The following applies to all transactions effective January 01, 2010 due to requirements under RESPA/Regulation X:

    All loans with an application taken on or after January 1, 2010, must contain the new GFE form
          *     Brokers are responsible for providing the initial GFE and Settlement Service Provider list to the borrower within three business days
          of obtaining the 6 items (Borrower’s Name, SS#, Gross monthly income, Property Address, Estimate value of property, Loan Amount)
          *     The initial GFE is a binding GFE, subject to any changed circumstances below. Please refer to the “changed circumstances.”
          *      After the borrower has received the initial GFE, the Broker is responsible for obtaining and documenting the borrower’s expressed
          intent to proceed with the transaction.
          *     With the RESPA amendments, the Fee Sheet is critical as the new GFE does not provide a breakdown of broker fees and
          compensation. The Fee Sheet supplements the GFE – and it will help ensure the borrower can clearly determine broker, lender fees and
          compensation.
          *     For all services where the borrower may select the provider, Loan Originators are recommended to provide borrowers with a list of
          Settlement Service Providers (Company Name, Address and Phone Number) in the borrowers’ geographic area along with the costs for the
          services.
          *     The maximum broker compensation allowed is:
                      o The broker’s Origination Fee (including all broker fees):
                         ≤ 3.5% for Conventional
                         ≤ 4.5% for FHA
                      o The broker’s Origination Fee (including all broker and lender fees):
                         ≤ 4% for VA in block 1 if there is a credit in block 2 and < 1% in block A
                         ≤ 1% for VA in block 1 if there is a cost in block 2 and no max in block A
                      o The total of all fees paid to broker if the loan amount is greater than $500,000, the greater of < 2% or $22,500
                      o Borrower credit is capped at 3%, unless otherwise indicated on rate sheet
          *     The following requirements also apply:
                      o All fees must be reasonable and customary
                      o All fees must comply with State, Federal and agency requirements
                      o Individual loan programs may have additional restrictions
         *     All loans must also pass all predatory lending, agency, federal and state checks, regardless of Reunion’s maximum compensation cap
         *     The GFE must be accurate as the Broker will be held to the fees disclosed on the initial GFE. If under disclosed, the shortage of
         funds will be netted from brokers compensation.


Changed Circumstances

The Broker must notify Reunion immediately of any changed circumstances.
         *     If a changed circumstance occurs, only those fees affected by the changed circumstance may change.
         *     If the estimates within the GFE are inaccurate and a valid changed circumstance does not occur, the Broker is bound to the amounts
         shown on the last disclosed GFE.
         *     If a changed circumstance occurs, the Lender must re-disclose within three business days after receipt of the information regarding
         the changed circumstance or the ability to re-disclose (and increase a fee) is lost.
         *     Brokers must retain documentation relating to the changed circumstance and fee change, if re-disclosed, for three years.
A “changed circumstance” is defined as follows:
         *     Acts of God, war or disaster
         *     Changes or inaccuracies in information relating to the borrower or the transaction that was relied upon in providing the GFE
         *     Changes to the loan amount or estimated value of the property
         *     New information regarding the borrower or transaction not relied upon when the initial disclosure was provided

A revised GFE must be issued upon a lock event (locking the rate or expiration of the lock) and may be issued in the event the borrower requests a
change in the mortgage loan that was identified in the GFE and that changes the settlement charges or terms of the loan.

Fee Tolerances

As a reminder, tolerances (locking the rate, extending the rate, or rate expiration) on changes to settlement charges between the final GFE and HUD-
1 will be defined in three categories beginning January 1, 2010:

1. Charges that cannot increase at settlement:
          *     Origination charges. Origination charges include the loan originator’s origination fees
          *     Borrower Credit or Charge for a specific interest rate selected (after interest rate is locked)
          *     Adjusted origination charges (after interest rate is locked)
          *     Transfer taxes

2. Charges that cannot increase in the aggregate by more than 10% at settlement:
         *      Required settlement services that the lender selects, such as appraisal services
         *      Title services and lender’s title insurance (if selected by originator or if the borrower uses a company identified on the Settlement
         *      Owner’s title insurance (if the borrower uses a company identified on the Settlement Services Provider List).
         *      Required settlement services (such as Pest Inspections) that the borrower selects from the Settlement Services Provider List
         *      Government recording charges

3. Charges that can increase at settlement:
          *     Required settlement services that the borrower can select, if the borrower selects a service provider not listed on the Settlement
          *     Title services and lender’s title insurance, if the borrower selects a service provider not listed on the Settlement Services Provider
          *     Owner’s title insurance, if the borrower selects a service provider not listed on the Settlement Services Provider List
          *     Initial deposit for borrower escrow account
          *     Daily interest charges
          *     Homeowner's insurance


Please note: For 1 and 2 above, should a changed circumstance occur that directly impacts the fee affected by the change circumstance and a
revised GFE was provided within three business days after receipt of the information regarding the changed circumstance, the tolerance is
determined by reference to the fees disclosed on the most recent GFE as compared to the fees at closing. Only fees directly impacted by the change
circumstance can be added and/or increased and re-disclosed.


It is imperative that all fees which affect the APR must be disclosed upfront to avoid delays at closing. Changes to the Truth in Lending Act (TILA) are
effective with all loan applications for primary residences, 2nd homes and investment properties received by Reunion beginning July 30, 2009.

Please ensure that you include all fees which apply to your loan on your GFE and Fee Sheet. Please review “List of All Possible Fees” Chart posted on
Reunion Wholesale website “Forms” section.
