An Act to Ensure Genomic Privacy
BE IT ENACTED BY THE YALE MODEL CONGRESS
1 Preamble: Whereas information obtained through genetic testing is private and medical in
2 nature, and whereas its use by life insurance providers to deny coverage violates the stated
3 purpose of insurance (i.e. to protect against premature death), singles out for discrimination
4 those individuals whose conditions we can now test for, and furthermore impedes both the
5 seeking of diagnosis and of treatment for certain genetic conditions, the United States
6 hereby proscribes the use of genetic tests in applications for life insurance.
8 SECTION 1: Let “genetic test” be defined as any laboratory test that obtains information by
9 subjecting a tissue or blood sample to chromosomal and/or genetic analysis.
10 a. The use of family history and blood and cholesterol tests are not included under
11 this definition.
13 SECTION 2: This proscription of genetic tests applies equally to tests ordered specifically
14 for assessing life insurance risks as well as those undertaken by an individual for other
17 SECTION 3: Genetic testing information should be removed from medical records prior to
18 the release of these records to insurance providers.
20 SECTION 4: Insurance providers found in violation of this act shall be subject to fines no
21 less than $1.65 million
23 SECTION 5: This bill will take effect 91 days after passage.
