acrobat Pro, Sketchup, GIS
software as necessary
If the Design Student has a Apple laptop computer:
Mac OS X; Microsoft Office; Adobe Creative Suite 3; Adobe Acrobat Pro; Sketchup, Final
Both platforms will include software from the manufacturer, utilities, and supporting software for
network connections, and Iowa State University site-licensed software.
15. College of Design Responsibilities. The College of Design shall:
a. Provide the hardware as described above;
b. Provide the software as available and described above, including manufacturer’s supplied
updates approved for this program by the College of Design Computer Support Center during
the term of the lease purchase agreement;
c. Provide maintenance for the computer and software as specified in paragraph 11;
d. Provide property insurance coverage on the computer;
e. Not provide maintenance and support for any peripheral hardware or software added to the
computer by the Design Student.
16. Design Student Responsibilities. The Design Student will:
a. Pay to Iowa State University the payments required by this agreement on the dates required;
b. Use this computer and associated software only for academic use in furtherance of the Design
Student's education at the College of Design;
c. Not use the computer for personal gain or commercial gain;
d. Follow the Iowa State University Computer Code of Ethics. The current version of this policy
is attached to this agreement as Exhibit "A" and incorporated in this agreement as if set out in
full. The Design Student is also responsible for becoming knowledgeable of, and complying
with, any updates to this policy;
e. Not misuse, modify or abuse the computer or software in any way;
f. Report any theft or damage or needed repairs to the College of Design Computer Support Staff
within seven (7) days of its occurrence;
g. Report any needed repairs to the College of Design Computer Support Staff within thirty
(30) days of repairs becoming necessary;
h. Pay the deductible amount of $500.00 if the computer is lost or damaged during the term of the

mail addresses, during the term of this agreement;
j. Return the computer to the College of Design at the conclusion of this agreement for purposes
of removing University-licensed software and inventory control tags within thirty (30) days
after the conclusion of final semester covered by this agreement;
k. Not install any software for which the Design Student does not legally have authorization
through an appropriate license and not install any software that conflicts with University-
licensed software listed in paragraph 14.
l. Students are financially responsible for this machine even if they are considered in default,
leave the College of Design or the University
a. This agreement will terminate, and any unpaid balance will become immediately due and
payable, when the Design Student is in default as defined in Paragraph 12.
b. Upon termination of this agreement by default, Iowa State University may accelerate any
unpaid balance, refer the amount to a third-party collection company, report the receivable to a
credit reporting agency and repossess the computer from the Design Student.
c. If this agreement is terminated for failure to pay, Iowa State University shall place a “hold” on
the Design Student’s account and the Design Student will not be allowed to register for the
next semester’s classes, will be prevented from obtaining official transcripts, graduating and
receiving a diploma.
d. If this agreement is terminated for failure to pay, the Design Student agrees to pay all attorneys'
fees and other reasonable collection costs and charges necessary for the collection of any
amount not paid when due or repossession of the computer.
18. Extension. Upon the written request of Design Student and approval of the College of Design, this
agreement may be extended for a time period not exceeding two additional years at a sufficient
charge per semester to cover maintenance, software use, and administrative costs. The actual
amount of the charge will be determined at the time the extension is agreed to by both parties.
19. Assignment. Design Student may not assign this agreement to another person or entity without the
express agreement of the College of Design. The College of Design may only assign this
agreement to another person or entity when the hardware is returned, and has been expressed by
the Design Student to be Terminated, as described in Paragraph 17, at which time the hardware
and un-paid balance may be transferred.
20. Miscellaneous. This Computer Lease Purchase Agreement constitutes the entire agreement and
understanding of the parties with respect to its subject matter. Any modifications of this
agreement shall be in writing to be effective. This agreement shall be governed by the laws of the
State of Iowa.
Effective Date. This agreement is effective on the 20th day of August 2007, or by the College of Design
signature date if signed after August 20, 2007.
