Title of Bill:
An Act to Ensure Genomic Privacy

BE IT ENACTED BY THE YALE MODEL CONGRESS

Preamble: Whereas information obtained through genetic testing is private and medical in
nature, and whereas its use by life insurance providers to deny coverage violates the stated
purpose of insurance (i.e. to protect against premature death), singles out for discrimination
those individuals whose conditions we can now test for, and furthermore impedes both the
seeking of diagnosis and of treatment for certain genetic conditions, the United States
hereby proscribes the use of genetic tests in applications for life insurance.

SECTION 1: Let “genetic test” be defined as any laboratory test that obtains information by
subjecting a tissue or blood sample to chromosomal and/or genetic analysis.
        a. The use of family history and blood and cholesterol tests are not included under
            this definition.

SECTION 2: This proscription of genetic tests applies equally to tests ordered specifically
for assessing life insurance risks as well as those undertaken by an individual for other
  purposes.

SECTION 3: Genetic testing information should be removed from medical records prior to
the release of these records to insurance providers.

SECTION 4: Insurance providers found in violation of this act shall be subject to fines no
  less than $1.65 million

SECTION 5: This bill will take effect 91 days after passage.
